5B Minister may declare section 49A of National Law to apply (mandatory approval in principle) (1) The Minister, by Order published in the Government Gazette, may declare that section 49A of the Education and Care Services National Law applies to, and in relation to, this jurisdiction. (2) Before making an Order under subsection (1), the Minister must consult the Minister responsible for administering the **Building Act 1993**. (3) An Order made under this section takes effect— (a) on and from the day it is published in the Government Gazette; or (b) if a later day is specified in the Order, on and from that day. (4) An Order made under this section may be varied or revoked by Order published in the Government Gazette. (5) An Order made under this section is not a legislative instrument within the meaning of the **Subordinate Legislation Act 1994**.
