218B Offence to enter into or carry out scheme (1) A person must not enter into, or carry out, a scheme, whether alone or with any other person, with the intention of circumventing a prohibition or requirement under this Part. Penalty: 10 years imprisonment. (2) Without limiting subsection (1), a person commits an offence under that subsection if the person enters into, or carries out, a scheme under which— (a) an entity that is not a nominated entity of a registered political party receives one or more gifts at a particular time; and (b) after receiving the gift or gifts, the entity becomes the nominated entity of a registered political party; and (c) the receiving of the gift or gifts by the entity would have constituted an offence against this Part if the entity had been the nominated entity of the registered political party at the time the gift or gifts were received; and (d) the person entered into the scheme with the intention of circumventing a prohibition or requirement under this Part.
