Electoral Rules 1908

The Rules advance a small set of interlocking procedural concepts that structure contested election litigation.

• Petition and Court of Disputed Returns. The litigation vehicle is a petition under Part V of the Electoral Act 1907, styled "Electoral Act 1907. In the Court of Disputed Returns" and "In the matter of the Election," divided into numbered paragraphs and ending with a prayer for relief (r 2, Schedule 1). The instrument treats the petition as the central document that triggers publication, service and the timetable for further steps (r 3-5).

• Filing, security and publication. Filing occurs at the Supreme Court's Central Office, with a requirement to lodge a copy and a form of notice for publication and to deposit $100 as security for costs plus an amount sufficient to defray publication costs (r 3). Immediately on filing, a Court officer must publish the petition in the Government Gazette and arrange a newspaper notice specifying presentation date, petitioner, nature of relief claimed and grounds in concise form (r 4). Publication is therefore a formal, Court‑administered step, financed initially by the petitioner.

• Service and address for service. The petitioner must serve a sealed copy on the person whose election is disputed within 14 days, unless the Judge allows more time (r 5). Service may be personal or by prepaid registered post to the address in the nomination paper. Returned members may send a signed writing nominating an address for service and appointing a solicitor; once lodged at Central Office, service can be effected by leaving the sealed copy with a person at that address (r 6). The Rules thus provide a default postal service route and a procedure for formalising an address for service.

• Particulars, lists and limits on issues. The Court can order particulars (r 7(a)). Where a petition claims the seat for a person not returned, parties must produce lists of the ballot‑papers or classes intended to be claimed or objected to and specify grounds for claims and objections within seven days of service (r 7(b)). Likewise, where the claim is that unqualified persons voted, the petitioner must list the alleged unqualified voters within seven days (r 7(c)). The lists operate to limit issues at trial: no claim or objection to a ballot‑paper, or objection to a vote, will be entertained unless specified or leave of Court is obtained (r 7(b),(c)).

• Counter‑charges and interlocutory control. A respondent who wishes to assert that the person claimed to have won was not duly elected on grounds other than those in r 7 may file a statement of grounds within seven days (r 8). Interlocutory matters are heard by a Judge in Chambers, who has the same control as in ordinary Supreme Court Chambers matters (r 9).

• Non‑opposition, trial timetable and advertising. A respondent can notify that he does not intend to oppose, enabling an ex parte order on the prayer of the petition; costs after the notice will not lie against the respondent unless the Court orders otherwise (r 10). Trials are appointed by Judge's order; ten days' notice of trial is required (or such other notice as the Judge directs) and, unless otherwise ordered, the notice must be advertised in a newspaper circulating generally in the State or in the relevant district (r 11).

• Withdrawal and substitution. Withdrawal requires leave, typically after 10 days' notice to the respondent and advertisement, and at the withdrawal hearing the Court may allow substitution by another person competent to present a petition on similar grounds; proceedings then continue as if the substitute were the original petitioner (r 12). If a sole petitioner dies before trial, a Judge may allow substitution (r 13). If the Court suspects parties are colluding to defeat the Electoral Act, it may substitute another person for a petitioner or respondent, and the proceedings continue as if that person had been an original party; the original party, not the substitute, remains liable for costs as ordered (r 14).

• Forms, fees and application of General Rules. Schedule 1 provides model forms for petition, notices, address for service, summons and related documents; Schedule 2 prescribes fees for filing, interlocutory applications and various orders. The General Rules of the Supreme Court and Orders relating to fees apply to these proceedings where applicable and not inconsistent with the Rules (r 15-16, Schedules 1-2).

These concepts combine to form a constrained procedural pathway: short timelines, mandatory particularisation for certain claims, initial financial deposit obligations on petitioners, and Court discretion over substitution, costs and interlocutory matters.

Primary parties

• Petitioners. Any person or entity who presents a petition under Part V of the Electoral Act 1907 is bound by these Rules from filing through to trial, withdrawal or substitution. Petitioners must file at the Central Office, lodge copies and notice forms, deposit security and publication funds, serve within specified timeframes and, where relevant, deliver ballot‑paper or voter name lists within seven days (r 2-3, r 5, r 7).

• Respondents, especially returned members. The person whose election or return is disputed must be served and may respond. If the person is a returned member, there is a formal route to nominate an address for service and to appoint a solicitor by a writing lodged at Central Office (r 6). Respondents may give notice of non‑opposition, which triggers the power for an ex parte order and affects costs exposure (r 10).

• Candidates who were not returned. The Rules directly impact candidates who claim a seat that they were not returned to hold; they require lists of ballot‑papers to be exchanged within narrow timeframes if such claims are to be pursued (r 7(b)).

Professional and administrative actors

• Solicitors and practitioners. The Rules refer to legal practitioners entitled to practise in the Supreme Court (r 6, Schedule forms). Solicitors will typically be appointed as agents and are the persons through whom applications, notices and submissions are lodged and served.

• Supreme Court officers and the Principal Registrar. Court officers are tasked with publishing the petition and notice (r 4), receiving filings and security deposits (r 3), and issuing summonses (Schedule 1). The Principal Registrar's imprimatur appears on the form of notice template in Schedule 1.

• Witnesses. The Rules provide for summons forms to require witnesses to attend hearings and to produce documents (Schedule 1), with fees for the issue of summonses recorded in Schedule 2.

Public and media

• Newspapers and the Government Gazette. Rule 4 makes the Government Gazette and local or state newspapers formal components of the process; petition notices must be placed there and trial notices must often be advertised in newspapers (r 4, r 11, r 12). The Rules therefore impose a practical communication duty on publishers and use the public media to ensure notice to the electorate and interested parties.

Fiscal and administrative consequences

• The State's registry and budget. While the petitioner deposits publication costs, the Court system administers publication and trial scheduling. Schedule 2 lists fees that are payable into Court. The Decimal Currency Act 1965 appears in the compilation table as an earlier law that affected fees conversion, reflecting that fees are set numerically in Schedule 2 and have been amended over time (Compilation table; Schedule 2).

Indirectly affected groups

• Electors whose ballots are challenged. Ballot‑paper claims and challenges (r 7(b)) and claims that unqualified persons voted (r 7(c)) directly involve electors whose votes may be objected to; the Rules provide the mechanism by which those votes are identified and limited for litigation purposes.

• Other candidates and the party system. Because petition outcomes can change declared results or void elections, party interests and other candidates are materially affected by the procedural avenues and constraints the Rules set.

Who decides and who pays

• Judges and Court officers control time extensions, particulars, substitution, costs orders, ex parte orders on non‑opposition notices, and interlocutory matters (r 7(a), r 9, r 10, r 12-14). Financially, petitioners pay the initial security for costs ($100) and publication costs, as well as the nominal fees in Schedule 2; the Court retains discretion on final costs orders at the close of proceedings (r 3, r 10, Schedule 2).

The Rules allocate clear duties to petitioners, respondents and the Court, and confer limited rights that shape litigation strategy.

Petitioner's duties

• Filing and initial deposits. The petitioner must file the petition at the Central Office, lodge a copy and a form of notice for publication, and deposit $100 as security for costs plus a sum sufficient to defray publication costs (r 3). The duty to deposit these amounts is a precondition to the Court officer publishing the petition (r 4).

• Form and content. The petition must be entitled as prescribed, divided into numbered paragraphs and conclude with a prayer, and may follow the form in Schedule 1 (r 2, Schedule 1). The petitioner must also comply with any Court order for particulars (r 7(a)).

• Service timelines. The petitioner must serve a sealed copy of the petition on the person whose election is disputed within 14 days of filing, subject to judicial extension (r 5).

• Particularisation when claiming the seat or voter qualifications. Where the petition claims the seat for a person not returned, or claims the election void because unqualified persons voted, the petitioner must serve detailed lists of ballot‑papers or names within seven days of service (r 7(b)-(c)). Failure to deliver these lists will limit admissible claims and objections at trial (r 7(b)-(c)).

• Advertising notices for withdrawal or trial. When seeking to withdraw, the petitioner generally must give 10 days' notice to the respondent and advertise the application in a newspaper circulating generally in the State or in the relevant district (r 12). If the petitioner obtains an order appointing the time and place of trial, ten days' notice is required and usually must be advertised (r 11).

Respondent's duties and rights

• Service compliance and address for service. If returned as a member, a person may lodge at Central Office a signed writing giving an address at which the petition may be served and appointing a solicitor (r 6). Once lodged, service may be made by leaving a sealed copy with a person at that address (r 6).

• Countercharges and defence. A respondent who wishes to assert grounds that the person claimed to have won was not duly elected, on grounds other than those covered by r 7, must deliver a statement of grounds within seven days after service (r 8).

• Right to cease opposition. A respondent may serve a written notice that he does not intend to oppose or further oppose the petition; on such notice, the Court may make an order in the terms of the prayer on the petition ex parte, and the respondent will not be liable for costs incurred subsequent to that notice unless the Court otherwise orders (r 10).

Court's powers and duties

• Control over particulars and interlocutory matters. The Court or a Judge may order a party to deliver particulars or further particulars (r 7(a)). All interlocutory matters may be dealt with by a Judge in Chambers, who has the same control as in ordinary Supreme Court Chambers matters (r 9).

• Time extension and discretion. Judges have discretionary power to extend the 7 and 14 day time limits in r 5 and r 7 and to allow amendments, adjournments and costs terms when lists are amended or leave to depart from lists is granted (r 5, r 7(b)-(c)).

• Substitution and anti‑collusion powers. If the Court believes parties are acting in collusion to defeat the Electoral Act, it may direct substitution of parties and continue proceedings as if the substitute had been an original party; costs are payable by the original party unless the Court orders otherwise (r 14). Likewise the Court can allow substitution following the death of a sole petitioner (r 13).

Fees, costs and office practice

• Prescribed fees. Schedule 2 prescribes fees to be paid in the Court of Disputed Returns, including the filing fee, fees on interlocutory applications and orders, sealing and copying fees, and witness summons fees. These are payable in the proceedings (r 15, Schedule 2).

• Application of General Rules. The General Rules of the Supreme Court and Orders relating to fees apply where not inconsistent with these Rules, thereby importing broader procedural obligations and rights from general Supreme Court practice (r 16).

Rights that shape litigation behaviour

• Right to seek leave to amend or to obtain relief outside list constraints. The Rules allow leave to be sought to introduce claims or objections not specified in the required lists, but leave is at the Court's discretion and may be conditioned on amendments, adjournments, and costs (r 7(b)-(c)).

• Right to ex parte order when respondent does not oppose. A petitioner has the right to seek an ex parte order on the prayer if the respondent serves a notice of non‑opposition (r 10). The Court may grant the order in those terms.

Collectively, these duties and rights create a compressed procedural regime in which timing, particularisation and early financial outlays are central. The Court retains significant managerial control through discrete powers to extend time, order particulars, substitute parties and control costs.

These Rules are procedural in character. They do not create criminal sanctions or prescribe statutory fines within their text. Enforcement is achieved through civil procedural mechanisms and the Court's exercise of judicial powers, including costs orders, control of admissible issues, and substitution directions.

Costs, deposits and financial enforcement

• Security for costs and deposit for publication. The petitioner is explicitly required to deposit $100 as security for costs and to provide a sum sufficient to defray the cost of publication of the petition and notice at the time of filing (r 3). This is an up‑front financial obligation that functions as a practical gatekeeping mechanism enforced by registry practice. The deposit for publication will be used to fund the mandatory Gazette and newspaper publication that the Court officer must effect under r 4.

• Court costs orders. The Court has express power to award costs in numerous contexts implicitly. Rule 10 states that where a respondent serves notice that he does not intend to oppose the petition, the respondent will not be liable for any costs incurred subsequent to such notice unless the Court or a Judge otherwise orders. Rule 14 ensures that where substitution is directed because of suspected collusion, "the original party and not the substituted party shall be liable to pay such costs of the proceedings as the Court may order to be paid." These provisions show that the Court uses cost orders to enforce compliance and to allocate the economic consequences of litigation conduct.

Monetary fees for registry services

• Schedule 2 fees. The Rules prescribe nominal fees for filing the petition, interlocutory applications, sealing and making copies, summonses for witnesses and various orders (Schedule 2). While those amounts are small numerically, they are payable in Court of Disputed Returns proceedings and will be charged and enforced under the General Rules and Orders relating to fees (r 15-16, Schedule 2).

Procedural exclusion and discretionary control as enforcement

• Limitation of issues by lists. The Rules enforce adherence to procedural timetables by making the lists required under r 7(b) and (c) binding: "no claim or objection shall be entertained ... except by leave of the Court or a Judge." That mechanism enforces compliance with the particularisation duty by excluding late or unspecified grounds unless leave is obtained, and by permitting the Court to condition leave on amendment, adjournment and costs.

• Substitution for collusion. The Court's power to substitute parties where collusion is suspected (r 14) is an enforcement tool to uphold the purpose of the Electoral Act. The substituted party becomes the litigating party, and the original party remains cost liable. This creates a civil sanction against collusive conduct.

Other enforcement mechanisms

• Interlocutory control and sanctions. A Judge in Chambers may decide interlocutory matters and control the proceedings as in ordinary Supreme Court practice (r 9). The General Rules of Court and Orders relating to fees apply "so far as applicable" (r 16), importing enforcement mechanisms and sanctions existing in Supreme Court practice for failure to comply with procedural rules, such as striking out, summary dismissal, or other measures available to the Court.

Limits to enforcement in the Rules

• No criminal offences or specified non‑payment penalties. The Rules do not specify offences such as contempt or statutory breaches beyond the usual powers of the Court to manage proceedings. Enforcement therefore proceeds through civil process, costs allocations and the Court's residual powers rather than through statutory penalties prescribed in these Rules themselves.

Practical enforcement consequences

• Who ultimately pays. The immediate payer for publication and security is the petitioner at filing (r 3). The ultimate liability for costs at the end of proceedings is determined by the Court, which may order payment by any party or preserve the $100 security to meet costs orders. The Rules give a measure of protection to respondents who cease to oppose, but otherwise preserve judicial discretion to allocate costs.

These Rules function as a procedural adjunct to substantive and broader procedural law. The text expressly references and imports other law, and the compilation table shows amendment sources.

Primary statutory interaction

• Part V of the Electoral Act 1907. The Rules are expressly framed as procedures for petitions brought under Part V of the Electoral Act 1907 (r 2, Schedule 1 heading). The Rules do not modify substantive electoral qualifications, offences or the grounds for declaring an election void; they prescribe the steps for bringing those substantive claims to the Court of Disputed Returns.

• General Rules of the Supreme Court and Orders relating to fees. Rule 16 states that the General Rules of the Supreme Court and the Orders relating to fees extend and apply to proceedings in the Court of Disputed Returns "so far as the same are applicable, and are not inconsistent with these rules." This provision imports procedural rules (for example, service rules, discovery practice, rules about pleadings and interlocutory procedures) and fee collection practice from general Supreme Court procedure where not inconsistent. The effect is that practitioners must consult both the Electoral Rules and the General Rules to understand applicable procedure.

Publication and administrative instruments

• Government Gazette and newspapers. Rule 4 mandates publication in the Government Gazette and in an appropriate newspaper. That requirement links these Rules to the administrative machinery that governs the Government Gazette and to the commercial newspaper industry; the Rules rely on those outlets for public notice and do not provide alternative electronic publication procedures. Any other legislation governing the Government Gazette will therefore intersect with execution of r 4.

Amendment and currency of fees

• Decimal Currency Act 1965 and later amending instruments. The compilation table records that the Decimal Currency Act 1965 affected provisions (notably fees) and that subsequent amendments occurred by Electoral Amendment Rules 2009 and Electoral Amendment Rules 2022. Those amendment instruments are cited in the text as having amended specific rules (for example, r 1, r 2, r 15 were amended in 2009 and 2022). Schedule 2 lists fees in dollars; the historical amendment references indicate that fee amounts and currency presentation have been updated by other laws.

Court of Disputed Returns context

• Nested within Supreme Court jurisdiction. The Rules presuppose the Court of Disputed Returns as the arena for adjudication and that Supreme Court practice and officers will perform registry functions. Consequently, general Supreme Court case law and practice on procedural matters, evidence and judicial discretion will be relevant to the conduct of petitions, subject to the constraints the Rules impose.

Limitations and areas where other laws govern

• Substantive electoral law remains in the Electoral Act 1907. The Rules do not displace substantive definitions of who is qualified to vote, offences related to voting, or the substantive grounds for declaring an election void; those matters are within the Electoral Act itself.

• No express intersection with criminal or administrative penalties. Because the Rules are procedural, they do not invoke criminal or administrative sanctions; any such sanctions would arise under separate electoral offences in the Electoral Act or other statutes, not in these Rules.

Practical consequence for practitioners

• Consult three sources. Practitioners must consult: (a) Part V of the Electoral Act 1907 for substantive grounds; (b) the Electoral Rules 1908 for the specialised procedural steps, timeframes and forms; and (c) the General Rules of the Supreme Court and Orders relating to fees for supplementary procedural obligations and fee practice (r 16). The compilation table and bracketed amendment notes indicate particular rules amended by 2009 and 2022 instruments and therefore that cross‑checking current legislative versions is necessary.

The compilation material embedded in the text documents a long history with discrete updates. The Rules were originally published as The Electoral Rules of 1908 and commenced on 9 October 1908 (Compilation table). The compilation table and bracketed annotations in the text identify later amendments and instruments affecting particular rules and Schedules.

Documented amendments and instruments

• The Electoral Rules of 1908. Original instrument published 9 October 1908, incorporating the original set of procedural provisions that these Rules preserve.

• Decimal Currency Act 1965. The compilation table records that the Decimal Currency Act 1965, assented on 21 December 1965, had operability for some sections from 14 February 1966 and the balance on 21 December 1965. The Decimal Currency Act is recorded in the compilation table as affecting the Rules, which is consistent with Schedule 2 being expressed in dollars; the annotation states Act No. 113 of 1965 s. 8(1) as an amendment source for r 3 and Schedule 2 (see r 3 amendment note).

• Electoral Amendment Rules 2009. Gazette reference 3 July 2009 p. 2681-2. The bracketed notes in the Rules show specific rule amendments ascribed to the 2009 instrument: for example, r 1 was amended (Gazette 3 Jul 2009 p. 2681) and Schedule 1 headings were amended (SL 2022/201 r. 15(1) also appears). The compilation table records which parts of the instrument commenced on 3 and 4 July 2009.

• Electoral Amendment Rules 2022. Statutory instrument SL 2022/201, published 22 November 2022 and with most rules commencing 23 November 2022, is recorded as an amending instrument. The bracketed annotations after several rules note amendment by SL 2022/201 r. X (for example r 2 amended: SL 2022/201 r. 4; r 3 amended: SL 2022/201 r. 5; r 4 amended: SL 2022/201 r. 6; r 5 amended: SL 2022/201 r. 7; r 6 amended: SL 2022/201 r. 8; r 7 amended: SL 2022/201 r. 9; r 8 amended: SL 2022/201 r. 10; r 10 amended: SL 2022/201 r. 11; r 11 amended: SL 2022/201 r. 12; r 12 amended: SL 2022/201 r. 13; r 15 amended: SL 2022/201 r. 14; Schedule 1 amended: SL 2022/201 r. 15; Schedule 2 amended: SL 2022/201 r. 16). These bracketed notes in the current text indicate which specific rules and Schedules were revised in 2022 but do not record the substance of each edit within this compilation extract.

Notes on citation and reprints

• Reprint of 19 October 2001. The compilation table lists a reprint as at 19 October 2001 that includes the amendments up to that date. This indicates a history of periodic consolidation for ease of reference.

• Citation change. The “Other notes” remarks state that these Rules are now known as the Electoral Rules 1908; a citation change appears under r 1, reflecting formalisation of the short title.

What the compilation history tells the practitioner

• Multiple amendment events over a century. The Rules have been maintained by periodic legislative and subordinate law amendment, with the most recent recorded instrument in the compilation table being SL 2022/201. The bracketed amendment notes tied to specific rules are the authoritative pointers to which parts were edited by those instruments.

• Fees and currency have been updated. The presence of the Decimal Currency Act 1965 in the compilation table indicates statutory adjustments to reflect currency conversion at that time. Later amendments in 2009 and 2022 have updated rule texts and possibly modernised wording or administrative details.

• Need to consult current consolidated text. Because multiple instruments have amended specific rules, practitioners must consult the current consolidated or reprinted text (or the electronic legislation clarity) to ensure the exact operative wording; the compilation table in the instrument provides references to amended rules and commencement dates to assist that verification.

The instrument provided contains no cases, judicial decisions, or a catalogue of litigation applying these Rules. The schedules and rules themselves refer to the Court of Disputed Returns and instruct how petitions are to be processed, but the text does not include or summarise any reported decisions that have interpreted or applied these Rules.

What is ascertainable from the Rules themselves

• No named cases in the text. The text does not list or cite judicial decisions. It does not provide precedent summaries or sample judgments applying the Rules.

• Judicial discretion exists and is referenced, but the scope of that discretion is not illustrated by cases in the instrument. For example, Judges have discretion to extend timeframes (r 5, r 7), to allow leave to amend lists with terms as to adjournment and costs (r 7(b),(c)), to substitute parties where collusion is suspected (r 14), and to make ex parte orders on non‑opposition notices (r 10). How these discretions have been exercised in practice is not recorded in the Rules.

What a researcher must do to compile litigation history

• Consult Court databases and reported decisions. Because the Rules themselves provide procedural text only, any analysis of how courts have interpreted these provisions requires independent research into Supreme Court and Court of Disputed Returns decisions. The Rule text identifies the procedural hooks (e.g. lists, substitution, ex parte orders) that are likely to have generated case law, and these topics can be the starting points for targeted searches in legal databases for decisions applying r 7, r 10, r 12-14 and r 16.

• Check for published Court of Disputed Returns judgments. Petition outcomes, particularisation disputes and substitution applications often attract reported reasons; a litigation history would be assembled by collecting such judgments and mapping their treatment of judicial discretion, admissibility of late challenges, and the interaction with General Rules.

Absent further material in the provided text, this section therefore records that the Rules contain no litigation history and indicates where and how a practitioner should look next for case law interpreting key provisions such as lists of ballot‑papers (r 7), substitution for collusion (r 14), and the effect of a respondent's notice of non‑opposition (r 10).

These Rules contain several procedural traps that materially affect a petition's prospects if missed. They are concrete, rule‑based constraints rather than policy criticisms.

Strict and short timeframes

• Seven‑ and fourteen‑day deadlines. The petitioner must serve the sealed copy of the petition within 14 days of filing (r 5). Parties must deliver lists of ballot‑papers or names within seven days after service when a petition claims the seat for a person not returned or that unqualified persons voted (r 7(b)-(c)). These short deadlines can be fatal if counsel or the petitioner fails to act promptly. Although Judges may extend time, extensions are discretionary (r 5, r 7).

Particularisation limits content at trial

• Lists limit admissible claims and objections. The requirements in r 7(b) and (c) are not mere administrative steps; the lists effectively lock in the grounds that may be pursued at trial. "No claim or objection shall be entertained" unless it appears in the list or leave is given. Practitioners who under‑list or omit critical grounds risk being precluded from raising them later unless they secure leave and accept conditions such as adjournment and costs.

Up‑front costs and cashflow constraints

• Deposit of $100 security and publication costs. Rule 3 requires an up‑front $100 security for costs and a separate deposit sufficient to cover the cost of publication in the Government Gazette and a newspaper. This immediate deposit can impede access for impecunious petitioners. Even though Schedule 2 shows nominal Court fees, the publication and expert evidence costs often exceed those amounts; the Rules make the petitioner the holder of initial financial responsibility (r 3, Schedule 2).

Service by post and address complications

• Service rules tied to nomination paper address. Service upon a returned person may be made personally or by prepaid registered post to the address in the nomination paper (r 5). If the nomination paper contains an outdated address and the petitioner relies on postal service, there is risk that service will not be effective. Conversely, returned members may lodge an address for service and permit service by leaving a sealed copy with someone at that address (r 6). Petitioners must check addresses and consider personal service where practical.

Ex parte disposition on non‑opposition

• Notice of non‑opposition can produce immediate relief. If a respondent serves a written notice that he does not intend to oppose, the Court may make an order in the terms of the prayer ex parte (r 10). Petitioners should be prepared to seek an immediate order in that event, and respondents should be aware that by serving such notice they generally avoid liability for subsequent costs unless the Court orders otherwise. That creates strategic considerations for both sides.

Substitution for collusion with cost consequence

• Court may substitute parties and preserve cost liability. If the Court believes parties are colluding to defeat the Electoral Act, it may substitute a different person for petitioner or respondent and continue the proceedings as if the substitute had been an original party (r 14). Critically, the original party remains liable for costs as ordered. Parties who coordinate improperly risk being replaced in the litigation and bearing the costs.

Withdrawal notice and advertising obligations

• Withdrawal generally requires 10 days' notice and advertisement. The petitioner cannot simply withdraw without leave; 10 days' notice to the respondent and a public advertisement are required unless the Court orders otherwise (r 12). Failure to follow those steps can cause procedural delay and cost consequences.

Ambiguity where General Rules apply

• "So far as applicable" standard imports uncertainty. Rule 16 imports the General Rules of the Supreme Court "so far as the same are applicable, and are not inconsistent with these rules." That phrase creates areas of ambiguity where practitioners must determine which General Rules apply and whether any conflict exists. This can create litigation over procedural points not expressly addressed in these Rules.

Small prescribed fees but real costs elsewhere

• Schedule 2 fee amounts are numerically low. The fees in Schedule 2 (for example, $1 on filing) look minimal, but they do not capture the real costs of running a contested election petition, expert evidence, scrutiny of ballot papers, printing, counsel fees, and the publication deposit mandated by r 3. Practitioners must therefore not be misled by the low fee numbers.

Witness attendance and production demands

• Summons forms and production obligations are specified. Schedule 1 contains a summons form requiring attendance and production of documents; failure to serve or comply could affect evidence gathering. A witness summons attracts a fee in Schedule 2.

Practical missteps to avoid

• Do not miss the seven‑day lists deadline. If a petition aims to show a non‑returned candidate had a majority, prepare and exchange lists immediately upon service.

• Do not forget the publication deposit. The filing will not be fully processed without funds to cover publication.

• Verify addresses for service by personal contact. When in doubt, effect personal service or obtain the returned member's address for service in writing.

• Seek immediate judicial directions if there is risk of collusion or substitution. If parties coordinate, the Court may substitute, and costs consequences will follow.

These are concrete procedural hazards embedded in the Rules. Complying strictly with the text, and using judicial notice to secure extensions where necessary, mitigates the risks.

This section provides a step‑by‑step compliance checklist aligned with the Rules and a pragmatic sequence for practitioners and petitioners. Each step cites the relevant rule.

1. Draft the petition precisely (r 2; Schedule 1)

• Use the model in Schedule 1 or a closely equivalent form.
• Divide into numbered paragraphs; keep each paragraph focused on a distinct allegation (r 2).
• End with a clear prayer specifying the relief sought (r 2).
• Include witness particulars where appropriate using Schedule 1 forms for summonsing witnesses.

2. Prepare filing materials and funds (r 3)

• File the petition at the Central Office of the Supreme Court.
• Lodge with the petition: (a) a copy of the petition and (b) a form of notice for publication (r 3; Schedule 1 has a model Notice of Presentation).
• Deposit $100 as security for costs plus a sum sufficient to defray publication costs in the Government Gazette and an appropriate newspaper (r 3). Obtain receipts for deposit.

3. Ensure immediate publication is arranged (r 4)

• The Court officer will publish the petition in the Government Gazette and arrange a newspaper notice setting out presentation date, petitioner, relief claimed and concise grounds (r 4).
• Confirm with the Court registry the newspaper chosen (state‑wide or district circulation as appropriate).

4. Effect service within prescribed period (r 5-6)

• Serve a sealed copy of the petition upon the person whose election is disputed within 14 days of filing, unless you obtain a Judge's extension (r 5).
• For persons returned as elected, you may serve personally or by prepaid registered post to the address provided in the nomination paper (r 5). Verify that address or effect personal service to avoid postal complications.
• Check whether the returned member has lodged an address for service at Central Office (r 6). If so, service can be left with a person at that address as specified in the lodged writing (r 6).

5. Particularise promptly where required (r 7)

• If the petition claims the seat for a person not returned and alleges that that person had the majority of valid votes, produce within seven days after service a list of ballot‑papers or classes of ballot‑papers you intend to claim or object to, specifying grounds for each claim or objection (r 7(b)).
• If the petition claims the election was void because certain persons who were not qualified voted, deliver a list of names of those alleged unqualified voters within seven days after service (r 7(c)).
• Remember: the lists are binding; issues not specified cannot be entertained at trial except by leave of the Court (r 7(b),(c)). If necessary, seek an extension or leave promptly from a Judge.

6. If the respondent wishes to raise countercharges, file them promptly (r 8)

• A respondent asserting that the person claimed was not duly elected on other grounds must deliver a statement of grounds within seven days after service, in the same manner as required of a petition (r 8).

7. Use interlocutory chambers effectively (r 9)

• All interlocutory questions can be heard and disposed of by a Judge in Chambers, who has the same procedural control as in ordinary Supreme Court proceedings (r 9).
• For extensions, amendments to lists, disputes about particulars, and similar applications, file an interlocutory application and attend Chambers for direction.

8. Prepare contingencies for non‑opposition notices (r 10)

• Monitor for any notice from the respondent that they do not intend to oppose. If served, the petitioner may apply ex parte for an order in the terms of the prayer (r 10). File that application promptly and ensure the Court has the necessary materials.
• Note the cost consequence: respondent will not be liable for costs incurred after the notice unless the Court orders otherwise (r 10). Be prepared to argue costs if the circumstances justify it.

9. Prepare and publish notices of trial (r 11)

• When the Court issues an order appointing time and place of trial, give at least ten days' notice of trial, or shorter or longer notice as the Judge directs. Unless the Judge orders otherwise, advertise the hearing in a newspaper circulating generally in the State or in the relevant district (r 11).
• Keep proof of advertisement and proof of service.

10. Procedures for withdrawal (r 12)

• If intending to withdraw, apply for leave, give 10 days' notice to the respondent and advertise as required, unless the Court orders otherwise (r 12).
• At the withdrawal hearing, be prepared that the Court may allow another competent person to be substituted in which case proceedings continue as if the substitute had been the original petitioner (r 12). Check whether substitution dilutes any strategic or evidentiary advantages.

11. Handling death of sole petitioner and substitution for collusion (r 13-14)

• If a sole petitioner dies before trial, apply to a Judge for substitution (r 13).
• If the Court believes parties are acting in collusion for an improper purpose, expect that the Court may direct substitution and hold the original party liable for costs as ordered (r 14). Counsel should advise clients against arrangements that might be characterized as collusive.

12. Fees, sealing and copies (r 15; Schedule 2)

• Pay the Schedule 2 fees in the proceedings: filing fees, interlocutory application and order fees, sealing fees and summons fees. While the amounts in the Schedule are numerically small, ensure all relevant fees are paid in accordance with registry practice (r 15; Schedule 2).
• Remember that actual operational costs, such as publication, expert reports and court time, may exceed the small Schedule fees; the petitioner must ensure the funds for publication and security for costs are on deposit (r 3).

13. Invite the Court to apply General Rules where helpful (r 16)

• Where a matter is not expressly dealt with in these Rules, rely on the General Rules of the Supreme Court and Orders relating to fees, subject to any inconsistency with these Rules (r 16). For areas of doubt, seek directions from the Court in Chambers.

14. Witness management (Schedule 1; Schedule 2)

• Use the summons form in Schedule 1 to require witnesses to attend and to produce documents. Pay the fee for issuing a summons as set in Schedule 2.
• Serve summonses in good time to secure attendance for trial.

15. Record keeping and proof of compliance

• Retain copies of deposit receipts, Gazette and newspaper advertisements, service proofs, lists exchanged under r 7, and all interlocutory applications and orders. These will be essential to demonstrate compliance and to support any costs application.

16. Seek early judicial guidance if the case has unusual features

• For issues such as large numbers of ballot‑papers, complex chain of custody, or disputed addresses for service, seek early directions in Chambers to avoid being precluded by tight deadlines or procedural limits such as r 7(b)-(c).

Following the above sequence and checking the relevant rule citations (r 2-16, Schedules 1-2) will align practice with the procedural obligations the Rules impose. When in doubt, seek a judge's direction promptly rather than rely on later cure by amendment, which will be discretionary and may attract costs.
