173AA Display and publication of quality and compliance history [NSW]

(1) For the National Law (NSW), section 172(1)(f) and (2)(f), the approved provider’s quality and compliance history is prescribed.

(2) The quality and compliance history for an approved provider includes the following actions and the provision of the National Law (NSW) or these regulations that was contravened that resulted in the taking of the action—

(a) the giving of a compliance direction or a compliance notice to the approved provider;

(b) a prosecution of the approved provider, or a nominated supervisor for the education and care service, initiated for an offence against the National Law (NSW) or these regulations, whether or not the proceedings for the prosecution have been completed;

(c) the issuing of an infringement notice to the approved provider or a nominated supervisor for the education and care service;

(d) the acceptance of an enforceable undertaking given by the approved provider or a nominated supervisor for the education and care service;

(e) the giving of an emergency action notice to the approved provider;

(f) any amendment of the approved provider’s provider approval or service approval made for enforcement purposes;

(g) the emergency removal of children under the National Law (NSW), Part 7, Division 4 from the approved provider’s education and care service premises;

(h) the giving of a direction under the National Law (NSW), section 171 to exclude persons from the approved provider’s education and care service premises;

(i) the giving of a prohibition notice to the approved provider or a nominated supervisor for the education and care service.

(3) For the National Law (NSW), section 172(3), the quality and compliance history must also be published digitally.
