#### 246 Reference of question as to qualification or vacancy 246 Reference of question as to qualification or vacancy > > (1) The Assembly may by resolution refer to the Court of Disputed Returns any question respecting— > > > > > (a) the qualification of a member to be or continue as a member of the Assembly, or > > > > > (b) a vacancy in the Assembly. > > > (2) The Council may by resolution refer to the Court of Disputed Returns any question respecting— > > > > > (a) the qualification of a member to be or continue as a member of the Council, or > > > > > (b) a vacancy in the Council. > > > (3) The Court of Disputed Returns has jurisdiction to hear and determine such a question.
