Education Services for Overseas Students (Notice Requirements) Instrument 2022

The instrument rests on a small set of interlocking concepts drawn from the Act and a related migration regulation. The operative concepts are provider default, discharge of obligations, confirmation of enrolment, and the computer system established by the Secretary under section 109 of the Act.

• Provider default. The instrument’s duties are triggered in relation to a provider default as referenced in sections 46B and 46D-46F of the Act. The instrument does not restate the statutory definition of default; it assumes the reader will refer to the Act for that definition. When a provider default occurs, the provider must enter specified information about the default and affected students into the Secretary’s computer system (section 6(1)).

• Confirmation of enrolment (CoE). The instrument restricts its application to "each student to whom the provider has issued a confirmation of enrolment" (section 6(1) and note in section 4). It imports the meaning of CoE from regulation 1.03 of the Migration Regulations 1994 (section 4, note), which the instrument states defines CoE as the registered provider’s confirmation that a student is enrolled in a registered course, as required by section 19 of the Act. The instrument therefore ties the data obligations to students who hold a CoE.

• Computer system established by the Secretary. All entry obligations are to be satisfied by entering information into the Secretary’s computer system established under section 109 of the Act (sections 6(1) and 7(1)). The instrument does not itself create or describe the technical specifications of that system; it merely mandates that the listed information be entered into it.

• Discharge of obligations. Where a provider faces a default, section 46D of the Act sets out ways the provider may discharge obligations to students (for example by arranging an alternative course or refunding fees). The instrument requires providers to report the outcome of that process to the Secretary’s system, and to identify the method used (section 7(1)(b)). It then lists the particular fields that apply to each method of discharge (sections 7(2)-(3)).

Other structural concepts include the "if known by the provider" qualifier used in relation to certain fields (section 6(2); section 7(2)(b)). The instrument also repeals two earlier determinations from 2012 (Schedule 1), signalling that the current instrument replaces those prior requirements.

In sum, the instrument narrows the statutory discretion over notice content by prescribing mandatory data fields providers must enter into the Secretary’s computer system when a default occurs and when a provider reports the outcome of its discharge of obligations.

The instrument directly binds registered providers under the Education Services for Overseas Students Act 2000. The operative obligations are expressed as duties that "the provider must enter" specified information in the Secretary’s computer system (see sections 6(1), 6(2), and 7(1)-(3)). The duties apply in respect of "each student to whom the provider has issued a confirmation of enrolment" (sections 6(1) and 7(1)), so the affected population of students is defined by the occurrence of a CoE issued by the provider as defined in regulation 1.03 of the Migration Regulations 1994 (section 4).

The Secretary, or the department acting through the Secretary, is the other institutional actor named. The instrument requires entry of the information "in the computer system established by the Secretary, as mentioned in section 109 of the Act" (sections 6(1) and 7(1)). That makes the Secretary responsible for maintaining the system that will receive and hold the data. The instrument does not set system specifications, access controls, or format validation; it presumes the Secretary’s system will be the vehicle for compliance.

Students are affected as subjects of the data entries. The instrument requires providers to enter students’ contact details "if known" (section 6(2)) and other data that identifies the outcome of the provider’s discharge of obligations in relation to those students (sections 7(2)-(3)). The instrument does not establish student-facing rights or procedures, nor does it set out how students will be notified through the computer system. It also does not stipulate how student privacy or data protection is to be handled; it simply directs that information be entered into the Secretary’s system.

Other indirect actors include administrative staff at providers who will perform the entries, and internal compliance or legal teams responsible for collecting and retaining the evidence referenced in section 7(2)(c) (confirmation that the provider has evidence of the student’s acceptance of an alternative course). The instrument’s repeal of two 2012 determinations (Schedule 1) affects any provider processes that were built to satisfy the now-repealed instruments, because providers must now ensure their processes align with the 2022 instrument’s fields and any operational details supplied by the Secretary’s system.

Finally, because the instrument imports the meaning of CoE from the Migration Regulations, the Department responsible for migration matters and the visa-processing system are indirectly implicated insofar as CoE status is consequential for the students to whom these reporting obligations relate (section 4).

The instrument establishes a concise set of mandatory data-entry duties for providers. It does not create statutory rights for providers or students beyond the duty-bearing structure, nor does it itself create administrative powers or penalties. The key duties are as follows.

Duties for notices of provider default (section 6)

• For each student to whom the provider has issued a CoE, the provider must enter into the Secretary’s computer system the date of the default (section 6(1)(a)).
• The provider must enter the reason for the default (section 6(1)(b)).
• If the listed items are known by the provider, the provider must also enter the student’s current residential address, email address, home phone number and mobile phone number (section 6(2)). The instrument’s language is "if known by the provider", which qualifies these additional fields as contingent on the provider’s knowledge.

Duties for notices of outcome of discharge of obligations (section 7)

• The provider must enter whether the provider has met its obligations in accordance with section 46D of the Act, and if not, the reason why the obligations were not met (section 7(1)(a)).
• If the provider has met its obligations under section 46D, it must state whether this was by arranging an alternative course under subsections 46D(4)-(5), or by providing a refund under subsections 46D(6)-(7) (section 7(1)(b)).
• If the provider discharged obligations by arranging an alternative course, the provider must enter the date the provider met their obligations, the confirmation of enrolment code of the alternative course accepted by the student if known, and confirmation that the provider has evidence of the student’s acceptance of an offer of a place in an alternative course (section 7(2)(a)-(c)).
• If the provider discharged obligations by providing a refund, the provider must enter the amount of the refund and the date the refund was paid (section 7(3)(a)-(b)).

Ancillary duties implied by the instrument

• Providers will need to retain the underlying evidence that supports the entries they make into the Secretary’s system, in particular the "confirmation that the provider has evidence of the student’s acceptance" where an alternative course has been arranged (section 7(2)(c)). The instrument does not detail storage formats or retention periods; those may be provided elsewhere in the Act or by administrative guidance.

No express rights

• The instrument does not grant express rights to providers or students in respect of the information entered. It does not set out review or appeal rights against entries, nor does it provide a right for students to access or correct the entries made on the Secretary’s system.

Limitations and qualifiers

• Several obligations are expressed with a knowledge qualifier, "if known by the provider" (sections 6(2), 7(2)(b)). Those qualifiers limit the mandatory nature of specific fields to the provider’s knowledge at the time of entry.
• The instrument does not specify timing thresholds for entry, nor technical standards for the information to be entered. Those elements are left to the Act’s broader framework and the Secretary’s computer system.

In sum, the instrument imposes discrete, record-oriented duties on providers to populate the Secretary’s system with particular data points whenever provider default and discharge-of-obligation processes are engaged.

The instrument itself does not create or specify penalties, sanctions or enforcement procedures. It is an instrument made under subsections 46B(6) and 46F(5) of the Act that prescribes required content for notices entered into the Secretary’s computer system (section 3). The instrument confines itself to specifying the information providers must enter for the purposes of subsections 46B(2) and (5) and subsection 46F(2) and (4) of the Act (sections 6 and 7). It contains no provisions creating offences, administrative penalties, civil causes of action, or enforcement mechanisms.

Because the instrument operates as a specification of information required under statutory notice provisions in the Act, any consequences for non-compliance with the information-entry duties will derive from the Act itself or from other instruments, regulations, or administrative rules made under the Act. The instrument does not reproduce those enforcement provisions, and does not provide interpretive guidance about what constitutes compliant or non-compliant entry beyond the list of fields. The instrument therefore leaves the following points to be governed elsewhere:

• How the Secretary will validate entries, whether incomplete entries are acceptable, and whether the Secretary may reject, amend or request clarification of entries in the computer system.

• What timeframes apply to entering the required information after a default or after the provider has met or failed to meet its obligations; the instrument does not set temporal deadlines.

• Whether failure to provide the prescribed information, or provision of incorrect information, triggers specific statutory offences or administrative sanctions under the Act, or whether such failures would be addressed through other compliance mechanisms.

• Whether the Secretary will use information entered to initiate external enforcement action, such as compliance audits, notices, or referrals to other agencies.

Practitioners should therefore read the instrument in conjunction with the Act to identify the enforcement framework that governs provider defaults, required notices, and any statutory sanctions referenced in the Act. The instrument’s Schedule 1 repeals indicate that it replaces earlier 2012 determinations that may have contained related compliance or administrative material; however, the instrument does not say that those determinations contained penalties. The instrument’s silence as to enforcement and penalties means compliance risk should be assessed by reference to the Act and any operational instructions or guidance issued by the Secretary about the computer system.

The instrument explicitly ties itself to the Education Services for Overseas Students Act 2000 and to the Migration Regulations 1994. It is made under subsections 46B(6) and 46F(5) of the Act (section 3). It prescribes the information a provider must enter "for the purposes of subsections 46B(2) and (5) of the Act" and "for the purposes of subsection 46F(2) and (4) of the Act" (sections 6(1) and 7(1)). The instrument therefore supplements and operationalises statutory notice obligations found in those specified subsections of the Act by specifying the content to be provided in the statutory computer system.

The instrument also imports the term "confirmation of enrolment" from regulation 1.03 of the Migration Regulations 1994 by stating that "confirmation of enrolment has the same meaning as in regulation 1.03" (section 4). The instrument then notes the substance of that definition for convenience, stating that the regulation provides that a confirmation of enrolment is "a confirmation by the registered provider that the student is enrolled in a registered course provided by the registered provider, as required by section 19 of the Act" (section 4 note). By doing this the instrument ties the data-entry obligations to the subset of students for whom a CoE has been issued, thereby creating a point of intersection between education compliance reporting and migration-related documentation.

The instrument also relies on the computer system established under section 109 of the Act, instructing providers to enter the prescribed information "in the computer system established by the Secretary, as mentioned in section 109 of the Act" (sections 6(1) and 7(1)). That linkage means the instrument’s operation depends on the Act’s provisions concerning the Secretary’s computer system, including any access, data handling, or administrative processes that section 109 enables or prescribes.

The Schedule 1 repeals eliminate two earlier instruments: the Education Services for Overseas Students (Notifying provider default - requirements for a notice) Determination 2012 (No. 1) and the Education Services for Overseas Students (Provider default - discharge of obligations - requirements for a notice) Determination 2012 (No. 1). Those repeals mean that any processes or compliance steps that depended on the 2012 instruments must now be aligned to the 2022 instrument. The instrument does not state whether any other legislative instruments are affected.

Beyond the explicit references to the Act, the Migration Regulations, and the Secretary’s computer system under section 109, the instrument does not specify interactions with other laws, such as privacy legislation or banking/payment statutes concerning refunds. The instrument therefore leaves open the question of how the duties to enter student contact details and refund information will align with other statutory obligations that may require or restrict the collection, use or disclosure of personal or financial information. In practice, providers will need to consider those other legal frameworks when entering personal data into the Secretary’s system, but the instrument itself neither references nor modifies them.

This instrument records a narrow amendment history internally, chiefly the repeal of two prior determinations and a commencement provision. The instrument commenced "the day after this instrument is registered" for the whole instrument (section 2(1)). The instrument is dated 29 September 2022 and signed by the Minister for Education (the instrument text records the date and the Minister’s name). The instrument is made under specified subsections of the Act (section 3), and it contains an express Schedule 1 entitled "Repeals."

Schedule 1 repeals two earlier instruments in full:

• Education Services for Overseas Students (Notifying provider default - requirements for a notice) Determination 2012 (No. 1) , the whole instrument is repealed (Schedule 1, item 1); and
• Education Services for Overseas Students (Provider default - discharge of obligations - requirements for a notice) Determination 2012 (No. 1) , the whole instrument is repealed (Schedule 1, item 2).

The instrument contains an explicit note that the commencement table relates only to the provisions "as originally made" and will not be amended in the instrument text to reflect later amendments (section 2 note). No subsequent amendments or modifications are recorded within the instrument itself.

There is no schedule or provision in the instrument that modifies other instruments beyond the two repeals. The instrument does not contain transitional or savings provisions addressing data entered under the repealed 2012 determinations, nor does it state how previously entered data should be treated after commencement. The instrument also does not specify retrospective operation beyond the general commencement clause.

Practitioners should therefore treat this instrument as replacing the 2012 determinations in their entirety from the date the 2022 instrument commenced. Any historical compliance or reporting steps based on the 2012 determinations should be re-examined and adapted to the 2022 instrument’s prescribed fields and the Secretary’s computer system requirements. The instrument’s own text does not record any further amendment history.

The instrument contains no references to litigation, judicial interpretation, or decisions. It does not cite case law and it does not include any schedule or provision summarising proceedings. The text makes no reference to legal challenges, appeals, or court orders in relation to its content or to the two 2012 determinations it repeals.

Because the instrument is a specification of notice content under the Act and a repealing instrument for two prior determinations, any litigation that might arise would depend on contested facts or statutory interpretation under the Education Services for Overseas Students Act 2000 or related instruments. The instrument itself provides no judicial history or precedent that would guide interpretation.

Users requiring an assessment of any litigation risk, precedent, or interpretive disputes will need to consult the Act, any published guidance from the Secretary about the computer system, and any case law that addresses subsections 46B, 46D, 46F, section 109, or related procedural requirements. Those materials are not included in this instrument and are not summarised here because the instrument contains no litigation history.

The instrument is lean and leaves several practical gaps and potential pitfalls for providers and their advisers. The following are concrete issues to watch for, based strictly on the instrument’s text.

1. "If known by the provider" qualifiers create uncertainty about completeness

• Several fields are required only "if known by the provider" (section 6(2) for contact details; section 7(2)(b) for the CoE code of an alternative course). The instrument does not define when a fact is "known" for these purposes, nor does it prescribe due diligence obligations to acquire the information. That leaves room for disagreement about whether an entry is complete and compliant.

2. No timing or deadlines for entries

• The instrument requires specified data to be entered "in the computer system" but does not provide any time limit within which the entries must be made. Providers must therefore look to the Act, the Secretary’s operational guidance, or administrative practice for timing requirements. Absent that, providers face operational ambiguity.

3. "Reason for the default" and "reason the provider has not met these obligations" are unspecified in format and scope

• The instrument requires a "reason" to be entered for defaults and for failure to discharge obligations (sections 6(1)(b) and 7(1)(a)). The instrument does not prescribe categories, degree of detail, or supporting documentation. Providers should anticipate that the Secretary may request further information, and should retain supporting records.

4. Verification of "evidence of the student’s acceptance" is unspecified

• Where an alternative course has been arranged, the provider must confirm that it "has evidence of the student’s acceptance of an offer of a place in an alternative course" (section 7(2)(c)). The instrument does not define what constitutes acceptable evidence (for example, a signed acceptance, email, or an electronic acknowledgement). Providers should retain contemporaneous records and be prepared to show them to the Secretary.

5. Refund entries require amount and date but not method

• The instrument requires entry of the refund amount and the date the refund was paid (section 7(3)(a)-(b)). It does not require a description of the refund payment method (for example bank transfer, cheque), or bank receipt evidence. Providers may need to retain that documentation for other compliance purposes, though the instrument does not require it.

6. Repeal of 2012 instruments may require process change

• The instrument repeals two 2012 determinations in full (Schedule 1). Providers who designed workflows to satisfy the 2012 instruments should verify whether their practices remain compliant, or whether they must adapt to the 2022 instrument’s precise field list.

7. Dependence on the Secretary’s computer system for guidance and validation

• The instrument mandates entry into the system established under section 109 of the Act (sections 6(1), 7(1)), but contains no technical guidance. Operational questions about field validation, formats, mandatory vs optional UI behaviour, and error handling will rest with the Secretary’s system and any accompanying instructions. Providers should monitor the Secretary’s guidance and system updates closely.

8. No express privacy or data-protection safeguards in the instrument

• The instrument requires entry of personal contact details (section 6(2)) but does not address privacy safeguards, access control, or data sharing. Providers should consider other applicable legal obligations when entering personal information into the Secretary’s system.

9. No appeal or correction mechanism specified

• The instrument does not provide a mechanism to correct erroneous entries or to note that information has been updated. Providers should seek procedural clarity from the Secretary and retain the records necessary to support any future corrections.

10. Narrow subject scope tied to CoE

• The instrument applies only to students to whom the provider has issued a CoE (sections 6(1) and 7(1), section 4). Students without CoEs are outside its scope, which may create edge cases if CoE status is disputed.

Being aware of these "gotchas" will assist providers to implement operational controls, to retain evidence beyond what the instrument strictly requires, and to seek clarifying guidance from the Secretary’s administration.

This section sets out a practical, source-grounded checklist for meeting the instrument’s requirements based solely on the instrument’s text. It groups actions into immediate process changes, data capture, record retention, and engagement with the Secretary’s system.

Immediate process checklist

• Identify all students to whom the provider has issued a confirmation of enrolment (CoE), as that is the population in respect of whom entries must be made (sections 6(1) and 7(1); section 4 note regarding meaning of CoE).
• Map current workflows that supported reporting under the 2012 determinations, and replace or update them to record the specific fields listed in the 2022 instrument (Schedule 1 repeals the 2012 instruments).
• Establish responsibility within the provider for making entries into the Secretary’s computer system and for maintaining supporting evidence (sections 6 and 7).

Data capture and entry fields

• For every student with a CoE affected by a provider default, ensure the following fields are entered into the Secretary’s computer system:
  • Date of the default (section 6(1)(a)).
  • Reason for the default (section 6(1)(b)).
  • If known by the provider: current residential address, email address, home phone number, and mobile phone number (section 6(2)).
• For the notice of outcome of discharge of obligations, ensure the following entries:
  • If obligations not met under section 46D: enter the reason the provider has not met its obligations (section 7(1)(a)).
  • If obligations met under section 46D: enter whether obligations were met by arranging an alternative course under subsections 46D(4)-(5) or by providing a refund under subsections 46D(6)-(7) (section 7(1)(b)).
• If the provider met obligations by arranging an alternative course, enter:
  • The date the provider met its obligations (section 7(2)(a)).
  • If known by the provider: the confirmation of enrolment code of the alternative course accepted by the student (section 7(2)(b)).
  • Confirmation that the provider has evidence of the student’s acceptance of an offer of a place in an alternative course (section 7(2)(c)).
• If the provider met obligations by providing a refund, enter:
  • The amount of the refund (section 7(3)(a)).
  • The date the refund was paid (section 7(3)(b)).

Record retention and evidentiary practice

• Retain underlying documents that support each entry. In particular:
  • Evidence supporting the "reason for the default" entry, such as internal decisions, correspondence, or operational records (section 6(1)(b)).
  • Proof of the student’s acceptance of an alternative course, since the instrument requires confirmation that such evidence exists (section 7(2)(c)). Save copies of the acceptance in retrievable form.
  • Documentation of refunds, showing amount and payment date, to match entries required by section 7(3).
  • Proof of efforts to obtain student contact details where those fields are marked "if known" so that the provider can demonstrate due diligence if queried (section 6(2)).
• Although the instrument does not specify retention periods or formats, maintain records in a durable, standardised manner suitable for audit and for potential requests from the Secretary.

Engagement with the Secretary’s computer system

• Determine the operational modes of the Secretary’s system (login credentials, data formats, mandatory fields in the UI, allowable file types) and incorporate those technical constraints into internal processes. The instrument directs entries into the Secretary’s system but leaves technical details to the system itself (sections 6(1) and 7(1)).
• Establish a procedure for entering data promptly once a default occurs or once obligations are discharged, subject to any timing guidance set out by the Act or by the Secretary. Because the instrument does not prescribe timing, follow the Act’s requirements and any administrative instructions.
• Confirm whether the Secretary’s system provides any error-checking, field validation, or confirmation receipts, and archive any confirmation receipts or acknowledgement messages issued by the system.

Operational controls and auditability

• Introduce internal sign-off procedures for entries, so that a named officer attests to the completeness and accuracy of each notice entered.
• Maintain an audit trail that links the data entered in the Secretary’s system to the supporting evidence stored by the provider, for example by recording a local reference number in both places.
• Where contact details are not known, record the steps taken to obtain them, to support a "not known" position if queried.

Interaction with other obligations

• Consider other statutory or contractual obligations when entering personal or financial data into the Secretary’s system, since the instrument itself does not deal with privacy, data protection, or payment processes. Ensure internal policies cover data confidentiality and secure transmission when using the Secretary’s system.

Prepare for queries

• Anticipate that the Secretary may seek clarifications or additional evidence after entries are made, especially where entries are qualified by "if known by the provider" or where "reason" fields are terse. Keep records and be ready to respond.

In short, compliance under this instrument is primarily an exercise in accurate, traceable record-keeping and disciplined use of the Secretary’s computer system to enter the fields listed in sections 6 and 7. Providers should align operational workflows, evidence-retention practices and internal controls to ensure entries into the Secretary’s system are accurate, complete and defensible.
