Education and Care Services National Law (ACT) Act 2011

Adoption mechanism: The core concept is statutory adoption by reference. Section 6(1) brings the national law into the ACT statutory regime by declaring it to apply “as a territory law” and “as if it were part of this Act”. That means the national law’s content, including offences, obligations, approvals, regulatory powers and the national regulatory framework, operate in the ACT subject to the modifications and mappings contained in this Act.

Participating-jurisdiction treatment and selective application: The Act records the Territory as a participating jurisdiction for the national law (s 6(2)(a)) and specifically brings in national-law Part 4 (approval in principle for premises located in certain buildings) to apply here (s 6(2)(b)). The Act selectively excludes or preserves particular national-law provisions: s 6(3) expressly applies national-law s 49A as territory law; s 6(7) and (8) remove s 303(4) and s 340 from the local operation of the national law while retaining s 303(5) and s 304. The main conceptual outcome is that the ACT accepts the national scheme but controls which parts and which mechanisms of parliamentary/regulatory scrutiny and transitional arrangements apply locally.

Legislative referral and oversight mechanics: The Act embeds a two-way dependency with Victorian Parliament activity. Victorian amendments to the national law will operate in the ACT unless presented to the ACT Legislative Assembly and disallowed by the Assembly (s 6(4)-(6)). The Act creates an inter-parliamentary presentation and disallowance mechanism: Victorian amendments must be presented to the ACT Assembly, and the Assembly can disallow them within the same period as a disallowable instrument (s 6(4)-(5)). If not presented or disallowed, those amendments are treated as not applying in the ACT (s 6(6)).

Local definitions and cross-references: Section 8 maps several generic terms used in the national law to specific ACT sources. For example, “child protection law” is the Children and Young People Act 2008; “registered teacher” is a registered teacher under the ACT Teacher Quality Institute Act 2010; “this jurisdiction” is the ACT (s 8). Sections 11-17 then identify local Acts that are to be treated as relevant laws for the national law, such as the Education Act 2004 and the Working with Vulnerable People (Background Checking) Act 2011. Section 17A maps Part 4 building law and Part 4 planning law to the Building Act 2004 and the Planning Act 2023, respectively.

Regulatory authority and judicial forum mapping: The Act designates the director-general as the Regulatory Authority (s 10). It specifies that the Magistrates Court and the ACT Civil and Administrative Tribunal (ACAT) are the relevant courts/tribunals for particular national-law provisions (s 9): the Magistrates Court is the relevant court for national-law s 181, and ACAT is declared the relevant tribunal for national-law Part 8. These mappings determine where enforcement proceedings, review applications and infringement mechanisms under the national law will run locally.

Transparency and procedural carve-outs: The Act’s exclusion of certain Territory laws from applying to the national law or instruments is a significant structural concept (s 7). In particular, the Freedom of Information Act 2016 and the Information Privacy Act 2014 are listed in s 7(1) as not applying to the national law or instruments made under it, which mechanically removes those statutory access and privacy regimes from objects created under the national law. Other public-sector accountability statutes are similarly excluded as to the national law, except to the extent the national law applies to the Regulatory Authority (s 7(3)).

Timing and transition of approvals: The local rule requiring applicants to seek approval in principle before a planning or building application is lodged creates a procedural sequencing requirement (s 17B). The transitional Part 10 qualifies the retrospective reach of certain new grounds for refusal (national-law s 49A) for applications where planning or building approval applications were already lodged before the commencement day (s 51), and Part 10 has a limited five-year life (s 52).

Penalties and enforcement note: The Act confirms that penalties specified at the end of provisions in the national law indicate the maximum penalty on conviction for contravention (s 18). The front-matter records the penalty unit values in force at the republication date ($160 for individuals, $810 for corporations), which controls monetary calculations of fines unless changed under the Legislation Act 2001.

Service providers and applicants for approvals: The Act directly governs entities that operate or seek to operate education and care services in the ACT because it brings the national law into local force and sets local procedural requirements. Applicants for an approval in principle must make that application to the Regulatory Authority prior to lodging the relevant development or building approval application (see s 17B). The transitional provision in s 51 creates tailored treatment for applicants who had already lodged building or planning applications before the commencement day, so some applicant cohorts are temporarily exempt from the national-law s 49A ground for refusal.

The Regulatory Authority and its staff: The director-general is designated the Regulatory Authority (s 10), and the Act frames the application of the national law and instruments to the Regulatory Authority. Section 7(3) says a group of public-sector statutes do not apply to the national law or instruments except to the extent the national law and instruments apply to the Regulatory Authority and its employees, decisions, actions and records; thus the Regulatory Authority remains a primary decision-maker and enforcer under the national law, and is the interface for applications, approvals and compliance. That body will need internal processes and resourcing to administer approvals in principle, service approvals, enforcement and record-keeping consistent with both the national law and the mapping set out here.

Planning and building regulators: Because the Act links the timing of applications for approvals in principle to planning and building approvals (s 17B),and maps “Part 4 planning law” and “Part 4 building law” to the Planning Act 2023 and Building Act 2004 respectively (s 17A),planning and building regulators and applicants will be affected by sequencing obligations. Developers, builders and owners proposing premises to be used as education and care services must coordinate with the director-general/Regulatory Authority to secure the approval in principle prior to lodging their planning or building applications.

Parents and children: The substantive obligations and standards that will govern education and care services operate under the national law adopted by this Act. While the national law schedule contains those operational requirements, this Act shapes how those requirements are implemented locally (for example, who the regulator is, what “child protection law” is in the ACT, and the court/tribunal routes for enforcement and review). Parents and children are therefore indirectly affected through the regulatory outcomes carried out by the Regulatory Authority under the adopted national law.

Public-sector accountability bodies and oversight entities: The Act removes a number of Territory accountability statutes from applying to the national law or instruments made under it (s 7(1)-(3)). The Freedom of Information Act 2016 and the Information Privacy Act 2014 are stated not to apply to the national law or instruments (s 7(1)(b)-(c)). A set of other public-sector statutes (annual reports, Auditor-General, Financial Management, Ombudsman, Public Sector Management and Territory Records Acts) are excluded from applying to the national law or instruments insofar as those instruments do not apply to the Regulatory Authority (s 7(3)). Those bodies and statutes therefore face narrower formal powers to access, audit or scrutinise materials that exist purely under the national law and associated instruments, unless those instruments apply to the Regulatory Authority.

Legislative actors: The ACT Legislative Assembly has a formal role in scrutinising and disallowing Victorian amendments to the national law that would otherwise apply in the ACT (s 6(4)-(6)). Victorian Parliament activity therefore has a de facto impact on the ACT’s regulatory law, subject to the presentation and disallowance regime established by the Act.

Legal practitioners, accountants and compliance advisers: Professionals who draft applications for service approval, or advise operators on regulatory compliance, must work with the hybrid framework created by the adoption of the national law and the local mappings and carve-outs in this Act. They must understand sequencing obligations (s 17B), transitional exclusions (Part 10), local definitions (s 8), and the limited application of Territory FOI and privacy statutes to instruments under the national law (s 7(1)).

Adopted national-law duties and rights: The Act itself does not restate the full regulatory obligations; rather, it adopts the Education and Care Services National Law so that the substantive duties and rights (service standards, staffing ratios, qualification requirements, approval conditions, incident reporting, sanctions, review rights, etc.) in the national law operate in the ACT (s 6(1)). Practitioners should therefore read the national law schedule in conjunction with this Act to determine the precise operational obligations and rights.

Timing duty for approvals in principle: Section 17B imposes a procedural duty on prospective education and care service applicants: an application for approval in principle must be made to the Regulatory Authority not later than the day before an application for development approval under the Planning Act 2023 is made, or, where no development approval is required, the day before a building-approval application is made under the Building Act 2004. This is an administratively binding sequencing requirement; failure to lodge in the prescribed order may expose applicants to the consequences in the national law (for example, as to mandatory refusal grounds where those apply).

Regulatory Authority decision-making powers and responsibilities: The director-general, as Regulatory Authority (s 10), holds the decision-making role under the national law framework as applied in the ACT. That role includes receiving applications for approvals in principle and service approvals, making compliance and enforcement decisions under the national law, and administering any licensing/registration regime that the national law prescribes. The Act maps other local laws to the national-law definitions (s 8 and ss 11-17A), meaning the Regulatory Authority must interpret and apply those local statutes to give meaning to national-law terms (for example, assessing background check obligations under the Working with Vulnerable People (Background Checking) Act 2011, s 16-17).

Rights of review and remedy: The Act identifies relevant judicial or quasi-judicial forums; for national-law s 181 the Magistrates Court is the relevant court, and ACAT is declared to be the relevant tribunal for national-law Part 8 (s 9). Those clauses determine where decisions under the national law can be challenged or enforced locally. The national law itself contains rights of review and appeal that will now operate subject to these forum mappings.

Presentation/disallowance and legislative oversight rights: Section 6(4)-(6) gives the ACT Legislative Assembly a right to be presented with Victorian amendments and a right to disallow those amendments in the same manner and period as a disallowable instrument. Practically, this gives the Assembly an oversight mechanism to prevent automatic importation of Victorian amendments to the national law, provided the Assembly exercises the disallowance power within the prescribed time.

Transparency and privacy carve-outs affecting rights: The Act expressly excludes the Freedom of Information Act 2016 and Information Privacy Act 2014 from applying to the national law and instruments (s 7(1)(b)-(c)). Mechanically, documents and instruments created under the national law will not be subject to those Territory access or information-privacy regimes. That exclusion affects the statutory right of external parties to request access or assert privacy obligations with respect to national-law material; however, the extent of the exclusion will be constrained where national law and instruments apply to the Regulatory Authority, because s 7(3) retains the operation of a set of public sector statutes to the extent the national law and instruments apply to the Regulatory Authority and its employees, decisions and records.

Penalty exposure and calculation: Section 18 confirms that a penalty specified at the end of a provision of the Education and Care Services National Law (ACT) indicates the maximum penalty on conviction. The front-matter of the republication records the penalty unit values in force at republication ($160 per unit for individuals; $810 per unit for corporations), which are used to calculate pecuniary fines for offences under the national law where relevant.

Transitional rights/exemptions: Part 10 creates transitional treatment for certain applications: where before, on or after the commencement day an application for service approval is made but a planning or building approval application for the premises was made before the commencement day, national-law s 49A (additional ground for refusal, mandatory approval in principle) does not apply to the application for service approval (s 51). That is a discrete protective right for applicants who had already begun the building/planning process before the commencement day; that transitional protection expires with Part 10 five years after the commencement day (s 52).

Regulation-making power and subordinate-rights framework: Section 19 gives the Executive a power to make regulations for this Act. That power enables the Executive to prescribe procedural and subsidiary matters necessary to give effect to the Act and the adopted national law, and thereby creates rights and duties contained in subordinate instruments.

Penalty structure reference: This Act does not list the substantive offences or in-prescription penalty quantum for most behaviours; instead, s 18 specifies that where a penalty is set at the end of a provision in the Education and Care Services National Law (ACT), that penalty identifies the maximum sanction on conviction for contravention. The Act’s front-matter notes the penalty unit values at the republication date , $160 for an individual and $810 for a corporation (refer Legislation Act 2001, s 133, noted in the republication preface). Therefore, monetary penalties specified in the national law must be computed using the applicable penalty unit value in force at the time of breach unless changed by law.

Enforcement actors and forums: The director-general, as Regulatory Authority, will be the principal administrative enforcement actor under the adopted national law (s 10). For court or tribunal enforcement or review, the Act identifies local forums: for national-law s 181 the Magistrates Court is the relevant court, and ACAT is declared the relevant tribunal for national-law Part 8 (s 9). Those mappings govern where prosecutions for offences, enforcement applications and merits review or administrative appeals under the national law will be heard in the ACT.

Infringement and enforcement law mapping: Section 14 maps infringements-law concepts for the national law to the Magistrates Court Act 1930, part 3.8, designating that part as an “infringements law” for national-law purposes. This identifies the local statutory framework under which infringement notices and expiation processes under the national law will operate.

Limits on certain oversight mechanisms: The Act’s exclusions of particular Territory laws from applying to the national law and instruments affect enforcement visibility and accountability. The Freedom of Information Act 2016 and the Information Privacy Act 2014 are excluded from applying to the national law or instruments made under it (s 7(1)(b)-(c)). As a result, enforcement actions, administrative documents and instruments created solely under the national law would not be subject to statutory FOI or Information Privacy Act processes, which changes the procedures by which third parties can obtain records related to enforcement or compliance activity stemming from the national law.

Application to the Regulatory Authority: Section 7(3) carves out a list of public-sector statutes (annual reports, Auditor‑General, Financial Management, Ombudsman, Public Sector Management and Territory Records Acts) from applying to the national law and its instruments, except to the extent the national law and instruments apply to the Regulatory Authority and its employees, decisions, actions and records. That means when the national law applies to the Regulatory Authority, some of those oversight regimes may still reach Regulatory Authority conduct, creating an enforcement and accountability link back to standard public-sector controls, but only insofar as the national law and its instruments apply to the Regulatory Authority.

Consequences of Victorian amendments and disallowance on enforcement: The mechanism in s 6(4)-(6) for presentation and possible disallowance of Victorian amending laws can generate legal uncertainty for regulated entities and enforcement authorities because legislative changes made by Victoria may apply in the ACT unless presented and disallowed. If a Victorian amending law is not presented, or is disallowed, s 6(6) takes the amending law not to be included in the ACT application of the national law. For enforcement actors, that mechanism might affect whether newly created sanctioning powers or changed enforcement procedures in Victorian amendments are available locally.

Regulation-making power and subordinate enforcement instruments: Section 19 authorises the Executive to make regulations for the Act. The Act therefore contemplates that some enforcement procedures, application fees, forms or other subordinate enforcement mechanisms can be made by regulation; such regulations must be notified and presented to the Legislative Assembly under the Legislation Act (s 19 note). The content of those regulations will shape practical enforcement.

Mapping of local statutes into national-law definitions: The Act systematically maps local ACT statutes into the generic terms used in the Education and Care Services National Law. Section 8 gives specific mappings , for example, “child protection law” is the Children and Young People Act 2008; “registered teacher” maps to the ACT Teacher Quality Institute Act 2010; “superior court” maps to the Supreme Court; “this jurisdiction” is the ACT. Sections 11-13 declare the Children and Young People Act 2008 chapter 20 and the Education Act 2004 as a children’s services law and an education law (ss 11-12), and ss 13-17 identify other local statutes as the local counterparts for national-law definitions: Magistrates Court Act 1930 (infringements law, s 14), Public Sector Management Act 1994 (public sector law, s 15), Working with Vulnerable People (Background Checking) Act 2011 (working with children/vulnerable people law, ss 16-17).

Interaction with planning and building law: The Act expressly maps Part 4 building law to the Building Act 2004 and Part 4 planning law to the Planning Act 2023 (s 17A). Section 17B then creates a sequencing rule for approvals in principle, requiring applicants to seek an approval in principle from the Regulatory Authority prior to lodging development or building approval applications under those mapped Acts. In practice, this creates a cross-agency procedural dependency: planning and building approvals will be contingent on an earlier step under the national-law administration, and administrative processes and timing across the Regulatory Authority and planning/building agencies must be coordinated.

Exclusions from Territory statutes and effects on access and oversight: Section 7 creates significant interactions by excluding several Territory statutes from applying to the national law or instruments under it. The Criminal Code 2002, Freedom of Information Act 2016 and Information Privacy Act 2014 are listed in s 7(1) as not applying to the national law or to instruments made under that law. The practical effect is that FOI and Information Privacy Act obligations do not attach to materials and instruments that are solely products of the national law regime. Separately, several public-sector oversight statutes do not apply to the national law and instruments except to the extent the national law and instruments apply to the Regulatory Authority (s 7(3)). This produces a bifurcation in how national-law materials are treated: documents and instruments that are purely national-law outputs will in some respects sit outside certain Territory transparency and oversight regimes, whereas documents and actions that implicate the Regulatory Authority may attract the specified public sector oversight statutes.

Legislative interplay with Victorian amendments: The Act creates a cross-jurisdictional legislative feedback loop: the national law as amended by the Victorian Parliament can affect ACT law, but the Act requires presentation of Victorian amending laws to the ACT Legislative Assembly and allows disallowance (s 6(4)-(6)). If a Victorian amendment is not presented, or is disallowed, s 6(6) treats the national law applying in the ACT as not including those amendments. This mechanism means that Victorian parliamentary action interacts with ACT law subject to an ACT oversight check. It also creates a dependence of the ACT’s statutory content on the Victorian parliamentary calendar and processes insofar as the national law remains materially updated in Victoria.

Interaction with administrative law remedies: The Act specifies the relevant courts and tribunals that will handle review and enforcement for specified national-law provisions (s 9). That determines where judicial review, merits review and enforcement will sit in the ACT and frames the interaction between the national-law remedies and ACT administrative law routes.

Regulation-making interaction: Section 19 permits the Executive to make regulations for this Act; those regulations must be notified and presented under the Legislation Act. That creates a subordinate-law layer that will interact with the national law’s content and the local maps and carve-outs in this Act.

Transitional interaction: Part 10 modifies how national-law s 49A applies to certain pending service-approval applications (s 51) and is itself time-limited (s 52). Practitioners must therefore assess interactions between national-law mandatory-refusal grounds and pre-existing planning or building application timelines, with that interaction determined by Part 10 for a five-year transitional window.

Chronology and key enactments: The Act’s endnotes record its legislative history and amendments. The Act was notified LR 3 November 2011, with remainder commencing 1 January 2012 (legislation history). Key subsequent amendments that appear in the endnotes include:

• Statute Law Amendment Act 2013 (No 2) A2013-44, notified 11 November 2013, with sch 1 pt 1.1 commencing 25 November 2013 (legislation history and amendment history note s 6 amended A2013-44 amdt 1.1).
• Freedom of Information Act 2016 A2016-55 (sch 4 pt 4.9), notified 26 August 2016, with sch 4 pt 4.9 commencing 1 January 2018; later affected by A2017-14 (see legislation history).
• Justice and Community Safety Legislation Amendment Act 2017 (No 2) A2017-14, notified 17 May 2017, with s 19 commencing 24 May 2017 (legislation history).
• Statute Law Amendment Act 2021 A2021-12, notified 9 June 2021, with sch 3 pt 3.12 commencing 23 June 2021; the dictionary was amended by A2021-12 (amendment history).
• Education and Care Services National Law (ACT) Amendment Act 2024 A2024-33, notified 10 July 2024. Section 1 and 2 commenced 10 July 2024; several provisions (including s 5, s 7, s 8, s 13) commenced 10 October 2024 and the remainder commenced 11 July 2024 (legislation history). Amendment A2024-33 inserted s 17A and s 17B and created Part 10 transitional provisions (amendment history).

Specific amendment mechanics created by 2024 changes: The A2024-33 changes inserted Part 10 (Transitional,Applications for service approval) (ss 50-52), and inserted s 17A (Part 4 building law and Part 4 planning law) and s 17B (Application for approval in principle) (amendment history). The amendment history notes that the Part 10 transitional provisions expire five years after the commencement day (s 52).

Expiry and transitional expiries: The amendment history records several expiries of transitional provisions over time. For example, earlier transitional provisions (parts of pt 4 and related definitions) expired on 1 January 2015; the amendment history tracks those prior expiries. The newly inserted Part 10 will expire five years after the commencement day (s 52), with the effect that the transitional protection in s 51 will be time-limited.

Presentation and disallowance mechanism preserved: Section 6 was amended in 2013 and again in 2024 (amendment history notes s 6 amended A2013-44 and A2024-33). The current s 6(4)-(6) creates the requirement that Victorian amending laws be presented to the Assembly and exposes them to a disallowance procedure, a mechanism that has been part of the Act through the amendment history.

Dictionary amendments: The dictionary was amended under A2021-12 (see amendment history: dict am A2021-12 amdt 3.29, amdt 3.30). The dictionary provides the local definitions necessary to interpret the national law in the ACT context.

Record of republications: The endnotes list several republications (R1-R10) and map when the Act was republished, and identify which amendments had taken effect at each republication (endnotes 5). The latest republication in the material is Republication No 10 effective 10 October 2024, reflecting amendments up to A2024-33.

How the amendment process operates mechanically now: Victorian amendments to the national law must be presented to the ACT Legislative Assembly (s 6(4)). The Assembly may disallow the amending law within the same period that a disallowable instrument may be disallowed (s 6(5); cf Legislation Act, s 65). If not presented or disallowed, the Act provides that the national law applying in the Territory is taken not to include the amendments and to include any provisions repealed or amended by the amending law as if the amending law had not been made (s 6(6)). The endnotes record the multiple amendments over time and show the modern framework is the product of iterative amendment.

No cases or litigation are recorded in this republication of the Act. The text and endnotes of the Education and Care Services National Law (ACT) Act 2011, including the schedule adoption mechanism and mapping provisions, do not list any court decisions, tribunal decisions or judicial interpretations. The endnotes set out legislative and amendment history, republication chronology and modifications, but do not record any reported litigation under this Act or the national law as applied in the ACT.

Practical implication for practitioners: Because the Act itself is primarily an adopting and mapping instrument rather than the substantive regulatory text, case law that interprets the national law’s operative provisions will generally arise from decisions applying the national law provisions themselves. Under s 6(1) the national law “applies as a territory law” and “as if it were part of this Act”. Therefore, ACT litigation will turn on the national law’s provisions as adopted and any local modifications. Where dispute resolution or judicial review occurs in the ACT, s 9 establishes the local forums for specified national-law provisions: the Magistrates Court for national-law s 181 and ACAT for national-law Part 8. Practitioners should monitor decisions of those forums for interpretations of how national-law obligations operate locally.

Advice on searching for precedent: Because the national law is a cross-jurisdictional instrument, authoritative interpretation may come from Victorian or other participating-jurisdiction courts or tribunals. However, the Act’s mapping provisions and the presentation/disallowance mechanism (s 6(4)-(6)) mean that Victorian amendments may not automatically apply in the ACT. Any litigation history relevant to national-law provisions adopted into ACT law will have to be read against the specific text of the national law as it applies in the ACT at the time of the dispute.

FOI and privacy carve-out: Section 7(1) expressly provides that the Freedom of Information Act 2016 and the Information Privacy Act 2014 do not apply to the Education and Care Services National Law (ACT) or instruments made under that Law. Mechanically, that removes the statutory right to seek access to, or complain about the handling of, documents and personal information that are purely products of the national law or the instruments made under it. Practitioners should not assume FOI or Information Privacy Act processes are available for materials created under the national law; this can affect discovery, information-gathering and transparency expectations. The Act does not, in s 7(1), carve out an exception for the Regulatory Authority in relation to FOI or privacy, so the statutory exclusion applies to national-law instruments and materials unless those instruments apply to the Regulatory Authority and are therefore subject to other public-sector statutes under s 7(3).

Distinction between instruments and Regulatory Authority records: Section 7(3) excludes several public sector laws from applying to the national law or instruments made under it, except to the extent the national law and those instruments apply to the Regulatory Authority and its employees, decisions, actions and records. That means material that the national law applies to the Regulatory Authority may still fall within oversight regimes (for example, Ombudsman or Auditor-General), but material that is purely national-law instrument content and does not apply to the Regulatory Authority will sit outside those oversight statutes. The boundary between “instrument that applies to the Regulatory Authority” and “instrument that does not” may be fact-sensitive and therefore a source of litigation or administrative uncertainty.

Dependency on Victorian parliamentary action and presentation/disallowance timing: The mechanism in s 6(4)-(6) can create timing and content uncertainty. Victorian amendments to the national law will normally apply in the ACT unless presented and disallowed by the ACT Legislative Assembly. If an amendment is made in Victoria and either not presented to the Assembly or disallowed, s 6(6) treats the amending law not to be included in the ACT application. Parties need to track Victorian legislative activity and the presentation/disallowance status in the ACT, because whether a particular national-law amendment is in force in the ACT depends on a cross-parliamentary process. This produces a risk that statutory text differs between Victoria and the ACT for the same-named national law provision at any given time.

Sequencing risk for planning/building approvals: Section 17B requires an approval-in-principle application to be made to the Regulatory Authority not later than the day before lodging a development application under the Planning Act 2023, or the day before applying for building approval under the Building Act 2004. Practically, that creates a tight sequencing obligation: applicants who lodge planning or building applications before obtaining an approval in principle risk the national-law consequences (including, potentially, mandatory refusal grounds such as national-law s 49A if applicable). The transitional s 51 provides temporary relief for certain pre-existing applicants, but that relief expires with Part 10 five years after the commencement day. Practitioners must sequence lodgements carefully to avoid procedural non-compliance.

Ambiguities about which Territory statutes continue to apply: The Act excludes the Legislation Act 2001 from applying to the national law and instruments made under it via s 7(1)(d), but s 7(2) clarifies that subsection (1)(d) does not limit the application of the Legislation Act to this Act. The interplay of those lines creates a subtle drafting point: the Legislation Act still applies to the Education and Care Services National Law (ACT) Act 2011 itself, but not generally to the national law and its instruments. This technical distinction can create confusion about how the Legislation Act’s procedures and instrument-making rules apply in practice to national-law instruments in the ACT context.

Transitional expiry risks: Part 10 provides transitional protection that excludes national-law s 49A from applying to certain applications where a development or building approval application had already been lodged before the commencement day (s 51). But Part 10 expires five years after the commencement day (s 52). Operators relying on the transitional carve-out must be aware the protection is time-limited. After the expiry, the national-law s 49A ground may apply in all cases as the national law, as adopted, provides.

Penalty calculation depends on external values: While s 18 clarifies the meaning of penalties at the end of national-law provisions, the actual monetary values hinge on penalty unit values determined elsewhere (not in this Act). The republication notes the penalty unit values at the republication date, but practitioners must check current penalty unit values and any changes to the Legislation Act when assessing financial exposure.

Regulatory Authority centralisation: The designation of the director-general as the Regulatory Authority (s 10) centralises regulatory control in a public-service official. For applicants and operators, this means the director-general’s office controls approvals in principle and service approvals. That centralisation has practical consequences for resourcing, response times and administrative practices; the Act does not set detailed administrative-process times in itself, though regulations may do so (s 19).

No litigation guidance in the Act: Because the Act primarily adopts and maps the national law, it contains no case law built into it. Practitioners must work from the national law text as applied and seek jurisdictional decisions elsewhere where interpretive questions arise; the Act’s mappings (e.g. relevant tribunal or court, s 9) should be checked against the national law’s remedies.

Step 1 , identify which legal texts you must follow: Compliance begins by treating the Education and Care Services National Law as territory law in the ACT (s 6(1)). Read the national law schedule side‑by‑side with the local mappings in this Act: definitions in s 8, children’s services/education law mappings in ss 11-13, the Working with Vulnerable People Act mapping in ss 16-17, and the building/planning mapping in s 17A. The director-general is the Regulatory Authority (s 10) and will be the decision‑maker for approvals and compliance matters.

Step 2 , sequence applications correctly: If you are proposing premises to be used for an education and care service, lodge an application for an approval in principle with the Regulatory Authority before lodging your development approval under the Planning Act 2023, or where no development approval is required, before lodging your building approval application under the Building Act 2004 (s 17B). Ensure the “day before” requirement is met in practice by maintaining filing records and receipts that demonstrate the correct sequence.

Step 3 , check transitional protections if relevant: If you submitted a development or building approval application before the commencement day and you are applying for service approval on or after the commencement day, confirm whether s 51’s transitional exclusion of national-law s 49A applies to your application. That transitional protection is time-limited by s 52 which causes Part 10 to expire five years after the commencement day. Do not rely on the protection beyond the expiry period.

Step 4 , understand privacy and access limits: Do not assume FOI or Information Privacy Act processes apply to documents or instruments created solely under the national law and instruments made under it (s 7(1)(b)-(c)). If you require access to records or expect privacy protections for national-law material, determine whether the instrument or document in question applies to the Regulatory Authority (in which case s 7(3) may preserve applicable public-sector statutes) or whether it is purely a national-law instrument outside those regimes.

Step 5 , prepare for the Regulatory Authority’s administrative requirements: The director-general will administer approvals, compliance notices, and possibly enforcement actions. Ensure your applications meet the national law’s substantive criteria and any procedural requirements set by regulations (s 19). Keep accurate records of applications and communications with the Regulatory Authority, since oversight statutes may apply to the Regulatory Authority and its records where the national law applies to it (s 7(3)).

Step 6 , address background-check and child-protection obligations: Map the national-law terms to the local statutes identified in s 8 and s 16-17. For example, working-with-children/vulnerable-people checks are governed by the Working with Vulnerable People (Background Checking) Act 2011 (ss 16-17). Child-protection interactions should be handled according to the Children and Young People Act 2008 where the national law refers to “child protection law” (s 8).

Step 7 , calculate penalty exposure correctly: Where an offence is specified in the national law with a penalty at the end of a provision, calculate the pecuniary amount using the current penalty unit value (s 18). The republication records penalty unit values at a point in time, but you must confirm the current values under the Legislation Act or any later amendments.

Step 8 , monitor Victorian amendments and ACT presentation/disallowance events: Because the national law is maintained in Victoria and Victorian amending laws may apply in the ACT unless presented and disallowed, practitioners should track Victorian amendments and the presentation status to the ACT Legislative Assembly (s 6(4)-(6)). If a Victorian amendment is relevant to your compliance obligations, verify whether it has been presented to and either accepted or disallowed by the ACT Assembly.

Step 9 , identify the correct forum for challenges and enforcement: For review or enforcement matters linked to specified national-law provisions check s 9: the Magistrates Court is the relevant court for national-law s 181; ACAT is declared the relevant tribunal for national-law Part 8. Ensure appeals, judicial-review and enforcement steps are directed to the appropriate tribunal or court.

Step 10 , engage regulatory and legal advisers early: Given the Act’s cross-references to planning, building, child-protection checks, and the potential absence of FOI/privacy access to national-law material, involve regulatory lawyers, planning/building advisers and compliance experts early in the project lifecycle. They should draft application material that demonstrates compliance with national-law standards and the ACT mappings, confirm the timing of submissions to meet s 17B, and advise on record-keeping practices that take account of the Act’s carve-outs in s 7.

Step 11 , watch for regulations: The Executive can make regulations for this Act (s 19). Check for any regulations that set fees, forms, application processes, timeframes or additional compliance obligations for the national law as applied in the ACT. Regulations must be notified and presented to the Legislative Assembly under the Legislation Act, so changes can occur at the subordinate-instrument level and affect compliance processes.

Step 12 , prepare for oversight where the national law applies to the Regulatory Authority: When national-law instruments apply to the Regulatory Authority and its employees, the public-sector statutes listed in s 7(3) may reach those activities. Keep contemporaneous records of Regulatory Authority interactions and ensure internal procedures for reporting and record-keeping meet public-sector expectations where they apply.

By following these steps and maintaining awareness of the national law text, the local mappings in this Act, transitional windows and the presentation/disallowance process for Victorian amendments, operators and advisers can align applications and compliance systems to the ACT’s legal framework for education and care services.
