Education and Early Childhood Services (Registration and Standards) Regulations 2025

Several core concepts structure the Regulations and determine their operation. These are: residual early childhood services; Board determinations; prescribed entities and consultation; service and provider approvals with conditions; the relationship to the Education and Care Services National Law (South Australia) and national regulations; records and standards; fees; and exemptions.

Residual early childhood services: The Regulations distinguish between education and care services that are governed by the National Law and a residual class of early childhood services captured by these Regulations (r 12 and Sch 1). Regulation 12 declares that entities listed in Schedule 1 are Schedule 1 early childhood services (r 12(1)) and goes on to define categories of in‑home care, occasional care, and rural and mobile care for purposes of the Act’s definitions (r 12(2)-(4)). That classification determines which services follow the National Law directly and which are treated as residual services subject to the specific regime in Part 3.

Board determinations and discretion: Where the National Law or national regulations require prescription by regulation, but the matter is not prescribed in this Division, the Board may prescribe or determine the matter, including opting not to require compliance (r 17). Numerous provisions make the prescribed information for applications, notifications and standards “such information as may be determined by the Board from time to time” (rr 18(1), 20(1), 27(1), 30(1)). Those repeated formulations concentrate a high degree of rule‑making and operational discretion in the Board.

Application and approval mechanics: Provider and service approvals for residual services follow the National Law’s procedural hooks but replace prescribed particulars with Board determinations. Applications must be accompanied by the fees set in Schedule 2 (rr 18(2), 20(2), Sch 2). The Board may refuse service approvals on additional grounds beyond the National Law, including capacity to operate and entitlement to occupy premises for centre‑based services (r 21).

Conditions on approvals: Service approvals are explicitly granted subject to conditions. The Regulations mandate a minimum insurance requirement (public liability cover with minimum $10,000,000 or government indemnity) (r 22), an ongoing entitlement to occupy premises for centre‑based services (r 23), and compliance with Board‑determined educator to child ratios and educator qualifications (rr 24-25). Family day care and in‑home services can be subject to standards or requirements determined by the Board (r 26).

Relationship to the Education and Care Services National Law and national regulations: The National Law and national regulations remain the baseline. Div 3 establishes that terms defined in the National Law retain their definitions in this Division (r 16(1)) and provides that Chapter 4 of the national regulations applies to residual services as if they were education and care services, subject to exceptions and modifications (r 29). However, record keeping requirements in Chapter 4 do not apply to residual services (r 29(3)), and the Board determines the documents an approved provider must keep (r 13). The result is selective application of national regulation with Board determinations filling many gaps.

Standards and record keeping: The Board is empowered to approve or adopt standards for residual services from time to time (r 30(1)). Approved providers must keep such documents as the Board specifies for at least 3 years (r 13); registered schools must keep Board‑determined records for at least 7 years (r 38). Those retention periods differ and are prescribed in the Regulations.

Exemptions and penalties: The Board may issue exemptions from specified provisions of the National Law for persons or classes, subject to conditions (r 11). Contravention of a condition of an exemption is an offence punishable by up to $10,000 (r 11(2)).

Fees and waivers: Schedule 2 sets specific fees for applications, copies of registers and endorsements (Sch 2). The Board may waive or remit fees in whole or in part (r 39(2)). The Regulations also clarify that fees set under the national law do not apply to residual services (r 39(1) note; Sch 2).

Consultation architecture: The Regulations prescribe numerous bodies and organisations for engagement in decision‑making and consultation under the Act,prescribed childcare bodies (r 5), prescribed designated entities (r 6), prescribed peak bodies (r 8) and prescribed bodies for school registration matters (r 34). The lists are explicit and determine the range of stakeholders the Board and Minister are to consult.

Delegation architecture: The Regulations specify functions and powers that may be delegated by the Minister (r 4) and the Board (r 9), identifying particular sections of the Act whose functions can be delegated (r 4 lists s 19, 22, 24, 62; r 9 lists s 29(1)(a),(b),(d), and s 30(2)). This allocates decision‑making flexibility within government structures.

Together, these concepts create a hybrid regime that selectively imports national regulation for many matters while leaving operationally significant choices to Board determinations, prescribes baseline fees and insurance, and defines who is to be consulted and who pays.

The Regulations affect several discrete groups and legal actors. Primary among them are approved providers and operators of residual early childhood services, registered schools and entities applying to register, the Board (and through it, the Minister), prescribed organisations for consultation, and a smaller set of parties that may seek exemptions.

Approved providers and service operators: Entities operating the Schedule 1 early childhood services listed in Schedule 1 (Kaurna Plains Childcare Centre; Koonibba Child Care Centre; Kura Yerlo Children's Centre; Marree Aboriginal School Creche; Milang Old School House Community Centre; Minya Bunhii Children's Centre; Port Lincoln Children's Centre Inc; Tjitji Tjapu Tjuta Childcare Centre; Wynbring Jida M.A.C.S Child Care Centre) are brought into the Act’s ambit by r 12(1) and Sch 1. Those providers must comply with the service approval regime (Part 3 Divs 2-3): apply for provider and service approvals with the fees in Sch 2 (rr 18(2), 20(2), Sch 2), comply with conditions attached to approvals (insurance r 22, entitlement to occupy premises r 23, Board‑determined educator ratios and qualifications rr 24-25), and meet record‑keeping requirements specified by the Board for at least 3 years (r 13). Providers of in‑home, occasional, rural and mobile services are affected where those services fall within the statutory definitions in r 12(2)-(4).

Other childcare operators and applicants: Entities that previously provided family day care under the Children’s Services Act 1985 and other providers that immediately before commencement operated a Schedule 1 early childhood service are declared to be included in the relevant transitional clauses (rr 14-15). Family day care and in‑home providers are excluded from Chapter 4’s application but are subject to Board‑determined standards under r 26. Providers will need to watch Board determinations because many application particulars are “to be determined” by the Board (rr 18(1), 20(1)).

Registered schools and prospective schools: Schools seeking registration on the schools register must meet standards for registration and review published by the Board (r 33), lodge applications accompanied by fees (Sch 2 item for application for registration $300) and maintain Board‑determined records for at least 7 years (r 38). Registered schools wishing to gain endorsement to enrol full fee paying overseas students must comply with either Board standards or the National Code as adopted, and, for ESOS students, be registered on the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS) (r 36). Secondary schools face endorsement fees according to size (Sch 2: $0-$2,000 depending on enrolment bracket).

Parents and families: Indirectly affected are parents and guardians who use residual early childhood services that are captured by Schedule 1 or fall into the regulatory definitions in r 12. The obligations on providers to hold insurance (r 22), to meet educator to child ratios and qualifications (rr 24-25), and to be entitled to occupy premises (r 23) are intended to shape the environment in which parents’ children are cared for.

The Board and Minister: The Board gains significant regulatory power to determine standards, application particulars, notification requirements and operational conditions for residual services (see rr 17, 18(1), 20(1), 27(1), 30). The Minister retains delegation powers but only for specific sections of the Act as prescribed (r 4) and the Board may delegate certain functions (r 9). The Board must include specific information in its annual report including consultation undertaken and national law information (r 10).

Prescribed stakeholder organisations: The lists in rr 5, 6 and 34 identify numerous sector organisations and education bodies (universities, unions, parent associations, curriculum boards, peak childcare bodies and various Ministers). Those organisations will be statutory participants in consultation, thereby affecting how policy and standards are formed.

Insurers and landlords: The insurance condition in r 22 (minimum $10,000,000 public liability cover or government indemnity) directly affects insurers and their pricing, and the occupancy condition in r 23 affects landlords and lease arrangements for centre‑based services.

Persons seeking exemptions: The Board may grant exemptions from specified National Law provisions for persons or classes under r 11, subject to conditions. Those who obtain exemptions must comply with conditions or risk the offence in r 11(2) (maximum $10,000).

Legal and compliance advisers: Lawyers, accountants and compliance professionals advising any of the above parties will be affected by the Board’s large margin of discretion. The repeated formulation that particulars are “to be determined by the Board” (rr 17-20, 27, 30) means advisers must monitor Board determinations and administrative practice. Finally, because the Regulations modify the application of the National Law and national regulations (r 29), specialists in that area must map the modified regime for residual services.

The Regulations impose specific duties on approved providers, service operators and registered schools, and they confer definitional and procedural rights such as application and review mechanisms under the parent Act as modified by these Regulations.

Duties on approved providers of residual early childhood services:

• Application and fee duty: Applicants for provider and service approvals under the National Law (as applied to residual services) must supply the prescribed information as determined by the Board and pay the application fees set in Schedule 2 (rr 18(1)-(2), 20(1)-(2), Sch 2). The Board should have regard to national requirements when determining the required information (rr 18(3), 20(3)).
• Insurance: Service approvals are subject to a condition that the approved provider must hold public liability insurance with a minimum $10,000,000 cover, or be covered by a government indemnity against public liability (r 22).
• Occupancy for centre‑based services: A centre‑based service approval is granted subject to the ongoing condition that the service remains entitled to occupy the premises at which it operates (r 23). That is an ongoing duty to maintain legal occupancy rights.
• Educator ratios and qualifications: Approved providers must comply with any minimum educator numbers and educator qualification requirements as may be determined by the Board from time to time; such determinations may vary by class of service, role of educator and ages of children (rr 24-25).
• Operational standards for in‑home and family day care: Those services are subject to any standards or requirements the Board determines (r 26).
• Notifications: The content of statutory notifications under section 56 (change of nominated supervisor) and section 59 (transfer of service approval) of the National Law, as applied to residual services, is to be determined by the Board (r 27(1)). Providers must furnish the required information when making those notifications.
• Records: Approved providers must keep records the Board specifies for at least 3 years and in a manner and place complying with Board requirements (r 13(1)-(2)).

Duties on registered schools:

• Compliance with Board standards: To be registered on the schools register a school must comply or be able to comply with the standards for registration and review published by the Board (r 33(1)). Those standards govern review cycles (r 37).
• Records retention: Registered schools must keep records determined by the Board for at least 7 years and in a manner determined by the Board (r 38(1)-(2)).
• Endorsement conditions for overseas students: For endorsement to enrol ESOS students, schools must comply with Board standards or the National Code, and for ESOS‑defined overseas students must be registered on CRICOS (r 36).

Rights and procedural mechanisms:

• Application and review mechanics: The Regulations preserve application and review frameworks under the Act and the National Law for provider and service approvals, including voluntary suspension processes (rr 18(1)(c), 20(1)(c)). The Board has explicit powers to refuse on additional grounds (r 21).
• Exemptions: The Board may grant exemptions from specified National Law provisions for persons or classes, and may vary or revoke exemptions (r 11(1)(a)-(b)). There is a right to hold an exemption subject to compliance with conditions, but contravening conditions is a criminal offence (r 11(2)).
• Fee waivers: The Board may waive or remit fees under the Act (r 39(2)), creating discretionary relief for applicants.
• Delegation: The Minister and the Board may delegate listed functions under the Act (rr 4 and 9), which affects administrative channels for exercise of powers.

Limiting provisions and exceptions:

• Chapter 4 applicability: Chapter 4 of the national regulations applies to residual early childhood services as if they were education and care services (r 29(1)), except that it does not apply to in‑home or family day care services (r 29(2)) and record keeping provisions in Chapter 4 do not apply to residual services (r 29(3)). This creates duties for most residual services while excluding specific subcategories.
• Board discretion to not require compliance: Where the National Law required a matter to be prescribed by national regulations and it is not the subject of a regulation in this Division, the Board may prescribe or determine the matter, including not requiring compliance (r 17). That is a statutory allowance for regulatory forbearance.

Offences and penalties as duties:

• Contravention of conditions of an exemption is an offence (r 11(2), maximum $10,000).
• The Regulations also prescribe certain offences for purposes of the Act (r 7): an offence of a sexual nature committed against or in relation to a minor, and an offence of dishonesty under the Act, are specified.

In short, the Regulations establish concrete operational duties (insurance, occupancy, educator ratios and qualifications, record keeping) and procedural rights (applications, exemptions, fee remissions), while embedding a structure where significant detail is left to the Board’s determinations. Providers and schools must observe the Board’s determinations to remain compliant.

The Regulations themselves contain a limited set of explicit penalties and focus more on procedural and condition‑setting mechanisms that feed into enforcement under the Act and the Education and Care Services National Law (South Australia) as applied to residual services.

Specified statutory penalty:

• Exemption condition breach: The Regulations expressly create an offence for contravening a condition of an exemption granted under regulation 11(1). That offence carries a maximum penalty of $10,000 (r 11(2)). The offence is framed narrowly: it targets failure to comply with the specific conditions attached to a Board exemption.

Prescribed offences for Act purposes:

• For the purposes of section 23(4)(d) of the Act, the Regulations prescribe particular offences (r 7): (a) an offence of a sexual nature committed against, or in relation to, a minor; and (b) an offence of dishonesty under the Act. Those prescriptions feed into the Act’s mechanisms that use prescribed offences as triggers for registration, licensing or other decisions (the Regulations do not, however, set the sanctions under the Act that may follow from those offences).

Suspension powers and maximum periods:

• The Regulations specify the maximum periods for suspension of provider approvals and service approvals for the sections of the National Law applied to residual services: 12 months is the prescribed maximum period of suspension for provider approvals under ss 27(b)(i) or 33(1)(a)(ii) of the National Law as applied (r 19), and 12 months is also the prescribed maximum period of suspension for service approvals under ss 72(b)(i) and 79(1)(a)(ii) of the National Law as applied (r 28). Suspension is an enforcement tool under the National Law and the Regulations cap how long a suspension may last in this jurisdictional application.

Administrative conditions and ongoing compliance as enforcement vectors:

• Several conditions on service approvals (insurance, entitlement to occupy premises, educator ratios and qualifications) create ongoing compliance obligations that can be enforced through the Board’s powers to refuse, suspend or impose conditions on approvals. Breach of those conditions will typically engage administrative enforcement under the Act and the National Law as applied; the Regulations do not always specify criminal penalties for such breaches, but they do create enforceable conditions on approvals that can lead to administrative sanctions (e.g. suspension, refusal, or revocation under the Act/National Law).

Fee and application consequences:

• The Regulations prescribe fees for applications and for copies of registers (Sch 2). While the instrument itself does not set out fines for late payment, failure to pay prescribed application fees will impede the grant of approvals because rr 18(2) and 20(2) require applications to be accompanied by the appropriate fee. The Board may waive or remit fees (r 39(2)), introducing administrative discretion.

Delegation and administrative enforcement channels:

• The Regulations permit delegation of certain functions by the Minister (r 4) and the Board (r 9), which affects who can exercise enforcement powers in practice. Delegation provisions determine administrative pathways for enforcement actions such as issuing notices, imposing conditions, granting exemptions, and conducting reviews.

Interaction with the National Law enforcement regime:

• Because many enforcement tools for providers and services exist in the Education and Care Services National Law (South Australia), the Regulations’ selective application of that Law (r 29) brings into play the National Law’s enforcement architecture (suspended approvals, transfer conditions, prohibited orders etc.) as adapted. Where the National Law provides a process or sanction, that process will generally apply to residual services unless the Regulations or the Act say otherwise.

In sum, explicit monetary penalties in the Regulations themselves are limited (notably the $10,000 maximum for breach of exemption conditions in r 11(2)), but the Instruments create a suite of enforceable administrative conditions and suspension powers (with prescribed maximum suspension durations of 12 months) that support the Act’s enforcement regime. Providers should treat the Board’s conditions as enforceable obligations; failure to meet them can trigger administrative sanctions under the Act and National Law as applied.

These Regulations are explicitly designed to operate alongside and, in part, to modify the application of the Education and Care Services National Law (South Australia) and other Commonwealth and State instruments. The text identifies specific interactions and carve‑outs.

Education and Care Services National Law (South Australia) and national regulations:

• Definitions and incorporation: Division 3 opens with an interpretive rule that terms defined in the National Law or national regulations maintain their meanings for the Division (r 16(1)). The Division also states that references to the National Law will be taken to be references to that Law as it applies to residual early childhood services (r 16(2)).
• Selective application: Chapter 4 of the national regulations applies to residual early childhood services as if they were education and care services, subject to the modifications in these Regulations (r 29(1)). However, Chapter 4 does not apply to in‑home care services or family day care services (r 29(2)), and record‑keeping obligations in Chapter 4 expressly do not apply to residual services (r 29(3)). Those carve‑outs create a partially overlapping regime rather than a complete supplanting or full incorporation of the National Law.
• Board determinations where national regulations leave matters to prescription: If the National Law requires a matter to be prescribed by national regulations and the matter is not addressed by these Regulations, the Board may prescribe or determine the matter, and may choose not to require compliance (r 17). That gives the Board a backstop to fill gaps where national prescription would otherwise be required.

Commonwealth ESOS regime and the National Code:

• Endorsement for full fee paying overseas students: The Regulations entangle school registration with Commonwealth ESOS obligations. For endorsement relating to overseas students under the Education Services for Overseas Students Act 2000 (Cth), a registered school must comply with Board standards or, if none are adopted, the National Code’s standards for registered providers as in force from time to time, and must be registered on the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS) (r 36(a)). Thus, the Regulations require schools to meet federal standards and registration to secure endorsement for ESOS students, linking State registration to Commonwealth regulation.

Other State Acts and Ministerial portfolios:

• Prescribed designated entities include Ministers who administer the Carers Recognition Act 2005, the Health Care Act 2008 and the South Australian Skills Act 2008 (r 6(o)-(q)). That creates a formalised consultation or designated‑entity relationship between the Board and those Ministerial portfolios.
• References to other State laws: r 12(2)(f) excludes care provided in accordance with a parenting order under the Family Law Act 1975 (Cth) or Family Court Act 1997 (WA) from the definition of in‑home care services; r 12(2)(g) excludes care provided under placements under ss 77 or 84 of the Children and Young People (Safety) Act 2017 (SA). These cross‑references delineate boundaries between jurisdictional regimes.

Transitional and repeals:

• The Regulations repeal the 2011 Regulations (Sch 3). Transitional inclusions are provided: persons or bodies who operated a Schedule 1 service immediately before commencement are declared to be included in the ambit of the relevant transitional clause (r 14); certain services provided under the earlier Children’s Services Act 1985 are declared to be included in the ambit of service approvals (r 15). That creates continuity with prior regulatory arrangements.

Administrative and information exchange:

• The Regulations prescribe parties for consultation (rr 5, 6, 8, 34). These statutory lists create formal channels for the Board to engage with unions, educational institutions, parent bodies and peak organisations, potentially affecting coordination with other regulatory regimes.

Fees and national fees exclusion:

• The Regulations note that fees set under the National Law do not apply to residual services (r 39(1) note), and Schedule 2 supplies the applicable fees instead. That creates divergent fee regimes for services depending on their classification.

In practical terms, the Regulations create a layered regime: they selectively import national regulation, replace certain national prescriptions with Board determinations, and link school registration to Commonwealth ESOS obligations where relevant. They also cross‑cut with family law, child protection placements and other State Acts to carve out certain relationships. The multiple cross‑references mean that operators must map the Regulations against the National Law, Commonwealth ESOS requirements and relevant State Acts to determine the applicable compliance matrix.

The Regulations themselves are new principal regulations made in 2025 and contain a short legislative history within the instrument. The document records the following specific amendment and commencement information.

• Repeal of earlier regulations: Schedule 3 expressly repeals the Education and Early Childhood Services (Registration and Standards) Regulations 2011 (Sch 3). This is an explicit replacement of the prior subordinate instrument with the 2025 Regulations.
• Principal Regulations details: The legislative history at the end records these Regulations as Principal regulations, Year 2025, No 131, Gazette 27.11.2025 p4652, with commencement effected on 1.12.2025 via regulation 2. That is the formal commencement record (Legislative history and r 2).
• Transitional declarations: The Regulations include transitional provisions by declaration rather than classical multi‑section transitional schedules. For example, r 14 declares that a person or body who, immediately before commencement, operated a Schedule 1 early childhood service is included in the ambit of Schedule 3 clause 29(g) of the Act. Regulation 15 declares that certain services, including family day care services provided under the Children’s Services Act 1985 immediately before commencement (other than those that are education and care services under the National Law), are included in the ambit of clause 30 of Schedule 3 of the Act. Those are operational transitional inclusions within the instrument.
• New delegations and prescriptive lists: The Regulations introduce fresh delegations and lists of prescribed bodies (rr 4, 5, 6, 8, 9, 34). These are not described as amendments to earlier regulations but are the new prescriptive content replacing the 2011 instrument.
• Fee schedule replacement: Schedule 2 replaces earlier fee provisions by setting explicit fees for provider and service applications, registry copies and endorsements. The note under r 39(1) emphasises that fees under the National Law do not apply to residual services, effecting an explicit divergence with prior fee arrangements.
• No further amendment entries: The instrument’s legislative history does not record any earlier amendments to the 2025 Regulations since they are the new principal regulations. The text contains no amending provisions for the 2025 instrument itself.

Because the document is the principal regulation, it is the operative subordinate instrument for the matters it covers as of 1 December 2025. Where the Regulations leave matters to be "determined by the Board from time to time" (see, for instance, rr 18(1), 20(1), 27(1), 30(1)), those Board determinations will be the locus of future operational changes and de facto amendments to the operating regime. Thus the formal amendment history of the Regulations to date is limited to the repeal of the 2011 Regulations and the 2025 commencement entry recorded in the Legislative history.

The Regulations contain no judicial decisions, no reported litigation and no case law citations in their text. The instrument is purely regulatory and does not itself record any judicial challenge or litigation outcome.

The legislative text names no cases and does not reference judicial determinations. Because these are principal regulations commencing 1 December 2025 and replacing the 2011 Regulations (Sch 3), any litigation arising from this new regulatory scheme would post‑date commencement and would appear in public law and administrative law reporting streams thereafter. At the time of enactment recorded in the instrument, no litigation history is stated within the Regulations.

Practitioners should therefore note that there is no litigation history to draw on in interpreting ambiguous delegations to the Board, the Board’s discretion to determine matters or how the carve‑outs from the National Law have been judicially treated. Administrative law and statutory interpretation principles under South Australian law and relevant Commonwealth jurisprudence (if engaged through ESOS matters) will be the likely interpretive tools until specific cases addressing these Regulations are decided.

Because many key matters are left to Board determinations (r 17 and other provisions), any future litigation is likely to concern (a) the legality of Board determinations (for example, whether they fall within the scope of the Act and regulations), (b) whether the Board’s exercise of discretion complied with procedural fairness, and (c) the application of the National Law as modified by these Regulations to particular facts. None of that litigation has occurred as of the instrument text provided.

The Regulations are precise in some respects and deliberately indeterminate in others; the interplay creates several practical risks and traps for practitioners and operators.

1. Heavy reliance on Board determinations:

• Recurrent formulation that application requirements, notification particulars and operational standards are “such information as may be determined by the Board from time to time” (rr 18(1), 20(1), 27(1), 30(1)) means substantive obligations may change without parliamentary amendment. That confers operational flexibility but raises legal uncertainty about current requirements until the Board publishes determinations. Practitioners must track Board instruments closely.

2. Board may “not require compliance”:

• Regulation 17 explicitly allows the Board to determine a matter by choosing not to require compliance with a National Law provision that would otherwise be prescribed. That can produce unexpected lacunae: an operator might assume a National Law standard applies when the Board has forborne. Confirming whether the Board has made a determination is essential.

3. Insurance condition wording:

• The service approval condition requires either a current public liability policy with minimum $10,000,000 cover or a policy/indemnity provided by the Government (r 22). That is a high monetary threshold, with commercial and market implications for premium costs and underwriting availability. The Regulations do not specify acceptable policy terms beyond the minimum quantum.

4. Occupancy as a condition:

• Centre‑based services must remain entitled to occupy the premises (r 23). For operators on short leases or informal occupancy arrangements, this condition may impede approval or lead to condition breaches if tenancy arrangements change. The Board may treat lack of secure occupancy as ground for refusal (r 21(b)).

5. Differential record‑keeping periods and carve‑outs:

• Chapter 4 record requirements do not apply to residual services (r 29(3)), and approved providers must keep Board‑specified records for at least 3 years (r 13), whereas schools must retain records for at least 7 years (r 38). Operators used to National Law Chapter 4 obligations should not assume identical retention or content obligations; they must confirm the Board’s record list. This divergence can create compliance mistakes, particularly in services operating across classifications.

6. Transitional inclusions by declaration:

• rr 14-15 declare certain persons to be included in the ambit of transitional clauses. That may not create the same detailed transitional protections as a dedicated transitional schedule. Affected providers should verify how prior approvals and compliance histories migrate.

7. Fees and apparent anomalies:

• Schedule 2 sets the fee for an electronic copy of the schools register at $65 and a hard copy at $5 per page (Sch 2). Depending on the number of pages, the hard copy cost may far exceed the electronic fee. Additionally, some endorsement application fees for secondary schools can reach $2,000, which may be material for small schools (Sch 2). The Board may waive fees (r 39(2)), but waiver is discretionary.

8. Exemption penalty is limited but real:

• Contravention of a condition attached to a Board exemption is a criminal offence carrying up to $10,000 (r 11(2)). Holders of exemptions must monitor compliance closely. The Regulations do not supply a range of graduated enforcement responses beyond that single monetary maximum.

9. Interaction with ESOS and Commonwealth requirements:

• For endorsement to enrol ESOS students, schools must be on CRICOS and meet National Code standards unless the Board adopts different standards (r 36). That linkage imposes federal compliance obligations on State registration status; lack of CRICOS registration will block endorsement.

10. Delegation specification:

• The Regulations specify which functions may be delegated by the Minister and the Board (rr 4, 9). Practitioners should confirm at an operational level who administratively exercises functions since delegation affects appeal rights and interlocutory remedies.

11. Prescribed lists are fixed in the Regulations:

• The specified childcare bodies and designated entities (rr 5-6) are expressly listed. Inclusion or omission from those lists has statutory significance for consultation and stakeholder status. Interested organisations not on the lists are not given the prescribed status and must seek alternative engagement pathways.

12. No litigation precedent:

• There is no litigation history recorded, so legal arguments about the Board’s scope of determination, interpretation of “residual”, or the limits of delegation will be novel. That increases litigation risk if parties disagree with how determinations are made or applied.

In short, the gotchas are primarily operational: many requirements are not fixed in the Regulations but left to the Board, insurance and occupancy conditions are potentially onerous, record‑keeping regimes diverge from national norms, and fees and exemptions have real compliance implications. Active monitoring of Board determinations and careful documentation of occupancy, insurance and educator qualifications are essential to avoid unexpected compliance failures.

Practical compliance requires mapping your service or school to the correct regulatory path, confirming Board determinations, and meeting the specific documentary, insurance and occupancy conditions set out by the Regulations.

Step 1 , Determine classification

• Identify whether your service is a Schedule 1 early childhood service (r 12(1) and Sch 1) or otherwise falls within the statutory definitions: in‑home care (r 12(2)), occasional care (r 12(3)), rural and mobile care (r 12(4)), or is an education service or registered school (Part 4). The classification determines which provisions apply, including whether Chapter 4 of the national regulations applies (r 29).

Step 2 , Confirm Board determinations and published standards

• Because the Regulations make many requirements “such information as may be determined by the Board from time to time” (rr 17-20, 27, 30), subscribe to or regularly check the Board’s published determinations and standards. Obtain the Board’s current lists of required application information, notification particulars, record specifications and any standards that apply to in‑home care and family day care services (rr 18(1), 20(1), 27(1), 26, 30(1), r 13).

Step 3 , Applications and fees

• For a provider approval, lodge the application with the prescribed application fee of $200 (r 18(2), Sch 2). For a service approval, lodge the application with the prescribed fee of $400 (r 20(2), Sch 2). For transfer of a service approval, pay the $100 notice fee (Sch 2). Keep records of payment and confirmation in case of later queries. If fee relief is necessary, apply for a fee waiver or remission under r 39(2); note that waiver is at the Board’s discretion.

Step 4 , Insurance coverage

• Ensure the approved provider acquires public liability insurance with a minimum $10,000,000 cover for the residual service, or confirm whether the Government provides an indemnity that covers the service (r 22). Review policy wording for exclusions, territorial limits, and coverage for staff and volunteers to ensure the Board would accept the policy. Keep evidence of the current policy accessible for inspection.

Step 5 , Premises and occupancy

• If centre‑based, confirm a legal entitlement to occupy the premises and document the occupancy arrangement (lease, licence or equivalent) because service approvals are conditioned on continued entitlement to occupy (r 23), and the Board may refuse applications where entitlement is not demonstrated (r 21(b)). If occupancy terms are limited, consider securing longer lease terms or written landlord consent prior to applying.

Step 6 , Educator numbers and qualifications

• Identify applicable educator to child ratios and educator qualification requirements as determined by the Board (rr 24-25). Where the Board has not published specific ratios or qualifications, maintain staffing that meets national expectations as a prudent interim step, but ensure you update policies in response to Board determinations. Document staff qualifications, certification, working with children clearances, and maintain training records in accordance with r 13 or Board specifications.

Step 7 , Operational standards for family day care and in‑home care

• If operating in‑home or family day care services, obtain and implement any standards the Board determines under r 26, since Chapter 4 does not apply to those services (r 29(2)). Retain operational manuals, risk management policies and supervisory systems complying with Board requirements.

Step 8 , Records management

• Approved providers must keep Board‑specified records for at least 3 years, in a place and manner complying with Board requirements (r 13). Registered schools must keep Board‑specified records for at least 7 years and in a manner the Board determines (r 38). Implement a records retention schedule, secure storage (physical or electronic), and an access control regime. Because Chapter 4 record provisions do not apply to residual services (r 29(3)), don’t assume national Chapter 4 templates suffice; follow the Board’s current list.

Step 9 , Notifications and governance:

• For change of nominated supervisor or transfer of a service approval, confirm the precise information the Board requires for notices under ss 56 and 59 of the National Law as applied (r 27). Ensure governance documents, supervisory arrangements, and transfer documentation are complete before lodging notifications.

Step 10 , Exemptions:

• If seeking an exemption under r 11, apply in writing to the Board. There is no application fee for an exemption (Sch 2). If granted, ensure strict compliance with any conditions because breach is an offence with a maximum $10,000 penalty (r 11(2)). Keep copies of exemption notices and evidence of compliance with conditions.

Step 11 , School registration and ESOS endorsement:

• Schools seeking registration must show they can comply with the Board’s standards for registration and review (r 33). For ESOS endorsements, ensure CRICOS registration where relevant and compliance with either Board standards or the National Code (r 36). Budget for endorsement fees as set in Sch 2 and gather documentary proof of compliance with relevant codes.

Step 12 , Administrative practice and dispute readiness:

• Keep contemporaneous records of submissions to the Board, decisions and communications. If an approval is refused or suspended, note that the Regulations prescribe maximum suspension periods (12 months, rr 19 and 28) and that grounds for refusal include inability to show entitlement to occupy premises or capacity to comply with requirements (r 21). Seek legal advice promptly if the Board exercises discretion in a way that may be reviewable.

Step 13 , Insurance and lease audit and budgeting:

• The $10,000,000 public liability minimum is a material cost item for budgeting. Seek insurer confirmation of available cover and premium costs before making business commitments. Similarly, verify lease security duration and assign responsibilities for occupancy compliance.

Step 14 , Keep an issues register and monitoring process:

• Maintain an internal compliance register mapping statutory obligations against Board determinations and update it every time the Board publishes a new determination or standard. Because the Board may alter the operating requirements without legislative amendment, active monitoring is essential.

Step 15 , Seek clarification early:

• Where a Board determination is unclear, seek written clarification from the Board or obtain procedural advice. Because many requirements are delegated, ensure you address the body or officer empowered to decide (rr 4, 9).

Following these steps aligns an operator’s practices with the Regulations’ substantive and procedural duties. Given the centrality of Board determinations in this regime, establishing a regular process for watching Board publications and documenting compliance will materially reduce regulatory risk.
