East Carey Park Land Vesting Act 1957

The Act is short and centred on a handful of legal concepts that control how the named land is to be handled.

• Gazetted land, Gazetted notice and specified Order in Council, defined in s 2. The Act ties its operation to those precise descriptions and to the Gazette entry of 25 August 1950. The identity of the land is therefore plan‑ and register‑specific (plan 4824, Certificate of Title Vol 1136 Folio 784), and the prior vesting action that it supersedes is the Gazette notice and Order in Council of the same date (s 2).

• Removal from the Transfer of Land Act 1893, and constitution as Crown land. Section 3(a)(i) removes so much of the Gazetted land as is subject to the stated Certificate of Title from the operation of the Transfer of Land Act 1893, and declares it to be Crown land according to the meaning of “Crown land” in section 4 of the Land Act 1933. This converts land previously dealt with under the Torrens system into land held by the Crown under the Land Act regime. The change is legal and categorical: the Act does not provide for partial continuance of the Transfer of Land Act over the affected parcels.

• Governor’s discretion to grant fee simple to the Commission, without consideration. Section 3(a)(ii) empowers the Governor to grant the fee simple in possession in the Gazetted land and in the land comprised in the road and right‑of‑way to the State Housing Commission. The grant may be without reservation, or with reservations including mineral rights, as the Governor “thinks fit”, and the Commission “shall not be required to pay any consideration or fee” for the grant. That is a statutory authorisation of a free transfer to a State instrumentality subject to executive reservations.

• Cancellation of the specified Order in Council. Section 3(a)(iii) expressly cancels the specified Order in Council that had authorised the Minister for Railways to provide cottages for railway employees on the Gazetted land. The cancellation is statutory, not administrative, and it alters the basis of the earlier public works vesting.

• Exclusion of later amendments to the Public Works Act. Section 3(a)(iv) contains an express non‑application saving: amendments in the 1955 and 1956 amending Acts to the Public Works Act 1902 “do not apply and shall be deemed never to have applied” to the Gazetted land, or to the operation of this Act, or to the Governor’s exercise of any power under this Act, or to use of the land for State Housing Act purposes. That provision is a statutory statement of how earlier and later legislation interact.

• Closure and revesting of road and right‑of‑way. Section 3(b) closes Carlotta Street (as described) and a public right‑of‑way, extinguishes rights‑of‑way, revests the land in Her Majesty as of her former estate, removes it from the Transfer of Land Act, and thus places it in the same re‑subdivision and grant pathway as the rest of the Gazetted land (s 3(b)(i)-(ii)).

These concepts interact to convert title, extinguish public access, cancel a prior authorising instrument, and allow the Commission to receive fee simple title for housing purposes without paying consideration, subject to gubernatorial reservation of rights. Each of these operations is effected by the Act’s text rather than by subsequent administrative procedure alone, though practical implementation will require executive and registry steps to reflect the statutory changes.

The Act expressly identifies a narrow set of legal actors and property interests, and it has direct legal effects on those actors and on incidental groups.

• The State Housing Commission, defined in s 2 as “Commission”, is the primary beneficiary. The Governor may grant the Commission the fee simple in possession in the Gazetted land and in the land from the closed road and right‑of‑way, and the Commission is expressly not required to pay consideration (s 3(a)(ii)). The Commission therefore stands to acquire ownership and control of the land for State Housing Act purposes without transactional purchase.

• The Crown and the Governor. The Act converts certain land to Crown land (s 3(a)(i)) and makes the Governor the decision‑maker for the grant and for the content of any reservations (s 3(a)(ii)). The Crown is also the recipient (re‑recipient) of the road and right‑of‑way when those are revested (s 3(b)(ii)). The Governor’s discretion over reservations is central to how the Crown may retain particular rights, including mineral rights.

• Persons with rights in the public road and right‑of‑way. The Act closes the public road known as Carlotta Street and a 30‑links‑wide public right‑of‑way as described on plan 4824, and “all rights‑of‑way over them cease” on commencement (s 3(b)(i)). Those who previously enjoyed access rights over those strips will thus have those specific statutory access rights extinguished by operation of this Act. The Act does not specify compensation or alternative access (the text is silent on those matters).

• Holders of the Certificate of Title Volume 1136 Folio 784. That title is removed from the operation of the Transfer of Land Act and constituted Crown land (s 3(a)(i)). Any proprietary interests encoded in that Certificate of Title will be affected by the statutory removal; the Act does not set out an administrative compensation or acquisition process in‑text.

• Entities or persons who relied upon the prior Order in Council authorising railway employee cottages. The specified Order in Council is cancelled by s 3(a)(iii). That cancellation negates the ministerial authorisation previously published in the Gazette that had led to vesting under the Public Works Act 1902.

• Agencies or parties concerned with the Public Works Act 1902 and its 1955/1956 amendments. Section 3(a)(iv) states explicitly that the amendments effected by those two amending Acts “do not apply and shall be deemed never to have applied” to the Gazetted land and the use of the land for State Housing Act purposes. This has a targeted effect on which statute governs the land’s status and any public works powers relevant to it.

• Land registry authorities and surveyors. Because part of the Gazetted land is removed from the Transfer of Land Act and parts of a road and right‑of‑way are closed and revested in the Crown, land records, plans and registers maintained by the Land Titles Office (now held by Land Information Authority, as the compilation note indicates) will need updating to reflect the statutory changes (s 3(a)(i); s 3(b)(ii)). The statute references specific plan numbers and a Certificate of Title, so administrators must reconcile those records with the statutory changes.

The Act is narrowly targeted geographically and institutionally. It does not create new private rights or duties beyond extinguishing enumerated rights and re‑allocating ownership claims to the Commission or the Crown. The Act is silent on compensation, compensation procedures, or transitional mechanisms for displaced users; therefore affected private parties may need to seek redress, if any, under other statutes or general law.

The Act creates, removes or clarifies a narrow set of legal rights and executive discretions; it does not create ongoing administrative duties beyond the execution of the statutory transfers.

Rights created or confirmed

• Right of the Governor to grant fee simple to the Commission. Section 3(a)(ii) authorises the Governor to grant the fee simple in possession in the Gazetted land and in the land comprised in the road and right‑of‑way to the Commission. That is a statutory power to vest ownership in a statutory body.

• Right of the Commission to receive the fee simple without payment. The Commission “shall not be required to pay any consideration or fee for the grant” (s 3(a)(ii)). That is an entitlement created by statute.

Rights extinguished or removed

• Public rights of way and the public road. On coming into operation, the Carlotta Street public road (one chain wide along specified boundaries) and the 30‑links public right‑of‑way along boundaries are closed, and “all rights‑of‑way over them cease” (s 3(b)(i)). The extinguishment is statutory.

• Prior legal status under Transfer of Land Act. The lands identified by Certificate of Title Vol 1136 Folio 784 and the closed road/right‑of‑way are removed from the operation of the Transfer of Land Act 1893 and constituted Crown land (s 3(a)(i); s 3(b)(ii)). That removes the protections, processes and registration mechanisms specific to the Torrens system as it applies to those parcels.

Discretions and decision points

• Governor’s discretion as to reservations. The Governor may grant the fee simple “either without reservation, or with such reservations including reservation to the Crown of rights to mines of coal and other minerals, if any, in the land, as the Governor thinks fit” (s 3(a)(ii)). The law therefore delegates to the Governor the content of any retained Crown rights at the time of grant.

• Cancellation of specified Order in Council is effected by the Act itself (s 3(a)(iii)). No administrative action is required to cancel, but the statute effects the cancellation as a legal operation.

Duties absent or silent

• No express duty to pay compensation. The Act contains no provision requiring payment of compensation to former titleholders or persons previously using the road and right‑of‑way, nor any procedure for compensation in respect of the extinguishment of rights (the Act is silent on compensation). That statutory silence creates a gap that may be relevant to claims under other law, which the Act itself does not resolve.

• No express procedural duty for the Commission after receiving a grant. Beyond authorising grants, the Act does not impose active duties on the Commission for development, re‑subdivision timing, or use other than the general purpose stated in the long title and s 3, which is to facilitate re‑subdivision for the purposes of the State Housing Act 1946.

Practical legal effects

• Change in title regime. A practical duty will arise on administrators to ensure land records reflect removal from the Transfer of Land Act and revesting as Crown land, and to execute the Governor’s grant when made (s 3(a)(i)-(ii); s 3(b)(ii)). While those duties are administrative, they follow directly from the statutory operations.

• Update of public road and plan records. The closure of Carlotta Street and the right‑of‑way extinguishes rights and requires updating of survey and municipal records (s 3(b)(i)).

In sum, the Act confers an entitlement to the Commission to be granted fee simple by the Governor, extinguishes the specified rights of way, converts the legal regime of identified parcels, and leaves other matters, compensation, implementation mechanics, and detailed development obligations,to be addressed outside the Act.

The Act contains no criminal offences, penalty clauses, or express administrative enforcement mechanisms. Its key operatives are statutory transfers and closures that take effect by operation of law rather than by enforcement proceedings.

Legal operation rather than penal sanction

• Transfers and cancellations occur by statutory direction. The removal of land from the Transfer of Land Act and its constitution as Crown land are effected by s 3(a)(i). The Governor’s power to grant fee simple is authorised by s 3(a)(ii). The specified Order in Council is cancelled by s 3(a)(iii). The public road and right‑of‑way are closed and their rights cease on commencement under s 3(b)(i). These are self‑executing statutory effects, they do not depend on a penalty regime to be enforced.

No express remedies or penalties in the Act

• Silence on proceedings. The Act does not create consequences for non‑compliance, because the principal operations are not framed as duties enforceable by penalty. For example, it does not prescribe penalties for continuing to use the closed road after revesting, nor does it provide a procedure for enforcing extinguishment. The practical consequence is that any contravention (for instance, unauthorised use after closure) would be dealt with, if at all, under other applicable laws or through civil proceedings, not under this Act.

Enforcement paths likely outside the Act

• Property, tort or public law remedies. Because the Act effects property transfers and extinguishments, disputes about title, trespass, or interference with land would proceed under general property law or other relevant statutes. The statute itself provides the legal basis for revesting and for the Governor’s grant, which would be relied upon as a title foundation in any subsequent civil litigation. The Act’s silence on enforcement mechanisms means parties must look to the Land Act 1933, Transfer of Land Act 1893 (to the extent it still applies elsewhere), local government bylaws, or court remedies for redress.

• Administrative implementation by executive agencies. The practical effecting of grants, registry changes and plan updates will require administrative steps by the Crown, the Commission and registry authorities. Failure to implement those administrative steps might be subject to administrative review or judicial review if a party alleges improper exercise of discretion, but the Act does not set out specific enforcement processes for such implementation.

Consequential legal uncertainty

• The absence of statutory compensation and enforcement mechanisms can create practical exposure. Because the Act extinguishes rights (for example public rights of way) and alters title without prescribing compensation, affected parties may seek remedies under other statutes or the common law. The Act does not specify the standard, forum, or mechanism for resolving such disputes.

Overall, the Act relies on legal effect and administrative implementation rather than on a bespoke penal or enforcement architecture. Enforcement and remedies for any disputes arising from the statutory operations will therefore depend on other laws and judicial processes outside the text of this Act.

The Act expressly references several existing statutes and an Order in Council, and it defines how they interact with the statutory operations it implements.

Primary statutory relationships

• Transfer of Land Act 1893. The Act removes specified parcels from the operation of the Transfer of Land Act 1893 (s 3(a)(i); s 3(b)(ii)). That statutory removal transforms the legal character of title and registration for the affected parcels by excluding them from the Torrens title system’s statutory regime. The Act does not otherwise amend the Transfer of Land Act; it creates an exception for the specific parcels described.

• Land Act 1933. When the Act removes land from the Transfer of Land Act, it simultaneously constitutes that land as Crown land “according to the meaning given to the expression, ‘Crown land’ by section four of the Land Act 1933” (s 3(a)(i)). The Act therefore imports the Land Act’s concept of Crown land to define the status of the parcels, thereby linking their subsequent management to the Land Act regime.

• State Housing Act 1946. The long title and the operative text state the purpose is “to facilitate re‑subdivision of the Gazetted land for the purposes of the State Housing Act 1946” (long title; s 3). The Commission defined in s 2 is the State Housing Commission constituted under the State Housing Act 1946. The Act therefore creates a pathway for the Commission (an instrumentality under the State Housing Act) to acquire land for housing purposes. The Act does not specify the content of subsequent housing developments; it creates the landholding and title pathway subject to the State Housing Act’s governance.

• Public Works Act 1902 and amending Acts. The Gazetted notice referenced in s 2 was published pursuant to the Public Works Act 1902. The Act contains a specific saving in s 3(a)(iv): the amendments to the Public Works Act effected by the Public Works Act Amendment Act 1955 and the Public Works Act Amendment Act 1956 are declared not to apply, and to be deemed never to have applied, to the Gazetted land, the operation of this Act, the Governor’s exercise of powers under this Act, or the use of the land for State Housing Act purposes. That is a direct legislative statement controlling the interplay between the Public Works Act amendments and this Act.

• Order in Council and Gazette entries. The Act cancels the specified Order in Council which had authorised the Minister for Railways to construct cottages on the land (s 3(a)(iii)). The Act therefore supersedes the prior executive authorisation published in the Gazette of 25 August 1950 (s 2). The Gazetted notice is defined in s 2 as the Gazette publication by which the land was vested in the Crown for railway cottages.

Registry and survey interaction

• Land Titles Office records and plans. The Act uses plan and certificate references (Plan 4824, Certificate of Title Volume 1136 Folio 784) (s 2). The operational changes, removal from Transfer of Land Act, revesting of road/right‑of‑way,will require the relevant land registry and land information authorities to update their records to reflect the Crown land status and the Governor’s grant where given (s 3(a)(i); s 3(b)(ii)). The compilation note indicates that Land Titles Office plans are now held by the Western Australian Land Information Authority, which implies administrative coordination will be required to reflect statutory changes.

Areas where the Act displaces or clarifies previous law

• Prior vesting and public works powers. By cancelling the specified Order in Council (s 3(a)(iii)) and declaring non‑application of later Public Works Act amendments to the Gazetted land (s 3(a)(iv)), the Act clarifies that the statutory regime governing this land shall proceed under the terms of this Act and the Land Act framework, not under the subsequent Public Works Act amendments. That is a directed legislative choice about which statutory powers and processes control the land.

Limits and silences

• Compensation and dispute resolution. The Act does not interact explicitly with compensation schemes or dispute procedures in other statutes. Because the statute extinguishes rights and alters title forms without prescribing compensation, parties seeking remedy must rely on other laws or common law processes. The Act’s silence means that its interactions with compensation or compulsory acquisition frameworks must be resolved by reference to other legislation or legal doctrines.

In short, the Act is framed to sit alongside and to override certain prior administrative acts (Order in Council and gazette notice) and to carve out specific parcels from the Transfer of Land Act into the Crown land regime under the Land Act, while expressly insulating the parcel from specified amendments to the Public Works Act.

The compilation and schedule material attached to the Act indicate a concise legislative history limited to the original enactment. The compilation table shows the East Carey Park Land Vesting Act 1957, No. 67 of 1957, assented on 6 December 1957 and commencing the same day. No subsequent amendments to the Act appear in the compilation table included in the text provided.

Matters of note from the Act text about legislative interaction

• The Act itself refers to earlier amending Acts of the Public Works Act, namely the Public Works Act Amendment Act 1955 and the Public Works Act Amendment Act 1956, by defining them as “amending Acts” in s 2 and then stating in s 3(a)(iv) that the amendments they effected do not apply and shall be deemed never to have applied to the Gazetted land or the operation of this Act. That provision is not an amendment to this Act, but an express statutory saving clarifying historical interplay between enactments. The Act therefore records a legislative intent to insulate the specified land from later statutory developments affecting public works.

• The compilation note appended to the Act observes that Land Titles Office plans are now held by the Western Australian Land Information Authority pursuant to the Land Information Authority Act 2006 s 100. This is a post‑enactment administrative change identified in the compilation note, not an amendment to the East Carey Park Land Vesting Act itself. The compilation note does not record any textual amendments to the 1957 Act.

Absence of recorded amendments

• The source supplied contains no entries in the compilation table showing any subsequent amendment Acts that alter the text of the East Carey Park Land Vesting Act 1957. The shortness of the Act and the compilation information provided suggest the instrument was enacted for a one‑off purpose and was not subsequently amended in the material supplied.

Practical implication of the static amendment history

• Because the Act is specific, targeted and short, and because no amendments are shown in the supplied compilation, practitioners should treat the statute as historically single‑purpose legislation remaining in its original form according to the supplied text. Any later legislative interventions affecting the land or the Commission’s powers would be reflected in separate statutes or later amendments, none of which are recorded in the present compilation excerpt.

The supplied text contains no recorded litigation history, case citations, or references to judicial interpretation. The Act itself names no cases and includes no schedule of judicial decisions. The compilation entry does not list any judicial decisions or disputes arising under the Act.

Observations and possible litigation vectors implied by the statutory text

• Silence on compensation and extinguishment of rights. Because the statute removes land from the Transfer of Land Act, extinguishes rights‑of‑way, and revests land in the Crown without providing for compensation in the text, legally aggrieved parties (for example, those who previously used the right‑of‑way or held interests tied to the Certificate of Title) might have had potential grounds to pursue remedies under other legislation or common law theories. The Act’s silence on compensation suggests that any litigation that might have arisen would have been grounded outside this Act, perhaps on claims for compensation under general acquisition statutes or on administrative law grounds. The supplied text does not record whether such claims were made or litigated.

• Cancellation of the specified Order in Council. The statutory cancellation of an Order in Council that originally authorised a public works vesting could potentially give rise to disputes about the legal effects of that cancellation, including the status of any works already carried out or contracts entered into under the prior authorisation. The supplied text contains no record of litigation on those points.

• Title and registration disputes. The conversion of Torrens title parcels to Crown land, and the Governor’s subsequent power to grant fee simple to the Commission, could, in principle, generate disputes about the formal steps required for title transfers, the adequacy of registration changes, or the content of reservations. Again, no litigation is recorded in the supplied statute.

Practical consequence for researchers and practitioners

• The absence of litigation history within the Act text means that to establish whether any disputes did arise, one must search external judicial databases, government records or archival material. The Act does not itself catalogue such events. The statutory silence should be treated as a gap in the supplied source rather than evidence that no disputes ever occurred.

In sum, the supplied material contains no litigation history. The statute sets out transactional and title changes that could, in principle, generate disputes, but any such litigation would have to be identified by independent case research; it is not recorded in the Act itself.

The Act’s brevity and targeted operations contain several technical features and silences that are practical hazards for lawyers, conveyancers, planners and administrators. The following points are grounded in the text.

1. Removal from the Transfer of Land Act is categorical. Section 3(a)(i) removes the specified titled land from the Transfer of Land Act 1893 and constitutes it as Crown land under the Land Act 1933. That is not a nugatory procedural step. It changes the title system from Torrens to Crown land, with different registration, dealings and disposal rules. Conveyancers and registries must not assume Torrens procedures continue to apply to the affected Certificate of Title (Vol 1136 Folio 784).

2. The Governor’s grant is discretionary in content. Section 3(a)(ii) allows grants “either without reservation, or with such reservations … as the Governor thinks fit.” Practically, this means the Commission may receive fee simple title subject to Crown‑reserved rights, including mineral reservations. The Commission is assured of not paying consideration, but the content of any retained Crown rights is left to gubernatorial choice.

3. No statutory compensation or transitional mechanism is provided. The Act extinguishes rights‑of‑way and closes a public road on commencement (s 3(b)(i)) and removes land from Torrens operation without specifying compensation or substitute access. If claims exist for loss of easements or access, the Act is silent; rights and remedies, if any, must be sought under other law or common law. Practitioners should note the statutory silence on compensation.

4. The Act cancels an Order in Council and excludes later Public Works Act amendments. Section 3(a)(iii) cancels the specified Order in Council that had authorised railway cottages, and s 3(a)(iv) declares certain Public Works Act amendments not to apply. These are narrowly targeted legislative overrides. When reviewing historical authorisations, one must rely on the Act’s cancellation and non‑application language rather than any continuing force of the prior Gazette or amending legislation.

5. Reliance on historic measurements and plans. The road and right‑of‑way closures are described by historical measures (one chain, thirty links) and by reference to Land Titles Office Plan 4824. Accuracy in survey interpretation is important. Where modern survey practice or metric conversions are required, care is needed to align plans and registry updates with the Act’s literal descriptions.

6. Registry implementation required. The statutory operations will require registry and administrative updating. Because land is removed from Transfer of Land Act operation and revested, registry authorities must reclassify the land. Failure to do so could cause title uncertainty. The Act does not spell out administrative steps; it simply effects the legal change.

7. Narrow geographic and textual scope. The Act pertains only to the parcels expressly identified, the Gazette entry of 25 August 1950 and the specified Order in Council. Any attempt to apply its mechanism to other parcels would require fresh legislative authority.

8. Effect on third‑party contracts and developments. The Act cancels the prior authorization for railway employee cottages and alters title. If third parties had contracts contingent on the prior Order in Council, the statutory cancellation may affect their expectations. The Act does not provide transitional contractual relief or express statutory validation for existing contracts.

9. The Commission acquires without payment, but may take subject to reservations. The statutory grant to the Commission is free of consideration (s 3(a)(ii)). That is a clear fiscal implication, but the grant may also carry reservations that limit effective ownership, depending on gubernatorial choices; the text permits such outcomes.

10. The Act is silent on subsequent development controls. While the Act enables re‑subdivision for State Housing Act purposes, it does not address planning approvals, compliance with local government requirements, or environmental obligations. Those processes remain governed by other statutes and rules.

These points are not conclusive criticisms, but they are technical traps and implementation issues that arise directly from the Act’s text and its silences. Practitioners should treat them as items for due diligence and administrative planning.

Compliance here predominantly means ensuring that the statutory transfers and closures are correctly implemented and that affected parties understand the change in legal status. The Act creates legal effects on commencement, and administrative steps should follow to align land records, planning, and titles with the statutory changes.

1. Confirm parcels and documentary references. Before taking any action, verify the exact parcels by reference to the Certificate of Title Volume 1136 Folio 784 and Land Titles Office Plan 4824 as defined in s 2. The Gazetted land definition lists specific Lots 20, 23-34 inclusive and parts of Lots 19, 21, 22, as well as Wellington Location 296 and Reserve No. 935. Accurate identification is necessary to avoid acting on the wrong parcels.

2. Note the automatic operations on commencement. The road and right‑of‑way closures occur “on the coming into operation of this Act” (s 3(b)(i)). That is an operative date on which rights of way cease. Administrators should record that date and ensure municipal road registers, cadastral maps and public access records are updated accordingly.

3. Implement registry changes to reflect removal from the Transfer of Land Act and constitution as Crown land. Section 3(a)(i) removes the specified titled land from the Transfer of Land Act and constitutes it as Crown land per Land Act 1933 s 4. Registry and land information authorities must therefore move the parcels out of Torrens registration into Crown land records and apply the Land Act framework. Practical steps include instructing the Land Titles Office (or current custodians, see compilation note) to note the statutory removal and to update plan custody and status.

4. Execute or procure the Governor’s grant instrument. The Act empowers the Governor to grant the fee simple in possession to the Commission (s 3(a)(ii)). For the Commission to obtain its legal title, a formal grant instrument should be prepared and executed under the Governor’s authority. The instrument must state whether any reservations are retained in the grant, because the Governor may include reservations “as the Governor thinks fit” (s 3(a)(ii)).

5. Record any reservations in the grant and in registry records. If the Governor reserves rights (for example mineral rights), ensure those reservations are expressed in the grant instrument and recorded in the relevant land records so that the Commission’s fee simple is clear as to its limitations.

6. Update cadastral and municipal records for the closed road and right‑of‑way. Section 3(b)(ii) revests the land comprised in the closed road and right‑of‑way in Her Majesty and removes it from the Transfer of Land Act to permit its inclusion in re‑subdivision and grant. Planning authorities, local councils, and surveyors should update their records to reflect the closure and revesting, and ensure that the land can be lawfully included in the re‑subdivision.

7. Check for contractual or statutory obligations arising from cancelled Order in Council. Section 3(a)(iii) cancels the specified Order in Council authorising railway cottages. If existing contracts or works were in place under that prior authorization, review contractual rights and obligations and any statutory pathways for redress, because the Act does not itself address transitional contractual consequences.

8. Consider external approvals for development. The Act facilitates re‑subdivision for State Housing Act purposes, but it does not supersede planning approvals, building permits or environmental approvals required under other statutes or local government instruments. The Commission should obtain any necessary approvals in the usual way for subdivisions and development.

9. Communicate to affected stakeholders. Because rights of way are extinguished and title regime changes occur, notify adjacent landholders, service providers and the public records offices. Clear communication will reduce the risk of inadvertent trespass or misunderstandings about public access.

10. Legal review for compensation exposure. The Act is silent on compensation for extinguished rights. The Commission and Crown agencies should obtain legal advice on whether any compensation claims might be brought under other laws and what administrative reserves or processes should be in place to address such claims if they arise.

11. Maintain documentary trace of statutory basis. When effecting all administrative changes, ensure that conveyancing instruments, registry entries and public notices cite the East Carey Park Land Vesting Act 1957 and the relevant sections used (notably s 3(a)(i), s 3(a)(ii), s 3(a)(iii), s 3(a)(iv), s 3(b)(i), s 3(b)(ii)) so that title and the public record reflect the statutory provenance of the changes.

Complying with the Act therefore requires coordinated steps between the Commission, the Governor’s office, registry authorities and local planning agencies to implement statutory vesting, effect necessary conveyancing instruments, update records, and manage any residual claims by third parties. The Act provides the statutory authority for the changes, but administrative execution is required to make the legal changes manifest on the ground and in registries.
