243 Inquiries by Court (1) For deciding the application, the Court of Disputed Returns may inquire into any of the following: (a) the identity of voters; Electoral Act 2004 136 (b) whether votes were improperly admitted or rejected; (c) whether the result of voting was correctly ascertained. (2) However, the Court must not inquire into the correctness of a roll and must take the roll to be conclusive evidence that the persons enrolled were, at the close of the roll, entitled to be enrolled. (3) In addition, the qualification of a person enrolled cannot be questioned.
