What it does
This Act creates three statutory charges connected to the Education Services for Overseas Students regulatory framework and delegates to regulation-making powers the detail of how much is payable and how amounts are calculated. The Act’s operative mechanics are limited and specific:
- It imposes an annual CRICOS registration charge on any provider who is a registered provider on 1 January of a calendar year (s 5(1)-(3)). The charge is labelled “CRICOS annual registration charge” (s 5(2)). The Act fixes who is liable: the provider (s 5(3)).
- It imposes a charge on certain applications for registration made by approved school providers who are not yet registered under the ESOS Act (the “schools initial registration charge”) (s 6(1)-(3)). Liability is on the applicant provider (s 6(3)).
- It imposes a charge on renewal-of-registration applications by registered approved school providers who meet the registration requirements (the “schools renewal registration charge”) (s 7(1)-(3)). Liability falls on the registered provider making the renewal application (s 7(3)).
For each charge the Act delegates the rate-setting and calculation method to regulations (s 5(4)-(5); s 6(4)-(5); s 7(4)-(5)). The regulations may either prescribe a fixed amount or prescribe a method for working the amount out; they may also provide that an amount equals the sum of prescribed components (s 5(4)-(5); s 6(4)-(5); s 7(4)-(5)). The regulations may also provide for indexation of amounts (s 5(8); s 6(7); s 7(7)) and may exempt whole classes of providers from particular charges (s 5(9); s 6(8); s 7(8)).
The Act imposes a precondition on regulation-making: before the Governor‑General makes regulations fixing amounts or methods for CRICOS annual charges, the Minister must be satisfied that those regulations will recover no more than the Commonwealth’s likely costs in connection with the Secretary’s performance of functions and exercise of powers under the Education Services for Overseas Students Act 2000 (s 5(6)). For the schools initial and renewal charges the Minister must be satisfied that the regulations will recover no more than the Commonwealth’s likely costs in connection with a set of specified functions and powers of the Secretary as the ESOS agency for approved school providers (s 6(6); s 7(6)). The CRICOS provision also states two categories of costs to be disregarded when the Minister assesses whether the regulations meet the cost‑recovery requirement (s 5(7)): costs in connection with functions or powers covered by s 6(6) or s 7(6), and costs likely to be offset by reinstatement fees.
