165 Offence to inadequately supervise children Sch. s. 165(1) amended by Nos 43/2022 s. 67(1), 53/2025 s. 28(1). (1) The approved provider of an education and care service must ensure that all children being educated and cared for by the service are adequately supervised at all times that the children are in the care of that service. (2) A nominated supervisor of an education and care service must ensure that all children being educated and cared for by the service are adequately supervised at all times that the children are in the care of that service. Sch. s. 165(3) amended by Nos 43/2022 s. 67(3), 53/2025 s. 28(3). (3) A family day care educator must ensure that any child being educated and cared for by the educator as a part of a family day care service is adequately supervised.
