106 Application for approval in principle (1) A person may apply to the Regulatory Authority for the approval in principle of proposed education and care service premises. (2) An application may be made if— (a) the premises are for an education and care service (other than a family day care service); and (b) the premises are proposed to be located in a new or existing Part 4 building; and (c) under a Part 4 planning law or Part 4 building law (or both) of the Part 4 jurisdiction, a permit or approval is required for the construction, alteration or repair of the proposed education and care service premises or the development of the land.
