Education Services for Overseas Students (Consequential and Transitional) Act 2000

The Act introduces or carries forward several concepts that are essential to understanding the transition. A notified trust account is a concept from the old ESOS Act (defined in section 6A of that Act). Under the transitional rules, the requirements relating to these accounts continue to apply after the repeal of the old Act, until Part 5 of the new ESOS Act commences, or if the Minister delays the start of the ESOS Assurance Fund, until the beginning of 2002 (Schedule 2, item 4). This means that during the transition, providers must still comply with the old trust account rules even though the legislation that created them is technically repealed. The ESOS Assurance Fund is the new replacement mechanism for protecting student fees; the Act allows the Minister to postpone its application from 2001 to 2002 by Gazette notice (item 4(3)). The starting day is a concept created by Schedule 2, item 1: the Minister must publish a notice in the Gazette specifying the day on which the core obligations under sections 19, 20, and 21 of the new ESOS Act begin to apply. That day must be at least 28 days after publication. The Minister must also notify each registered provider in writing of that starting day. This is not merely an administrative detail; it is the trigger for new duties regarding notification of accepted students, notification of student visa breaches, and record-keeping. The Act distinguishes between different categories of events and students for the application of these duties. For example, the notification duty under section 19 applies to all events on or after the starting day for students accepted on or after that day, but also applies to certain events (paragraphs 19(1)(d) and (e) and subsection 19(2)) for students accepted before the starting day (item 1(4)). This means providers must retroactively apply some new rules to existing students, which imposes a special compliance burden at the transition point. Another concept is the continuation of registration: providers registered under the old Act are automatically deemed registered under the new Act for the same courses, including any existing suspension (item 2). This is a clean transfer, but it also means that any flaws or gaps in the old registration carry over. The Act also creates a power for the national code to prescribe extra time for compliance (item 3), and for regulations under the new ESOS Act to handle transition matters generally (item 6). Regarding course money in notified trust accounts, item 5 provides that once the old trust account requirements cease to apply, the money is no longer considered held on trust. This is a significant legal change: the fiduciary obligation is extinguished, and the money presumably becomes the provider’s own funds, subject to any new requirements under the new regime. This could expose providers to claims if students later seek refunds, but the Act does not resolve that; it simply removes the trust character.

The primary group affected by this Act is registered providers of education services to overseas students , that is, private and public education institutions that have been approved to enroll international students. For these providers, the Act dictates the timing and manner of their transfer from the old regulatory scheme to the new one. They must track the Minister’s Gazette notice and written notification to determine when their new duties start. They must also continue complying with old trust account requirements until the Minister announces that the ESOS Assurance Fund is operational. This creates uncertainty for providers who might be tempted to assume that the repeal of the old Act instantly lifts all old obligations. The Act also imposes a one-off compliance cost on providers to adjust their systems to meet the new notification, record-keeping, and visa breach reporting duties from the starting day, and potentially retroactively for existing students in relation to certain events. The Department of Education (or the agency administering the new ESOS Act) is affected because it must prepare and publish the starting day notice, notify all registered providers in writing, and decide whether to delay the ESOS Assurance Fund to 2002. The Department of Immigration (and its Minister) is affected through the amendments to the Migration Act 1958 (Schedule 3). The new information-sharing provisions allow the Secretary of Immigration to give information to agencies responsible for regulating providers, for the purpose of assisting regulation or promoting compliance with student visa conditions. This expands the flow of data between departments, which has privacy implications for students and operational implications for both departments. The Administrative Review Tribunal (or its predecessor, the AAT) is affected by Schedule 4, which updates references in the new ESOS Act to substitute the ART for the AAT; however, this only takes effect once the ART is established, so for an interim period the AAT continues to have jurisdiction. Overseas students are indirectly affected: their personal information may be shared between immigration and education regulators more freely under section 488A of the Migration Act. Their fee protection arrangements shift from the old notified trust account system to the new ESOS Assurance Fund, but with a possible gap if the Minister delays the Fund. Students may find that money previously held in trust on their behalf is no longer legally held on trust once the transition occurs (Schedule 2, item 5), which could affect their legal rights to recover that money if the provider fails. Finally, state and territory agencies that have a role in regulating providers may be authorised to receive immigration information under prescribed arrangements (Migration Act amendment item 2 adding paragraph 488(2)(g)), so they are drawn into the federal information-sharing network.

The Act imposes a specific duty on the Minister (item 1 of Schedule 2): to publish a notice in the Gazette specifying the starting day for the obligations under sections 19, 20, and 21 of the new ESOS Act, and to notify each registered provider in writing of that day. The starting day must be at least 28 days after publication. This is not a discretionary power in the sense that the Minister may choose to never set a starting day; the transitional provisions are designed to implement the new Act, so in practice the Minister must act, but the Act provides no deadline other than the general commencement provisions of section 2. The Minister also has the right to delay the ESOS Assurance Fund requirements to 2002 by Gazette notice (Schedule 2, item 4(3)). The national code may prescribe extra time for compliance (item 3). Registered providers have the duty to comply with the new Act’s notification, visa breach, and record-keeping obligations from the starting day, but they also have the right to receive written notice of that day from the Minister, and to rely on the published Gazette notice. Providers who were already registered under the old Act have the right to have their registration continue under the new Act for the same courses without re-application (item 2). They also have the right to benefit from any extra time the national code may give for compliance with code requirements. However, providers do not have the right to choose to stay under the old regime; the transition is forced. Regarding notified trust accounts, providers have the duty to continue complying with old Act requirements until Part 5 of the new Act commences (or 2002 if the Minister delays). Once those requirements cease, providers no longer hold the course money on trust (item 5). This creates a right: providers may treat that money as their own, subject to any other legal obligations (such as refund policies or contract terms). But it also carries a risk: if a provider fails to maintain adequate records or refund processes, the loss of trust status could expose them to liability for misappropriation. Students have no explicit rights or duties under this Act; their rights are derived from the new ESOS Act or the old ESOS Act during the transition. However, the removal of the trust character of money (item 5) could implicitly affect a student’s right to claim that money if the provider becomes insolvent or refuses a refund. The Act does not create a substitution for that trust protection; the ESOS Assurance Fund is meant to replace it, but only when it commences. Immigration officials have a new right under Schedule 3: the Secretary may give information to relevant agencies for regulation and compliance purposes, and employees may be authorised to perform actions under the new ESOS Act. This right is subject to section 488 (which restricts disclosure of movement records), so it is not unlimited. Agencies receiving information have no explicit duties under this Act, but would receive information subject to their own secrecy provisions.

This Act does not itself create offences or penalties. The enforcement teeth for the new regulatory scheme are contained in the new ESOS Act. However, this Act affects enforcement in several ways. First, it ensures continuity: by continuing the old trust account requirements after the repeal of the old Act (Schedule 2, item 4), the Act preserves the enforceability of those requirements during the twilight period. If a provider fails to maintain a notified trust account while item 4 is in effect, they may still be subject to penalties under the old Act, even though that Act is repealed. This is an unusual feature: the old Act is repealed, but its provisions relating to trust accounts continue to apply as if still in force for a limited period. The Act does not specify whether the penalty provisions of the old Act are also preserved, but logically they must be, otherwise the requirement would be unenforceable. Second, the Act creates a duty for the Minister to notify providers of the starting day. There is no penalty specified for the Minister’s failure to do so, but a provider could argue that the obligations under sections 19, 20, and 21 of the new Act cannot be enforced until proper notice is given. The Act requires the Minister to notify each provider in writing, so failure to give individual notice could be a procedural bar to enforcement against that provider. Third, the amendments to the Migration Act 1958 (Schedule 3) expand the enforcement toolkit for regulators by allowing the flow of immigration information to agencies that regulate providers. This can assist in enforcing student visa conditions and provider obligations. For example, if a provider fails to notify the Department of a student visa breach (as required under section 20 of the new Act), immigration information could be used to cross-check. The new section 488A authorises the Secretary to give information for the purposes of assisting with regulation or promoting compliance with student visa conditions. This is a permissive power, not mandatory, so enforcement agencies have discretion. Fourth, the transitional provisions regarding registration (Schedule 2, item 2) ensure that any suspension under the old Act continues under the new Act. This means enforcement actions that were underway at the time of repeal are not extinguished; they continue with the same effect. Finally, Schedule 4 updates the administrative review references from the AAT to the ART, which will affect the avenue for challenging enforcement decisions once the ART is established. For decisions made under the new ESOS Act during the interim period, the AAT remains the review body; the shift to ART occurs only when that tribunal is commenced. This introduces a jurisdictional complexity: a provider challenging a decision might need to check which tribunal was in force at the time of the decision.

The most direct interaction is with the Education Services for Overseas Students Act 2000 (the new ESOS Act). This consequential Act is designed to complement the new Act by managing the transition. It defines terms like “new ESOS Act” and “old ESOS Act”. It also, via Schedule 4, makes amendments to the new ESOS Act itself to update references from the Administrative Appeals Tribunal to the Administrative Review Tribunal. The new ESOS Act is not reproduced here, but this Act references its sections 19, 20, 21, and 176, and Part 5. The interaction is one of timing: the obligations of the new Act take effect on a starting day set by the Minister, not on the day the new Act receives Royal Assent. Thus, the two Acts are in force simultaneously but the new Act’s operative provisions are suspended until the Minister acts. The Act also interacts with the Migration Act 1958. Schedule 3 inserts into that Act: (1) a reference to the new ESOS Act in the list of laws for which movement records may be disclosed (amending subsection 488(2)); (2) a power to authorise employees of the department administering the new ESOS Act to perform actions under that Act (new paragraph 488(2)(f)); (3) a power to authorise prescribed employees of agencies to perform actions for prescribed purposes (new paragraph 488(2)(g)); and (4) a new section 488A allowing the Secretary to give information to agencies regulating providers. This creates a formal information-sharing gateway that overrides privacy restrictions but is subject to the constraints of section 488 regarding movement records. The consequence of a person who holds a migration law exemption in terms of disclosure for the purpose of provider regulation. Old ESOS Act: This Act repeals the old ESOS Act and the Education Services for Overseas Students (Registration Charges) Act 1997, but with carve-outs. The old Act continues to apply in relation to notified trust accounts until Part 5 of the new Act commences or 2002 (Schedule 2, item 4). So the interaction is a concurrent application: the old Act is repealed but its trust account provisions are kept alive by this Act. The Administrative Appeals Tribunal Act 1975 and the Administrative Review Tribunal Act 2000 (or 2001) are implicated by Schedule 4. The schedule substitutes references to the AAT with the ART, but only when the ART is established. Until then, the AAT retains jurisdiction under the new ESOS Act. So this consequential Act coordinates the transition of tribunals. The Acts Interpretation Act 1901 may also interact through the operation of section 7 (repealed acts continue in force for certain purposes) but this Act explicitly provides for the continuation of old requirements rather than relying on default rules.

This Act is a consequential and transitional Act, not an amending Act in the sense of being amended itself. The source provides no amendment history of this Act. The Act was assented to on 21 December 2000. Section 2 sets out the commencement schedule, which includes amendments to itself (Schedule 4) that depend on the later establishment of the Administrative Review Tribunal. Those amendments are to the new ESOS Act, not to this Act. The Act does not provide for any amendment mechanism of its own text. It is likely that subsequent legislative amendments may have occurred in the years since 2000 to extend transition periods or adjust references, but the source does not disclose them. The analyst must note that the references to the Administrative Review Tribunal Act 2000 or 2001 indicate that the government anticipated a new tribunal which may not have eventuated as planned; in fact, the Administrative Review Tribunal was not established until much later (the ART was eventually created by the Administrative Review Tribunal Act 2024). The note in section 2(2) and in Schedule 4, item 6 shows the legislature was aware of uncertainty as to which year’s Act would establish the ART. This means that the commencement of Schedule 4 was effectively suspended for many years, and the original AAT references in the new ESOS Act remained in force until the ART eventually commenced. The practical amendment history of this Act is that its Schedule 4 may have been spent or rendered moot by later reforms. However, based solely on the source, no amendments to this Act are recorded.

The source contains no references to any litigation, court cases, or tribunal decisions involving this Act. The Act is procedural and transitional in nature, so it is unlikely to be the direct subject of litigation unless a dispute arises about the timing of the starting day, the continuation of trust account obligations, or the validity of information sharing under the Migration Act amendments. One potential area of dispute is whether the Minister gave proper written notice to each provider of the starting day. If a provider failed to comply with the new Act’s obligations before receiving notice, a question of procedural fairness could arise. Another area: the fate of money in notified trust accounts after the trust character is removed (Schedule 2, item 5) could lead to litigation between providers and students or refund guarantors. If a provider becomes insolvent and the money is no longer held on trust, liquidators might claim it as general property, whereas students might argue that a constructive trust or equitable obligation remains. The Act does not resolve this. Additionally, the information-sharing provisions of Schedule 3 could be challenged on privacy grounds, although the Migration Act 1958 review mechanism might apply. The analyst must note that without access to case law databases, it is not possible to identify any specific cases. The instructions forbid inventing cases. Therefore, the litigation history is that the source does not disclose any. It is possible that no significant litigation has occurred, or that cases have not been reported in the source material.

Several traps in this Act could catch out the unwary practitioner, provider, or government officer. First, the assumption that repeal means immediate freedom from old obligations. Schedule 2, item 4 explicitly continues the old Act’s requirements relating to notified trust accounts after the old Act is repealed. A provider who reads that the old ESOS Act is repealed in Schedule 1 and stops maintaining a notified trust account would be in breach of this Act. The continued requirements last until Part 5 of the new Act commences, or if the Minister delays the ESOS Assurance Fund, until the beginning of 2002. Even after that, the provider must transition to the new Fund. Second, the uncertain status of trust account money: item 5 says that once the old trust account requirements cease, the course money is no longer considered held on trust. This is a blunt change. Providers might treat those funds as their own, but that could be premature if students have contractual or statutory rights to refunds or if the new Act imposes other obligations. The removal of trust status does not imply the provider can spend the money; it only means the equitable interest of students under the old trust is extinguished. This could expose providers to claims if they dissipate funds and then fail. Third, the starting day is set by the Minister with only a 28-day minimum notice. Providers must monitor the Gazette and their mail closely. There is no obligation on the Minister to give any advance warning beyond the 28-day period, and the Act does not allow providers to opt for a later start. This gives the executive branch significant control over when the new duties bite, and creates compliance scramble if the notice period is tight. Fourth, retroactive application of certain new duties to existing students. Item 1(4) provides that paragraphs 19(1)(d) and (e) and subsection 19(2) of the new ESOS Act apply to events happening on or after the starting day in relation to persons who became accepted students before that day. This means a provider with a pre-existing student cohort must immediately start reporting certain events (such as changes in student circumstances) as if the new regime had always applied to those students. Fifth, the interaction with the Migration Act amendments: the new section 488A allows the Secretary to give information to agencies regulating providers. This is a permissive power, but it could be used to share information that a provider considers confidential. There is no requirement for provider consent or notification. Sixth, the phantom administrative review tribunal. Schedule 4 replaces AAT references with ART references, but this only commences when the ART is established. The Act notes that the Act establishing the ART is either the 2000 or 2001 Act; in reality, the ART did not commence for many years. This means that for a long period, the new ESOS Act contained references to a tribunal that did not exist, and the AAT continued to have jurisdiction under the original references. Anyone relying on the printed text of the new ESOS Act as amended by Schedule 4 without checking the commencement would be misled. Seventh, the Minister’s discretion to delay the ESOS Assurance Fund to 2002 (item 4(3)) is not automatically exercised. If the Minister does not publish a notice, the Fund applies to 2001 and later years. But the old trust account requirements continue only until Part 5 commences or 2002, whichever is later. This creates a potential gap where neither the old trust accounts nor the new Fund are fully operational, leaving student fee protection in limbo. Eighth, the application of the national code: item 3 allows the code to prescribe extra time, but if the code does not do so, providers must comply from the code’s effective date. The Act does not require the code to grant extra time.

Compliance with this transitional Act requires a step-by-step approach. For a registered provider transitioning from the old to the new regime, the first step is to monitor the Gazette for the Minister’s notice specifying the starting day for obligations under sections 19, 20, and 21 of the new ESOS Act. The provider must also ensure that the Minister sends them written notification; if not received, they should contact the department. The starting day will be at least 28 days after the Gazette publication, so the provider should use that period to update systems and train staff. Second, continue to operate the notified trust account fully in accordance with the old ESOS Act until either: (a) Part 5 of the new Act (ESOS Assurance Fund) commences, or (b) the Minister publishes a Gazette notice delaying the Fund to 2002, in which case the trust account requirements continue until the later of the beginning of 2002 and the commencement of Part 5. During this period, do not assume the trust account can be closed or the money treated as general funds. Third, prepare for the automatic continuation of registration: no new application is needed, but the provider should verify that old registration details (including any suspension) carry over correctly. Check that the courses listed align with those under the new Act. Fourth, implement the new notification obligations from the starting day. For accepted students who enrolled on or after the starting day, all events under section 19 must be notified. For students enrolled before the starting day, only the events specified in paragraphs 19(1)(d) and (e) and subsection 19(2) need to be notified for events occurring on or after the starting day. This requires careful segmentation of the student database. Fifth, implement visa breach notification under section 20 from the starting day for all breaches that happen on or after that day. This means the provider must have systems to detect breaches and notify the relevant authorities. Sixth, maintain records under section 21 from the starting day. This includes current and future accepted students from that day. If the Minister’s notice prescribes an extra period for compliance with section 21, the provider can use that extra time. Seventh, monitor the national code: the code may prescribe additional time to comply with its requirements, so the provider should read the code carefully and not assume immediate compliance is mandatory. Eighth, assess the funds formerly held in trust: once the old trust account requirements cease (at the end of the transition), the money is no longer held on trust per item 5. The provider should then ensure that any new fee protection arrangements under the ESOS Assurance Fund are in place, and consider the legal status of that money. Seek advice on whether any contractual or statutory refund obligations attach to those funds. Ninth, train staff on information-sharing provisions: under the Migration Act amendments, the Department of Immigration may share information with the provider’s regulator. The provider should ensure that student data handling complies with privacy laws and that students are informed (where required) that their immigration information may be shared. Tenth, keep records of all transitional steps: the dates of Gazette notices, written notifications, and compliance actions should be documented to defend against any enforcement action that might arise from a gap or misunderstanding of the transition rules. Eleventh, review administrative review rights: depending on whether the ART has commenced, decisions under the new ESOS Act may be reviewable by either the AAT or the ART. Providers should check the commencement status of Schedule 4 to know which tribunal has jurisdiction for any challenge. Finally, engage with the Department (the body administering the new ESOS Act) to clarify any ambiguities, especially regarding the precise scope of the continued trust account requirements and the status of pre-existing students. Proactive communication can reduce the risk of inadvertent non-compliance.
