#### 109 Requirement to notify Electoral Commission of changes in registered particulars 109 Requirement to notify Electoral Commission of changes in registered particulars (cf section 38 EFED Act) > > (1) If a change occurs in any of the particulars stated in the Register of Candidates in relation to a candidate or group (being particulars of the kind required to be stated in an application for registration of the candidate or group), the candidate or group must, within 30 days after the date of the change, notify the Electoral Commission of the change in the manner and form approved by the Electoral Commission. > > > > Maximum penalty—2 penalty units. > > > (2) If the Electoral Commission believes on reasonable grounds that a candidate or group has not notified the Electoral Commission of a change in particulars as referred to in subsection (1), the Electoral Commission may, by notice in writing served on the candidate or group, require the candidate or group to notify the Electoral Commission of the change before the date specified in the notice, or before the date of expiry of the period of 30 days after service of the notice, whichever is later. > > > (3) If a candidate or group fails to notify the Electoral Commission in accordance with subsection (2), the Electoral Commission may cancel the registration of the candidate or group. > > > (4) The regulations may provide that this section does not apply to particulars or variations of a class or description specified in the regulations for the purposes of this subsection.
