Part 12 of the Education and Care Services National Law (Victoria) applies as a law of Victoria as if after section 261 there were inserted—
"261A Regulatory Authority may give directions to approved providers
(1) The Regulatory Authority may, by written notice, direct an approved provider to take action specified in the direction for the safety, welfare or wellbeing of a child or children to whom education and care is provided by the approved provider.
(2) The Regulatory Authority may give a direction under this section only if the Regulatory Authority has reasonable grounds to believe giving the direction is necessary to prevent unacceptable risk to the safety, welfare or wellbeing of a child or children to whom education and care is provided by the approved provider.
(3) A direction under this section takes effect on the later of the following—
(a) when the Regulatory Authority gives the direction to the approved provider;

(b) the date specified in the direction.
(4) An approved provider to whom a direction is given under this section must comply with the direction.
