#### 16 Incapable permanent employee may be retired 16 Incapable permanent employee may be retired > If— > > > (a) a permanent employee is found unfit to discharge or incapable of discharging the duties of his or her position, and > > > (b) the unfitness or incapacity appears likely to be of a permanent character, and has not arisen from actual misconduct on his or her part, or from causes within his or her control, > > the Secretary may cause the employee to be retired.
