287A Transitional provision for Education and Care Services National Law, Part 6A

287A Transitional provision for Education and Care Services National Law, Part 6A

(1) This regulation applies if, immediately before the commencement of this regulation, an authorisation to use, possess or control a device at an education and care service was in force under a Ministerial direction.

(2) From the commencement, the authorisation—

(a) is taken to be an authorisation granted under the relevant provision; and

(b) may be varied, suspended or revoked under the relevant provision as if the authorisation had been granted under the relevant provision.

(3) Subject to subregulation (2)(b), the authorisation—

(a) continues in force subject to any conditions or limitations applied by the Ministerial direction; and

(b) if the authorisation was subject to an expiry date under the Ministerial direction—ends on that date.
