109 Determination of application for an approval in principle In determining an application for an approval in principle, the Regulatory Authority must have regard to— (a) the suitability of the proposed education and care service premises and the site and location of those premises for the operation of an education and care service; and (b) whether the proposed education and care service premises would meet the approval in principle criteria once constructed, altered or repaired; and (c) whether the proposed education and care service premises will have direct egress to an assembly area to allow the safe evacuation of all children; and (d) any other matter the Regulatory Authority considers relevant; and (e) any other prescribed matters.
