Education Services for Overseas Students (Exempt Courses) Instrument 2021

The instrument rests on a small set of definitional and inclusion/exclusion concepts. The central legal concept is the statutory determination that certain offerings are “not a course” for the purposes of subsection 5AA(1) of the Act (s 5). The instrument treats three principal categories as eligible for that determination, each governed by precise conditions.

First category: VET units-based offerings (Schedule 1 Part 1). The instrument specifies an enumerated list of units of competency (for example, HLTAID011 Provide First Aid; TLILIC0003 Licence to operate a forklift truck) and expressly captures any later version or superseding unit listed on the National Register referred to in s 216 of the National Vocational Education and Training Regulator Act 2011 (Schedule 1 Part 1). The exemption applies only where the requirements of the course “only consist of one or a combination of any of the units of competency specified in Part 1” and where the course does not lead to a qualification recognised under the Australian Qualifications Framework (s 5(a)). The instrument contains a “To avoid doubt” proviso: where the requirements consist of a combination of more than one specified unit, no other units that are not specified in Part 1 can form part of the course requirements (s 5, note).

Second category: specified VET courses (Schedule 1 Part 2). The instrument lists two particular course codes (22556VIC; 22578VIC) and treats those courses, and any later version or superseding course shown on the National Register, as exempt (Schedule 1 Part 2; s 5(b)). The same precondition that the course not lead to an AQF-recognised qualification is stated in s 5(a) for the units-based exemption; while s 5(b) refers to the courses specified in Part 2, the instrument’s structure links both Part 1 and Part 2 to the determinations in s 5.

Third category: higher education non-AQF courses offered by registered higher education providers (Schedule 2). Schedule 2(1) specifies courses offered by a registered higher education provider that satisfy three cumulative criteria: they do not lead to an AQF-recognised qualification (Schedule 2(1)(i)); the provider does not recognise the course as eligible for granting credit toward another AQF course it offers (Schedule 2(1)(ii)); and the course is not eligible for credit toward an AQF course at another provider where there is an agreement between providers to grant credit (Schedule 2(1)(iii)). Schedule 2(2) creates express carve-outs: the Schedule 2 exemption does not apply if the course is provided as ELICOS, a Foundation Program, study abroad or student exchange, a tertiary coursework and research preparatory course, or a professional outcomes and placement course (Schedule 2(2)(a)-(e)). The instrument relies on the definitions in section 5 of the Act for terms such as ELICOS and registered higher education provider (s 4, note).

Cross-cutting concepts: the Australian Qualifications Framework is taken as the relevant measure of whether an offering “leads to a qualification recognised under the Australian Qualifications Framework”, but the instrument fixes that reference to the AQF “as in force on the day this instrument is made” (s 4). For VET matters the instrument links to the National Register and s 216 of the National Vocational Education and Training Regulator Act 2011, so later versions or superseding units/courses listed there are included (Schedule 1 Part 1; Part 2). The determination is framed as operating for the purposes of subsection 5AA(3) of the Act, so the instrument is a statutory determination rather than primary legislative amendment (s 3; s 5).

The instrument affects providers, programs and students in three clearly delimited ways.

Registered VET providers and registered higher education providers: Providers that design, list and deliver short VET unit-based offerings or the specified VET courses, or that run higher education non-AQF courses, are the primary actors affected because the instrument changes whether particular offerings are treated as a “course” for the purposes of subsection 5AA(1) of the Act (s 5; Schedule 1; Schedule 2). For VET, any provider that offers a course whose requirements consist only of one or more of the enumerated units in Schedule 1 Part 1 must consider whether the course leads to an AQF-recognised qualification; if it does not, the offering is within the exemption (s 5(a); Schedule 1 Part 1). For higher education, registered higher education providers will be affected when they offer activities that do not lead to AQF qualifications and where those activities are not eligible for credit, either within the provider or through an agreement with another provider (Schedule 2(1)(i)-(iii)).

Students (including prospective overseas students): Students enrolled in or seeking to enrol in the listed VET unit combinations, the specified VET courses, or the higher education courses described in Schedule 2 will be affected indirectly because the instrument may alter whether those offerings fall within the regulatory ambit tied to the definition of “course” in subsection 5AA(1). The instrument itself does not state the downstream consequences for student protections, visa conditions, or provider obligations; it only determines that the specified offerings are “not a course” for the purposes of the definition in s 5AA(1). Providers and students are the parties whose choices and entitlements are shaped by that classification.

Agreements between providers and credit recognition actors: The clause in Schedule 2(1)(iii) makes the exemption conditional on the absence of an agreement with another registered higher education provider to grant credit for the course toward an AQF course. Accordingly, institutions that enter such credit-transfer agreements will potentially displace the exemption for that offering. Equally, the institution’s internal recognition of a course as eligible for credit toward an AQF qualification will also displace the exemption (Schedule 2(1)(ii)).

Regulatory registries and officials: The instrument explicitly cross-references the National Register under s 216 of the National Vocational Education and Training Regulator Act 2011 for later versions or superseding entries (Schedule 1 Part 1; Part 2). Officials and registry operators who maintain those registers will therefore be relevant to determining whether a particular unit or course falls within the instrument by virtue of being a later version or a superseding listing.

Who does not qualify: The instrument excludes certain higher education modalities from the Schedule 2 exemption: ELICOS, Foundation Programs, study abroad/student exchange, tertiary coursework and research preparatory courses, and professional outcomes and placement courses (Schedule 2(2)). Providers offering those categories cannot rely on the Schedule 2 exemption.

The instrument itself mostly specifies eligibility criteria rather than imposing new affirmative duties or conferring administrative rights. Its operative legal force is a determination that particular offerings are “not a course” for the purpose specified in the Act. The practical duties and rights that follow for affected parties are therefore duties of qualification, documentation and internal decision-making.

Duties of qualification and course design. For a VET offering to be within the exemption in s 5(a), the provider must ensure the course requirements consist only of one or a combination of the units of competency listed in Schedule 1 Part 1, and must ensure the course does not lead to a qualification recognised under the AQF. The instrument contains an express restriction that, where a course’s requirements consist of a combination of more than one specified unit, no other units of competency not listed in Part 1 can form part of the requirements (s 5, note). That is a design constraint on the composition of exempt VET offerings.

Duties on recognition of credit. Schedule 2(1)(ii) makes the exemption for higher education offerings conditional on the provider not recognising the course as eligible for granting credit toward an AQF-recognised qualification. This places a duty on institutions to make an internal determination about credit eligibility and to document that determination if they wish to rely on the exemption. The provider’s own choice to recognise a course for credit will remove the exemption.

Duties regarding inter-provider arrangements. Schedule 2(1)(iii) makes exemption conditional on the course not being eligible for credit toward another provider’s AQF course where there is an agreement between providers to grant credit. Parties contemplating articulation or credit-transfer arrangements should be aware that entering such an agreement will affect the exempt status of the specified offering.

Rights to rely on prescribed register entries. For VET items, the instrument explicitly extends to “any unit identified in the National Register referred to in section 216 of the National Vocational and Training Regulator Act 2011 as a later version of, or a superseding unit of” the listed units (Schedule 1 Part 1). The right to treat a later version or superseding unit as within the exemption is therefore available, subject to that register listing.

Record-keeping and evidential duties. While not stated as formal statutory obligations in this instrument, the conditions for exemption make effective record-keeping a practical necessity. Providers wishing to rely on the exemptions will need to retain evidence that an offering meets the listed conditions: course documentation showing only listed units are required (where relevant), AQF status evidence showing the course does not lead to an AQF-recognised qualification, records of internal credit decisions, and copies of or absence of agreements with other providers regarding credit transfer.

No new express private rights or remedies are created or altered in the instrument text. The instrument operates as a specification under the Act; any enforcement, registration or remedy consequences are governed by the Act itself rather than by express rights set out in this instrument (s 3).

The instrument does not itself establish criminal offences, pecuniary penalties, or enforcement mechanisms. It is a statutory determination made under the power in section 5AA of the Act (s 3). That means the instrument’s role is to define a category of offerings as “not a course” for the statutory purpose identified; whether any contravention of obligations or penalties apply in relation to courses or non-courses depends on the parent Act and associated regulatory instruments outside this text.

What the instrument does specify is the criteria that must be met for the exemption to apply (s 5; Schedule 1; Schedule 2). Enforcement, monitoring or any sanction for non-compliance with the Act’s requirements would be matters for the Act and the executive/regulatory apparatus that administers it. The instrument therefore functions as a classificatory device: it changes which offerings fall within or outside the statutory category, and that change alters which provisions of the Act apply to those offerings. The text does not list or modify penalty structures; accordingly, readers must consult the Act for the specific enforcement and penalty regime that attaches to activities defined as “courses” (s 3).

Practical enforcement-related implications that follow from the instrument’s structure include evidential burdens on providers. Because the exemptions are conditional , for example, on non-recognition for credit or on not leading to an AQF qualification (Schedule 2(1)(i)-(iii)) , regulators or reviewing authorities administering the Act would likely look to provider documentation to determine whether the exemption applies in a given instance. The instrument also brings in external registers (the National Register referenced in s 216 of the National Vocational Education and Training Regulator Act 2011) for determinations of later versions or superseding units/courses (Schedule 1 Part 1 and Part 2), so registry records will be material to any compliance review.

The instrument’s commencement provision states it commences on the day after registration (s 2). That means anything relying on the exemptions must be assessed with reference to the instrument’s effective date. The instrument does not create retrospective penalty exposure or provide a transition mechanism within its own text; any such issues would be governed by the Act and by administrative practice.

The instrument cross-references and relies on definitions and registers established in other Commonwealth statutes and subordinate instruments. The key interaction points are with the Education Services for Overseas Students Act 2000, the Higher Education Support Act 2003, and the National Vocational Education and Training Regulator Act 2011.

Primary-act interaction. The instrument is made under section 5AA of the Education Services for Overseas Students Act 2000 (s 3). Its determinations refer expressly to subsection 5AA(1) (the definition of “course”) and subsection 5AA(3) (the power to determine) , the instrument declares which offerings are to be treated as “not a course” for the purposes of that definition (s 5). The instrument does not reproduce or modify the operative provisions of the Act; it exercises the power the Act confers to make determinations affecting the scope of statutory coverage.

AQF and Higher Education Support Act. The instrument adopts the Australian Qualifications Framework (AQF) as defined in Schedule 1 of the Higher Education Support Act 2003 and fixes the relevant version as the AQF “as in force on the day this instrument is made” (s 4). Consequently, whether a course “leads to a qualification recognised under the Australian Qualifications Framework” is to be assessed by reference to the AQF version current on the instrument’s making. Changes made to the AQF after that date are not incorporated by this instrument’s text; the instrument therefore establishes a temporal anchor for the AQF reference.

VET registers and NVETRA. For VET items, the instrument relies on the National Register referred to in section 216 of the National Vocational Education and Training Regulator Act 2011 (Schedule 1 Part 1 and Part 2). It expressly includes “any unit identified in the National Register ... as a later version of, or a superseding unit” of the listed units, and likewise for the listed courses. That ties the instrument’s scope to the maintenance and contents of the National Register under the NVET regulator legislation. Changes to unit or course codes recorded on that register will therefore carry into the instrument’s coverage so long as the register is the authoritative source of later versions or superseding entries.

Definitions in the Act. The instrument notes that a number of expressions used in it are defined in section 5 of the Act, including ELICOS and registered higher education provider (s 4). Those statutory definitions in the Act therefore determine and limit the scope of the Schedule 2 carve-outs and the identification of actors to whom the instrument applies.

No express interaction with visa, immigration or other Commonwealth regulatory schemes is set out in the instrument’s text. The instrument’s practical consequence is to change which offerings are “course” for the Act’s purposes. Any interaction with other regulatory regimes that refer to the Act’s definition of “course”, or that rely on the Act’s regulatory perimeter for student visa, consumer protection, or other statutory purposes, will arise from that change in classification rather than from any direct amendment to those other laws in this instrument.

Temporal anchoring and versions. The instrument’s treatment of later versions or superseding units/courses is mediated through the National Register under the NVET Regulator Act (Schedule 1) and by fixing the AQF reference to the date the instrument was made (s 4). Those choices create a dependence on external legislative and administrative resources for determining whether specific offerings are captured.

This instrument contains its own commencement and dating details and does not record any subsequent amendments in the text provided. The instrument was made by the Minister for Education and Youth, Alan Tudge, and is dated 25 June 2021 (signature block). The commencement table in section 2 states that “The whole of the instrument” commences “On the day after the instrument is registered” (s 2(1)). The table includes a note that it relates only to the provisions of the instrument “as originally made” and that it will not be amended to deal with later amendments of the instrument (s 2(1) note). Section 2(2) clarifies that any information in column 3 of the table is not part of the instrument and may be edited in published versions.

No amending instrument or subsequent variations are contained in the supplied text. The instrument’s Schedule 1 provisions include a running incorporation of later versions or superseding units/courses as recorded on the National Register (Schedule 1 Part 1 and Part 2), which provides an administrative updating mechanism for unit/course versions even where the instrument itself remains static. The AQF reference is fixed to “as in force on the day this instrument is made” (s 4), which means any subsequent amendments to the AQF after 25 June 2021 are not incorporated into the definition used by this instrument unless and until the instrument itself is amended.

Users seeking a complete amendment history should consult the official legislative register for any subsequent instruments that vary or revoke this determination, and the National Register referred to under the National Vocational Education and Training Regulator Act 2011 for later versions or superseding VET units and courses captured by Schedule 1. The instrument’s own text does not provide a history beyond its original making and commencement details.

The instrument as presented contains no litigation history. It does not cite any judicial decisions, and there are no references to case law, stayed proceedings, or legal challenges in the text supplied. The instrument is a statutory determination made under s 5AA of the Education Services for Overseas Students Act 2000; whether the instrument has been the subject of litigation would need to be determined by searching judicial and administrative tribunal records external to this instrument.

Within the instrument itself there are no procedural statements about merits review, judicial review, or dispute-resolution mechanisms that would generate an administrative record of challenges. The instrument’s effect is classificatory , it determines that certain offerings are not a “course” for the purposes of the Act , and any litigation that might arise would be about the legal consequences of that determination, its interpretation, or its application to particular offerings. The instrument does not record any such disputes.

For practitioners looking to assess litigation exposure, the practical starting points are the Act itself (to see what reliefs, obligations and enforcement powers exist in relation to the definition of “course”) and administrative law remedies available against ministerial instruments. The instrument text does not provide further guidance.

This instrument contains a number of specific drafting and scope features that are fertile ground for mistakes if readers assume broader or narrower coverage than the text provides. The following points are concrete, textual “gotchas” to watch for.

Narrow unit list and the “only consist of” language (Schedule 1 Part 1; s 5(a)). For VET exemptions, the course requirements must “only consist of one or a combination of any of the units of competency specified in Part 1 of Schedule 1” and the course must not lead to an AQF-recognised qualification (s 5(a); Schedule 1 Part 1). That word “only” is restrictive: including any unit that is not on the Schedule 1 Part 1 list will remove the course from the exemption where that unit forms part of the requirements. The instrument’s “To avoid doubt” note reinforces that principle: where a course comprises more than one of the specified units, no other non-specified units may form part of the requirements (s 5, note).

Superseding versions and the National Register (Schedule 1 Part 1 and Part 2). The instrument captures later versions and superseding units/courses where those later versions are identified in the National Register referred to in s 216 of the National Vocational Education and Training Regulator Act 2011 (Schedule 1 Part 1; Part 2). Practitioners must therefore check the National Register entries to determine whether a listed unit has been superseded or altered. Failure to check the register could misclassify an offering.

AQF reference fixed to instrument date (s 4). The instrument adopts the AQF “as in force on the day this instrument is made.” That fixes the AQF reference to the state of the AQF at the date of the instrument (25 June 2021). Subsequent changes to the AQF framework are not incorporated by this instrument. When determining whether a course “leads to a qualification recognised under the Australian Qualifications Framework,” users must apply the AQF as it existed on the instrument’s making date, not a later AQF.

Higher education credit recognition hinges on provider decisions (Schedule 2(1)(ii)). Schedule 2’s exemption for higher education courses depends on the provider’s own recognition that the course is not eligible for credit toward an AQF-recognised qualification. That means an internal administrative decision by the provider will control whether an offering is exempt. If a provider later changes its credit policy and recognises the course for credit, the exemption would not apply to that course (Schedule 2(1)(ii)).

Inter-provider agreements negate exemption (Schedule 2(1)(iii)). Even if the provider itself does not recognise the course for credit, the exemption is lost if the course is eligible for credit toward another provider’s AQF course and there is an agreement between providers to grant that credit (Schedule 2(1)(iii)). Institutions should therefore scrutinise articulation and credit-transfer agreements carefully.

Schedule 2 carve-outs (Schedule 2(2)). The higher education exemption explicitly excludes ELICOS, Foundation Programs, study abroad or student exchange, tertiary coursework and research preparatory courses, and professional outcomes and placement courses (Schedule 2(2)(a)-(e)). Courses that fall into these modalities cannot rely on the Schedule 2 exemption even if they meet other elements of the definition.

No penalty provisions in the instrument (s 3). The instrument does not set out penalties or enforcement mechanisms. It is a determination rather than a sanctions instrument. Do not assume the instrument on its face creates or removes penalties; those consequences depend on the Act and other instruments.

Record and evidentiary burden. Because the exemptions are conditional on specific predicates (e.g., composition of units, AQF status, internal recognition of credit, inter-provider agreements), a lack of documentary evidence (course syllabi, credit policy statements, signed agreements, register entries) will be a practical barrier to demonstrating entitlement to the exemption.

Course naming vs. course requirements. The instrument focuses on the “requirements” of the course rather than the course’s title. A named “short course” that includes non-specified units in its requirements will not be exempt even if its label suggests it should be.

Jurisdictional nuance in the listed VET course codes. The instrument lists particular course codes (22556VIC, 22578VIC). Those course codes are state-specific bodies of registration; practitioners must confirm whether the course code being offered corresponds exactly to the codes listed and whether later versions on the National Register apply.

Providers who wish to rely on the instrument’s exemptions should implement a compliance pathway tied to the instrument’s precise criteria. The following steps set out concrete actions grounded in the text.

1. Map each offering to the instrument’s categories. For any short VET or higher education offering, determine whether it falls into Schedule 1 Part 1 (an enumerated unit), Schedule 1 Part 2 (one of the two enumerated VET course codes), or Schedule 2’s higher education description. The relevant text is s 5 (which specifies the categories) and Schedule 1 and Schedule 2. Do not rely on course titles; map by course requirements and unit codes.

2. For VET unit-based offerings, verify unit list membership and register status. Confirm that every unit that forms part of the course requirements is either one of the units listed in Schedule 1 Part 1 or a later version/superseding unit recorded on the National Register referred to in s 216 of the National Vocational Education and Training Regulator Act 2011 (Schedule 1 Part 1). If a course’s requirements include any unit not listed in Part 1, the exemption does not apply (s 5(a); note).

3. Confirm AQF non-qualification status. Establish that the offering does not “lead to a qualification recognised under the Australian Qualifications Framework.” The instrument fixes the AQF definition to the version “as in force on the day this instrument is made” (s 4). Obtain documentary evidence showing that the course is not an AQF-recognised qualification under that AQF version.

4. For higher education offerings, document internal credit recognition positions. If the course is offered by a registered higher education provider, confirm and document that the provider does not recognise the course as eligible for granting credit toward an AQF qualification (Schedule 2(1)(ii)). Provide written policy or a formal decision record to evidence that position.

5. Check inter-provider agreements and eligibility for credit. Verify that the course is not eligible for credit toward an AQF course at another registered higher education provider where there is an agreement to grant credit (Schedule 2(1)(iii)). If any articulation or credit-transfer agreements exist, they will preclude reliance on the Schedule 2 exemption. Maintain records that either confirm the absence of such agreements or document that no credit eligibility exists.

6. Exclude Schedule 2 carve-outs. Confirm that the offering is not provided as ELICOS, a Foundation Program, study abroad or student exchange, a tertiary coursework and research preparatory course, or a professional outcomes and placement course (Schedule 2(2)). If the offering falls within any of those categories, the Schedule 2 exemption is inapplicable.

7. Maintain up-to-date register checks. For VET units and courses, maintain periodic checks against the National Register (s 216 NVETRA reference in Schedule 1). The instrument includes later versions and superseding units/courses only insofar as they appear on that register.

8. Keep contemporaneous decision and course documentation. Because the exemptions depend on course requirements and credit-recognition status, retain course design documents, unit lists, curriculum requirements, internal credit policy documents, approved minutes or signed director-level decisions, and records of exchanges with other providers. This evidentiary trail will be essential to demonstrate compliance if queried by a regulator.

9. Adopt clear student-facing communications. Ensure that course marketing and information provided to students accurately reflect that the course is not an AQF-recognised qualification (where relevant) and explain any implications required by the Act or other regulatory regimes. The instrument itself does not prescribe marketing language, but material inconsistencies between marketing and documented course requirements could create regulatory or consumer risks.

10. Time and version control. Be aware that the instrument’s AQF reference is frozen to the AQF as at the date the instrument was made (s 4). If a provider intends to rely on the exemption over time, it should document the AQF reference it used and review whether any subsequent amendments to the instrument or to external rules require re-evaluation.

11. Seek administrative advice where uncertain. The instrument is a statutory determination made under s 5AA of the Act (s 3). If there is doubt about whether an offering qualifies, providers should obtain formal administrative confirmation from the relevant Commonwealth authority responsible for implementing the Act or seek legal advice. The instrument does not provide an internal dispute mechanism; it establishes conditions whose application may be subject to administrative interpretation.

Following these concrete steps will place providers in the position of being able to demonstrate that their offerings fall within the instrument’s exemptions by reference to the textual criteria: unit/course codes and National Register entries (Schedule 1), AQF status as at the instrument date (s 4), provider decisions on credit (Schedule 2(1)(ii)), and the absence of inter-provider credit agreements (Schedule 2(1)(iii)).
