DOMESTIC AND FAMILY VIOLENCE REGULATIONS 2008

Key statutory objects and terms are concentrated in Part 3 and the definitions in regulation 5. The operative concept is that testing is an ancillary compliance mechanism attached to a DVO that expressly prohibits alcohol or drug use and requires monitoring to enforce that prohibition (regulation 4). The Regulations then specify the available tests, who may direct them, who may perform them, and how test results are to be converted into admissible evidence.

Definitions and roles (regulation 5)

• Authorised person: by default a police officer, and otherwise any other person or class of persons authorised in writing by the Commissioner of Police for the purposes of this Part (reg 5(1)(b)). This creates a tripartite structure: police as the baseline enforcers; the Commissioner as gatekeeper for delegation to others; and the written-authorisation mechanism that imposes a formal control on non-police delegation (reg 17 sets training and capability conditions).
• Analyst: defined by cross-reference to other Acts (Traffic Act s19C for saliva and blood analysts and the Misuse of Drugs Act s3(8) appointment), thereby importing specialist accreditation regimes for laboratory analysis (reg 5(1)(a)).
• Qualified person: a person trained by a registered training organisation to take blood samples (reg 5(1)).
• Health practitioner: a person registered under the Health Practitioner Regulation National Law (reg 5(1)).

Types of tests and triggering mechanics

• Breath test: a preliminary test to assess whether alcohol may be present (reg 6). A respondent must comply with reasonable directions to submit to such a test, and "reasonable" does not require suspicion that the person has consumed alcohol (reg 6(2)).
• Breath analysis: a formal analytical measurement using a prescribed breath analysis instrument (reg 7). It can be required if a sufficient breath sample cannot be provided or if there are reasonable grounds to suspect alcohol consumption. The regulation permits detention or arrest for the purpose of conducting the breath analysis or taking the respondent to a place where it is to be carried out (reg 7(3)). Only authorised operators may use the breath analysis instrument (reg 8; regime for authorisation in regs 16-17).
• Saliva and urine tests: employed to assess whether prohibited drugs may be present (regs 10-11). Respondents must comply with reasonable directions to submit to these tests; again, reasonable does not require suspicion (regs 10(2), 11(2)). Police may detain or arrest for the purposes of conducting these tests or taking the respondent to testing (regs 10(3), 11(4)).
• Blood samples: may be required in enumerated circumstances (reg 12(1)), including failure to provide sufficient samples for other tests, suspicion when breath analysis is not possible or malfunctions, or where the respondent has a medical condition impeding other sample collection methods (reg 12(1)(a)-(g)). Samples must be taken by a health practitioner or a qualified person and may be taken regardless of consent (reg 13(1)-(2)). The sample becomes the property of the Territory (reg 13(3)).

Evidence and proof

• Analyses must be carried out by analysts (regulation 14).
• Regulation 15 prescribes certificates from three sources as evidence: the Commissioner of Police (about authorised statuses), an authorised person (about breath instrument use and results and tests administered), and an analyst (about sample analysis). The certificates are evidence of the matters stated and the facts on which they are based (reg 15).

Controls on who may act

• Police are the automatic authorised persons for breath, saliva and urine tests (reg 16(1)). Police officers authorised under the Traffic Regulations to operate a prescribed breath analysis instrument are authorised for breath analyses under these Regulations (reg 16(2)).
• The Commissioner of Police may authorise non-police persons in writing to carry out breath tests, saliva tests and urine tests, and may authorise them to perform breath analyses if further training and capability criteria are met (regulation 17). The Commissioner must be satisfied of training and capability (reg 17(2)-(3)).

Protections and liabilities

• Health practitioners, qualified persons and analysts (and persons acting under their supervision) have civil and criminal immunity for acts and omissions done in good faith for the purposes of this Part (regulation 18).

Interjurisdictional recognition

• Regulation 3 prescribes certain interstate DVOs for the purposes of section 103A(1)(h) of the Act; regulation 3A prescribes certain registered foreign orders for section 103B(h). The Regulations list specific Acts and orders by name, including family violence restraining orders under WA’s Restraining Orders Act 1997, certain ACT and Queensland orders, and registered foreign orders under particular interstate Acts (regs 3 and 3A).

Taken together, the Regulations establish a statutory architecture that channels enforcement through police or Commissioner-authorised persons, requires trained analysts for laboratory work, makes Territory ownership of samples explicit, and streamlines evidentiary proof by certificate.

Primary affected actors

• Respondents to DVOs that both prohibit alcohol or a specified drug and include an ancillary testing requirement: the testing regime applies only where those two conditions are met (regulation 4). This means that respondents subject to DVOs without such prohibitions or without a monitoring ancillary order are outside this Part.
• Police officers: every police officer is automatically authorised to carry out breath, saliva and urine tests under this Part (reg 16(1)), and police authorised under traffic legislation are authorised to conduct breath analyses (reg 16(2)). Police exercise powers to require tests, to detain or arrest respondents for testing, and to provide certificates about testing and instrument operation (regs 6-7, 10-12, 15-16).
• Commissioner of Police: decides whether to authorise non-police persons in writing to carry out tests or breath analyses (regulation 17). The Commissioner also provides certificates as to authorised statuses and analyst appointments (regulation 15(a)-(b)).

Secondary affected actors

• Non-police persons who may be authorised by the Commissioner: the Regulations foresee authorised classes other than police (reg 5(1)(b) and reg 17). Such persons must be trained and capable to be authorised. Their role may be operational testing in roles outside direct police delivery, subject to written authorisation and training criteria (reg 17(2)-(3)).
• Health practitioners and qualified persons: authorised to take blood samples (reg 13(1)), and given statutory protection against civil and criminal liability for acts done in good faith under this Part (reg 18). Qualified persons must have specific vocational training (reg 5(1)).
• Analysts and laboratories: analysts are the only persons permitted to carry out analysis of saliva, urine and blood samples (regulation 14). The analyst definition imports statutory appointment or authorisation processes from the Traffic Act and the Misuse of Drugs Act (reg 5(1)(a)). Analysts or their employees may sign certificates that are admissible in court (reg 15(d)).
• Courts and prosecutors: receive and rely on certificates as evidence under regulation 15. The certificate mechanism affects how evidence of testing and analysis is tendered and proved.
• The Territory as institutional owner: blood samples taken under this Part are expressly the property of the Territory (reg 13(3)). This confers statutory ownership and therefore control over the sample post-collection.

Who bears compliance costs and practical burdens

• Respondents bear the immediate compliance burden of submitting to tests and following directions for how samples are to be provided (regs 6(1), 7(2), 10(1), 11(1), 11(3)). They also face the risk of detention or arrest for non-compliance (regs 7(3), 10(3), 11(4), 12(2)).
• Police and the Commissioner’s office bear administrative and operational costs of authorising non-police persons, maintaining training standards, organising access to breath analysis instruments and analysts, and exercising detention and transport powers.
• Health services and laboratories that take and analyse samples will incur the work of sample collection and analysis, but the Regulations confer immunity for good faith acts (reg 18), which removes certain legal cost risks.

Indirectly affected groups

• Protected persons and victims named in DVOs may be indirectly affected because the Regulations implement a monitoring mechanism that may influence respondent behaviour and enforcement activity; the text, however, prescribes only testing mechanics and does not specify victim-facing processes.
• Interjurisdictional applicants or respondents: regulation 3 and regulation 3A specify which interstate and registered foreign orders are taken for particular statutory recognitions, affecting persons with cross-border orders (regs 3 and 3A).

The Regulations operate by placing statutory obligations on respondents where particular DVO terms exist, vesting coercive powers in authorised persons with police as the primary enforcers, creating a defined role for health practitioners, qualified persons and analysts, and establishing evidence and ownership rules that affect courts, laboratories and the Territory.

Duties imposed on respondents

• Submit to tests and follow directions: A respondent must comply with reasonable directions by an authorised person to submit to breath, saliva or urine tests and to the directions about how those tests are to be conducted (regs 6(1)(a)-(b), 10(1)(a)-(b), 11(1)(a)-(b)). Regulation 7(2) similarly requires compliance with reasonable directions to submit to a breath analysis where triggered.
• Provide sufficient samples and not tamper: For urine testing, the respondent must provide a sufficient sample and must not tamper with the sample (reg 11(3)(a)-(b)). A breath test may require provision of a sufficient breath sample for completion (reg 7(1)(a)).
• Consent not required for blood sampling: If blood is required under the enumerated circumstances in regulation 12(1), a health practitioner or qualified person may take a sample of blood whether or not the respondent consents (reg 13(2)). The Regulations therefore impose a duty to submit, in statutory terms, to blood sampling when the preconditions in regulation 12 arise.

Authorised persons’ powers and duties

• Issue reasonable directions: Authorised persons may direct respondents to submit to tests and must ensure directions are reasonable; the Regulations clarify that reasonableness does not require suspicion for breath, saliva and urine tests (regs 6(2), 10(2), 11(2)).
• Detain and arrest where necessary: An authorised police officer may detain and, if necessary, arrest a respondent for the purposes of conducting breath analyses, saliva tests, urine tests or taking blood samples, or to convey the respondent to testing locations (regs 7(3), 10(3), 11(4), 12(2)). The authority to detain or arrest is expressed for specific testing purposes and is not unlimited in the Regulations.
• Use of breath analysis instruments: An authorised person must not use a breath analysis instrument under this Part unless they are authorised under regulation 16(2) or 17(1)(b) (regulation 8). Regulation 16(2) links the power to authorisation under Traffic Regulations; regulation 17 prescribes Commissioner authorisation for non-police persons, subject to training and capability requirements.

Health practitioners, qualified persons and analysts

• Blood sample takers: Only health practitioners or qualified persons may take a sample of blood (reg 13(1)). Qualified persons must have training from a registered training organisation (reg 5(1)). A person so authorised may take the sample without consent (reg 13(2)).
• Analysts: Analysis of saliva, urine or blood must be carried out by an analyst (regulation 14). The analyst definition imports appointment or authorisation under other Acts (reg 5(1)(a)).

Evidence mechanics and administrative duties

• Provision of statements: Where breath analysis indicates alcohol present, the authorised person who operated the instrument must give the respondent, without delay, a written statement or an instrument-printed statement stating date, time and results of the analysis (regulation 9). This is a procedural duty to ensure immediate notification.
• Certificates: Regulation 15 creates specific evidentiary certificates that can be signed by the Commissioner of Police, an authorised person, or an analyst. These certificates are evidence of the matters stated and the facts on which they are based. The Commissioner’s certificates cover matters like who is authorised to use a breath analysis instrument or to be an analyst; an authorised person’s certificate can state that a breath analysis instrument was used and the result; an analyst’s certificate covers the laboratory analysis. These provisions give administrative actors the duty to produce accurate certificates and give recipients notice of their evidentiary effect.

Protections and limits on liability

• Good faith immunity: Health practitioners, qualified persons and analysts, and persons acting under their supervision, are not civilly or criminally liable for acts done or omitted in good faith under this Part (regulation 18). This is a statutory protection rather than an affirmative right to indemnity funding; it removes personal liability risk so long as acts are in good faith.

Rights not expressly conferred

• The Regulations do not specify rights to independent testing, retention periods, or disclosure protocols for samples once they become Territory property (reg 13(3) makes property ownership explicit but does not set subsequent procedural rights). The text does not create a statutory right to refuse blood sampling where the enumerated preconditions for requiring blood exist, because subregulation 13(2) authorises taking blood whether or not the respondent consents.

Who decides

• The Commissioner of Police decides on non-police authorisations in writing and must be satisfied about training and capability before doing so (regulation 17). Police officers decide on reasonable directions and may detain or arrest for testing purposes where the statutory triggers are met (regs 6-12). Analysts and health practitioners decide on analysis and sample-taking consistent with their statutory statuses and duties. Courts receive certificate evidence under regulation 15.

In sum, the Regulations impose affirmative testing duties on respondents where the DVO terms exist, grant police and Commissioner-determined authorised persons specific coercive and procedural powers, and allocate evidentiary roles to authorised persons and analysts with statutory immunity for good faith acts.

The Regulations themselves do not set specific monetary fines or imprisonment terms within the text supplied. Instead, they create enforcement mechanisms and procedural evidentiary rules that facilitate enforcement of DVO conditions and subsequent proceedings under the Domestic and Family Violence Act and other relevant legislation. The enforcement architecture in the Regulations is shown through the following mechanisms.

Coercive powers for compliance

• Directions and compliance obligations: Respondents must comply with reasonable directions to submit to specified tests, and with directions about how to submit to tests (regs 6(1), 7(2), 10(1), 11(1)). Non-compliance with an order in a DVO will be enforced under the primary Act and related enforcement provisions of the Northern Territory legal framework; the Regulations create the test-enforcement duties that feed into those processes.
• Detention and arrest: Police may detain and, if necessary, arrest a respondent for the purpose of conducting breath analyses, saliva tests, urine tests or taking a blood sample, and to take respondents to the places where tests should be carried out (regs 7(3), 10(3), 11(4), 12(2)). These provisions give police operational enforcement options short of criminal charging, but the Regulations do not define the statutory basis for arrest beyond stating the permissible purposes.

Procedural enforcement supports

• Immediate written statement for breath analysis results: Where the breath analysis indicates alcohol, the operator must give the respondent a written statement setting out date, time and results without delay (regulation 9). This procedural duty supports enforcement by evidence preservation and informs the respondent immediately of the outcome.
• Sample ownership and chain of custody: Blood samples are the property of the Territory (reg 13(3)), and analyses must be carried out by analysts (reg 14). These rules help centralise control of evidentiary samples and support the integrity of subsequent prosecutions or compliance processes.

Evidentiary streamlining and prosecutorial effect

• Certificates as evidence: Regulation 15 makes specific certificates from the Commissioner of Police, an authorised person, or an analyst admissible evidence of the matters stated. The Commissioner’s certificates can confirm that a person is a police officer authorised to use prescribed breath instruments or that someone is an analyst (reg 15(a)). An authorised person’s certificate can attest to instrument use, instrument condition and indicated breath alcohol concentration (reg 15(c)). An analyst’s certificate is evidence of laboratory analysis (reg 15(d)). The certificate route reduces the need for live witness testimony on technical or administrative matters and streamlines proof, by statutory design.

Protections that shape enforcement risk

• Immunity for good faith acts: Health practitioners, qualified persons and analysts are protected from civil and criminal liability for acts done in good faith for this Part (regulation 18). This reduces the legal risk to medical and laboratory personnel who participate in enforcement activities, likely making enforcement more practicable from the Territory’s standpoint.

Limitations and cross-references

• The Regulations do not themselves prescribe criminal penalties; they operate within the wider framework of the Domestic and Family Violence Act and other laws, which will set penalties and procedural pathways for contraventions of DVO conditions. The note to regulation 4 references section 126E of the Police Administration Act 1978 and regulation 19AB of the Police Administration Regulations 1994 as conferring entry power for police to exercise powers under this Part, indicating cross-Act enforcement synergies.

Implementation and administrative enforcement costs

• The mechanics of detention, transport to testing locations, availability of breath analysis devices or analysts, and the need for training and written authorisations for non-police executors create operational enforcement costs and dependencies that affect how frequently and effectively these powers will be exercised.

In short, enforcement under these Regulations relies on statutory duties to submit to testing, police powers to detain and arrest for testing purposes, centralised sample ownership and laboratory analysis by analysts, and certificate evidence that eases prosecution. The Regulations themselves do not set penalty amounts or imprisonment terms; those are controlled by the principal Act and other criminal or regulatory statutes.

The Regulations are not standalone; they operate by frequent cross-reference to other statutory instruments and to the principal Domestic and Family Violence Act. The interaction points set practical limits and definitional imports.

Interaction with the Domestic and Family Violence Act and DVOs

• Applicability condition: The whole Part 3 testing regime only applies where a DVO prohibits consumption of alcohol or use of a drug (except prescribed drugs) and includes an ancillary order requiring testing by an authorised person for compliance monitoring (regulation 4). The Regulations therefore operate as an enforcement adjunct to certain DVO provisions in the principal Act.
• Evidential and enforcement feed: While these Regulations set testing mechanics, enforcement actions for breach of the DVO or criminal offences for contravention of orders are governed by the Domestic and Family Violence Act and other enforcement statutes. The Regulations provide the testing evidence and operational powers that those Acts can use.

Traffic Act 1987 and Traffic Regulations

• Analyst definitions and breath instrument authorisation: The definition of analyst in regulation 5 imports authorisation under section 19C of the Traffic Act 1987 for analysis of saliva or blood, and regulation 5 refers to a breath analysis instrument as one prescribed under regulation 56 of the Traffic Regulations. Regulation 16(2) expressly authorises police officers who are authorised under regulation 59 of the Traffic Regulations 1999 to use a prescribed breath analysis instrument to carry out breath analyses under this Part. These cross-references tether technical device prescription, training and authorisation to the traffic law regime, using its specialist accreditation and device specification systems for accuracy and standardisation.

Misuse of Drugs Act 1990

• Analyst appointment: Regulation 5(1)(a) also includes persons appointed under section 3(8) of the Misuse of Drugs Act 1990 as analysts. This imports laboratory appointment and capability standards from the drugs regime, linking forensic analysis standards across Acts.

Police Administration Act 1978 and Police Administration Regulations 1994

• Entry and exercise powers: The explanatory note to regulation 4 references section 126E of the Police Administration Act 1978 and regulation 19AB of the Police Administration Regulations 1994 as conferring the power on a police officer to enter certain places for the purpose of exercising the officer's powers under this Part. That cross-reference indicates that police entry and search powers for testing will be governed by the police administration regime.

Health Practitioner Regulation National Law and National Vocational Education and Training Regulator Act 2011 (Cth)

• Health practitioner definition: The Regulations define health practitioner as a person registered under the Health Practitioner Regulation National Law to practice in a health profession (reg 5(1)). This aligns blood sample takers’ credentials with the national registration framework.
• Qualified person training: Qualified persons must be trained by a registered training organisation as defined in the National Vocational Education and Training Regulator Act 2011 (Cth) (reg 5(1)), tying sample-taking competence to nationally recognised vocational training.

Interstate and foreign orders

• The Regulations prescribe particular interstate DVOs and registered foreign orders for purposes of the principal Act (regs 3 and 3A), referencing specific Acts in WA, ACT, Qld and SA. The provisions therefore interact with interstate registries and recognition schemes, affecting which out-of-territory orders are treated as DVOs for enforcement purposes.

Evidentiary and procedural statutes

• Certificates under regulation 15 are admissible in courts as evidence of specified matters. Courts’ treatment of certificates will interact with common law and statutory rules of evidence and procedure. The Regulations do not remove cross-examination rights or other procedural safeguards, but they create a statutory evidentiary presumption by stating that the certificate "is evidence" of the matters stated.

Property and sample handling regimes

• Blood samples become the property of the Territory (reg 13(3)). The Regulations do not prescribe retention, disclosure, or destruction rules; those will be governed by other Territory policies or statutes, or by administrative practice. The property rule affects access rights and may interact with privacy, forensic, and criminal disclosure obligations under other legislation.

Criminal law and rights frameworks

• The Regulations authorise detention, arrest and non-consensual blood sampling in specified circumstances (reg 13(2) combined with reg 12 triggers). Those powers must be exercised compatibly with other legal protections such as criminal procedure rules, search and seizure law, and human rights frameworks where applicable. The Regulations do not themselves calibrate those rights beyond the specified testing powers.

In short, these Regulations are tightly integrated with: the principal Domestic and Family Violence Act (for scope and enforcement), traffic and drugs legislation (for device and analyst standards), police administration statutes (for entry powers), national health and training regimes (for practitioners and qualified persons), and interstate recognition schemes (for out-of-jurisdiction orders). Several operational details such as sample retention, disposal, and interface with criminal procedure are left to other statutes or administrative rules.

The endnotes attached to the Regulations provide a chronological list of enactments and subordinate legislation that have inserted, amended or repealed parts of the instrument. The Regulations were originally made as the Domestic and Family Violence Regulations (SL No. 17, 2008), notified and commenced 1 July 2008. Since then several amendments have modified definitions, Part and Division headings, and the drug and alcohol testing regime.

Key amendments and their effects as recorded in the endnotes and list of amendments

• 2013: Domestic and Family Violence Amendment (Drug and Alcohol Testing) Regulations 2013 (SL No. 45, 2013) inserted Part 3 and the drug and alcohol testing provisions (r 4 et seq). This was a structural change introducing testing mechanics into the Regulations.
• 2014: Commencement details indicate commencement of these provisions under the amended Act conditions.
• 2015: Domestic and Family Violence Amendment Regulations 2015 (SL No. 31, 2015) made amendments to certain regulations, reflected in the amendment notes to regs 4, 5, 6-7 and 9 (see list of amendments where r 4 is noted as amended).
• 2017: The Domestic and Family Violence (Recognition of Domestic Violence Orders) (National Uniform Law) Amendment Act 2017 (Act No. 2, 2017) and associated subordinate amendments inserted or repealed certain provisions for interstate recognition. Regulation 3 was amended and regulation 3A inserted (No. 33, 2017, r 4), with related changes to the list of interstate orders in r 3.
• 2021-2023: Multiple amendments (SL No. 6, 2021; SL No. 2, 2022; SL No. 20, 2023) updated various provisions, including additions to the list of registered foreign orders (r 3A) and technical amendments across Part 3.
• 2023-2025: Justice Legislation Amendment (Domestic and Family Violence) Act 2023 (Act No. 33, 2023) and Justice and Other Legislation Amendment Act 2024 (Act No. 4, 2024) effected further amendments to definitions and certain regulatory cross-references. The Police Administration Legislation Amendment Act 2025 (Act No. 8, 2025) and the Domestic and Family Violence and Victims Legislation Amendment Act 2025 (Act No. 12, 2025) made later amendments with commencement dates in 2024 and 2025 for specific parts.
• 2026: The Statute Law Revision and Repeals Act 2026 (Act No. 3, 2026) commenced on 10 February 2026, producing formal amendments of a technical nature to various regulations (see endnotes noting general formal amendments under the Interpretation Legislation Amendment Act 2018 to rr 1, 2, 5, 15 and 16).

The list of amendments in the endnotes shows granular reworkings of Part headings and the insertion of specific regulatory provisions. The amendments reflect:

• Structural insertions of Part 3 and its Divisions (No. 45, 2013, r 8).
• Ongoing adjustments to definitions and cross-references to align with changes in other legislation (for example the Traffic Regulations, Misuse of Drugs Act and interstate recognition Acts).
• Periodic updates to the list of interstate DVOs and registered foreign orders that are to be recognised under regs 3 and 3A.

The endnotes do not provide legislative policy debates or explanatory material beyond brief notes (for example, the note that the ACT Act was repealed but orders made under it can have continuing effect). They do provide the precise statutory instruments and commencement dates for each amendment, which practitioners should consult when tracing the regulatory lineage and operative text in force on a given date.

When advising or litigating, practitioners should consult the specific amending instruments listed in the endnotes to confirm the exact wording in force at any relevant time, as the Regulations have been amended multiple times since 2008 and cross-references to other Acts or Regulations (Traffic Regulations, Misuse of Drugs Act, Police Administration Act, etc.) have changed.

The Regulations themselves do not record case law or litigation outcomes. The instrument does not name any judicial decisions or provide citations to reported cases that have interpreted these Regulations. Therefore, based on the text provided, there is no litigation history set out within this statutory instrument.

Practical implications for research and practice

• Absence of recorded cases in the instrument: Because the Regulations do not list judicial determinations, practitioners must seek case law through legal databases and court and tribunal reports to identify any litigation that has construed these provisions, particularly regarding the scope of detention/arrest powers for testing, the reasonableness standard for directions, non-consensual blood sampling, and the admissibility and weight of certificates under regulation 15.
• Matters likely to generate litigation: The Regulations create points of constitutional, criminal procedure and evidence law friction where litigants may have raised rights-based challenges, for example: the lawfulness of detention or arrest for testing, reasonableness and suspicion thresholds (the Regulations state a direction need not be based on suspicion for certain tests, regs 6(2), 10(2), 11(2)), the legality of non-consensual blood sampling (reg 13(2) combined with reg 12 triggers), and the evidentiary status of certificates. Those are the legal issues to search for in case law databases outside the statutory text.
• Cross-jurisdictional or interjurisdictional disputes: Because regs 3 and 3A prescribe interstate and registered foreign orders, litigation could involve questions of recognition and enforcement of out-of-territory orders or conflicts about scope.

Recommended next steps for practitioners

• Conduct an independent case-law search: Use court databases and legal reporting services to identify decisions that involve the Regulations, particularly in the Northern Territory Supreme Court, local courts, or appellate courts that have considered detention/arrest powers, sample-taking without consent, and the use of certificates in evidence.
• Check administrative decisions and policy guidance: Police or health agencies may have administrative policies about testing logistics, sample retention and disclosure, and authorisation procedures under regulation 17. These may not be judicially binding but will shape operational practice and potential administrative law challenges.
• Trace amendments and consequential changes: Some litigation risk or interpretation may hinge on amendments made over time. When assessing a historical matter, ensure the operative text at the time of the testing or prosecution is retrieved and cross-checked against the list of amendments in the endnotes.

In sum, the Regulations contain no internal litigation history. Practitioners must rely on external legal research to find cases interpreting these specific provisions.

The Regulations contain several provisions that can produce unexpected operational or legal consequences if overlooked. These are practical points that tend to cause disputes or implementation errors.

1. The part applies only where the DVO both prohibits use and expressly requires testing (regulation 4)

• The testing regime in Part 3 is not automatically available simply because a person has a DVO. It applies only when the DVO (a) prohibits consumption or use of alcohol or a drug (except prescription drugs), and (b) includes an ancillary order requiring the respondent to submit to testing by an authorised person to monitor compliance (regulation 4). Practitioners must confirm the precise terms of the DVO before directing or submitting to testing.

2. "Reasonable" directions do not require suspicion (regs 6(2), 10(2), 11(2))

• For breath tests (reg 6(2)), saliva tests (reg 10(2)) and urine tests (reg 11(2)), the Regulations state that a direction to submit to testing can be reasonable even if the authorised person does not suspect the respondent has consumed alcohol or used drugs. This is a statutory calibration that lowers the threshold for issuing directions compared with common-law suspicion standards. Practitioners should note this when advising on rights and when litigating alleged unlawful directions.

3. Police detention and arrest powers are expressly tied to testing purposes (regs 7(3), 10(3), 11(4), 12(2))

• The Regulations permit police to detain and, if necessary, arrest respondents specifically for the purposes of conducting tests or taking them to testing locations. That specified purpose limitation is important for assessing the lawfulness of detention or arrest; however, the power remains coercive and may be deployed without the usual criminal-suspicion threshold when the statutory conditions are met.

4. Blood may be taken without consent in enumerated circumstances (regs 12-13)

• Regulation 12 lists multiple circumstances in which a blood sample may be required, including failures to provide sufficient samples for other tests, malfunction or unavailability of breath analysis devices, or medical conditions impeding other samples. Regulation 13(2) then allows health practitioners or qualified persons to take blood whether or not the respondent consents. Practitioners must note there is no general consent requirement for blood where the regulation’s triggers apply.

5. Samples become property of the Territory (reg 13(3))

• Blood samples taken for analysis are the property of the Territory. The Regulations do not set retention, disclosure, testing re-requests, or destruction protocols. Ownership confers control and may affect access, independent retesting requests and disclosure strategies. Practitioners should check local administrative rules or adjacent legislation for protocols on handling, retention and disclosure.

6. Breath analysis may be used only by authorised operators (reg 8, 16-17)

• A breath analysis instrument must not be used under these Regulations unless the operator is authorised under reg 16(2) (police authorised under Traffic Regulations) or reg 17(1)(b) (non-police authorised by the Commissioner). Operators must therefore be properly authorised; failure to ensure operator authorisation may affect admissibility or the integrity of results.

7. Certificates reduce opportunities for live evidence but are not definitive proof of correctness (reg 15)

• Regulation 15 makes particular certificates evidence of matters stated and the facts on which they are based. While certificates streamline proof, their status does not mean they are immune from challenge. The Regulations do not stipulate that certificates are conclusive; they are evidence that courts will weigh in context, and opposing parties may challenge the underlying facts or procedures.

8. Commissioner authorisation for non-police testers is discretionary but subject to training and capability tests (reg 17)

• The Commissioner may authorise non-police persons in writing to conduct tests and breath analyses but must be satisfied about their training and capability (reg 17(2)-(3)). This creates a delegable pathway but imposes an administrative precondition that will need documentary proof in disputes.

9. Cross-Act dependencies and device standards (reg 5 and notes)

• Breath analysis instruments must be those prescribed under Traffic Regulations r56 and operators authorised under r59. The Regulations therefore depend on the traffic instrument and procedural regimes; practitioners must check the Traffic Regulations for device models, calibration standards and operator training requirements.

10. Immunity limited to good faith (reg 18)

• The civil and criminal immunity for health practitioners, qualified persons and analysts applies only to acts done or omitted in good faith for this Part. This is a fact-sensitive shield and may not cover reckless or bad-faith conduct. Documentation and adherence to protocols remain essential to preserve the immunity.

11. No specified procedural detail on sample handling and retention

• The Regulations are silent on retention duration, destruction, sample access by defence or third parties, and chain-of-custody detail beyond requiring analysis by an analyst and property assignment to the Territory. Those omissions can create litigation points and administrative uncertainty.

12. Interjurisdictional lists are narrow and specified (regs 3 and 3A)

• The Regulations prescribe particular interstate orders and registered foreign orders by naming specific Acts and instruments. This is not an open-ended recognition scheme; inclusion or exclusion in the lists has practical consequences for enforcement of out-of-territory orders.

These "gotchas" indicate the technical and operational features that practitioners should verify in advance of testing or enforcement actions: the exact DVO terms, authorised-person status, operator authorisations under traffic regulations, the statutory triggers for non-consensual blood taking, sample possession and evidence procedures, and the administrative authorisation records from the Commissioner of Police.

For respondents, authorised persons, police agencies, health services and courts, the Regulations set discrete compliance steps. The practical checklist below tracks statutory obligations and operational duties derived from the text.

For respondents subject to a qualifying DVO (regulation 4)

• Confirm the DVO wording: Verify that the DVO expressly prohibits alcohol or drug use and contains an ancillary testing requirement. The Part applies only where both elements are present (regulation 4).
• Comply with reasonable directions: If an authorised person directs you to submit to a breath, saliva or urine test or breath analysis, comply and follow the authorised person’s directions about how to provide the sample (regs 6(1), 7(2), 10(1), 11(1)). Note that reasonableness does not require the authorised person to harbour suspicion (regs 6(2), 10(2), 11(2)).
• For urine tests, provide a sufficient sample and do not tamper with it (reg 11(3)). For breath tests, provide a sufficient breath sample when required (reg 7(1)(a)).
• Be aware of blood sample rules: If conditions in regulation 12(1) exist, an authorised person may require a blood sample. Health practitioners or qualified persons may take blood whether or not you consent (reg 13(2)). Know you may be detained or arrested for purposes of testing or transport (regs 7(3), 10(3), 11(4), 12(2)).

For police and authorised persons

• Verify the DVO: Ensure the subject’s DVO contains the requisite prohibition and ancillary testing order before invoking Part 3 powers (regulation 4).
• Confirm authorisation to conduct each test: All police officers are authorised to carry out breath, saliva and urine tests (reg 16(1)). Confirm whether you are authorised under Traffic Regulations to operate breath analysis instruments for breath analyses or whether the Commissioner has authorised non-police persons (reg 16(2) and reg 17).
• Ensure directions are reasonable and documented: While the reasonableness standard does not require suspicion for certain tests, document the directions given and the administrative justification (regs 6, 10, 11).
• Use authorised breath analysis operators only: Do not operate prescribed breath analysis instruments unless authorised under the Traffic Regulations or under Commissioner authorisation as appropriate (regs 8, 16(2), 17(1)(b)).
• Follow procedural duties for test results: If a breath analysis indicates alcohol, give the respondent a written statement without delay including date, time and results (regulation 9). Prepare and preserve certificates as set out in regulation 15 to support admissible evidence in court.
• Exercise detention/arrest powers only for the specified testing purposes, and record the purpose and duration (regs 7(3), 10(3), 11(4), 12(2)). Confirm any entry powers used are compliant with police administration legislation referenced in the note to regulation 4.

For health practitioners and qualified persons

• Ensure appropriate registration and training: Health practitioners must be registered under the Health Practitioner Regulation National Law (reg 5(1)). Qualified persons must have the required vocational training from an accredited registered training organisation (reg 5(1)).
• Take blood samples in accordance with conditions listed in regulation 12: Confirm the statutory trigger for blood sampling is present before proceeding. Remember blood may be taken without consent where the triggers apply (reg 13(2)).
• Maintain good-faith practice and documentation: Immunity under regulation 18 applies only for acts done in good faith. Keep contemporaneous records of the circumstances and the statutory trigger for the procedure.

For laboratories and analysts

• Confirm statutory analyst status: Analysts must be authorised under section 19C of the Traffic Act or appointed under the Misuse of Drugs Act as referenced in regulation 5(1)(a) before analysing samples (regulation 14).
• Maintain chain-of-custody and analysis records: Analysts’ certificates are admissible under regulation 15(d). Maintain records that allow the analyst to attest to the analysis and the facts on which the certificate is based.

For the Commissioner of Police and administrative units

• Authorisations: Provide written authorisations under regulation 17 for non-police persons only after confirming training and capability consistent with reg 17(2)-(3). Keep a register of such authorisations and training evidence.
• Interagency coordination: Ensure coordination with traffic authorities regarding breath analysis instrument models and operator authorisations under the Traffic Regulations (regulation 5 and 16(2)).
• Sample management policies: Because the Regulations make samples the property of the Territory (reg 13(3)) but do not set retention or destruction protocols, the Commissioner’s office should have documented policies on retention, access, disclosure, and destruction consistent with other statutory obligations.

For courts and prosecutors

• Use certificates under regulation 15: Procure the relevant certificates (Commissioner, authorised person, analyst) as evidence of the matters stated and the facts on which they are based (regulation 15). Ensure chain-of-custody and analyst credentials are documented to support admissibility and weight.
• Anticipate challenges: Defence may challenge operator authorisation, device condition and calibration, chain-of-custody, the sufficiency of samples, or the statutory triggers for blood sampling. Ensure records and certificates address these points.

Operational and compliance checklist

• Confirm DVO scope and ancillary testing order (regulation 4).
• Confirm authorised-person status and written authorisations for non-police testers (regs 5, 16-17).
• Use only prescribed breath analysis instruments and authorised operators (reg 8; Traffic Regulations references).
• Document directions, sample sufficiency, and any refusal or failure to provide samples (regs 6-7, 10-12).
• Provide mandated written statements to respondents for breath analysis results (regulation 9).
• Ensure analyses are performed by analysts and secure analyst certificates (regs 14-15).
• Maintain records that demonstrate good faith for health practitioners and analysts to preserve immunity under regulation 18.

Following these steps aligns operational practice with the statutory requirements in the Regulations and creates the documentary base necessary for enforcement and evidentiary use in court.
