89 Spoilt or discarded ballot paper (1) Subsection (2) applies if an authorised officer at a voting centre: (a) is satisfied a ballot paper given to the officer by a person has been spoilt by mistake or accident; or (b) finds a ballot paper discarded at the voting centre. (2) The officer must: (a) cancel the ballot paper by writing "spoilt" or "discarded" on it; and (b) place the ballot paper in an envelope, seal the envelope and endorse the envelope with a statement of its contents; and (c) for a spoilt ballot paper – issue to the person an unused ballot paper. (3) As soon as practicable after the close of voting, the officer must place all envelopes mentioned in subsection (2)(b) with unused ballot papers.
