#### 34 Delegation by Secretary 34 Delegation by Secretary > > (1) The Secretary may delegate to a Public Service employee, a member of the Teaching Service or a permanent employee the exercise of any of the Secretary’s functions under this Act. > > > (2) If— > > > > > (a) a function of the Secretary is delegated to a person in accordance with subsection (1), and > > > > > (b) the instrument of delegation authorises the sub-delegation of the function, > > > > then, subject to any conditions to which the delegation is subject, the person to whom the function is delegated may sub-delegate the function to any other person to whom the function may be delegated under subsection (1). > > **s 34:** Am 2006 No 114, Sch 3 \[1\] \[2\]; 2018 No 3, Sch 2 \[5\].
