92 Employee wishing to vote (1) On notice by an employee before an election day, the employee's employer must allow the employee, without penalty or any disproportionate deduction of pay, to take any necessary leave (not exceeding 2 hours) for the purpose of voting. (2) However, subsection (1) does not apply if the employee's absence may cause danger or substantial loss. (3) An employee must not notify an employer under subsection (1) unless the employee genuinely intends to vote during the leave to be granted for the purpose of voting. Electoral Act 2004 51
