Subdivision 5—Removal of members of governing councils and affiliated committees etc 44—Minister may remove member of governing council or affiliated committee The Minister may remove a member of the governing council of a school or an affiliated committee from office— (a) for misconduct (including any breach of a code of practice approved by the Minister under section 10(2)(b) and applying to the member); or (b) for failure or incapacity to carry out the duties of office satisfactorily; or (c) for any other reasonable cause. 45—Minister may prohibit or limit performance of functions etc by governing council or affiliated committee (1) The Minister may, if the Minister considers it necessary or appropriate to do so, by notice in writing, prohibit or limit the performance of a specified function, or the exercise of a specified power, by the governing council of a school or an affiliated committee. (2) The Minister must cause a copy of a notice under subsection (1) to be given to the principal of the school. (3) A prohibition or limitation imposed under this section— (a) must comply with any requirements set out in the regulations; and (b) has effect despite the provisions of the constitution of the governing council or affiliated committee. (4) The Minister may, by notice in writing, vary or revoke a notice under subsection (1).
