sec.41 Application of Commonwealth Ombudsman Act

The Ombudsman Act 1976 (Cwlth) applies under the Education and Care Services National Law (Queensland) , section 282 as if a reference in the applied provisions to the Administrative Review Tribunal were a reference to QCAT. This Act is taken to be an enabling Act under the QCAT Act that confers jurisdiction on QCAT by applying the Ombudsman Act 1976 (Cwlth) as mentioned in subsection (1) . To remove any doubt, it is declared that QCAT has the jurisdiction mentioned in subsection (2) even to the extent the jurisdiction is not original, review or appeal jurisdiction. s 41 amd 2024 No. 47 s 78 sch 2 (sec.41-ssec.1) The Ombudsman Act 1976 (Cwlth) applies under the Education and Care Services National Law (Queensland) , section 282 as if a reference in the applied provisions to the Administrative Review Tribunal were a reference to QCAT.
