sec.369 Entities engaged before commencement to assist college in performing functions

Subsection (2) applies if— before the commencement, an entity that was an employing authority for a non-State school represented by QCEC was engaged under section 230B(3) to assist the college in performing its functions under section 230B; and on the commencement, the entity is an employing authority for a non-State school represented by CEQL. To remove any doubt, it is declared that the representation of the non-State school by CEQL does not affect the engagement of the employing authority under section 230B(3). Subsection (4) applies if, before the commencement, QCEC was engaged under section 230B(3) to assist the college in performing a function of the college under section 230B. From the commencement— CEQL is taken to have been engaged under section 230B(3) to assist the college in performing the function on the same terms and conditions as QCEC was engaged immediately before the commencement; and if QCEC was engaged to assist the college in performing its functions of deciding certification applications or renewal applications—anything done by, or in relation to, QCEC before the commencement in relation to a certification application or renewal application that was not decided before the commencement is taken to have been done by, or in relation to, CEQL. s 369 ins 2025 No. 24 s 39ZH (sec.369-ssec.1) Subsection (2) applies if— before the commencement, an entity that was an employing authority for a non-State school represented by QCEC was engaged under section 230B(3) to assist the college in performing its functions under section 230B; and on the commencement, the entity is an employing authority for a non-State school represented by CEQL. (sec.369-ssec.2) To remove any doubt, it is declared that the representation of the non-State school by CEQL does not affect the engagement of the employing authority under section 230B(3). (sec.369-ssec.3) Subsection (4) applies if, before the commencement, QCEC was engaged under section 230B(3) to assist the college in performing a function of the college under section 230B. (sec.369-ssec.4) From the commencement— CEQL is taken to have been engaged under section 230B(3) to assist the college in performing the function on the same terms and conditions as QCEC was engaged immediately before the commencement; and if QCEC was engaged to assist the college in performing its functions of deciding certification applications or renewal applications—anything done by, or in relation to, QCEC before the commencement in relation to a certification application or renewal application that was not decided before the commencement is taken to have been done by, or in relation to, CEQL.
