201Secrecy

201 Secrecy (1) This section applies to an analyst or any other person who is, or has been, engaged in exercising powers or duties under this Act. (2) A person to whom this section applies shall not, either directly or indirectly, except in the exercise of a power or a duty under this Act— (a) make a record of, or divulge or communicate to any person, any information acquired by the firstmentioned person about a manufacturing or trade process or the affairs of another person; or (b) produce to a person a document produced to, or otherwise acquired by, the firstmentioned person; because of the exercise of those powers or duties. (3) Nothing in this section applies in relation to the giving of information— (a) about a person if the giving of the information is necessary to remove a threat to the life or health of the person; or (b) to a police officer in answer to a lawful request by the police officer while acting in the course of his or her duty; or (c) to a court, by way of the production of a document or otherwise, in accordance with a subpoena; or (d) to a person, relating to the personal affairs of the person requesting the information.
