What it does
This instrument is a short, specific administrative determination made by the Tertiary Education Quality and Standards Agency (TEQSA). It fixes the timing rule for when registered providers must submit applications to TEQSA to renew their registration, for the purposes of subsection 10D(3) of the Education Services for Overseas Students Act 2000 (ESOS Act). The operative text provides two alternatives. A renewal application must be made either:
- "at least 90 days prior to the date on which a provider’s registration is due to expire"; or
- "within such shorter period as TEQSA allows."
The determination is dated 29 September 2016 and signed by the Chief Commissioner and two Commissioners of TEQSA. The instrument identifies its legal operation as "for the purposes of subsection 10D(3) of the Education Services for Overseas Students Act 2000 (ESOS Act)" and refers to renewal under "subsection 10D(1) of the ESOS Act." Those two cross references are the only statutory hooks the instrument records.
Mechanically, the determination imposes a temporal filing requirement on renewal applications and concurrently preserves TEQSA's discretion to permit departures from the 90 day minimum in individual cases. The instrument does not include conditions, criteria, or procedural detail for how TEQSA will decide whether to allow a shorter period. The text does not specify a commencement provision beyond the date on the document, and it does not attach schedules, forms, fees, or transitional arrangements. The instrument is thus narrowly focused: it prescribes the minimum advance notice for renewal applications and records that TEQSA can allow a shorter lead time.
