EastLink Project Regulations 2016

Several interlocking concepts form the operational core of the Regulations: prescribed tolling system and devices; digital files, images and checksums as evidentiary instruments; testing and recordkeeping regimes; prescribed exemptions; notice obligations; and prescribed certificate forms.

Prescribed tolling system and devices

• The Regulations identify the "prescribed tolling system" as the system installed, used and maintained in accordance with the Agreement (reg 10). The Agreement is a defined reference in the Act but is not reproduced here; the Regulations therefore operate by reference to that external contract. The Regulations then specify discrete prescribed tolling devices: a digital toll camera unit (reg 11(1)) and a tag (reg 11(2)). The definitions list specific hardware models (multiple Kapsch Vehicle Registration Sensor parts, controllers and Kapsch transponders) as the digital toll camera units and tags (reg 4 definitions for digital toll camera unit and tag). This ties prescribed device conformity to named manufacturer parts.

Digital files, digital images and checksums

• The Regulations define a "digital file" as a file created by a digital toll camera unit (or an electronic copy) that contains a digital image, toll zone data, date/time data sufficient to calculate the time and date of travel in the toll zone, and a checksum (reg 4 definitions). A "digital image" is an image of the vehicle or trailer (or an electronic copy) processed into digital format by a digital toll camera unit (reg 4). The "toll message file" is a digital file created by a control unit containing toll zone, date/time, and checksum for each digital image (reg 4).

Checksum and verification

• Before producing printed images for evidence, the Regulations require verification by a computer that recalculates the checksum and confirms identity with the checksum contained in the file or the toll message file (reg 14(1)(b)). The process for creating the digital file includes converting the captured image into digital format, generating toll zone and date/time data, calculating a checksum, and combining the image, data and checksum into one digital file (reg 14(2)(a)-(d)).

Printed images and evidentiary process

• A printed image for evidentiary use must be produced from such a verified digital file and contain the image and a message indicating the toll zone and date/time of travel (reg 14(1)(a) and (c)). The Regulations permit images to be processed with or without decompressing the digital image (reg 14(1)(c) and (2)(a)).

Testing, testing officers and records

• The Regulations prescribe who may be a testing officer. That includes heads or authorised persons of certain university/TAFE engineering faculties, persons or classes approved by the Transport Secretary, officers of NATA-accredited testing facilities, or persons who hold a Bachelor (or higher) in relevant engineering disciplines, are members of Engineers Australia and are approved by the President of the Victorian Division (reg 4 definition of testing officer). A testing officer must certify that, if positioned correctly, the unit takes images of registration numbers and transmits to a control unit, and that any maintenance/repairs are satisfactory (reg 13(1)(a)). The testing officer must record serial number, date/time of the test and a statement that the unit satisfied testing requirements, sign the record and set out name and qualifications (reg 13(1)(b)-(c)). Records are to be provided to Freeway Corporation and the enforcement agency within 21 days and retained by the Freeway Corporation for at least one year (reg 13(2)-(3)).

Exemptions and registration authority

• The Regulations prescribe categories of vehicles exempt from payment of tolls for the purposes of s 198(2) of the Act, including ambulances, fire services, police vehicles, SES vehicles, Emergency Management Commissioner controlled vehicles, Australian Defence Force vehicles engaged in duty/marching or ordnance disposal, vehicles under the control of Airservices Australia, and vehicles defined as emergency vehicles in the Road Safety Road Rules 2017 when operated in the performance of emergency services (reg 5). The Freeway Corporation is designated as the body that may exempt vehicles or classes of vehicles from the requirement to be registered under Part 9 of the Act; it may impose conditions, differing scopes, and time limits on those exemptions (reg 6).

Notices and safe avoidance

• The Freeway Corporation must, with the consent of the responsible road authority, cause notices to be placed on every road that connects to EastLink, before each entrance, adjacent to the carriageway and facing approaching drivers; notices must be placed at a reasonable distance so a driver can safely avoid entering EastLink (reg 7(1)-(2)). Notices must indicate the driver is approaching EastLink and that tolls will apply; they may include registration information and any other details the Freeway Corporation with the Authority's consent considers necessary (reg 8).

Certificates and forms

• The Regulations set out prescribed content for certificates under ss 221, 221A and 222 of the Act. Certificates must identify the issuing authority or person, refer to the relevant Act provision, and certify state records or printed images as true or correct to the issuer's knowledge and belief (regs 15-17). In particular, a Freeway Corporation certificate certifying a printed image must be issued by the person who caused the printed image to be printed (reg 17(b)).

Administrative amount and other cross‑references

• The Regulations fix the prescribed administrative amount at $40 per charge found proven for the purposes of s 206B(1) (reg 18). Throughout the instrument, references to the Act, the Agreement, the enforcement agency and the Transport Secretary connect these Regulations to external statutory and contractual frameworks.

Together, these concepts form a closed technical and administrative system intended to produce admissible evidence of vehicle use of EastLink, set out how to validate and preserve that evidence, identify exemptions, and assign administrative responsibilities to the Freeway Corporation, the Transport Secretary, testing officers and the enforcement agency.

Statutory allocation of responsibilities and the exemptions list show who bears legal obligations and who receives legal privileges under these Regulations.

Directly affected entities and persons

• Road users who drive on EastLink: subject to tolls unless they fall within an exemption in reg 5 or otherwise have an approved tag/registration arrangement. Drivers must be given adequate notice approaching EastLink on roads that connect to it (regs 7-8). The obligation to pay tolls and the evidentiary regime will primarily impose costs on these users, either in direct tolls, potential enforcement action, or administrative charges under s 206B as given effect by reg 18.
• Freeway Corporation: has multiple operational and decision-making duties. It must cause notices to be placed (reg 7); may exempt vehicles from the requirement to be registered under Part 9 of the Act (reg 6(1)); receives and retains testing records (reg 13(2)-(3)); and issues certificates under s 222 (reg 17). The Freeway Corporation is the central operational actor required to administer signage, exemption policies, record retention, and printed-image certification.
• Transport Secretary and authorised persons: authorised to issue certificates under s 221 referenced in reg 15; the Transport Secretary also has an approval role with respect to testing officer classes or persons (reg 4 definition of testing officer).
• Enforcement agency: receives copies of testing records from testing officers (reg 13(2)(b)) and issues certificates under s 221A (reg 16). It is the entity that keeps records used for certification and will typically be the prosecuting or administrative enforcement arm in tolling matters.
• Testing officers and accredited testing facilities: individuals or classes authorised or approved by Transport Secretary, NATA testing officers, or qualified engineers approved by the President of Engineers Australia Victorian Division can perform required tests and prepare the test records (reg 4). Testing officers have evidentiary roles and must certify compliance with testing requirements (reg 13).
• Device manufacturers, suppliers and operators: the Regulations are prescriptive about device models (Kapsch parts named in reg 4). Operators must install, maintain and test those devices in accordance with the Regulations (regs 12-14). Suppliers of non‑prescribed equipment may not be compliantly used for the prescribed tolling system.

Indirectly affected parties

• Responsible road authorities: their consent is required before the Freeway Corporation places notices on connecting roads (reg 7). This gives local or state road authorities a practical veto or participatory role in signage placement and timing.
• Vehicle owners and registered operators: the certificates in reg 15 allow the Transport Secretary or authorised officers to certify registration records and link registration numbers to persons; this affects privacy and data-handling flows between registration databases, the Transport Secretary, enforcement agency and Freeway Corporation.
• Emergency services and the Australian Defence Force: specifically listed as exempt from toll payment when acting in prescribed capacities (reg 5). The exemptions affect budgets and operational logistics for these agencies.

Who pays, and who decides

• Road users (drivers) normally pay tolls; the list of exemptions in reg 5 narrows who does not pay. The Freeway Corporation and the enforcement agency decide how exemption from registration is administered (reg 6), what notices are placed (regs 7-8), and who certifies printed images (reg 17). The Transport Secretary and the enforcement agency decide testing officer approvals and issue evidentiary certificates (reg 4; regs 15-16). Courts applying s 206B orders will impose the administrative amount prescribed in reg 18 ($40 per proven charge).

Behaviour changes imposed or incentivised by the Regulations

• Use of specified hardware and data verification processes creates an incentive for operators and the Freeway Corporation to deploy and maintain the named digital toll camera units and tags, adhere to the testing schedule, keep checksum‑verified digital files, and produce printed images that meet the required content. Drivers are incentivised to register vehicles or arrange tags or avoid EastLink where feasible because signs must be placed sufficiently in advance for safe avoidance (regs 7-8). Emergency service operators and certain public agencies are relieved of toll payments under reg 5, which may affect route choice for those agencies.

Key gaps and dependencies

• The Regulations repeatedly reference the Agreement and the Act for substantive definitions and authority (e.g., the prescribed tolling system is that installed "in accordance with the Agreement" (reg 10)). Because the Agreement itself is not reproduced here, compliance or interpretation in areas tied to the Agreement may require consulting that contract. The Regulations also cross‑refer to provisions of the Act (sections 198(2), 199A(1), 206, 206B, 221, 221A, 222) for matters like evidentiary consequences and enforcement; readers must consult the Act for the full legal effect.

In combination, the instrument affects a mix of private road users, government agencies, the Freeway Corporation (as gatekeeper and administrator), testing professionals, manufacturers/suppliers of the named devices, and the enforcement and registration authorities who produce and rely on certificates and records.

The Regulations allocate operational duties, evidentiary powers and limited privileges across several public and private actors. I list the principal duties and rights with precise references to the Regulations.

Duties of the Freeway Corporation

• Place notices: The Freeway Corporation must, with the consent of the responsible road authority, cause a notice that provides the information in reg 8 to be placed on every road that connects to EastLink, before each entrance, adjacent to the carriageway and facing approaching drivers (reg 7(1)). Notices must be placed at a reasonable distance so a driver can safely avoid entering EastLink (reg 7(2)). The Freeway Corporation may place additional notices with consent (reg 7(3)).
• Exempt vehicles from registration: The Freeway Corporation is the body that may exempt vehicles or classes from the requirement to be registered under Part 9 of the Act (reg 6(1)). It may grant exemptions that vary by case, be subject to conditions, and be time-limited (reg 6(2)(a)-(c)).
• Retain testing records: The Freeway Corporation must retain testing records provided under reg 13(2)(a) for at least one year after the date of the test (reg 13(3)).
• Issue certificates: The Freeway Corporation issues certificates under s 222 executed in the form prescribed by reg 17, and where certifying a printed image the certificate must be issued by the person who caused the printed image to be printed (reg 17(b)).

Duties of testing officers

• Carry out prescribed tests: A testing officer must be satisfied that a digital toll camera unit, if positioned as required, takes images of registration numbers and transmits images to a control unit, and that maintenance or repairs were carried out satisfactorily (reg 13(1)(a)).
• Record and sign findings: The testing officer must record serial number, date/time of the test, and a statement that the unit satisfied each testing requirement; the officer must sign the record and include name and qualifications (reg 13(1)(b)-(c)).
• Distribute records: Within 21 days after testing, the testing officer must give the record to the Freeway Corporation and provide a copy to the enforcement agency (reg 13(2)(a)-(b)).

Duties of the enforcement agency

• Receive and rely on testing records: The enforcement agency must be given copies of testing records within 21 days (reg 13(2)(b)). It also issues certificates under s 221A in the form prescribed (reg 16), certifying that matters in the certificate appear in the records kept by the enforcement agency and are, to the knowledge and belief of the officer issuing the certificate, true and correct (reg 16(a)-(b)).

Duties of operators of digital toll camera units

• Use units in prescribed manner: Units must be positioned to take images of registration numbers and transmit to a control unit, be tested as required (including after repair and within 24 months of use) and otherwise be used and maintained in accordance with the Agreement (regs 12( a)-(c); 10).
• Ensure digital file creation and verification: The device/process pipeline must produce a digital file with image, toll zone and date/time data and a checksum, and printed images must be produced only after computer verification of checksum identity (reg 14(1)-(2)).

Duties of the Transport Secretary

• Issue certificates as to registered operator: Certificates under s 221(1) and s 221(3) must be issued by the Transport Secretary or an authorised person in the form prescribed by reg 15 (reg 15(1)-(2)). The Transport Secretary also may approve a person or class to be a testing officer (reg 4 definition of testing officer).

Rights and privileges

• Exempt vehicle classes: Specified classes (ambulances, fire services, police, SES, Emergency Management Commissioner, Australian Defence Force vehicles in duty/march or ordnance disposal, Airservices Australia, and emergency vehicles within Road Safety Road Rules 2017) are exempt from payment of tolls for the purposes of s 198(2) (reg 5). The Freeway Corporation has a right under reg 6 to exempt vehicles from registration under Part 9.
• Evidentiary utility of certificates and printed images: Certificates issued under regs 15-17 and printed images produced in accordance with reg 14 are designed to be admissible and conclusive evidence under the Act (the Act provisions are referenced in those regs). The Regulations accordingly prescribe forms and verification processes to give evidentiary weight to the materials.

Administrative amounts and enforcement consequences

• The Regulations prescribe $40 as the administrative amount for the purposes of s 206B(1) of the Act (reg 18). That amount will be applied by courts under orders made pursuant to the Act.

Interaction with the Agreement and the Act

• Several duties and rights under these Regulations depend on the Agreement and the Act (e.g., definition of the prescribed tolling system, obligations under Part 9 of the Act): the Agreement and Act allocate further powers, liabilities and remedies, which must be read together with these Regulations to determine the full set of rights and duties.

Key operational constraints implicit in duties

• Time limits for tests and provision of records (24 months for testing, 21 days for sending test records) impose administrative scheduling requirements on operators and testing officers (regs 12( c)(ii); 13(2)). The Freeway Corporation’s duty to obtain the responsible road authority’s consent for signage gives local road authorities practical influence over the timing and placement of the notices (reg 7(1)). The Regulations therefore create distributed operational responsibilities rather than concentrating duties in a single entity.

The Regulations themselves do not create new criminal offences in text reproduced here; rather, they operate to prescribe technical, evidentiary and administrative processes that feed into the Act’s enforcement regime. Enforcement consequences therefore arise principally through the Act’s provisions (which are repeatedly cross‑referenced).

Administrative amount and court orders

• The Regulations fix the "prescribed administrative amount" for the purposes of s 206B(1) of the Act at $40 in respect of each charge found proven (reg 18). Section 206B of the Act is not reproduced in these Regulations, but the cross‑reference makes clear that courts will be required to apply the fixed figure when they make orders under s 206B. The practical effect is to standardise the amount recoverable under court orders allied to enforcement of tolling charges or related charges specified under the Act.

Evidentiary regime and implication for enforcement

• The Regulations prescribe the form and creation of printed images, digital files and certificates that an enforcement agency, Freeway Corporation or court may rely upon (reg 14 for printed images; regs 15-17 for certificates). The procedural and technical requirements (for example checksum recalculation, signature and qualification of testing officers, and timely provision and retention of records) are intended to ensure that electronic capture of vehicle registration data, and the derived printed images and certificates, will be admissible and persuasive in enforcement proceedings under the Act. The Regulations thereby shape enforcement capability by establishing standards for evidence.

Record retention and disclosure obligations

• Testing officers must provide records to the Freeway Corporation and enforcement agency within 21 days of testing (reg 13(2)). The Freeway Corporation must retain those records for at least one year (reg 13(3)). These obligations enable enforcement agencies to access contemporaneous testing records that corroborate the reliability of devices used to obtain images relied upon in enforcement actions.

Prescribed devices as basis for enforcement

• Because the Regulations specify exact device models (Kapsch part numbers) as the prescribed devices for digital toll camera units and tags (reg 4 definitions; reg 11), enforcement and evidentiary reliance will turn on whether the prescribed devices were used, installed and maintained in accordance with regs 12-14 and the Agreement. If a device outside the prescribed list were deployed, enforcement agencies may face challenges to the admissibility or sufficiency of the evidence depending on how the Act frames admissibility.

No penalties specified in the Regulations text

• The text of these Regulations as supplied does not itself create penalty units, criminal offences or civil sanctions; it prescribes technical means to create evidence and sets administrative amounts under the Act (reg 18). Any sanctions for non‑compliance with evidence standards, device requirements, or obligations to pay tolls will be enforced under the Act and related enforcement frameworks. To understand specific penalties or fines for failing to pay tolls, or for contravening particular parts of the Act, one must consult the EastLink Project Act 2004.

Enforcement actors and their powers

• The enforcement agency is an actor with record-keeping and certifying duties (reg 13(2)(b); reg 16). The Freeway Corporation issues certificates and retains records (regs 17 and 13(3)). The Transport Secretary issues registration certificates (reg 15). Each of those actors is likely central to enforcement processes by supplying certified records and printed images to courts or tribunal processes under the Act.

Practical enforcement risks and evidentiary challenges

• The Regulations' stringent requirements for checksum verification and for testing officer certification are designed to limit evidentiary challenge. However, if testing records or checksum verification are incomplete, delayed beyond 21 days, or not retained for the minimum one-year period, an enforcement agency's case may be weakened. Because the prescribed administrative amount is fixed, enforcement outcomes on costs will be predictable in one respect, but the Regulations do not address other enforcement-related fees or legal costs that may arise.

In short, enforcement under these Regulations is effected through the evidentiary and administrative architecture that supports prosecutions and civil enforcement under the Act. The Regulations set out how to create admissible technical evidence and fix an administrative amount for court orders but do not, on their face, add new penalties separate from the Act's enforcement provisions.

These Regulations are explicitly framed as secondary legislation operating under the EastLink Project Act 2004 and they cross-reference several other pieces of legislation and instruments. Their legal effects therefore depend on, and interact with, these other legal texts and administrative instruments.

Primary statutory parent

• EastLink Project Act 2004: The Regulations are made under s 258 of the Act (reg 2). Numerous provisions of the Regulations are expressly for the purposes of particular sections of the Act: reg 5 is for s 198(2), reg 6 for s 204(9), reg 9 for s 199A(1), reg 10 for Part 9, reg 11 for Part 9 and s 206, regs 14 and 15 reference evidentiary provisions in ss 221, 221A and 222, and reg 18 is for s 206B(1). Therefore, the Regulations must be read in the context of those Act provisions to determine legal consequences, admissibility of evidence, enforcement processes and liability. The Regulations implement the Act's substantive and procedural powers.

Contractual Agreement

• The "Agreement" (capitalised) is used in reg 10 to identify the prescribed tolling system as that installed, used and maintained in accordance with "the Agreement." The Agreement is therefore a crucial source of operational detail, standards, performance specifications, obligations, rights and dispute resolution procedures that affect the tolling system. The Agreement will typically be the contract between the state (or its agency) and the toll operator (such as the Freeway Corporation). Because the Agreement's text is not included here, compliance with several regulations (notably reg 10 and devices installed "in accordance with the Agreement") requires consulting that contract.

Road Management Act 2004

• The Regulations reference "responsible road authority" with the same meaning as in s 3(1) of the Road Management Act 2004 (reg 4 definition). That cross‑reference affects consent for placement of notices under reg 7. The responsible road authority therefore participates in signage decisions and placement timing.

Road Safety Road Rules 2017

• Reg 5(j) exempts, without limiting other paragraphs, vehicles that are emergency vehicles within the meaning of the Road Safety Road Rules 2017 when used in emergency services. The definition of "emergency vehicle" in the Road Safety Road Rules 2017 (dictionary) is therefore incorporated by reference to determine the scope of that exemption.

Ambulance Services Act 1986 and various emergency management statutes

• The exemptions in reg 5 refer to ambulance services under the Ambulance Services Act 1986, Fire Rescue Victoria, the Department of Energy, Environment and Climate Action, Country Fire Authority, the Victoria State Emergency Service Act 2005, the Emergency Management Act 2013 (Emergency Management Commissioner), and Airservices Australia under the Air Services Act 1995 (commonwealth). The scope of the exemptions thus depends on definitions and structures in those acts.

Education and Training Reform Act 2006; Engineers Australia; NATA

• The testing officer definition in reg 4 imports training and accreditation references from the Education and Training Reform Act 2006 for university and TAFE credentials, requires membership of Engineers Australia (and approval by the President of its Victorian Division) for certain testing officers, and recognises NATA accreditation. Those cross-references set the professional standards applicable to persons who may perform testing.

Subordinate Legislation Act 1994 and Interpretation of Legislation Act 1984

• Endnotes mention the Subordinate Legislation Act 1994 with respect to sunset (regulations will sunset 10 years after making). The endnotes and the "Interpretation of Legislation Act 1984" text in the Endnotes explain interpretative formalities such as headings, notes and punctuation forming part of the Statutory Rule. These interpretative rules affect how the Regulations are read in legal proceedings.

Other subordinate instruments and revocations

• Reg 3 revokes earlier EastLink Regulations and amendment regulations (S.R. Nos listed). The Table of Amendments in endnotes lists EastLink Project Amendment Regulations 2019 (S.R. No. 149/2019) and EastLink Project Amendment Regulations 2025 (S.R. No. 98/2025). Those instruments have effected prior and recent changes to definitions, fee amounts and other details. Practitioners must account for historical changes and the consolidated text which incorporates those amendments.

Evidence law and procedure

• The Regulations' focus on checksum verification, certified printed images, and prescribed certificate wording indicate an interaction with rules of evidence in courts and tribunals. The Act's provisions that admit such certificates and printed images as evidence will interact with the Evidence Act and relevant civil and criminal procedure rules. The Regulations strengthen the technical predicate for admissibility, but actual admissibility will depend on those external evidentiary rules and judicial assessment.

Privacy, data protection and freedom of information

• Although not expressly discussed in these Regulations, collection, retention and transmission of digital images, registration data and testing records will intersect with privacy obligations and freedom-of-information regimes under other state statutes. The Regulations do not modify those laws but create data flows that legal advisers must reconcile with data-protection obligations.

In short, the Regulations do not operate in a vacuum. They are an implementing instrument interlaced with the Act, the Agreement, and multiple other statutes and administrative instruments that together determine the operational and legal consequences of tolling, evidence-gathering, exemptions and administrative charges.

The Regulations carry a concise recorded amendment history and internal amendment markers. The version presented is a consolidated instrument "incorporating amendments as at 30 September 2025." Key recorded amendments and timeline details included in the instrument are:

Original making and commencement

• The EastLink Project Regulations 2016 (S.R. No. 150/2016) were made on 13 December 2016 by the Governor in Council under s 258 of the EastLink Project Act 2004 and came into operation on 13 December 2016 (Endnotes 1).

Sunset provision

• Endnotes state the Regulations will sunset 10 years after the day of making, that is, 13 December 2026 (Endnotes 1). Practitioners should note the approaching sunset date and check for any extension, replacement or remaking instruments.

Table of amendments (consolidated)

• The Regulations incorporate amendments made by:
  • EastLink Project Amendment Regulations 2019, S.R. No. 149/2019 (made 17 December 2019; commenced 1 January 2020 per reg 3); and
  • EastLink Project Amendment Regulations 2025, S.R. No. 98/2025 (made 30 September 2025; commenced 30 September 2025).

Inline amendments recorded in the consolidated text

• The consolidated text annotates particular regulations with amendment markers. Examples include:
  • Reg 1(j) amended by S.R. No. 98/2025 reg 4.
  • Definitions in reg 4 for digital file, digital image and testing officer amended by S.R. No. 98/2025 reg 5(a)-(c).
  • Reg 5(b)(i) and (ii) substitutions by S.R. No. 98/2025 reg 6(1)-(2); reg 5(j) amended by S.R. No. 98/2025 reg 6(3).
  • Reg 14(1)(c)(i) and (ii) amended by S.R. No. 98/2025 reg 7(1); reg 14(2)(b)(i)-(ii) similarly amended by reg 7(2).
  • Reg 15, 17 and 18 headings and content have amendment annotations referencing S.R. No. 98/2025 reg 8(1)-(2), reg 9, and S.R. No. 149/2019 reg 4 where applicable.

Revocations

• Reg 3 revokes prior EastLink subordinate instruments: EastLink Project Regulations 2008 and several amendment Regulations (S.R. No. 81/2008 as amended and S.R. Nos 104/2013, 167/2014, 36/2016 as specified in the endnotes). The consolidated instrument thus replaced those earlier instruments.

Explanatory details and notes

• Endnotes include explanatory details for specific amendment entries and list a large number of S.R. numbers used to update cross-referenced materials like reg 5(j) (Endnotes 3). The explanatory note to reg 5 also points users to the Road Safety Road Rules 2017 for the definition of "emergency vehicle" (see Notes under reg 5).

Implications for practitioners

• The amendment history shows active updating particularly in 2019 and 2025; various definitions and procedural paragraphs were changed or clarified, including the prescriptive identification of device model numbers and adjustment of which fire and emergency agencies are listed in reg 5. Lawyers and compliance officers should ensure they reference the consolidated instrument current to the matter date, and, given the approaching sunset (13 December 2026), check for any remaking or extension instruments, or for replacement provisions migrating into other subordinate or primary legislation.

In summary, the Regulations have been amended at least in 2019 and 2025 and consolidate prior revocations. The annotated amendments in the text identify where definitions or paragraphs were changed; practitioners should consult the specific S.R. instruments for the amendment history and legislative intent where relevant.

The text of these Regulations does not record any litigation decisions. It lists the instruments it revokes and the instruments that amend it, but it contains no references to cases, judicial interpretations or tribunal determinations applying these Regulations.

Implications

• Because the Regulations are heavily technical and evidentiary, litigation arising from their application is predictable,in areas such as:

  • the admissibility and sufficiency of printed images or certificates produced under regs 14-17;
  • challenges to compliance with testing and verification processes (for example, checksum verification, testing officer qualifications, retention and disclosure of testing records);
  • disputes over whether vehicles fall within the exemptions in reg 5 or have been correctly exempted from registration by Freeway Corporation under reg 6;
  • procedural disputes about notice placement (reg 7) and whether signs gave sufficient opportunity for safe avoidance; and
  • enforcement actions using court powers under the Act (including s 206B and reg 18 administrative amount).

• None of these litigated issues are recorded in the Regulations themselves; to locate litigation applying or interpreting these Regulations, one must search case law databases and tribunal records for decisions citing the EastLink Project Regulations 2016, the EastLink Project Act 2004, or the S.R. numbers of the amending instruments.

What to check in litigation research

• Search for decisions that address the evidentiary weight of printed images where checksum verification is at issue, or where device model compliance is contested.
• Look for rulings interpreting the effect of the Freeway Corporation's discretionary exemption powers (reg 6) or the scope of exemptions in reg 5, including whether particular operational uses of emergency vehicles fall within the listed categories.
• Check for cases interpreting the time limits and procedural obligations in s 199A (for the nomination rejection statement) given reg 9 prescribes the period as 14 days from the invoice date.
• Investigate any challenges to the administrative amount prescribed by reg 18 as it applies under s 206B(1), and whether courts have interpreted "each charge found proven" in particular fact patterns.

Because the instrument contains no litigation references, practitioners should perform jurisdictional case-law searches rather than rely on the Regulations for litigation history. The absence of litigation references in the instrument does not imply that litigation has not occurred; it simply means the text itself does not record or summarise judicial responses.

The Regulations are technical and precise; several features can present traps for the unwary practitioner, operator or enforcement officer. Below I list the principal practical pitfalls and the specific regulatory hooks that create each risk.

Device and vendor specificity

• Prescribed devices named by Kapsch part numbers (reg 4 definitions and reg 11). Risk: the Regulations require use of specified device models as the "digital toll camera unit" and identify specific transponder models as "tags." If a toll operator deploys different hardware or newer models not listed, the evidentiary basis for enforcement may be challenged. The Regulations do not provide a mechanism in the text for approving alternative makes or models; instead the prescribed list is definitive. Practitioners should review the Agreement (reg 10) to determine whether the Agreement authorises other devices or provides a process for updating the list.

Checksum processes and unspecified algorithm

• The Regulations require a checksum and verification process: the digital file must contain a checksum and printed images must be produced only after a computer recalculates and confirms the checksum matches (reg 14(1)(b) and 14(2)(c)). Risk: the instrument does not specify the checksum algorithm, format, or the provenance of the original checksum (other than that it is "produced by the application of an algorithm"). If an enforcement agency cannot demonstrate the algorithm used or the reliability of the checksum process, an opponent may challenge the validity of checksum verification. The instrument's silence about algorithm choice and security of key materials may be a litigable gap.

Testing frequency, repair timing and record retention windows

• Testing is required after repair/modification and "within a period of 24 months before the occasion of its use" (reg 12(c)(i)-(ii)). Testing officers must provide records to the Freeway Corporation and enforcement agency within 21 days, and the Freeway Corporation must retain those records for at least one year (reg 13(2)-(3)). Risks and friction points:
  • A 24‑month testing window means tests can be infrequent; if a device malfunctions between tests, evidence obtained may be contestable.
  • The mandatory one-year retention period may be shorter than some retention policies or litigation timeframes; if records are destroyed after one year and later required in civil or administrative proceedings, a gap will appear. The instrument requires at least one year; it does not limit longer retention but does not mandate it either.
  • The 21‑day distribution requirement for test records imposes an administrative deadline that must be tracked; failing to provide records within 21 days could raise chain-of-custody problems.

Printed image content and formatting

• Printed images must contain an image derived from the digital image and a message indicating the toll zone, date and time (reg 14(1)(c)). Risk: a conforming printed image requires both the image and the textual message; if the printed image lacks the required message or if the message is unclear or not linked to the checksum-verified digital file, a court may find the printed image non-compliant with the prescribed process.

Signage consent and "safe avoidance"

• The Freeway Corporation must obtain the consent of the responsible road authority before placing notices (reg 7(1)). Notices must be placed at a "reasonable distance" so a driver can safely avoid entering EastLink (reg 7(2)). Risks:
  • If consent is delayed or withheld, signage may not be in place, which affects the statutory notice requirement and may be a defence in enforcement or civil cases.
  • "Reasonable distance" is fact-dependent; inadequate placement could expose the Freeway Corporation to legal challenges from drivers or enforcement agencies, or complicate enforcement.

Exemption scope ambiguity

• The list of exempt vehicles includes categories linked to other statutes and rules (e.g., Road Safety Road Rules 2017 for "emergency vehicle") and includes ministerial power to declare ambulance services from other jurisdictions (reg 5(a)(ii)). Risk: determining whether a particular vehicle is covered may require cross-referencing those other instruments and ministerial notices; operational ambiguity may arise at the roadside.

Dependency on the Agreement

• The prescribed tolling system is the system in the Agreement (reg 10). Risk: many operational requirements therefore depend on a separate contract; any inconsistency between the Regulations and the Agreement may create disputes about which standard governs in specific circumstances. Parties must check the Agreement's text for operational definitions, device updates, compliance mechanisms, and maintenance obligations.

Limited scope of prescribed administrative amount

• Reg 18 prescribes $40 per charge found proven for the purposes of s 206B(1). Risk: without consulting the Act one cannot determine the types of charges covered (for example, infringement, fixed penalties, administration fees). Practitioners should not assume that $40 is the only recoverable cost; legal costs, other fines, or fee recovery under different sections of the Act may still apply.

Testing officer approval routes and capacity constraints

• The testing officer definition includes a number of alternative qualification routes (reg 4). Risk: the Transport Secretary's approval role and the need for Engineers Australia or NATA approval could create administrative bottlenecks in obtaining qualified testing officers, especially in areas where NATA‑accredited facilities or qualified academics are scarce.

Formality of certificate content

• Certificates under regs 15-17 must state particular matters and are designed to be relied upon by enforcement agencies and courts. Risk: failure to include required wording, issuer identification, or a certification of truth "to the knowledge and belief" may render a certificate non‑compliant.

Sunset deadline

• The Endnotes indicate a sunset on 13 December 2026. Risk: regulatory planning and device procurement timelines must account for that point; operators and legal advisers should track whether the instrument is remade, amended, or allowed to lapse.

Taken together, these "gotchas" arise because the Regulations are precise in some areas (device part numbers, checksum verification, certificate wording) and silent or referential in others (algorithm specification, Agreement content, longer-term retention beyond one year). Practitioners and operators should map these pitfalls into operational checklists and review the Agreement and the Act for the full picture.

Practically useful, specific steps to comply with the Regulations follow. The focus is on meeting the technical, administrative, evidentiary and signage requirements the instrument prescribes.

1. Confirm the applicable legal framework

• Read the EastLink Project Act 2004 sections referenced in these Regulations (for example, ss 198(2), 199A, 206, 206B, 221-222 and Part 9) to understand the enforcement, evidentiary and substantive consequences that rely on compliance with the Regulations (reg 2 and scattered cross-references).
• Obtain and review the Agreement that defines the "prescribed tolling system" (reg 10), because many operational standards and device requirements are framed in relation to that Agreement.

2. Use prescribed devices or obtain express approval

• Deploy only the prescribed digital toll camera units and tags listed by part number in the definitions (reg 4) and ensure installations conform to the Agreement (reg 10). If contemplating alternative hardware:
  • Seek confirmation in writing whether the Agreement permits other models;
  • If necessary, seek administrative approval from the Transport Secretary or the Freeway Corporation (document the authority relied upon).
• Maintain vendor documentation and serial number logs for each device, as serial numbers are required to be recorded during testing (reg 13(1)(b)(i)).

3. Implement the digital file, checksum and printed image process

• Ensure the digital toll camera unit pipeline produces a single digital file combining the digital image, toll zone data, date/time data and an internally calculated checksum (reg 14(2)(a)-(d)).
• Adopt a documented checksum algorithm and system architecture so a computer can recompute the checksum and verify identity before printing a printed image (reg 14(1)(b)). Although the Regulations do not prescribe the algorithm, document chain-of-custody and algorithm parameters to support admissibility.
• Configure printed-image generation to include the image derived from the digital image and a message indicating the toll zone and the date/time of travel (reg 14(1)(c)).

4. Establish testing and maintenance procedures

• Arrange testing by appropriately qualified testing officers in the categories set out in reg 4 (university/TAFE heads or authorised persons; persons approved by the Transport Secretary; NATA-accredited facility testing officers; or qualified engineers approved by the Engineers Australia Victorian Division President).
• Implement a testing schedule that requires tests within 24 months before the occasion of use and immediately after any repair or modification and before first use after those works (reg 12(c)(i)-(ii)).
• Ensure testing officers complete full records including serial number, date/time of test, a statement that testing requirements were met, and sign with name and qualifications (reg 13(1)(b)-(c)). Provide these records to the Freeway Corporation and enforcement agency within 21 days of testing (reg 13(2)); the Freeway Corporation must retain records for at least one year (reg 13(3)).

5. Certification and records management

• Maintain a records management system that links each printed image and digital file to the controlling device serial number, checksum verification logs, the testing record, time stamps and the printed image used in any enforcement action.
• When issuing or relying on certificates under regs 15-17, ensure the certificate contains the required elements: identification of the issuing authority, reference to the Act provision, and the prescribed certifications about records or printed images (regs 15-17). The Freeway Corporation must ensure the person who caused a printed image to be printed issues the certificate where that is required (reg 17(b)).

6. Signage compliance and coordination

• Coordinate with the responsible road authority to obtain required consent for placement of notices before each entrance to EastLink (reg 7(1)). Document consents and placement plans that demonstrate notices are placed at a reasonable distance to allow safe avoidance (reg 7(2)).
• Ensure notices include the minimum information required (that the driver is approaching EastLink and tolls will apply) and consider including registration information and guidance on how to register vehicles (reg 8).

7. Exemptions and registration management

• If operating a fleet that may qualify for exemption from the payment of tolls (reg 5) or for exemption from registration under Part 9 (reg 6), apply to the appropriate authority (Freeway Corporation for registration exemptions) and maintain written records of any exemptions and attached conditions (reg 6(2)). Ensure any ministerial notice relied upon (for non‑Victoria ambulance services under reg 5(a)(ii)) is contemporaneously recorded.

8. Administrative and enforcement financial procedures

• Where court orders under s 206B are possible, account for the prescribed administrative amount of $40 per proven charge (reg 18) in internal cost-recovery and debtor handling procedures. Cross-check with the Act to establish when courts will order this amount and how it interacts with other fees or legal costs.

9. Staff training and policy

• Train operational and enforcement staff on:
  • Device handling and serial-number tracking;
  • Digital file and checksum verification procedures;
  • Testing schedules and the 21‑day record distribution requirement;
  • Proper completion and storage of certificates; and
  • Procedures for signage coordination and obtaining responsible road authority consent.
• Create compliance checklists that map each regulatory requirement to responsible officers with deadlines and audit logs.

10. Audit, legal review and contingency planning

• Conduct periodic internal audits of the testing records, checksum verification logs, printed image production processes and certificate forms to ensure compliance with regs 12-17.
• Because the instrument references the Agreement and the Act, maintain a legal file that includes the Agreement, the Act, and any ministerial notices or approvals relied upon for exemptions or equipment changes.
• Plan for the Regulations' sunset (13 December 2026 per the Endnotes) by tracking remaking or replacement instruments, and build contractual flexibility into device procurement and maintenance arrangements in case changes are required.

These steps map directly to the regulatory clauses (regs 4, 10-14, 15-18, 5-8) and translate them into operational obligations. Documentation, chain-of-custody rigor, timely testing and record transfer, and inter-agency coordination (with responsible road authorities and the enforcement agency) are the primary compliance levers under the Regulations.
