45A Initial assessment of referral On a referral being made under section 45, a conciliation officer nominated by the chief dispute resolution officer must make an initial assessment to determine whether— (a) the dispute referred is a domestic building work dispute; and (b) the referral was made within the required time; and (c) at least one of the parties to the dispute appears willing to participate in conciliation in good faith; and (d) proceedings in relation to the matter in dispute have commenced in VCAT or in a court.
