Electoral (Political Finance) Regulations 1996

The Regulations rest on a small set of controlling concepts and mechanisms:

• Prescriptive records architecture: The Regulations mandate particular physical and informational structures for records. Receipt books and acknowledgment books must contain machine‑numbered duplicate forms and specified fields (for example the date, amount/value, form of payment, name and address of donor, and purpose) (regs 7(1), 8(1), 16(1), 17(1), 23(1), 24(1)). Bank and financial institution statements are required as the primary documentary trail for deposits and electoral expenditure (regs 10, 19, 25, 30).
• Duplicate documentation and retention: Every receipt or acknowledgment must be issued in duplicate with carbon impressions retained, cancelled forms kept, and all such books or printed copies of accounting system information retained for six years after the last entry (regs 7(3)-(6), 8(3)-(6), 13(1), 21(1), 27(1), 32).
• Role allocation: The Regulations impose duties on named operational office‑holders: the agent of a political party (regs 5, 11), the financial controller of an associated entity (regs 5, 12), the agent of a candidate or group (regs 15, 16), and third‑party campaigners themselves in specified categories (regs 22, 28). Reg 14 makes the agent or financial controller responsible for ensuring compliance.
• Verification tied to returns: When lodging returns under specified sections of the Electoral Act, the relevant responsible person must lodge a declaration that the records required under Part 4 have been kept and are available for inspection by the Electoral Commissioner (reg 4(1), (1A)-(5)). Failure to lodge truthful verification attracts specified fines (reg 4).
• Delegated flexibility: The Electoral Commissioner may approve alternative accounting systems for parties or associated entities if an auditor certifies that return information is ascertainable from the proposed system (regs 11-12). The Commissioner may also modify record form requirements to facilitate computerised systems for candidates, groups and certain third‑party campaigners (regs 20, 26). Approvals can be conditional and can be cancelled with at least one month’s notice (regs 11(3), 12(3)).
• Differentiated scope of third‑party regulation: The Regulations distinguish between third‑party campaigners required to lodge returns under s.175Q of the Act and those required under s.175SD, imposing broader book and bank statement requirements on the former and bank‑statement‑only requirements on the latter (Divs 3-4; regs 22-25; regs 28-32).

These concepts define the record lifecycle: creation (receipts/acknowledgements), documentary linkage (bank statements, cross‑references where proceeds of sale arise), storage and preservation (binding, carbon copies, cancelled originals), verification on lodgement of returns (reg 4), and oversight through the Electoral Commissioner’s approval and modification powers (regs 11-12, 20, 26).

The Regulations identify multiple categories of private actors and public officers and allocate responsibilities and potential penalties among them.

Primary actors who must keep records and who are exposed to fines and verification duties:

• Political parties: agents of political parties must keep receipt books, acknowledgment books and bank/financial statements in accordance with regs 5-10, unless a party has an approved alternative accounting system under reg 11. The agent must furnish a declaration when lodging returns under sections 175N or 175SA of the Act that the records required by reg 5(1) (or the approved alternative system) have been kept and are available for inspection (reg 4(1)). Failure to comply with recordkeeping rules attracts a $3 000 penalty in multiple provisions (reg 5(1), reg 13(1), etc.).
• Associated entities: financial controllers of associated entities must keep the same kinds of records as parties (regs 5-10), unless an approved alternative system under reg 12 applies. Financial controllers must verify returns under s.175NA with a declaration (reg 4(2)); penalties for non‑compliance include $3 000 (regs 5, 12, 13).
• Candidates and groups: agents of candidates or groups must keep receipt books, acknowledgment books and bank statements for each disclosure period under ss.175O or 175P (reg 15). The agent must verify returns under ss.175O, 175P, 175SB or 175SC with a declaration (reg 4(3)). Penalties for these actors range (for agents) typically at $1 500 for failures to verify or retain records (reg 4(3); regs 15, 21).
• Third‑party campaigners: the Regulations split third‑party campaigners into two classes:
  • Those required to lodge returns under s.175Q(1) of the Act must keep receipt books, acknowledgement books and bank statements under regs 22-27. These third‑party campaigners must lodge a declaration with their s.175Q return that the records required by reg 22 have been kept and will be available for inspection (reg 4(4)). Penalties for failing to verify or retain records are $1 500 (reg 4(4); reg 27).
  • Those required to lodge returns under s.175SD must, for the relevant election, keep bank and financial institution statements showing accounts from which electoral expenditure was incurred (regs 28, 30, 32). The agent must verify s.175SD returns that the records required by reg 28 have been kept (reg 4(5)). Penalty $1 500 (reg 4(5); reg 28, 32).
• Agents and financial controllers: agents and financial controllers are designated as responsible persons to ensure compliance (reg 14). That is the operational compliance obligation sits with those office‑holders rather than a generic corporate body reference.

Decision‑makers and intermediaries:

• Electoral Commissioner: the Commissioner approves alternative accounting systems for parties and associated entities on receipt of an auditor’s statement (regs 11-12), may publish modifications by Gazette to facilitate computerised accounting for candidates, groups and some third‑party campaigners (regs 20, 26), and is the recipient of declarations that records are available for inspection (reg 4).
• Auditors: while not specified as decision‑makers, an auditor must supply a statement with an application for an alternative system for a party or associated entity, stating that return information is ascertainable from the proposed system (regs 11(2), 12(2)). The auditor’s statement is a precondition for Electoral Commissioner approval.

Who pays and who bears compliance costs:

• Political parties, associated entities, candidates, groups and third‑party campaigners bear the direct compliance costs: maintaining books, purchasing machine‑numbered forms, retaining carbon copies or printed copies from accounting systems, binding loose leaves annually (reg 6(3)), and storing bank statements for six years (regs 13(2), 21(2), 27(2), 32). If seeking an alternative accounting approval, parties and associated entities bear the cost of an auditor’s statement (regs 11(2), 12(2)). Fines for non‑compliance fall on the persons who are responsible under the regulations (agents, financial controllers, third‑party campaigners) as specified.

Indirectly affected parties:

• Financial institutions: the Regulations rely on bank and financial institution statements as documentary evidence (regs 10, 19, 25, 30); banks therefore may be asked to supply periodic statements, but the Regulations do not impose recordkeeping duties on banks directly.
• Electoral Commission resources: the Commissioner’s powers to approve, cancel and modify may impose administrative work and judgment on the Office of the Electoral Commissioner, including assessing auditor statements and monitoring compliance.

The Regulations carve obligations by statutory role and by the kind of political actor (party, associated entity, candidate/group, two classes of third‑party campaigner), and allocate enforcement consequences accordingly.

This section states the principal duties the Regulations impose and the limited discretionary rights they provide, with section citations.

Principal duties:

• Keep specified records: Political parties and associated entities must keep receipt books, acknowledgment books and bank/financial statements in accordance with regs 6-8 and 10 (reg 5(1)). Candidates and groups must keep the same kinds of records for each disclosure period under ss.175O or 175P in accordance with regs 16, 17 and 19 (reg 15(1)). Third‑party campaigners to whom s.175Q applies must keep equivalent records in accordance with regs 23-25 (reg 22(1)). Third‑party campaigners to whom s.175SD applies must keep bank and financial institution statements for the election concerned (reg 28).
• Issue receipts and acknowledgments on receipt of money, gifts or services: On receipt of money, gifts or proceeds of sale the relevant actor must issue a receipt or acknowledgment from the respective book, include required particulars, sign in permanent ink or indelible pencil, make a carbon impression on the duplicate to retain, cancel receipts where appropriate and retain cancelled originals and copies (regs 7(1)-(6); 8(1)-(6); 16(1)-(7); 17(1)-(6); 23(1)-(7); 24(1)-(6)).
• Retain records and bank statements for six years: Parties, associated entities, candidates, groups and specified third‑party campaigners must retain books and bank statements for six years after the last entry or receipt (regs 13(1)-(2); 21(1)-(2); 27(1)-(2); 32).
• Bind loose leaves: Books may be kept in book, loose‑leaf or card systems, but all loose leaves for the financial year ending 30 June must be bound on or before 30 November of that year (reg 6(2)-(3)).
• Cross‑reference proceeds of sale: If money arises from the sale of a gift, the receipt must contain a cross‑reference to the related acknowledgment entry (reg 16(4); reg 23(4)).
• Lodge a declaration with returns: Responsible persons lodging notices or returns under specified Electoral Act sections must lodge a declaration that records required under Part 4 have been kept and are available for inspection by the Electoral Commissioner. The persons required to verify differ by return type: agents of parties for s.175N and s.175SA (reg 4(1)); financial controllers of associated entities for s.175NA (reg 4(2)); agents of candidates/groups for s.175O, 175P, 175SB, 175SC (reg 4(3)); agents of third‑party campaigners for s.175Q and s.175SD returns (reg 4(4)-(5)). Penalties apply for failing to comply with these verification requirements (reg 4).

Principal rights and discretions:

• Apply for alternative accounting systems: The agent of a party or the financial controller of an associated entity may apply to the Electoral Commissioner for approval to keep a different system of accounting records other than regs 6-8, provided that an auditor states that return information is ascertainable from the proposed system (regs 11(1)-(2), 12(1)-(2)). The Electoral Commissioner may approve unconditionally or subject to conditions (regs 11(3), 12(3)). While approval is in force, regs 5-8 do not apply except as provided in the approval (regs 11(6), 12(6)). The Commissioner can cancel approval with at least one month’s notice (regs 11(3), 12(3)).
• Commissioner modifications for computerised systems: The Electoral Commissioner may, by Gazette notice, modify the operation of regs 16 and 17 (candidates/groups) or regs 23 and 24 (third‑party campaigners) to facilitate use of computerised accounting systems (regs 20(1), 26(1)). Notices can be targeted to classes of persons as specified (regs 20(3), 26(3)).
• Forms approved by the Electoral Commissioner for third‑party books: Regs 23(1) and 24(1) require a third‑party campaigner’s receipt and acknowledgment book to be in a form approved by the Electoral Commissioner, giving the Commissioner control over the permissible template for those parties.

Allocation of responsibility:

• Agents and financial controllers are explicitly responsible for ensuring the duties in a Division are complied with (reg 14).
• The Electoral Commissioner is the overseer for approvals and modifications and the recipient of promises to make records available for inspection.

Limitations and procedural safeguards:

• Auditor precondition: For alternative systems of accounts the application must be accompanied by an auditor statement opining that required return information is ascertainable from the proposed system; this places an auditor gatekeeper between applicants and the Commissioner (regs 11(2), 12(2)).
• Conditional approvals and cancellation: Commissioner approvals may include conditions and can be cancelled with at least one month’s notice (regs 11(3), 12(3)), creating a procedural notice period before reversal.

Operational implications:

• The Regulations specify operational formality (machine numbering, permanent ink, carbon copies) that governs the way records are produced and stored (regs 7(1), 8(1), 16(1), 17(1), 23(1), 24(1), and their subparts).
• The verification duty on lodgement of returns (reg 4) ties the existence and availability of Part 4 records to statutory reporting triggers in the Electoral Act.

The Regulations impose monetary penalties for a range of non‑compliant acts and provide administrative powers to the Electoral Commissioner to approve, condition or cancel alternative accounting arrangements. The text of the Regulations links the penalties to specific provisions, and enforcement rests in significant part on the lodgement‑linked declarations and the Commissioner’s oversight.

Specified penalties:

• Verification declarations: The responsible person for a political entity lodging a notice under s.175MA must lodge a declaration confirming records have been kept and will be available for inspection; a penalty of $3,000 attaches to that subregulation (reg 4(1A)). Similar declarations required when lodging returns under s.175N or s.175SA (agent of party) carry a $3,000 penalty (reg 4(1)). Financial controllers lodging s.175NA returns must verify records and face a $3,000 penalty (reg 4(2)). Agents lodging candidate/group or third‑party returns face $1,500 penalties where those verification requirements are specified (reg 4(3)-(5)).
• Recordkeeping and retention: Several recordkeeping and retention requirements have explicit penalties. For example reg 5(1) (obligation for parties/associated entities to keep the three core record types) carries a $3,000 penalty. Reg 13 requires six‑year retention of books and printed accounting information, and reg 13(2) requires retention of bank statements for six years, each with a $3,000 penalty. For candidates/groups, reg 21(1)-(2) impose retention duties with $1,500 penalties. For third‑party campaigners reg 27(1)-(2) and reg 32 impose similar retention duties with $1,500 penalties.
• Alternative systems: Non‑compliance with the terms of an approval under regs 11 or 12 may expose the party or associated entity to a $3,000 penalty where the approval requires the entity to keep accounting records in accordance with the approval (regs 11(4), 12(4)). The text does not specify criminal sanctions beyond the monetary fines in the Regulations; enforcement mechanisms for these fines would arise under the enforcement framework of the electoral legislation and general enforcement mechanisms of Western Australian law.

Enforcement mechanisms and administrative powers:

• Declarations and inspection: The Regulations create a procedural enforcement lever by requiring declarations that records are kept and available for inspection (reg 4). The Regulations state that records must be available for inspection upon request by the Electoral Commissioner (reg 4(1A), 4(1)-(5)).
• Commissioner's approval and cancellation powers: The Electoral Commissioner has the power to approve alternative accounting systems for parties and associated entities, to impose conditions, and to cancel approvals with at least one month’s notice (regs 11(3), 12(3)). The Commissioner may also modify requirements to facilitate computerised systems by Gazette notice for candidates, groups and third‑party campaigners (regs 20, 26). These powers create administrative control points where the Commissioner can accept different compliance methods or revert to prescriptive forms.
• Forms control: For third‑party campaigners required to lodge s.175Q returns, the receipt and acknowledgment books must be in a form approved by the Electoral Commissioner (regs 23(1), 24(1)). This allows the Commissioner to standardise templates and thus facilitates auditability.
• Temporal enforcement levers: The Regulations include transitional provisions (regs 33-34) that apply unamended pre‑1 July 2024 return rules to the 2024 financial year in particular circumstances; this can affect how enforcement is applied retrospectively for that financial year.

Limits in enforcement detail in the Regulations:

• The Regulations specify fines and administrative decision powers but do not set out the procedural enforcement steps, adjudication processes or appeal mechanisms inside the Regulations themselves; those processes are expected to be found in the Electoral Act or general administrative law and enforcement statutes, which are referenced but not reproduced here. The Regulations focus on the documentary obligations and the monetary penalties attached to failing to meet those obligations.

Practical enforcement consequences:

• The combination of record retention duties, verification declarations and bank statement reliance means that failure to produce required records on inspection or to lodge the required declaration exposes the responsible persons to the specified fines. The Commissioner’s ability to approve alternative systems or to modify requirements offers a mechanism to accommodate technological change but is exercisable by administrative discretion and subject to conditions and cancellation.

The Regulations are framed as subordinate legislation to the Electoral Act 1907 and are tightly integrated with specified reporting and disclosure provisions of the Act. The Regulations operate as procedural and evidentiary detail for the Act’s reporting architecture rather than creating standalone offences or disclosure regimes.

Cross‑references to the Electoral Act:

• The Regulations are expressly triggered by, and provide procedural detail for, a number of sections of the Electoral Act. The verification requirements in regulation 4 reference returns lodged under ss.175N, 175NA, 175O, 175P, 175Q, 175SD, 175SA, 175SB, 175SC and notices under s.175MA of the Act (reg 4(1A) and (1)-(5)). Thus the Regulations make recordkeeping and verification part of the statutory regime for the returns mandated by those Act sections.
• Part 5 transitional provisions (regs 33-34) explicitly interpret the application of the Act as amended by the Electoral Amendment (Finance and Other Matters) Act 2023. Reg 33 applies “unamended” ss.175N and 175NA of the Act (that is, the Act as in force immediately before 1 July 2024) to persons who received contributions or income in the 2024 financial year for which a return is required under those sections as in force on 1 July 2024. Reg 34 declares that s.175LQ of the Act does not apply in relation to the financial year ending 30 June 2024. These transitional rules directly interact with the amended Act’s timing and reporting scope.
• Many reporting and retention obligations in the Regulations are tied to the Act’s disclosure periods and return lodgement duties (for example the references in Divisions 2-4 to disclosure periods under ss.175O or 175P and disclosure periods in s.175Q).

Delegated administrative powers vis‑à‑vis the Act:

• The Electoral Commissioner’s power to approve alternative accounting systems (regs 11-12) and to publish modification notices in the Gazette for computerised systems (regs 20, 26) complement the Act’s reporting architecture by offering delegated administrative flexibility within the statutory disclosure regime. Those delegated powers are constrained by procedural steps (auditor’s statement as precondition, conditional approvals, cancellation notice) but otherwise give the Commissioner discretion to adapt recordkeeping methods to operational realities.

Interaction with auditing and accounting law:

• While the Regulations do not alter the duties of accountants or auditors in general law, they make an auditor’s statement a statutory precondition for alternative systems approval for parties and associated entities (regs 11(2), 12(2)). That interlocks electoral recordkeeping with professional auditing assurance: the electoral scheme relies on the auditor’s opinion that required return information is “ascertainable” from the proposed system.

Documentary evidence and financial institution interaction:

• The Regulations rely on bank and financial institution statements as key documentary evidence for deposits and electoral expenditure (regs 10, 19, 25, 30). This implies coordination in practice between regulated actors and their financial institutions when producing statements for inspection and retention. The Regulations do not impose duties directly on financial institutions; they assume the availability of periodic statements as a practical documentary source.

Complementarity with general administrative law:

• The Commissioner’s decisionmaking under regs 11-12 (approve/cancel) and regs 20 and 26 (Gazette modifications) will be exercised subject to principles of administrative law generally, including procedural fairness and possible judicial review, though the Regulations themselves do not detail those remedies. The Regulations thus sit within a broader legal architecture in which administrative decisions are reviewable under general law.

Limits of this interaction analysis:

• The text of the Regulations repeatedly references sections of the Electoral Act but does not reproduce the operative provisions of the Act itself. Any enforcement, appeal routes, criminal penalties beyond the monetary fines specified here, or more detailed inspection powers are to be found in the Act and other statutes, and are not contained in the Regulations as provided. The Regulations therefore function as the evidentiary and process detail implementing disclosure and return rules specified in the Electoral Act.

The Regulations as provided include an explicit compilation table and amendment notes that show the instrument’s evolution, including a significant 2024 amendment package.

Foundational instrument and reprint:

• The Electoral (Political Finance) Regulations 1996 were published 8 November 1996 and commenced 9 November 1996 (see Compilation table). A Reprint 1 is noted as at 7 May 2004.

Key 2024 amendments:

• The Regulations have been amended by the Electoral Amendment Regulations (Finance and Other Matters) Regulations 2024, cited as SL 2024/124 Pt. 2, published 26 June 2024 and commencing 1 July 2024 (Compilation table; see r. 2(b)). The text of the Regulations includes numerous amendment notes indicating changes effected by SL 2024/124; for example the heading of Part 4 was amended (r. 6), numerous specific regulations were amended (see the bracketed editorial notes after reg numbers), and several provisions were deleted or inserted by SL 2024/124 (for example regs 3, 9, 18, 29, 31 are shown as deleted or renumbered).
• Part 5, a new transitional provisions Part related to the Electoral Amendment (Finance and Other Matters) Act 2023, was inserted by SL 2024/124 r. 32. Regs 33 and 34 were inserted as transitional provisions dealing with the application of unamended ss.175N and 175NA to the 2024 financial year and the non‑application of s.175LQ for that year (regs 33-34). These insertions explicitly manage the interface between the 2023 Act’s amendments and reporting obligations for the 2024 financial year.

Specific deletions and amendments:

• Several subregulations and regulation numbers are shown as deleted by SL 2024/124 (for example “Part 2 (s. 3) deleted: SL 2024/124 r. 4” and “(2) deleted” in reg 5, or regs 9, 18 and others marked as deleted by r. 11, r. 17, and so on). The Amendment notes in the footers to many regulations record the precise r. numbers in the amending instrument that made the change (for example “Regulation 7 amended: SL 2024/124 r. 9”).
• Several substantive changes are visible in the current text that reflect amendment: new subregulations that explicitly reach to digital/computerised accounting (for which the Commissioner may publish modifications; regs 20, 26), the creation of Division 4 for third‑party campaigners to whom Act s.175SD applies (reg 28 inserted: SL 2024/124 r. 27), and the addition of reg 4(1A) which requires the responsible person for a political entity lodging a s.175MA notice to lodge a declaration (reg 4 amended: SL 2024/124 r. 5).

Temporal operation clauses:

• The commencement clause remains unusual: the Regulations come into operation on either the day section 4 of the Electoral Amendment (Political Finance) Act 1992 comes into operation or the Gazette publication date, whichever is later (reg 2). That historical drafting note is retained and sits alongside the later 2024 amendments’ commencement (SL 2024/124 r. 2(b) effective 1 July 2024).

Compilation practice:

• The document is a statutory compilation as of 2024 and includes editorial notes about reprints and amendments. The Compilation table summarises the original instrument’s publication and commencement and records the 2024 amending instrument and its commencement date.

Practical consequence of the recent amendments:

• The 2024 amendments introduced new procedural categories (notably third‑party campaigners to whom s.175SD applies) and adjusted verification, recordkeeping and transitional arrangements for the 2024 financial year. They also recalibrated fines and duties in several places and modernised the scheme in limited ways by expressly enabling computerised accounting modifications and alternative systems with auditor verification (regs 11-12, 20, 26).

The Regulations as provided do not include any reported litigation, case citations or judicial decisions. The text contains no references to court determinations or appeals concerning the Regulations themselves, and the compilation table and notes list statutory amendments but do not catalogue litigation. Accordingly, within the four corners of the supplied instrument there is no litigation history to summarise.

Implications for practitioners:

• Because the Regulations reference many sections of the Electoral Act (for example ss.175N, 175NA, 175MA, 175O, 175P, 175Q, 175SD, 175SB, 175SC, 175LQ and Part VI), any litigation that addresses the validity, interpretation or enforcement of the recordkeeping or verification duties is likely to be reported alongside cases interpreting the Electoral Act provisions rather than the Regulations alone. However, the present text supplies no such cases.
• The lack of litigation referenced in the Regulations does not mean enforcement is inactive; it simply reflects that this compiled statutory instrument does not annotate or summarise judicial decisions. Practitioners seeking precedential authority for contested enforcement actions, interpretations of the scope of “ascertainable” in an auditor’s statement, or the limits of the Commissioner’s discretion to modify requirements for computerised accounting must look to case law on the Electoral Act and administrative law beyond the Regulations themselves.

Points to consider when researching litigation:

• Potentially material issues that could have generated litigation (but are not recorded here) include: the scope of the Electoral Commissioner’s discretion under regs 11-12 and 20-26 (approval, imposition of conditions, cancellation, Gazette modifications), the sufficiency of an auditor’s statement for alternative systems approval (regs 11(2), 12(2)), the evidentiary adequacy of computerised records and the Commissioner’s modifications to accommodate them (regs 20, 26), and challenges to the imposition of the specified fines for recordkeeping failures. Any authoritative adjudication of these issues will appear in judicial reports and not in this statutory compilation.

The Regulations contain several technical, timing and form‑sensitive requirements that can create compliance pitfalls if overlooked. Below are concrete provisions that commonly produce implementation risk for practitioners and regulated entities.

1. Machine‑numbered duplicate forms and carbon impressions

• Receipt and acknowledgment books must contain machine‑numbered duplicate forms and practitioners must retain carbon impressions and cancelled originals and copies (regs 7(1)-(6), 8(1)-(6), 16(1)-(7), 17(1)-(6), 23(1)-(7), 24(1)-(6)). Failure to use machine‑numbered duplicates or to retain the duplicate can undermine the statutory retention obligation and expose the responsible person to fines (regs 13, 21, 27). If an entity has shifted to digital receipts, the Commissioner’s modification powers (regs 20, 26) or an alternative system approval (regs 11-12) must be used to avoid non‑compliance.

2. Carbon copies and permanent ink requirement

• Each receipt or acknowledgment must be entered in permanent ink or indelible pencil and signed by an authorised person (regs 7(3), 8(3), 16(3), 17(3), 23(3), 24(3)). Handwritten entries in erasable ink or unsigned forms will fail to meet the requirement.

3. Binding loose leaves annually

• Books kept as loose leaves must be bound on or before 30 November in each year for the financial year ending 30 June that year (reg 6(3)). Missing the binding deadline is a procedural non‑compliance risk that could impede the ability to produce complete, sequential documentation on inspection.

4. Cross‑references for proceeds of sale

• When money is received as proceeds of sale of a gift, receipts must contain a cross‑reference to the corresponding acknowledgment entry (reg 16(4), reg 23(4)). Administrative systems that do not support cross‑referencing will need to adjust bookkeeping practices to comply.

5. Different requirements for different actor classes

• The Regulations apply different recording regimes to parties/associated entities, candidates/groups, third‑party campaigners under s.175Q, and third‑party campaigners under s.175SD (Divs 1-4). Treating all third parties the same risks missing the bank‑statement‑only requirement for s.175SD campaigners (reg 28) or the full book requirements for s.175Q campaigners (reg 22). Practitioners should confirm which Act section triggers a third party’s obligations.

6. Auditor statement precondition for alternative systems

• An application from a party or associated entity for an alternative accounting system must be accompanied by a statement of an auditor opining that return information is ascertainable from the proposed system (regs 11(2), 12(2)). The Regulations do not define “ascertainable”, so applicants should ensure the auditor’s statement is sufficiently detailed to satisfy the Commissioner. Cost and timing of obtaining an auditor’s statement is a practical compliance cost.

7. Commissioner discretion and cancellation notice

• Approvals for alternative systems may be conditional and may be cancelled by the Commissioner on one month’s notice (regs 11(3), 12(3)). Entities relying on an alternative system must therefore be prepared to revert to the default books within a one‑month window or to accommodate conditions imposed at approval time.

8. Forms for third‑party campaigners approved by Commissioner

• Regs 23(1) and 24(1) require the receipt and acknowledgment books for third‑party campaigners (s.175Q) to be in a form approved by the Electoral Commissioner. If a third‑party uses its own form without prior approval, it risks a non‑compliance finding.

9. Declaration verification tied to returns and different fines

• Declaring that records are kept is a formal step when lodging returns. The fines differ by actor and by the return type , $3,000 for party/associated entity declarations (reg 4(1A), (1), (2)), $1,500 for candidate/group and third‑party declarations (reg 4(3)-(5)). Practitioners should confirm who must sign which declaration and what fines apply.

10. Transitional rules for the 2024 financial year

• Regs 33-34 treat 2024 reporting in specific ways: unamended ss.175N and 175NA apply for the 2024 financial year in specified circumstances (reg 33), and s.175LQ does not apply for the 2024 financial year (reg 34). Entities must check whether they fall within the transitional scope; automatic reliance on the post‑1 July 2024 Act could misalign returns for 2024 if the transitional rule applies.

11. Retention periods and printed copies of electronic systems

• Where accounting systems are computerised and approved or modified under regs 20 or 26, the Regulations still require printed copies of the information to be retained for six years (regs 13(1)(b), 21(1)(b), 27(1)(b)). Entities must ensure backups and printed records are retained; ephemeral electronic files alone may not satisfy the printed‑copy requirement absent a modification notice or approval.

12. Administrative variation via Gazette

• The Commissioner modifies operation of certain regulations by Gazette notice (regs 20(1), 26(1)). It is the regulated entity’s responsibility to monitor Gazette notices to understand applicable modifications or to apply for an approval where necessary.

Practically, these “gotchas” point to the importance of mapping statutory obligations to operational accounting workflows, ensuring authorised signatures and duplicate retention, obtaining prior approvals where recordkeeping diverges from the prescribed forms, and monitoring both the Commissioner’s Gazette notices and transitional rules that affect reporting periods.

Compliance under the Regulations requires a program that integrates statutory form requirements, retention timelines, declaration procedures and liaison with auditors and the Electoral Commissioner where alternative arrangements or computerisation are desired. The following is a practical, source‑grounded checklist and procedural guide mapped to the Regulations.

1. Identify which regime applies to you

• Confirm whether you are a political party, associated entity, candidate, group, third‑party campaigner required to lodge a return under s.175Q, or a third‑party campaigner required to lodge under s.175SD of the Electoral Act. The recording requirements differ by class (Divs 1-4; regs 5, 15, 22, 28).

2. Establish the required record types and their form

• For parties and associated entities: ensure receipt books, acknowledgment books and bank/financial institution statements are kept in accordance with regs 6-8 and 10 (reg 5(1)).
• For candidates and groups: set up receipt and acknowledgment books and bank statements per regs 16-17 and 19 (reg 15(1)).
• For third‑party campaigners under s.175Q: use receipt/acknowledgment books in a form approved by the Electoral Commissioner and keep bank statements as required (regs 22-25; regs 23(1), 24(1)).
• For third‑party campaigners under s.175SD: ensure periodic bank/financial statements cover accounts from which electoral expenditure is incurred (regs 28, 30).

3. Procure compliant book templates and numbering

• Use machine‑numbered duplicate forms for all receipt and acknowledgment books as required (regs 7(1), 8(1), 16(1), 17(1), 23(1), 24(1)). For third‑party campaigners under s.175Q ensure the form is approved by the Electoral Commissioner (regs 23(1), 24(1)). Keep carbon duplicates and cancelled originals and copies (e.g. regs 7(4)-(6), 8(4)-(6)).

4. Implement data capture and signing processes

• Ensure entries are made in permanent ink or indelible pencil and signed by an authorised person (e.g. regs 7(3), 8(3), 16(3), 17(3), 23(3), 24(3)). For receipts arising from sale proceeds, include cross‑references to the acknowledgment entry (reg 16(4), reg 23(4)).

5. Bank account structuring and statement retention

• Maintain bank accounts that clearly segregate deposits of contributions/income and accounts from which electoral expenditure is incurred, as the Regulations require bank statements for these accounts (regs 10, 19, 25, 30). Arrange to receive and retain bank statements on a regular periodic basis and store them for six years after receipt (regs 13(2), 21(2), 27(2), 32).

6. Binding and annual housekeeping

• If records are maintained in loose‑leaf form, ensure all loose leaves for the financial year ending 30 June are bound on or before 30 November (reg 6(3)). Maintain an annual process to bind and archive all loose documents.

7. Retention and printed backups for computerised systems

• For electronic/computerised accounting systems, obtain either:
  • an approval or modification from the Electoral Commissioner under regs 11-12 (alternative systems for parties/associated entities) or regs 20, 26 (modification notices for candidates/groups and relevant third‑party campaigners); or
  • as a minimum, retain printed copies of the information recorded in the accounting system for six years after the last entry (regs 13(1)(b), 21(1)(b), 27(1)(b)). Where relying on electronic systems without a modification notice, ensure printed copies are produced and archived.

8. Auditor involvement if seeking alternative accounting

• If a party or associated entity intends to use an alternative accounting system, engage an auditor to prepare the required statement that “in the auditor’s opinion, the information to be included in a return under section 175N or 175SA (or 175NA for associated entities) is ascertainable from the proposed system” (regs 11(2), 12(2)). Prepare the application to the Electoral Commissioner and be ready to accept conditions on approval and the risk of cancellation on one month’s notice (regs 11(3)-(4), 12(3)-(4)).

9. Declare record availability when lodging returns

• When lodging returns or notices under the specified Electoral Act sections, ensure the appropriate responsible person (agent or financial controller) signs and lodges the required declaration that the Part 4 records have been kept and will be made available for inspection by the Electoral Commissioner (reg 4(1A) and reg 4(1)-(5)). Treat this declaration as a formal compliance step: different fines attach depending on the return type ($3,000 for certain party/associated entity returns and $1,500 for certain candidate/group/third‑party returns) (reg 4).

10. Monitor Commissioner notices and the Gazette

• The Electoral Commissioner may publish Gazette notices modifying regs 16-17 and 23-24 to facilitate computerised accounting systems and these notices may be targeted to classes of entities (regs 20(1)-(3), 26(1)-(3)). Maintain a process to monitor Gazette notices and to apply for approvals where appropriate.

11. Implement role‑based responsibility and training

• Agents and financial controllers are statutorily responsible for ensuring compliance with the Division’s duties (reg 14). Document internal delegations, authorisations and signatory lists so that the authorised person requirement for signatures is met and so that compliance duties are demonstrably owned by named responsible persons.

12. Prepare for inspection

• Ensure records are stored and retrievable for inspection by the Electoral Commissioner on request, consistent with the declaration lodged on returns (reg 4). Maintain an indexed archive that supports retrieval of duplicate forms, cancelled originals, cross‑references and six years’ bank statements.

13. Transitional year checklist for 2024

• For the 2024 financial year, verify whether the transitional provisions in reg 33 apply to your returns. If you received political contributions or income in the 2024 financial year for which a return is required under ss.175N and 175NA as in force on 1 July 2024, unamended ss.175N and 175NA apply to you for that year and unamended Part VI applies to such returns (reg 33). Also note reg 34 suspends s.175LQ for the 2024 financial year.

14. Maintain an audit trail for any alternative approvals or modifications

• Keep copies of all applications to the Electoral Commissioner, auditor statements, approval letters with any conditions attached, and any cancellation notices received. These will support compliance and defence if a verification or inspection raises questions about the adequacy of records.

In practice, compliance requires integrating statutory record templates into finance and fundraising workflows, engaging auditors early if alternative systems are sought, and establishing a formalised process for declarations on return lodgement and for archival of six years’ worth of bank statements and printed accounting outputs.
