EDUCATION AND CARE SERVICES (NATIONAL UNIFORM LEGISLATION) (INFRINGEMENT NOTICE) REGULATIONS 2019

Key statutory concepts are defined or established by cross‑reference and by express provision.

• Infringement notice (regulation 3). The Regulations use the defined term “infringement notice” to mean a notice served under section 291(1) of the Education and Care Services National Law (NT). The content and legal effect of an infringement notice are governed by both the National Law and these Regulations.

• Infringement notice offence (regulation 3 and regulation 4). The Regulations define an “infringement notice offence” as an offence against a provision either specified in section 291(1) of the National Law (NT) or prescribed for that subsection. Regulation 4 operates as a gatekeeper: only offences falling within the National Law’s s 291(1) or any regulations made under that subsection may be dealt with by an infringement notice under this instrument.

• Prescribed amount (regulation 3). The “prescribed amount” is not set in these Regulations; it is determined in accordance with section 291(2) of the National Law. Thus the monetary quantum required to expiate an infringement notice is located in the National Law, not in the Northern Territory infringement notice Regulations themselves.

• Enforcement agency (regulation 3). The Regulations adopt the definition of “enforcement agency” by reference to section 5 of the Fines and Penalties (Recovery) Act 2001. The enforcement agency is the body to whom the prescribed amount must be paid (regulation 5(1)(f)) and to whom a statement of election must be given if the recipient elects to have the matter dealt with by a court (regulation 5(2)(b)).

• Regulatory Authority (regulation 7). The power to withdraw an infringement notice is given to the Regulatory Authority (regulation 7(1)). The Regulations do not define “Regulatory Authority” within their four corners, instead using the term as a role with power to withdraw notices within a set period (regulation 7(2)). The identity and functions of the Regulatory Authority must therefore be sought in the National Law or other primary legislation.

• Expiation and election (regulation 5). The Regulations require each infringement notice to include a statement that the person may expiate the infringement notice offence by paying the prescribed amount within 28 days; or may elect, under section 21 of the Fines and Penalties (Recovery) Act 2001, to have the matter dealt with by a court by completing and returning a statement of election to the specified enforcement agency (regulation 5(2)(a)-(b)). The notice must also include a completed form for the statement of election (regulation 5(3)).

• Enforcement consequences (regulation 5(2)(c)). The Regulations oblige the notice to list that failure to respond may result in enforcement action under the Fines and Penalties (Recovery) Act 2001 and provide non‑exclusive examples: suspension of a driver licence, seizure of personal property, wage deduction, registration of a statutory charge on land, community work order and imprisonment for breach of a community work order (regulation 5(2)(c)(i)-(v)).

• Payment mechanics (regulation 6). For electronic payments, payment is effected only when the prescribed amount is credited to the enforcement agency’s bank account (regulation 6(1)). For cheques, payment takes effect only if the cheque clears on first presentation (regulation 6(2)). These provisions determine the temporal moment of expiation under the Regulations.

• Withdrawal (regulation 7). The Regulatory Authority may withdraw an infringement notice by written notice given to the person, but only if the withdrawal is given within 28 days after the infringement notice is given and before payment of the prescribed amount (regulation 7(2)(a)-(b)).

• Non‑preclusion and multiplicity (regulation 8). The Regulations state that they do not prejudice or affect the start or continuation of proceedings for an offence for which an infringement notice has been given unless the offence is expiated (regulation 8(1)). They also do not require a notice to be given, do not affect liability to prosecution where no notice has been given, and do not prevent the service of more than one infringement notice for the same offence; where multiple notices are given, expiation can be achieved by paying the prescribed amount in accordance with any of the notices (regulation 8(2)-(3)).

These concepts operate together to set legal entitlements and procedural mechanics for both persons receiving notices and the public bodies that serve, accept payment and can withdraw notices.

Primary affected parties are clearly identified by the Regulations’ content and cross‑references.

• Persons receiving an infringement notice. The obligations and rights created by the instrument are primarily aimed at any person served with an infringement notice under section 291(1) of the National Law. The notice must identify the person, where known, and set out options and consequences (regulation 5(1)(a), (2)). The recipient bears the legal choice to expiate by paying the prescribed amount within 28 days or to elect for the matter to proceed to court by completing the statement of election and giving it to the enforcement agency (regulation 5(2)(a)-(b); regulation 5(3)).

• Enforcement agencies. The Regulations require that an enforcement agency be specified on the notice as the recipient of the prescribed amount (regulation 5(1)(f)). The enforcement agency is defined by reference to section 5 of the Fines and Penalties (Recovery) Act 2001 (regulation 3). The agency is the entity whose bank account must be credited for electronic payments to take effect (regulation 6(1)), and to which a statement of election must be given (regulation 5(2)(b)).

• The Regulatory Authority. The Regulations give the Regulatory Authority the power to withdraw an infringement notice by written notice to the person, provided the withdrawal occurs within 28 days after the notice was given and before payment of the prescribed amount (regulation 7(1)-(2)). The Regulatory Authority therefore controls the limited window for after‑issue cancellation of an infringement notice.

• Courts. Courts are implicated indirectly through the right of election under section 21 of the Fines and Penalties (Recovery) Act 2001, which the notice must explicate (regulation 5(2)(b)). The Regulations themselves do not set court procedures, but they preserve the recipient’s right to elect court proceedings.

• Entities or persons affected by enforcement action. The Regulations explicitly list enforcement measures available under the Fines and Penalties (Recovery) Act 2001 that may follow non‑payment, e.g. suspension of driving licence, seizure of property and registration of charges on land (regulation 5(2)(c)(i)-(v)). Therefore persons who own land, receive wages, or hold driver licences may be affected by enforcement steps if they do not expiate or contest the notice.

• Administration and compliance officers. The Regulations impose specific form requirements on notices (regulation 5(1)-(3)), and transactional rules on payments (regulation 6), which will require operational arrangements and recordkeeping by whoever prepares and serves infringement notices and by the enforcement agency that processes payments.

• Parties who might be prosecuted. The Regulations expressly preserve the prosecutorial option: they do not prevent proceedings for an offence for which an infringement notice has been given unless the offence is expiated, and they do not affect liability to prosecution where no notice has been given (regulation 8(1)-(2)(b)). Prosecutors, defence counsel and accused persons therefore remain stakeholders in the enforcement ecosystem.

Several affected roles are defined only by cross‑reference (for example, “enforcement agency” per s 5 of the Fines and Penalties (Recovery) Act 2001, and the offences listed in s 291(1) and the “prescribed amount” in s 291(2) of the National Law). The Regulations therefore require practitioners to consult the National Law and the Fines and Penalties (Recovery) Act 2001 to identify, in concrete terms, the full set of affected persons and bodies in any particular case.

The Regulations create specific duties for authorities issuing notices and specific rights for persons receiving them.

Duties imposed on issuing bodies and enforcement agencies

• Content duty. An issuer must ensure that each infringement notice specifies the particulars set out in regulation 5(1): the person’s name and address (if known), the date the notice is given, the date/time/place of the alleged offence, a description of the offence, the prescribed amount and the enforcement agency to which the amount is payable. This is a mandatory content checklist for any valid notice under these Regulations.

• Explanatory duty. The issuer must include the specific explanatory statement required by regulation 5(2), informing the recipient of the right to expiate by paying within 28 days, the right to elect court proceedings under section 21 of the Fines and Penalties (Recovery) Act 2001, and examples of potential enforcement actions if the person does nothing. The wording of that explanatory statement is required to be “to the effect of” the enumerated points; it must convey these three discrete elements.

• Provision of election form. The issuer must include an appropriate form for the statement of election required by regulation 5(3). The Regulations make the inclusion of that form a formal requirement of the infringement notice.

• Payment handling rules. Enforcement agencies receiving electronic payments must accept that such payments are not effective until credited to the agency’s bank account (regulation 6(1)). Where payment is by cheque, the agency must treat payment as effected only if the cheque clears on first presentation (regulation 6(2)).

• Withdrawal procedure. The Regulatory Authority has the duty and power to issue a written withdrawal of an infringement notice; such withdrawal must be given within 28 days after the initial notice and before payment (regulation 7(1)-(2)).

Rights conferred on recipients

• Right to expiate. A person served with an infringement notice may expiate the offence and avoid further action by paying the prescribed amount to the specified enforcement agency within 28 days after the notice is given (regulation 5(2)(a)).

• Right to elect court proceedings. A recipient may elect under section 21 of the Fines and Penalties (Recovery) Act 2001 to have the matter dealt with by a court instead of under that Act by completing a statement of election and giving it to the enforcement agency specified on the notice (regulation 5(2)(b); regulation 5(3)). The notice must include the relevant form.

• Right to withdrawal. A person has a contingent right to have the notice withdrawn if the Regulatory Authority elects to issue a written withdrawal within the 28‑day, prepayment window (regulation 7).

• Right to expiate under multiple notices. Where more than one notice for the same offence has been given, the person may expiate by paying the prescribed amount in accordance with any of the notices (regulation 8(3)). This preserves the recipient’s practical ability to finalise the matter via any one of multiple notices.

Limitations on rights and duties

• No bar to prosecution. The Regulations do not prevent the commencement or continuation of proceedings for an offence for which an infringement notice has been given unless the offence is expiated (regulation 8(1)). Nor do they affect liability to be prosecuted where no notice has been given (regulation 8(2)(b)). Consequently, payment or election rights do not automatically preclude parallel or subsequent court action unless the offence has been expiated.

• Discretionary issuance. The Regulations do not require that an infringement notice be issued (regulation 8(2)(a)). The issuing of a notice remains an administrative option rather than a statutory obligation.

• Temporal limits on withdrawal. Withdrawal is possible only within 28 days and only before payment (regulation 7(2)). Once payment is made in accordance with the payment mechanics, the window for unilateral regulatory withdrawal closes.

These duties and rights define clear procedural obligations for issuers and consequential entitlements for recipients. Practitioners should note that several operative concepts are defined elsewhere (the National Law and the Fines and Penalties (Recovery) Act 2001) and that the Regulations are procedural and content‑oriented rather than setting substantive offence parameters or monetary amounts.

The Regulations themselves do not create criminal penalties or set monetary amounts; they set the means by which a designated “prescribed amount” is used to expiate specified offences and the routes by which enforcement action under the Fines and Penalties (Recovery) Act 2001 may follow non‑payment.

Enforcement mechanics and examples

• Expiation. Payment of the prescribed amount within 28 days, to the specified enforcement agency, expiates the infringement notice offence and thereby avoids further action in relation to that offence, according to the explanatory requirement that must be included on the notice (regulation 5(2)(a)). The Regulations rely on the National Law for the definition and effect of expiation (regulation 3).

• Examples of enforcement action. Where the person does nothing in response to the notice, the notice must state that enforcement action may be taken under the Fines and Penalties (Recovery) Act 2001, including (non‑exhaustively) the following measures: suspension of a driver licence; seizure of personal property; deduction from wages or salary; registration of a statutory charge on land owned by the person; making a community work order and imprisonment if the person breaches that order (regulation 5(2)(c)(i)-(v)). These examples indicate the types of coercive steps that are available once enforcement under the Fines and Penalties (Recovery) Act 2001 is engaged.

• Timing of payment. The exact moment when payment is considered to have been effected is governed by regulation 6: electronic payments are not effective until credited to the enforcement agency’s bank account (regulation 6(1)); cheques are not effective unless cleared on first presentation (regulation 6(2)). Those temporal rules affect whether an offender is treated as having expiated within the 28‑day period and therefore whether further enforcement steps are available.

Interaction with prosecutorial processes

• Concurrent proceedings permitted. The Regulations state that they do not prejudice or affect the start or continuation of proceedings for an offence for which an infringement notice has been given unless the offence is expiated (regulation 8(1)). That preserves the prosecutorial right to bring or continue criminal proceedings despite the issuance of an infringement notice, subject to statutory expiation.

• Prosecution where no notice given. The Regulations explicitly do not affect liability to be prosecuted in a court for an offence for which an infringement notice has not been given (regulation 8(2)(b)). Therefore the absence of a notice cannot be relied on as a bar to prosecution.

Multiplicity and finality

• Multiple notices. The Regulations permit more than one infringement notice for the same offence to be given to a person (regulation 8(2)(c)). Where more than one notice is given, the person may expiate by paying the prescribed amount in accordance with any of the notices (regulation 8(3)). This treats multiple notices as alternative paths to expiation rather than cumulative financial obligations.

Withdrawal and its effects

• Withdrawal window. The Regulatory Authority may withdraw an infringement notice by written notice to the person, but only if the withdrawal is issued within 28 days after the infringement notice was given and before payment of the prescribed amount has been made (regulation 7(1)-(2)). The Regulations do not specify the legal effect of a withdrawal beyond its being a written notice to the person; the practical effect is to remove the instrument that otherwise enabled expiation. The Regulations do not set any compensatory or procedural obligations following a withdrawal.

Sanctions and limits

• The Regulations do not specify fixed penalties or penalty units themselves; those figures are determined by reference to section 291(2) of the National Law (regulation 3). The coercive enforcement measures listed are those available under the Fines and Penalties (Recovery) Act 2001; the Regulations therefore rely on that Act for the range and severity of enforcement responses.

In summary, enforcement under the Regulations unfolds through expiation by payment or through enforcement action under the separate Fines and Penalties (Recovery) Act 2001, with procedural determinants, notice content, payment timing, withdrawal window and multiplicity rules, set by the Regulations.

The Regulations operate through explicit cross‑reference to two principal statutory instruments: the Education and Care Services National Law (NT) and the Fines and Penalties (Recovery) Act 2001. They do not purport to be self‑standing in many respects; they are a procedural adjunct to those laws.

Cross‑references and dependency

• Education and Care Services National Law (NT). The Regulations repeatedly refer to section 291 of the National Law. Regulation 3 defines “infringement notice” as a notice served under s 291(1), and defines “prescribed amount” as that determined in accordance with s 291(2) of the National Law. Regulation 4 then states that an “infringement notice offence” is an offence against a provision specified in s 291(1) of the National Law or prescribed for that subsection. Thus the content of s 291(1) and s 291(2) of the National Law,specifying which offences may be subject to infringement notices and the quantum of prescribed amounts, are essential to the operation of these Regulations.

• Fines and Penalties (Recovery) Act 2001. Regulation 3 references the definition of “enforcement agency” in section 5 of that Act. Regulation 5 requires that the notice include a statement that the person may elect under section 21 of the Fines and Penalties (Recovery) Act 2001 to have the matter dealt with by a court. Regulation 5(2)(c) lists examples of enforcement action that may be taken under the Fines and Penalties (Recovery) Act 2001. The Regulations therefore depend on that Act for the mechanisms, institutional roles and enforcement remedies associated with unpaid prescribed amounts.

Operational interaction

• Enforcement agency functions. Because the Regulations require payment to a specified enforcement agency and treat payment as effected only when credited to that agency’s bank account (regulation 6(1)), practical implementation requires the agency’s banking, receipting and recordkeeping systems to be aligned with the 28‑day expiation window and with the agency identity specified on the notice.

• Court election process. The Regulations require that recipients be informed of their right to elect to have the matter heard in court under the Fines and Penalties (Recovery) Act 2001 and that the notice include the form for that election (regulation 5(2)(b), (3)). The procedural step of lodging a statement of election therefore bridges from the infringement notice framework into the court system governed by the Fines and Penalties (Recovery) Act 2001 and the ordinary jurisdictional and procedural rules of courts hearing such matters.

• Regulatory Authority defined elsewhere. Regulation 7 confers withdrawal power on the Regulatory Authority, but does not define that authority. The identity, powers and administrative structure of the Regulatory Authority are matters for the Education and Care Services National Law (NT) or other primary legislation. Practitioners should therefore read the National Law in conjunction with these Regulations to establish the full chain of authority and any limits on withdrawal power.

Limitations and preservation of prosecutorial options

• No derogation of prosecution. The Regulations expressly preserve prosecutorial options under other laws. Regulation 8(1) says the Regulations do not prejudice or affect the start or continuation of proceedings for an offence for which an infringement notice has been given unless the offence is expiated. Regulation 8(2)(b) says they do not affect liability to be prosecuted in a court for an offence for which an infringement notice has not been given. Those clauses navigate the relationship between administrative expiation and criminal or regulatory prosecution.

• Multiple notices and cross‑statutory effect. Regulation 8(2)(c) permits more than one infringement notice for the same offence. Where multiple notices exist, payment under any of them expiates the offence (regulation 8(3)). The practical consequence is that the existence of multiple statutory instruments or multiple enforcement agencies might not create cumulative monetary obligations, provided the prescribed amount is paid under any valid notice.

Silos and interdependency

• Procedural role only. These Regulations are explicitly procedural, not substantive. They do not alter the substantive elements of offences under the Education and Care Services National Law (NT) nor do they change the enforcement powers under the Fines and Penalties (Recovery) Act 2001. They operate as the NT’s local instrument to give effect to the National Law’s infringement notice regime and to connect that regime to the Fines and Penalties (Recovery) Act 2001 enforcement processes.

To use the Regulations effectively, practitioners must therefore treat them and the cited Acts as an integrated system: the National Law specifies which offences and the prescribed amount; the Regulations specify notice content, payment mechanics and withdrawal rules; and the Fines and Penalties (Recovery) Act 2001 provides the enforcement architecture and the right of election to court.

The Regulations include endnote information on their legislative provenance and on specific amendments effected by later primary legislation.

• Original instrument. The Endnotes list an instrument titled “Education (Infringement Notice) Regulations 2019 (SL No. 2, 2019)” which was notified and commenced on 6 March 2019. The present Regulations are recorded “As in force at 18 December 2019” (Endnotes and heading materials).

• Amendment by Education and Care Services (National Uniform Legislation) Amendment Act 2019. The Endnotes identify the Education and Care Services (National Uniform Legislation) Amendment Act 2019 (Act No. 28, 2019). That Amendment Act received assent on 3 September 2019 and commenced on 18 December 2019 (Gazette G51, 18 December 2019, p 2) (Endnotes, list of legislation). The Endnotes also record specific regulation amendments effected by that Act: regulation 1 amended by s 14; regulation 3 amended by s 15; regulation 4 amended by s 16; regulation 7 amended by s 17 of Act No. 28, 2019 (Endnotes, list of amendments).

• Specific amendment references. The Endnotes provide the mapping of which sections of the Amendment Act altered which regulations: r 1 was amended by Act No. 28, 2019, s 14; r 3 by s 15; r 4 by s 16; r 7 by s 17 (Endnotes, list of amendments). The Endnotes do not set out the precise textual changes effected; they record only that amendments were made to those numbered regulations by the cited sections of the Amendment Act. The date on which the Amendment Act commenced (18 December 2019) is the operative date for those amendments.

• No subsequent amendments recorded in the instrument. The copy of the Regulations provided is annotated “As in force at 18 December 2019” and the Endnotes list the amendments up to that date. No later amending instruments or repeals are recorded in the supplied text. Practitioners must therefore confirm whether any further amendments have been made after that date by consulting the official legislation register.

• Drafting provenance. The Regulations are under the Education and Care Services (National Uniform Legislation) Act 2011 and were prepared to implement section 291 of the Education and Care Services National Law (NT) at the Territory level. The amendment by Act No. 28, 2019 altered specific provisions of the Regulations in sections 14-17 of that Amendment Act; the Endnotes do not state the policy reasons for those amendments.

• Commencement of regulations and related instruments. The Endnotes also note that the Education (Infringement Notice) Regulations 2019 were notified and commenced on 6 March 2019, and that the Amendment Act (No. 28, 2019) commenced on 18 December 2019. The data in the Endnotes therefore indicate two distinct commencement events relevant to the legal framework: the subordinate legislation in March 2019 and the Amending Act’s effect in December 2019.

In short, the Regulations as presented incorporate amendments made by the Education and Care Services (National Uniform Legislation) Amendment Act 2019 that took effect on 18 December 2019; the Endnotes provide the statutory citations for those amendments but not their textual detail. Users should consult the current published instrument to verify present‑day wording and any further amendments.

The supplied instrument contains no case law, adjudicative references or reported litigation relating to these Regulations. The text does not identify any judicial decisions interpreting the Regulations, nor does it cite administrative tribunal determinations. The only statutory cross‑references are to provisions of the Education and Care Services National Law (NT) (section 291(1) and (2)) and to the Fines and Penalties (Recovery) Act 2001 (section 5 and section 21), but no case law is provided on how courts have treated the interaction between these instruments.

What can be said from the instrument about litigation avenues and potential legal disputes

• Right to elect to court. The Regulations must inform recipients of their right to elect to have the matter dealt with by a court under section 21 of the Fines and Penalties (Recovery) Act 2001 (regulation 5(2)(b)). That statutory right creates the procedural mechanism by which a recipient can challenge the matter in court rather than by administrative payment, and it is the avenue by which litigated disputes about the underlying facts or law will reach judicial authorities.

• Preservation of prosecutions. The Regulations preserve prosecutorial powers and permit continuation of proceedings even after an infringement notice has been issued, unless the offence is expiated (regulation 8(1)). That express preservation creates a locus for litigation in cases where prosecutors advance charges in parallel with or subsequent to an infringement notice.

• Multiplicity and potential disputes. Regulation 8(2)(c) permits more than one infringement notice for the same offence. Regulation 8(3) allows expiation by paying the prescribed amount under any of those notices. Multiple notices may give rise to factual disputes about service, timing, or which notice the person relied upon; the Regulations do not resolve judicial processes for those disputes, so litigation may be necessary to test validity, service or procedural fairness in particular circumstances.

Limitations of the available materials

• No judicial interpretation provided. Because the instrument contains no court decisions, it does not indicate how tribunals or courts have interpreted key elements such as the adequacy of notice wording, the sufficiency of the statement of election form, the moment of payment under electronic means in tightly contested deadlines, or the scope of the Regulatory Authority’s withdrawal powers. All such matters remain open to judicial development but are not addressed in the current text.

• Reliance on external Acts for enforcement consequences. Enforcement actions listed in regulation 5(2)(c) are taken under the Fines and Penalties (Recovery) Act 2001; how courts or tribunals have applied those enforcement powers in the context of infringement notices under the National Law is not recorded in the Regulations themselves.

Practical implication for litigators and advisers

• To identify litigation history and precedential decisions, practitioners will need to search case law and tribunal records in the Northern Territory and relevant appellate courts for decisions addressing s 291 of the National Law, the Fines and Penalties (Recovery) Act 2001, and the interaction of those statutes with the infringement notice regime. The Regulations as supplied do not provide that material.

The Regulations are short and procedural but contain several provisions that generate practical risks or implementation pitfalls; these follow directly from the text.

• Prescribed amount not stated in the Regulations. The monetary amount required to expiate an offence is determined under section 291(2) of the Education and Care Services National Law (NT) and is not included in these Regulations (regulation 3). Practitioners must locate s 291(2) to know the quantum; assuming the amount from the Regulations is an error.

• Payment timing risks for electronic transfers. Regulation 6(1) states that electronic payment is not effected until the amount is credited to the enforcement agency’s bank account. Where payments are made close to the 28‑day expiry date specified on the notice, the payer bears the risk that the transfer will not be credited in time. Initiating a transfer within 28 days but arriving late to the enforcement agency’s account will not constitute payment for expiation purposes.

• Cheque clearance requirement. Cheque payments are treated as effective only if the cheque clears on first presentation (regulation 6(2)). Payers using cheques must ensure funds and banking arrangements are such that first‑presentation clearance will occur, or they risk non‑expiation.

• Limited withdrawal window. The Regulatory Authority may withdraw an infringement notice only within 28 days after the notice is given and before payment of the prescribed amount (regulation 7(2)). If the Regulatory Authority does not act quickly, or if the recipient pays promptly, the opportunity for administrative withdrawal is foreclosed.

• Multiple notices can complicate strategy. Regulation 8 permits more than one infringement notice for the same offence, and allows expiation by paying under any of the notices (regulation 8(2)(c), (3)). Multiple notices could lead to confusion over which enforcement agency is specified, which bank account must be credited, and which notice’s 28‑day period applies. Recipients and enforcement agencies must track notice identifiers and service dates carefully.

• Prosecution may proceed despite notice. Regulation 8(1) permits the start or continuation of proceedings for an offence for which an infringement notice has been given unless the offence is expiated. This means that paying the prescribed amount (to expiate) is the only clear route to prevent further proceedings; simply receiving or relying on the notice does not automatically halt criminal or regulatory prosecutions.

• The notice wording requirement is precise. Regulation 5(2) requires the notice to include a statement “to the effect of” the enumerated rights and consequences and to provide examples of enforcement action under the Fines and Penalties (Recovery) Act 2001. Inadequate explanation or failure to include the statement of election form (regulation 5(3)) could expose the issuing body to procedural challenges about the validity of the notice or the recipient’s informed choice.

• Regulatory Authority identity and powers are external. The Regulations refer to the “Regulatory Authority” (regulation 7) but do not define it. Users must identify the Regulatory Authority in the National Law to understand who may lawfully withdraw notices, and whether internal policies constrain that power.

• Enforcement agency identity matters. The notice must specify the enforcement agency to which the prescribed amount is payable (regulation 5(1)(f)), and payment is effective only when credited to that agency’s bank account (regulation 6(1)). If the notice specifies an incorrect agency or account, payment attempts may fail to effect expiation, with consequent enforcement risk.

• No requirement that a notice be issued. Because the Regulations do not require issuance of an infringement notice (regulation 8(2)(a)), a person cannot assume the administrative path will be taken before prosecution. Prosecutors may proceed without issuing an infringement notice.

• Examples of enforcement action are non‑exhaustive. Regulation 5(2)(c) lists types of enforcement action as examples; it characterises them as “including (but not limited to)”, which means other enforcement measures available under the Fines and Penalties (Recovery) Act 2001 may also be used. Recipients should not treat the list as exhaustive.

These “gotchas” are mechanical and procedural rather than substantive. They create practical decision points for recipients, issuing officers and enforcement agencies and justify close attention to notice wording, payment timing, recordkeeping, and cross‑checking the relevant provisions of the National Law and the Fines and Penalties (Recovery) Act 2001.

This section provides a practical checklist and stepwise operational guidance grounded in the Regulations’ requirements.

For issuing authorities (drafting and serving an infringement notice)

1. Confirm the offence is eligible. Before issuing, verify the offence falls within section 291(1) of the Education and Care Services National Law (NT) or is otherwise prescribed for that subsection (regulation 4). The Regulations do not expand the list; they rely on the National Law for the catalogue of eligible offences.

2. Determine the prescribed amount. Obtain the prescribed amount from section 291(2) of the National Law; do not presume a figure from the Regulations (regulation 3).

3. Identify the enforcement agency and bank account. Ensure that the enforcement agency to be specified is the agency defined under section 5 of the Fines and Penalties (Recovery) Act 2001 and that the correct bank account details are available for electronic payments to be credited (regulation 3; regulation 5(1)(f); regulation 6(1)).

4. Draft the notice to include required particulars. The notice must expressly set out each item in regulation 5(1): recipient name and address (if known); date the notice is given; date/time/place of the offence; description of the offence; the prescribed amount; and the enforcement agency to which payment is payable.

5. Include the required explanatory statement and election form. Insert a statement to the effect of regulation 5(2) telling the recipient they may pay the prescribed amount within 28 days to expiate; they may elect to go to court under s 21 of the Fines and Penalties (Recovery) Act 2001 by completing and returning a statement of election; and that enforcement action may follow non‑payment, with the specified examples. Attach a completed and appropriate statement of election form as required by regulation 5(3).

6. Verify service date and time. Ensure accurate recording of the date the notice is given for the purposes of the 28‑day expiation and withdrawal windows (regulation 5(1)(b); regulation 7(2)(a)).

7. Maintain audit trails. Keep records of the notice wording, date of issue, the enforcement agency specified, any statements of election received, payment receipts and bank credits, and any withdrawal communications from the Regulatory Authority.

For enforcement agencies (accepting and processing payment)

1. Bank credit monitoring. Because electronic payment takes effect only when the sum is credited to the enforcement agency’s bank account, set up reconciliations and timestamped receipts that confirm the credited date and time (regulation 6(1)).

2. Cheque handling policy. For cheque payments, ensure bank arrangements provide for first‑presentation clearance and document the clearance status (regulation 6(2)).

3. Receipt practice. Issue receipts showing the time and date when the amount was credited or when the cheque cleared, and ensure these receipts are matched to the specific infringement notice reference.

For recipients (responding to an infringement notice)

1. Check the notice contents. Verify the notice contains the items required by regulation 5(1). If the notice fails to include required particulars or the statement of election form, consider whether procedural remedies exist.

2. Identify the prescribed amount and recipient enforcement agency. Confirm the prescribed amount by reference to the National Law (s 291(2)) and the enforcement agency specified on the face of the notice (regulation 5(1)(e)-(f)).

3. Decide whether to expiate or elect to go to court. If electing court proceedings under s 21 of the Fines and Penalties (Recovery) Act 2001, complete the statement of election form included with the notice and give it to the specified enforcement agency within any time limits provided in the Fines and Penalties (Recovery) Act 2001. If paying, ensure payment will be effective within 28 days.

4. Timing of payment. For electronic payments, initiate transfers with sufficient lead time so the prescribed amount will be credited to the enforcement agency’s bank account before the 28‑day deadline (regulation 6(1)). For cheques, ensure funds and banking arrangements support clearance on first presentation (regulation 6(2)).

5. Preserve evidence. Keep proof of payment credit or cheque clearance and of any statement of election lodged. Where payment is via electronic means, obtain and preserve the enforcement agency’s acknowledgement of credit.

6. Monitor for withdrawal by the Regulatory Authority. Be aware the Regulatory Authority may withdraw the notice in writing within 28 days and before payment (regulation 7). If notice is withdrawn, confirm in writing with the Regulatory Authority and retain that correspondence.

General compliance practices

• Cross‑check primary Acts. Because many operative definitions and the prescribed amount are located in the Education and Care Services National Law (NT) and the Fines and Penalties (Recovery) Act 2001, consult those statutes for full compliance obligations and for the mechanics of court election, enforcement measures and the definition of the enforcement agency.

• Establish internal timelines. Create procedures that ensure notices are drafted correctly, payments are reconciled promptly and any withdrawal notices from the Regulatory Authority are acted upon within statutory timeframes.

• Train staff on payment timing. Staff responsible for receiving and processing payments must understand that electronic transfer initiation is not the same as credited arrival and that cheques require first‑presentation clearance.

• Ensure forms are available and accurate. The Regulations require inclusion of a statement of election form on each notice (regulation 5(3)). Ensure the form is available, complete and compliant with any requirements in the Fines and Penalties (Recovery) Act 2001.

• Keep clear records for prosecutions. Because the Regulations do not preclude prosecution where an infringement notice has been issued (regulation 8(1)), maintain complete records that prove expiation or election status in case of subsequent court proceedings.

• Manage multiple notices. Where multiple infringement notices exist for the same offence, track which notices have been served, their service dates, and which notice a payment relates to, even though payment under any notice expiates the offence (regulation 8(3)).

Checklist summary (must‑do items)

• Verify offence eligible under s 291(1) National Law before issuing or responding (regulation 4).
• Ensure notice contains required particulars (regulation 5(1)).
• Include the explanatory statement and the statement of election form (regulation 5(2)-(3)).
• For payers, ensure electronic payment is credited to agency account within 28 days, or cheque clears on first presentation (regulation 6).
• Regulatory Authority withdrawal window is 28 days and prepayment (regulation 7).
• Be aware prosecutions may proceed unless the offence is expiated (regulation 8).

Following these steps aligns operational practice with the precise procedural obligations set out in the Regulations and reduces the risk of contested enforcement outcomes.
