What it does
This instrument sets the numerical parameters used to apply the Eastern Tuna and Billfish Fishery Management Plan 2010 provisions titled "Obligations relating to overcatch" and "Obligations relating to undercatch" for three consecutive fishing seasons, 1 January to 31 December in each of 2025, 2026 and 2027 (s 6). It is made under the Fisheries Management Act 1991 and specific provisions of the Management Plan (s 3), and it ceases on 31 December 2027 unless revoked earlier (s 5).
Mechanically, the instrument determines two kinds of figures for each quota species: a determined percentage to be applied for overcatch under s 4.5 of the Management Plan, and a determined percentage to be applied for undercatch under s 4.6 of the Management Plan. For the stated seasons the instrument also sets a determined weight for the purpose of s 4.5 of the Management Plan. For every quota species listed for each of the three seasons the instrument fixes a 10% determined percentage for overcatch and a 10% determined percentage for undercatch, and a 2,000 Kg determined weight for the overcatch provision (s 6 and accompanying tables). The quota species covered each season are Albacore Tuna, Bigeye Tuna, Yellowfin Tuna, Striped Marlin and Broadbill Swordfish, although the exact ordering and inclusion of species varies slightly across the three seasonal tables in the instrument (s 6).
The instrument explicitly cross‑references that the total allowable commercial catch (TACC) for each quota species for each fishing season is determined by a separate instrument, the Eastern Tuna and Billfish Fishery (Fishing Season and Total Allowable Commercial Catch) Determination (No.2) 2024 (notes accompanying each seasonal table in s 6). Definitions used in the instrument refer to the Act and to the Management Plan, and the instrument notes that a number of expressions are defined in section 1.3 of the Management Plan, including "fishing season", "Eastern Tuna and Billfish Fishery", "total allowable commercial catch", and "quota species" (s 4).
