Drugs, Poisons and Controlled Substances (Poppy Cultivation and Processing) Regulations 2024

• Where a processor has a current contract with a licensed grower, the processor must report a set of discrete crop events to the Secretary within 28 days, including hectares sown, hectares failed with the date of failure, and hectares harvested with total poppy straw in kilograms (reg 17(g)). Processors must therefore collect and retain field-level data from growers and be able to report it to the Secretary within that window. This creates contractual and data-flow obligations between processors and growers.

7. Inspector charging mechanics

• Authorised inspectors are "authorised and required" to impose fees at the stated rates (reg 22(1)). Charges are computed in quarter-hour increments or parts thereof both for work performed and for travel time at a higher rate, with a set travel cap (reg 22(2)). Practically, this can produce a material cost where an inspection requires significant sampling, travel or multiple inspector visits. The Regulations do not prescribe dispute or appeal procedures for those charges, and they do not specify invoicing intervals.

8. Access to the alkaloid poppy register by contractors and subcontractors

• Reg 20(c) allows contractors, subcontractors and their employees to be authorised to access the register. That broad class raises operational data access and privacy considerations because authorisation may cause data to leave the core Departmental staff; the only safeguard in the Regulations is that authorisations must be in writing (reg 21), not that data transfer protections are set out within the instrument.

9. No transitional provisions in the instrument

• The Regulations revoke the 2014 Regulations (reg 4) but do not include transitional savings or express continuity provisions. Practitioners should check whether departmental guidance or the principal Act provides transitional arrangements for licences that existed under the old instrument.

10. Multiple small deadlines and recordkeeping

• The Regulations impose several short and discrete deadlines (7 days, 14 days, 28 days) for different operational tasks (reg 10(d); reg 10(f); reg 17(f); reg 17(g)). Combining these with the requirement to hold and supply employee identification certificates and contract copies may create administrative complexities for multi-site operators.

11. Differences in penalty unit amounts across offences

• The Schedule sets different penalty units for different Act sections. For several reporting failures the infringement level is 10 penalty units (≈ $1,923), while some lesser procedural breaches attract 5 or 6 penalty units (≈ $962 or $1,154). Practitioners must map the precise Act provision in question to the Schedule item to determine the infringement quantum (reg 23; Schedule 1).

Each of these "gotchas" is a concrete operational or fiscal hazard stemming from the text of the Regulations. Compliance systems should be designed around the numerics (fee unit multipliers, penalty unit values and rounding rules), the notification windows, signage and destruction deadlines, inspector charging exposure, and the contract/data reporting flows between processors and growers.

Below is a practical compliance checklist and recommended administrative measures directly tied to the Regulations’ text. Each item references the relevant regulation(s) so practitioners can trace obligations to source.

A. Before applying for a licence

• Identify licence class: cultivation or processing, and confirm which sections of the Act (Part IVB) apply. The Regulations are made under s 69V and s 132 (reg 2).
• Prepare employee particulars and identification certificates: For an application you must supply the full name, date of birth, residential address and position of each employee to be employed under the licence and a copy of the employee identification certificate for each (cultivation: reg 7(a)-(b); processing: reg 14(a)-(b)). Collate and retain certified copies of employee identification certificates so they are ready for submission and for renewal.
• Budget for fees and charges: Use the fee unit conversion rules in the Endnotes and the current fee unit value. For 2023-24, use $15.90 per fee unit and round to the nearest 10 cents (Endnotes). Anticipate:
  • Cultivation application: 58.88 fee units ≈ $936.20 (reg 6).
  • Processing application: 58.88 fee units ≈ $936.20 (reg 13).
  • Processing licence administrative recovery fee: 811.27 fee units ≈ $12,899.20 payable on issue (reg 18).
  • Designate a cashflow plan for these costs.

B. Site security and signage (operational controls)

• Gates and locks: Ensure any gate to a cultivation area is kept securely locked except when a licensed grower or authorised employee is present (cultivation: reg 10(a)). For processors, ensure premises and buildings are kept securely locked unless the licensed processor or an employee authorised to undertake activities under the licence is present (processing: reg 17(b)).
• Fencing: For cultivators, install and maintain a fence between cultivation areas and livestock on-site or on adjacent land to prevent livestock entry (reg 10(b)). For processors, ensure sufficient fencing exists to prevent unauthorised access (reg 17(a)).
• Signage: Place and maintain signs that meet the prescribed wording and technical requirements:
  • Cultivation signs must include the words "danger", "prohibited area", "keep out", "trespassers prosecuted" and "illegal use of crop may cause death", be A3 or larger, weather resistant, legible and placed at intervals of 250 metres or less along a fence or boundary adjacent to a public road (reg 10(c)(i)-(v)).
  • Processing signs must include "danger", "prohibited area", "keep out" and "trespassers prosecuted", be A3 or larger, weather resistant and legible (reg 17(c)(i)-(iv)).
• Maintain photographic or dated records of signage placement and condition to demonstrate compliance.

C. Cultivation and post-harvest destruction processes

• Implement a documented procedure to destroy alkaloid poppy material remaining in cultivation areas within 7 days of harvest (reg 10(d)). Maintain dated records of destruction.
• Implement a monitoring program to identify any alkaloid poppy plants that are volunteers (not intentionally grown) and destroy them prior to flowering, with dated evidence (reg 10(e)).
• For processors, prepare an immediate removal/destruction protocol for any alkaloid poppies found on the specified premises (reg 17(d)).

D. Notifications to the Secretary

• Employee changes: Prepare a notification template for provision within 14 days of any change to current employees carrying out activities under the licence, including full name, date of birth, residential address, position and a copy of the employee identification certificate (cultivation: reg 10(f); processing: reg 17(e)).
• Risk management plan changes: Prepare a template and internal trigger to provide written notice to the Secretary within 14 days of any change to the risk management plan for the licence (cultivation: reg 10(g); processing: reg 17(f)).
• Contract registration: When requesting registration of a contract under s 69TA of the Act, ensure a copy of the contract is provided to the Secretary (reg 11).
• Processor reporting for contracted growers: If the processor holds a current contract with a licensed grower, set up data collection and reporting workflows to report within 28 days of the completion of sowing (total hectares planted), of crop failure (date and hectares failed), and of harvest (total hectares harvested, date and total quantity of poppy straw harvested in kilograms) (reg 17(g)). This will require data transfers from growers and clear contractual obligations about data timeliness.

E. Licence amendment and renewal planning

• Plan for licence amendment fees: Any application to amend a licence will attract a prescribed fee of 13.08 fee units (reg 19). Budget and plan for timely amendments to avoid multiple application cycles.
• Renewal calendars: Renewals have set renewal fees (cultivation renewal 39.25 fee units; processing renewal 19.63 fee units) and the processing licence also incurs the administrative recovery fee on renewal (reg 8; reg 15; reg 18( b)). Maintain an internal licence register and calendar to manage renewals, payments and supporting documentation.

F. Inspection readiness and managing inspector charges

• Prepare to be charged for inspection time and travel: Authorised inspectors are authorised and required to impose fees at 1.45 fee units per quarter of an hour or part thereof for inspection and related services, and 2.08 fee units per quarter of an hour or part thereof for travel time, subject to a travel maximum of 16.64 fee units (reg 22). With a 2023-24 fee unit value this is approximately $23.10 per quarter hour for inspection and $33.10 per quarter hour traveled with a travel cap of $264.60. Ensure a mechanism for prompt payment and dispute resolution with the inspecting authority as appropriate.
• Maintain compliance documentation and records to reduce inspection durations and therefore inspector charges. Keep records of destroyed material, signage photos, employee identification certificates, risk management plan versions and contract copies readily accessible to inspectors.

G. Data protection and register access

• Limit contractor access to the alkaloid poppy register to those with written authorisation from the Secretary (reg 20; reg 21). Retain copies of any written authorisation, and ensure any contractor/subcontractor with access is bound by contractual confidentiality and data protection obligations.

H. Financial controls and cashflow

• Because processing licence administrative fees are large and recurring on renewal, processors must include these charges in their pricing and cashflow models. Cultivators must budget for the annual cultivation administrative fee in any year that poppies are cultivated (reg 12(2); reg 18).
• Implement fee schedules and a payment authorisation process to ensure timely payment of licence fees, amendment fees, inspector charges and any infringement penalties.

I. Prepare for infringement risks

• Map the Act sections referenced by Schedule 1 to internal procedures so that breaches of the Act that are prescribed as infringement offences with fixed penalty units can be identified and managed before an infringement notice is issued (reg 23; Schedule 1). For any alleged breach, practitioners should consider contesting an infringement within the administrative framework or seeking legal advice on potential defences and the impact of paying versus contesting.

J. Record retention

• Keep records sufficient to demonstrate compliance with the Regulations: employee particulars and identification certificates, contract copies provided to the Secretary, destruction records and dates, risk management plan versions and change notices, signage placement/maintenance records, and processor grower-reporting data (hectares and poppy straw weights). These records will be relevant during inspections and in responding to any infringement notice.

Following this checklist will align operational practice to the specific prescriptions of the Regulations: application/renewal particulars (reg 7, reg 9, reg 14, reg 16), minor licence conditions (reg 10, reg 17), contract and reporting requirements (reg 11, reg 17(g)), inspector charging (reg 22) and fee payment obligations (reg 6, reg 8, reg 12, reg 13, reg 15, reg 18, reg 19). Where departmental guidance exists it should be reviewed for administrative forms, submission methods and billing procedures not detailed in the instrument.
