#### 46 Agreements and arrangements arising from mediation 46 Agreements and arrangements arising from mediation > > (1) The Tribunal may make orders to give effect to any agreement or arrangement arising out of the mediation of a claim. > > > (2) The Tribunal is not to make an order entering judgment in favour of the plaintiff if the plaintiff has failed to provide any evidence that the plaintiff has been required to provide by the mediator under clause 42 and that failure is continuing, unless the failure is due to the death or permanent incapacity of the plaintiff. > > > (3) This Division does not affect the enforceability of any other agreement or arrangement that may be made, whether or not arising out of mediation of a claim, in relation to the matters the subject of a mediation.
