Education Services for Overseas Students (Calculation of Refund) Instrument 2024

This instrument prescribes numeric rules for calculating refunds of tuition (and in one place, course) fees where the Education Services for Overseas Students Act 2000 (the Act) gives rise to a refund entitlement. It operates as a formula-based implementing instrument under the Act (made under ss 46D(7) and 47E(4) , see s 3) and commences the day after registration (s 2). The instrument replaces the earlier specification listed in Schedule 1 by repealing the Education Services for Overseas Students (Calculation of Refund) Specification 2014 in full.

Mechanically, the instrument does four things.

• It defines a weekly tuition fee for a course as the course’s total tuition fees divided by the number of calendar days in the course, multiplied by seven, with any fractional dollar amount rounded up to the next whole dollar (s 6(1)-(2)).
• It defines “weeks in default period” as the number of calendar days from the default day to the end of the period to which the payment relates, divided by seven, rounded up to the nearest whole week (s 7(1)-(2)).
• It prescribes that, where a provider default or the provider’s failure to enter a compliant student default agreement triggers a refund under the Act, the refund amount is the weekly tuition fee multiplied by the weeks in default period (ss 8-9).
• It sets out a different calculation for refunds caused by student visa refusal: if the refusal causes non‑start on the agreed day, the refund equals the course fees received less the lesser of 5% of course fees received before the default day or $500; if the refusal causes withdrawal or failure to pay during the course, the refund reverts to the weekly‑fee × weeks formula (s 10(1)-(4)). For that purpose, “course fees” includes tuition fees and any non‑tuition fees received (s 10(3)).

The instrument is narrowly focused: it supplies arithmetic methods to translate statutory refund entitlements into dollar amounts. It depends on terms and circumstances defined in the Act (s 4 note), such as “default”, “default day”, “course”, “tuition fees”, and “agreed starting day”. The prescribed rounding rules are explicit (ss 6(2), 7(2)), and Schedule 1 repeals the 2014 specification in full.

The instrument turns legal refund triggers under the Act into precise arithmetic components. The central concepts it introduces and operationalises are:

• Weekly tuition fee (s 6). This takes the total tuition fees for a course, divides by the number of calendar days in the course and multiplies by seven, producing a weekly equivalent. Where the calculation yields a fraction of a dollar, the figure is rounded up to the next whole dollar (s 6(2)). The element “total tuition fees for the course” is not redefined in the instrument; the instrument relies on the Act’s definitions noted in s 4.

• Weeks in default period (s 7). This is the ceiling of the number of calendar days from the default day to the end of the period to which the payment relates, divided by seven. The calculation uses calendar days and rounds up to the nearest whole week (s 7(2)).

• Refund amount as weekly fee × weeks (ss 8-9). For provider default events under s 46D(6) of the Act and for provider failures to enter a compliant student default agreement under s 47E(2) of the Act, the refund is the product of weekly tuition fee and weeks in default period. The instrument therefore treats refund liability as proportional to the time span of services (weeks not delivered) and the weekly rate derived from total tuition fees.

• Visa refusal special rules (s 10). The instrument distinguishes between two visa‑refusal scenarios. Where refusal caused failure to start the course at the agreed location and day, refunds are the course fees received minus the lesser of 5% of course fees received before the default day and $500 (s 10(2)). “Course fees” explicitly includes tuition and non‑tuition fees received (s 10(3)). Where the refusal caused withdrawal or failure to pay mid‑course, the instrument applies the weekly fee × weeks calculation (s 10(4)).

• Relationship to Act definitions (s 4). The instrument notes that many expressions (for example, “course”, “default day”, “tuition fees”, “agreed starting day”) are defined in s 5 of the Act. The instrument does not redefine those terms: its arithmetic depends on how they are defined in the parent statute.

• Repeal (Schedule 1). The 2014 specification is repealed in full, meaning any prior numeric rules in that instrument are displaced.

The instrument therefore converts time and aggregate fee measures into a per‑week metric and uses a single product to calculate refunds in most default scenarios, while carving out a fixed percentage/flat cap mechanic for pre‑start visa refusals. Rounding rules for both the weekly fee and the weeks in default period are mandatory and stated in the instrument.

The instrument affects two primary groups through the financial mechanics that it prescribes: registered providers (as entities that receive tuition and must calculate and, where required, pay refunds) and students (overseas students and intending overseas students, defined in the Act and referenced in the instrument , s 4). Other affected parties include education agents, administrators, accounting and student‑billing systems, and compliance officers who must implement the formulas when statutory refund triggers occur.

• Registered providers. Providers must apply the instrument when the Act requires a refund under the statutory provisions cited in the instrument’s authority (s 3) , specifically when ss 46D(6), 47E(1)-(2) and the scenarios described in s 47D(5) of the Act are engaged. Providers need to compute the weekly tuition fee (s 6), establish the number of weeks in the default period (s 7), and apply the product rule for provider default and certain student default agreement failures (ss 8-9). In visa refusal scenarios addressed in s 10, providers must determine which subparagraph applies (non‑start v withdrawal/failure to pay) and carry out the alternative arithmetic. Providers will have to identify the “course fees” components when applying s 10(2) because that term, for the visa rule, includes non‑tuition fees as well as tuition fees (s 10(3)). The instrument therefore imposes a computational burden and a need to maintain precise records of course calendar days, payment periods, dates of default and dates of any visa decision.

• Students (overseas and intending overseas). Students’ refund entitlements are defined in the Act; this instrument operationalises how much they receive once a statutory trigger occurs. The instrument’s rounding rules (ss 6(2) and 7(2)), and the 5%/ $500 lesser‑of retention on pre‑start visa refusals (s 10(2)), directly determine quantum. Where non‑tuition fees have been paid, the visa‑refusal rule includes them in the course fees basis for the lesser‑of calculation (s 10(3)), which affects the net refund a student obtains.

• Administrators and compliance professionals. Systems and staff processing refunds must be able to compute calendar days in a course (required by ss 6(1) and 7(1)), identify the “period to which the payment relates” (s 7(1)(b)), and determine the “default day” (referred throughout). The instrument assumes availability of those inputs, which are defined or referenced in the Act and related enrolment documents.

• Other stakeholders. Education agents and third‑party administrators who manage payments or enrolments will see procedural impacts because providers may change billing cycles or payment receipts to align with the refund mechanics prescribed.

This instrument creates numeric duties on providers and clarifies the arithmetic right of students to a particular quantum where the Act creates a refund entitlement. The duties are primarily computation and payment duties; rights are refund entitlements exercisable by students under the Act and quantified by the instrument.

Provider duties (computation and payment)

• Apply the weekly tuition fee calculation (s 6). Providers must calculate the weekly tuition fee by dividing total tuition fees for the course by the number of calendar days in the course and multiplying the result by seven (s 6(1)). If the resulting figure is fractional, round up to the nearest whole dollar (s 6(2)). Duty: produce a whole‑dollar weekly rate.

• Calculate weeks in default period (s 7). Providers must determine the number of calendar days from the default day to the end of the period to which the payment relates, divide by seven, and round up to the nearest whole week (s 7(1)-(2)). Duty: produce a whole‑week count.

• Compute refund amounts (ss 8-9). For provider default (s 46D(6) of the Act) and where a provider has not entered into a compliant student default agreement (s 47E(2) of the Act), providers must compute the refund as weekly tuition fee multiplied by the weeks in default period (ss 8-9).

• Apply visa refusal rules (s 10). Where the provider is in the specific visa refusal posture described in s 10(1), the provider must calculate refunds either by deducting the lesser of 5% of course fees received before the default day and $500 from course fees received (s 10(2)-(3)), or by applying the weekly × weeks formula for mid‑course withdrawal/failure to pay (s 10(4)).

• Note reliance on Act definitions (s 4). Providers must be able to identify the “default day”, “period to which the payment relates”, “number of calendar days in the course”, and other defined terms in the Act to feed the arithmetic.

Student rights (monetary entitlement)

• Right to a quantified refund. Where the Act creates a refund entitlement, the instrument fixes the amount using its formulas (ss 8-10). For a provider default or non‑compliant agreement, the student’s right is to weekly tuition fee × weeks in default period (ss 8-9). For visa refusal pre‑start, the student’s net right is course fees received less the lesser of 5% or $500 (s 10(2)-(3)); for mid‑course visa refusals, the weekly × weeks rule applies (s 10(4)).

The instrument itself does not create penalties or enforcement mechanisms. It is a methods instrument that prescribes calculation rules; the Act supplies enforcement regimes, sanctions and regulatory consequences for non‑compliance. The instrument’s s 3 states the authority under the Act (ss 46D(7) and 47E(4)), indicating the instrument functions as an operational specification for statutory refund provisions. Enforcement is therefore a matter of the Act and its regulatory framework, not this instrument.

However, the instrument’s provisions create practical enforcement‑adjacent points:

• Quantification for compliance assessment. By prescribing exact formulas and rounding rules (ss 6-7), the instrument produces a clear arithmetic standard against which regulators and students can test a provider’s refund calculations. Non‑compliant calculations are therefore straightforward to detect: use the instrument’s inputs and steps to recompute the refund quantum.

• Evidence and auditability. Because the instrument depends on definitional inputs (for example, default day, number of calendar days in a course, period to which payment relates, amounts received), enforcement will require providers to produce contemporaneous records showing those inputs. Regulators enforcing the Act will likely request the same records to verify correct application of ss 6-10.

• Dispute focal points. The instrument’s mathematical precision narrows disputes to factual inputs (calendar days, payments, default day), but also creates discrete legal questions that enforcement agencies or courts may need to resolve under the Act: how the Act’s definitions apply (the instrument notes several expressions are defined in s 5 of the Act , s 4 note), whether particular amounts received are “tuition fees” or “non‑tuition fees” for the purpose of s 10(3), and whether particular events trigger the special visa refusal rule in s 10(2) versus the weekly‑fee × weeks rule in s 10(4).

• Administrative retention for visa refusals. The visa‑refusal pre‑start rule (s 10(2)) permits a provider to retain the lesser of 5% of course fees received before the default day and $500. That retention acts as an express, administratively calculable deduction permitted by the instrument. Enforcement will therefore focus on whether the provider correctly identified course fees received before the default day and deducted the correct lesser amount.

• No new offence provisions or civil penalty amounts. This instrument does not specify criminal penalties, civil penalties, or disciplinary processes; any penalties for failing to pay refunds, paying incorrect amounts, or failing to calculate in accordance with the instrument will flow from the Act and regulatory instruments or administrative processes under the Act.

The instrument is a subordinate instrument made under the Act, and its operation is explicitly contingent on the Act’s substantive refund provisions and defined terms. Its interaction with other legal instruments or laws is therefore primarily through the Act framework rather than via direct cross‑references to external statutes.

Key interactions and dependencies:

• Dependency on Act definitions (s 4 note). The instrument repeatedly refers to terms the Act defines (including “agreed starting day”, “course”, “default”, “default day”, “tuition fees”, “overseas student” and “intending overseas student”). The numerical outputs under ss 6-10 depend on how the Act and any relevant regulations define those terms. For instance, what constitutes the number of calendar days in a course, or the “period to which the payment relates” (s 7(1)(b)), are matters that will be resolved by reference to the Act, associated regulations, and any enrolment documentation consistent with those definitions.

• Authority under specified Act subsections (s 3). The instrument is made under ss 46D(7) and 47E(4) of the Act. Those statutory subsections (not reproduced in this instrument) are the legal hooks: the instrument provides methods for calculating refunds where the Act directs a calculation under those subsections. If other parts of the Act or associated regulations affect refund entitlements (for example, exceptions, offsets, or administrative directions), the instrument operates within that wider statutory structure.

• Relationship to provider obligations under the Act. The instrument prescribes how to compute refunds once an obligation under the Act arises. It does not alter the conditions under which an obligation arises, the identity of the obliged party, or the enforcement mechanisms; those stay with the Act. Any conflict between the instrument’s arithmetic and the Act’s substantive provisions would be resolved in favour of the Act. The instrument’s s 5 clarifies that instruments listed in its Schedule are amended or repealed as specified, and Schedule 1 repeals the 2014 instrument, so the new arithmetic now applies in place of older methods.

• Interaction with consumer, contract and tax law. The instrument does not directly address or displace consumer protection law, contract terms between provider and student, or tax law. Providers should consider that the instrument prescribes a statutory calculation for refunds; contract terms cannot lawfully produce results inconsistent with statutory refund entitlements where the Act governs. Likewise, tax treatment of refunds or retained amounts is not addressed here and remains subject to taxation law.

This instrument is a single, self‑contained instrument dated 26 September 2024 and commences the day after registration (s 2). It expressly repeals the predecessor instrument in whole. The relevant points from the instrument are:

• Date and maker. The instrument is dated 26 September 2024 and is made by the Minister for Education, Jason Clare (front page).

• Commencement. It commences the day after registration (s 2). The instrument therefore takes immediate effect upon its stated commencement trigger.

• Authority and scope. It is made under ss 46D(7) and 47E(4) of the Education Services for Overseas Students Act 2000 (s 3), indicating that it is an implementing instrument that specifies calculation methods required by those subsections.

• Repeal of the 2014 specification. Schedule 1 provides for the repeal of the entire Education Services for Overseas Students (Calculation of Refund) Specification 2014: Schedule 1, item 1: “The whole of the instrument , Repeal the instrument.” That is an express and complete repeal of the prior numeric specification.

• No other amendments. The instrument does not list amendments to any other instruments beyond the repeal specified in Schedule 1. It contains ten operational provisions and a schedule. There are no transitional provisions in the instrument text, and no saving clauses are included.

Because this instrument replaces the 2014 specification in full, entities affected by the prior rules should update their systems and procedures to apply the 2024 arithmetic. The instrument provides no transitional rules within its text; parties should therefore check whether the Act or other regulations supply transitional arrangements or whether administrative guidance has been issued by the regulator to bridge the repeal and replacement. The instrument itself does not state how refunds calculated under the old instrument should be treated where events straddle the change‑over, so providers should refer to the Act and regulator guidance for transitional treatment.

The instrument does not record any litigation; it is a newly made subordinate instrument and contains no case law citations. The text itself does not refer to judicial decisions or tribunal outcomes. Because the instrument is a method specification, litigation that might engage it would arise from disputes over its application rather than from the text directly.

Predictable dispute themes derive from the instrument’s arithmetic and its reliance on Act definitions:

• Input disputes. Litigation is likely to centre on factual inputs required by the instrument: the “default day”, the “number of calendar days in the course”, and the “period to which the payment relates” (see ss 6(1) and 7(1)). Parties may contest how those dates are identified in enrolment documentation or whether inclusions/exclusions of boundary dates are correct. The instrument’s calculations are precise given those inputs, so disputes will tend to focus on facts and documentary interpretation under the Act and the provider’s terms.

• Characterisation of fees. Under s 10(3), “course fees” for the visa refusal pre‑start rule include tuition fees and non‑tuition fees “(if any) received by the provider in respect of the student”. Disputes could arise over whether particular amounts are “non‑tuition fees received in respect of the student” and when they were received relative to the default day. That characterisation affects the base against which the 5%/ $500 lesser‑of deduction is applied.

• Application of visa‑refusal subparagraphs. The instrument distinguishes a pre‑start, non‑start scenario (s 10(2)) from mid‑course withdrawal/failure to pay (s 10(4)). Litigation could concern causation: whether a visa refusal “caused” the failure to start, the withdrawal, or the failure to pay (s 10(1)). Determining causation of that type may require factual inquiry into timing, communications and whether the student had alternatives (for example, transfer to another location or deferral options).

• Period to which payment relates. The weeks in default period depend on the period for which the provider received payment in respect of the student (s 7(1)(b)). Disputes may arise where payments cover multiple courses or overlapping periods, or where a single lump sum covers tuition and ancillary services with different time spans. Parties may litigate about apportionment.

• Rounding and arithmetic. The instrument requires rounding up (s 6(2) for dollars, s 7(2) for weeks). While rounding itself is numerically straightforward, small differences from previous methods may be contested if refund amounts change materially for large cohorts. Litigation could test whether providers applied rounding at the correct step in a multi‑stage calculation.

This instrument uses straightforward arithmetic but contains several points where practical pitfalls can produce material differences in refund outcomes. The following are concrete issues to watch, each grounded in the instrument’s text.

Rounding directions favour discrete results, but vary the quantum

• Weekly fee rounding: s 6(2) requires rounding up to the nearest whole dollar if the weekly tuition fee is not a whole dollar. Rounding up increases the weekly rate compared to truncation or rounding to the nearest dollar. Providers must therefore implement upward rounding at this step.
• Weeks rounding: s 7(2) requires rounding up the computed number of weeks to the nearest whole number. For example, 1.1 weeks becomes 2 weeks for refund calculation, increasing the refund compared with rounding down. Both upward rounding rules have an additive effect on refund totals.

Care with calendar day counts and inclusion rules

• The instrument repeatedly uses “number of calendar days” (s 6(1) and s 7(1)). Small differences in counting conventions (inclusive v exclusive of boundary dates) can change the denominator in the weekly fee or the numerator for weeks in default period. The instrument does not define whether start and end dates are inclusive; those determinations fall to the Act’s definitions or enrolment documentation. Ambiguity here can produce materially different refund figures.

Period to which payment relates

• The weeks in default period depend on the “period to which the payment relates” (s 7(1)(b)). Payments that cover multiple terms, multiple courses or mixed categories (tuition and ancillary services) require apportionment. The instrument does not specify apportionment methodology; providers must determine and document how a payment maps to an enrolment period.

Course fees include non‑tuition fees for visa refusal offset

• In the s 10(2) pre‑start visa refusal rule, “course fees” is defined to include non‑tuition fees if any (s 10(3)). Providers may be able to retain a 5% or $500 amount based on the sum of tuition and non‑tuition fees received. That increases the base from which the deduction is calculated and may surprise providers or students who think the retention applies only to tuition.

Less‑or‑greater cap interplay on retention

• For pre‑start visa refusal (s 10(2)), the provider keeps the lesser of 5% of course fees received before the default day and $500. For low‑fee courses, 5% may be less than $500, so the provider keeps a smaller proportional fee; for high‑fee courses, the provider keeps $500 only. Providers and students should model both outcomes.

This section sets out a practical checklist and systems‑level actions for registered providers and their compliance teams to implement the instrument’s arithmetic consistently and defensibly. All references are to this instrument.

1. Confirm applicability and legal basis

• Review the Act to identify when ss 46D(6), 47E(1)-(2) or the subparagraphs referenced in s 10(1) of the Act create a refund obligation. The instrument prescribes calculation methods for those statutory triggers (s 3). Do not apply the instrument outside the statutory circumstances described in the Act.

2. Identify and document inputs

• Default day: Record the date that constitutes the default day as defined in the Act and in the provider’s records.
• Number of calendar days in the course: Determine and document how the course length is computed (including whether start and end dates are inclusive).
• Period to which payment relates: For each payment received, document the precise period (start and end dates) that the payment covers (s 7(1)(b)).
• Amounts received: Maintain ledger detail separating tuition fees from non‑tuition fees (s 10(3)) and record dates of receipt relative to any default day.

3. Implement the weekly tuition fee calculation (s 6)

• Compute: (Total tuition fees for the course ÷ Number of calendar days in the course) × 7.
• Rounding: If the result is not a whole dollar, round up to the next whole dollar (s 6(2)).
• Record the computed weekly tuition fee and the calculation steps used.

4. Implement weeks in default period (s 7)

• Compute the number of calendar days from the default day to the end of the period to which the payment relates; divide that number by seven.
• Rounding: If not a whole number, round up to the nearest whole week (s 7(2)).
• Record the calendar‑day counts and the rounding step.

5. Apply refund formulae

• Provider default and non‑compliant agreement: Refund = weekly tuition fee × weeks in default period (ss 8-9). Apply the weekly fee computed in step 3 and the weeks computed in step 4.
• Visa refusal:
  • If refusal caused failure to start at the location on the agreed day: Refund = course fees received − lesser of (5% of course fees received before the default day) and $500 (s 10(2)). For this purpose, course fees = tuition fees received + non‑tuition fees received (s 10(3)). Compute both 5% total and $500, apply the lesser, and subtract it from course fees.
