Dog and Cat Management Regulations 2017

The Regulations revolve around a small set of operational levers. Each concept below is anchored to the regulation provision that creates it.

• Identification and microchipping. The Regulations specify when an animal is “identified” for the Act by requiring microchipping either before sale or by statutory age/timelines and by prescribing the microchip standard AS 5018-2001 (r 10(1)(a)-(c), (6), (8)). They also require owners to provide the microchip identification number to the local Registrar and to notify the Board of changes to contact details (r 10(6)-(7)).

• Desexing. The timing, who may perform the procedure, and exemptions are prescribed. Desexing must occur before six months of age or within 28 days of taking possession, whichever is later, and must be performed by a registered veterinary surgeon (r 12(1)(a)-(b)). Exemptions are set out (r 12(2)-(6)) and an interstate desexing is accepted where it complies with interstate law (r 12(7)).

• Sale and breeder obligations. Sellers must supply prescribed information to buyers, covering seller and breeder contacts, vaccination and desexing details, microchip data, medical matters, control orders and any exemptions or extensions granted (r 19). The Regulations also expand the notion of “breeder” to include those contributing semen or ova, providing facilities or failing to prevent impregnation (r 17).

• Fund and fee flows. Regulation 6 fixes the share of dog registration fees councils must pay into the Fund and the share the Board must pay back to councils for dogs registered through the Board. The percentages differ for a list of named “prescribed councils” versus other councils, and they change on or after 1 July 2018 (r 6(1)-(4)). Regulation 22 gives the Board and councils roles in setting fees, with Board-fixed maxima or Board-notified fees (r 22).

• Exemptions, extensions and administrative discretion. Registered veterinary surgeons may grant medical exemptions, subject to reporting duties and limits (r 13). The Board can grant, condition, vary or revoke time extensions for microchipping and desexing, and must issue notices of extension (r 14). The Board can also prescribe classes of exemptions, declare classes by Gazette notice, and impose conditions on exemptions (rr 10(2), 12(2), 12(3)). Several powers require or permit Board action by notice in the Gazette, for example prescribing accreditation bodies (r 5), specifying persons approved to destroy or detain cats (rr 15-16), and specifying prescribed persons for Registrar notifications (r 21).

• Compliance devices and penalties. The Regulations tie specific behaviours to penalties or expiation fees: wearing registration discs while not confined (r 9), guard dog notification and display (r 20), and owners’ microchipping notification duties (r 10(6)-(7)). The Act itself supplies broader enforcement architecture, but these Regulations detail some of the discrete sanctioned defaults.

• Inter-jurisdictional recognition. The Regulations accept microchipping and desexing performed in other States and Territories as compliant if performed in accordance with the law of the other jurisdiction and consistent with the specified microchip standard (rr 10(8), 12(7), 18(3)). They also recognise private body rules such as Greyhound Racing SA where relevant (r 12(2)(a), r 18(4)(b)).

Together these concepts construct a system that moves from clinical action (implant, desex) to administrative outcomes (registry entries, sales disclosures), and from funding formulas to local enforcement. The Board emerges as the central administrative node, with councils, registered veterinary surgeons and registries carrying out critical operational tasks.

The Regulations allocate duties and consequences across several discrete actor groups. Summaries below cite the regulation clauses that create the obligations or status.

• Owners of dogs and cats. Owners must ensure microchipping and desexing occur on the statutory timetable (rr 10, 12, 18), provide microchip numbers to Registrars (r 10(7)), notify the Board of changes to contact details within 14 days (r 10(6)), and ensure dogs wear registration discs while not confined (r 9). Owners may apply to the Board for extensions (r 14) or obtain veterinary exemptions (r 13). Owners selling animals must provide prescribed information to buyers (r 19).

• Sellers and breeders. Sellers are bound by r 19 to disclose specific information to buyers covering breeder identity, vaccination, microchipping, desexing, exemptions or extensions, illnesses, and control orders. The Regulations broaden who is a “breeder” for Act purposes to include persons contributing semen/ova, providing facilities, or failing to prevent pregnancy (r 17). Registered breeders have particular interactions with desexing and pre-sale exceptions (r 12(2)(c), r 18(4)(a)).

• Registered veterinary surgeons and those acting under their supervision. Vets must implant microchips or perform desexing if they carry out those services (rr 10(1)(d), 12(1)(b)). Vets may issue medical exemptions in writing, but only where satisfied microchipping or desexing would pose undue risk or adverse effects; vets who grant exemptions contrary to that standard commit an offence (r 13(1)-(3)). Vets must provide information to the Board after issuing an exemption (r 13(6)) and, more generally, to the Board as required about microchipping and desexing where the Board has specified information by Gazette notice (rr 10(4)-(5), 12(8)-(9)).

• Councils. Councils collect registration fees and must pay the prescribed percentages into the Fund (r 6(1)). The Board pays a proportion of fees it receives to the council in whose area the dogs are usually kept (r 6(2)-(3)). Councils approve business identification marks for kennel/business dogs and receive guard dog notifications and display telephone numbers (r 9(1)(b), r 20). Councils also set certain local fees up to Board maxima (r 22(2)(b)).

• The Board. The Dog and Cat Management Board gains broad administrative powers: to prescribe by Gazette (r 5, r 12(2)(e), r 10(2)), to grant and manage time extensions (r 14), to receive information and require particulars regarding microchipping and desexing (rr 10(4)-(5), 12(8)-(9)), to pay councils from the Fund (r 6(2)-(3)), and to approve persons or bodies to destroy or detain cats (rr 15-16). The Board may impose conditions on exemptions and vary or revoke those conditions (r 12(3)-(5)).

• Registrars and registries. The Regulations refer to registries as publicly accessible databases that store owner identity information (r 3). Owners must provide microchip numbers to Registrars (r 10(7)). Boards may require persons who microchip or desex to provide specified information to the Board (rr 10(4)-(5), 12(8)-(9)).

• Animal welfare organisations, accreditation bodies, licenced holders under the Animal Welfare Act and veterinary surgeons. Specified as entities where dogs held in custody are not required to be registered (r 7). Accreditation bodies for assistance animals are listed and may be expanded by Board prescription (r 5).

• Businesses using dogs (kennels, guard dog operations). They must ensure business identification appears on collars or tags (r 9(1)(b)), register details of guard dog use and a contact number with the local council and display a contact number at the premises (r 20), and notify the Registrar of certain events such as exceeding the maximum number of dogs on a registered business property or attacks involving trained or bred dogs (r 8).

Financially, owners and breeders bear direct clinical and administrative costs (microchip implantation, desexing, compliance with disclosure duties). Councils must share registration fee revenue into the Fund in prescribed proportions (r 6). The Board and councils incur administrative costs to process extensions, exemptions, notices and registrations; vets have reporting duties. The Regulations create discrete compliance burdens spread across these groups and centralise certain discretionary powers in the Board and registered veterinary surgeons.

This section sets out the principal mandatory actions, permissive powers and rights created by the Regulations. Citations point to the exact provisions.

Duties imposed on owners and sellers

• Microchipping: Owners must ensure animals are microchipped before sale and by specified timelines (r 10(1)(a)-(b)). Owners must provide the microchip number to the relevant Registrar in the form determined by the Board (r 10(7)). Owners must notify the Board within 14 days of change to name, residential address or telephone number in the form determined by the Board (r 10(6)).

• Desexing: Owners must ensure animals are desexed by the specified age or timeline and that desexing is performed by a registered veterinary surgeon (r 12(1)).

• Registration disc: Owners must ensure, while a dog is not effectively confined to premises occupied by the owner, the dog wears a collar with the registration disc or an approved business identification (r 9(1)), with certain exemptions such as health or organised activities (r 9(2)).

• Sales disclosure: Sellers must supply prescribed information to buyers including seller and breeder contact details, vaccination/desexing data, microchip information and any exemptions or extensions (r 19(1)-(5)).

• Guard dogs: Persons keeping guard dogs for protection must notify the local council of premises and times, provide a contact telephone number, and ensure a conspicuous telephone contact is displayed at the premises (r 20(1)-(2)).

Administrative and reporting duties

• Microchipping/desexing reporting: Persons who microchip or desex must provide to the Board the information the Board requires by Gazette notice (rr 10(4)-(5), 12(8)-(9)).

• Veterinary exemption reporting: A registered veterinary surgeon who grants an exemption must provide such information to the Board as the Board may reasonably require as soon as reasonably practicable (r 13(6)).

• Registrar notifications: Registered businesses must notify the Registrar where the number of dogs kept exceeds the number specified in the registration application, or where a dog trained/bred at the kennel attacks a person or animal (r 8).

Rights and permissive powers

• Veterinary medical exemptions: Registered veterinary surgeons may exempt an owner from microchipping, desexing or pre-sale obligations where the vet is satisfied the procedures would pose undue risk or adversely affect growth/development/wellbeing (r 13(1)-(2)). Exemptions have defined maximum durations (r 13(4)).

• Board extensions and conditions: The Board may extend time periods for microchipping and desexing, and such extensions may be conditional, varied or revoked (r 14). The Board must issue a notice of extension to the owner specifying dates (r 14(3)).

• Board Gazetted powers: The Board may declare classes of persons, bodies or animals exempt by notice in the Gazette for multiple provisions (rr 10(2), 12(2)(e), 12(3), 19(5)(e), 21). The Board can prescribe accreditation bodies for assistance animals (r 5) and approve persons/bodies to destroy or detain cats (rr 15-16).

• Fee setting: The Board may fix maximum registration fees for non-standard dogs or cats by notice in the Gazette; councils may set fees for other matters up to Board maxima (r 22).

Limits, conditionalities and offences

• Vet constraints: Vets who issue exemptions contrary to the required medical standard commit an offence subject to a maximum penalty (r 13(3)).

• Conditional exemptions and revocation: Exemptions and extension notices may carry conditions; contravention of conditions suspends the benefit while non-compliance continues, and the Board may vary or revoke conditions (r 12(3)-(6)).

• Penalties: Several contraventions carry specified maximum penalties and expiation fees such as failing to ensure collars/discs (r 9), failing to comply with microchipping notification duties (r 10(6)-(7)) and guard dog notification/display requirements (r 20).

Rights to recognition and interstate conformity

• Interstate procedures: The Regulations give owners and sellers certainty that microchipping and desexing performed in other States or Territories will be taken to comply with the requirements if done according to the laws of that jurisdiction and consistent with the microchip standard (rr 10(8), 12(7), 18(3)).

Summary Owners have substantive clinical and administrative duties before sale and during ownership, sellers must provide extensive sale-related disclosures, vets have both authority to grant medical exemptions and reporting obligations, councils and the Board share financial and regulatory administration duties, and the Board retains flexible rule‑making and conditional powers through Gazette notices. Many duties are time-sensitive and document-heavy, creating ongoing compliance responsibilities for several actors.

The Regulations specify discrete offences with maximum penalties or expiation fees and create the administrative architecture applicable to enforcement. The Regulations rely on the Act for broader enforcement, but they detail specific sanctioned defaults.

Named penalties in the Regulations

• Registration disc duty: Failure by an owner to ensure a dog wears the registration disc while not effectively confined attracts a maximum penalty of $5 000 and an expiation fee of $170 (r 9). Exemptions from wearing a collar are provided where the dog is not required to be registered, is unfit to wear a collar for health reasons, or is under effective control in specified activities (r 9(2)).

• Microchipping/desexing notification duties: The owner’s failures to notify the Board within 14 days of contact detail changes, and to provide the microchip number to the local Registrar, each attract a maximum penalty of $2 500 and an expiation fee of $170 (r 10(6)-(7)). These are administrative default offences tied to registry integrity.

• Veterinary contravention: A registered veterinary surgeon who contravenes r 13(2), that is, issues an exemption without the required satisfaction that microchipping or desexing would pose undue risk or adversely affect growth/development/wellbeing, is guilty of an offence with a maximum penalty of $5 000 (r 13(3)).

• Guard dog duties: Failure to comply with guard dog notification and display requirements carries a maximum penalty of $2 500 and an expiation fee of $170 (r 20(1)).

Enforcement architecture and administrative levers

• Expiation fees: The Regulations set expiation fees for certain offences providing an administrative enforcement pathway for relatively minor contraventions such as collar/disc failures and failure to comply with microchipping notifications (rr 9, 10, 20). Expiation provides an alternative to prosecution.

• Board and Registrar powers: The Board’s role in receiving information, granting and revoking exemptions and extensions, and approving persons and bodies who may destroy or detain cats creates administrative oversight points that feed into enforcement decisions (rr 10(4)-(5), 12(3)-(5), 14, 15-16). The Board may revoke an exemption if the grounds no longer apply (r 13(7)) and may vary or revoke conditions imposed on exemptions (r 12(5)).

• Notices in the Gazette and compliance monitoring: The Board may require specified reporting by persons who microchip or desex animals, by notice in the Gazette (rr 10(4)-(5), 12(8)-(9)). The Regulations therefore create a reporting duty that the Board can use for monitoring and enforcement.

• Interaction with Act enforcement: The Regulations implement particular parts of the Act and use the Act’s enforcement backbone where broader measures such as seizure, destruction or control orders are required. For example, rr 15-16 specify persons or bodies approved by the Board for powers under the Act to destroy or detain cats, tying the Regulations to the Act’s operational enforcement provisions (rr 15-16).

Practical enforcement consequences and risks

• Administrative burden as enforcement vector. The Regulations turn compliance into a series of documentary and timing requirements, microchip numbers, notification windows, and sale disclosures, each enforceable with penalties or expiation fees. This creates enforcement friction points that are administratively straightforward to monitor but may generate disputes over forms, timing and the sufficiency of notices.

• Discretion-driven revocation. Several defences and exemptions are conditional and revocable by the Board or the vet who issued them. This leaves scope for administrative enforcement actions to suspend benefits where conditions are contravened (r 12(4)-(5), r 13(7)).

• Concentrated offences. The Regulations concentrate explicit monetary penalties on a small set of owner and veterinary obligations. The amounts, where specified, give councils and prosecutors room to prioritise enforcement on visible defaults such as dogs not wearing registration discs and failures to notify registries.

In short, the Regulations set out a mixture of criminal penalties, expiation schedules and administrative revocation tools, with the Board and veterinary surgeons as key decision-makers in exercising conditional exemptions and extensions. The predominant enforcement mechanism for routine defaults is administrative assessment supported by expiation fees.

The Regulations expressly operate as subordinate legislation under the Dog and Cat Management Act 1995. They contain multiple cross-references and interactions with other legal regimes and standards.

Interaction with the Dog and Cat Management Act 1995

• Operationalises Act provisions. The Regulations supply definitions, technical standards and procedures for specific Act sections. For example, r 10 implements s 42A of the Act on microchipping, r 12 implements s 42E on desexing, and r 18 implements s 70 on pre-sale microchipping and desexing requirements. They also specify matters required by the Act such as prescribed accreditation bodies for assistance animals under section 21A(7) (r 5), persons for the purposes of section 33(5)(b)(iii) (r 7), and prescribed persons for section 64D(3) (r 21).

• Fee and Fund mechanics. Regulation 6 operationalises s 26(5) of the Act by fixing the percentage of dog registration fees councils must pay into the Fund and the percentages the Board must pay to councils where it receives registration fees directly.

Interstate recognition and national standards

• Microchip standard. The Regulations require microchips conform to AS 5018-2001 Electronic Animal Identification,National Coding Scheme or AS 5018-2001 Electronic Animal Identification,Radiofrequency Methods (r 10(1)(c)). They also recognise microchipping and desexing performed in other States or Territories as compliant if done in accordance with that State or Territory’s law (rr 10(8), 12(7), 18(3)), providing inter-jurisdictional recognition.

Interaction with the Animal Welfare Act 1985

• Licensing and registration exceptions. Regulation 7 specifies that holders of licences under Part 4 of the Animal Welfare Act 1985 are among those not required to register dogs held in custody for the purposes of section 33(5)(b)(iii) of the Act, linking the two Acts on custody and registration exemptions.

Industry rules and control bodies

• Greyhound Racing SA. The Regulations exempt registered greyhounds under the rules of Greyhound Racing SA from certain desexing requirements, illustrating how industry regulatory rules are recognised for specific animal classes (r 12(2)(a), r 18(4)(b)).

Administrative law and Gazette notices

• Delegated policy via Gazette. The Board is authorised to make numerous specifications and impose information requirements by notice in the Gazette (for example, rr 5, 10(4)-(5), 12(2)(e), 12(8)-(9), 19(5)(e), 21, 22(1)). These Gazette powers embed an administrative technique that enables ongoing rule modification without primary legislation, subject to principles of administrative law and the public availability of Gazette notices.

Local government powers and constraints

• Fee setting. Regulation 22 sets an interplay between Board-determined maxima and council-determined fees. Councils may set fees for matters not fixed by the Board, but must not exceed Board maxima where the Board has set such maxima (r 22(2)(b)). The payments into and out of the Fund create fiscal flows tying council registration income to the Fund (r 6).

Criminal and civil enforcement mechanisms under the Act

• Seizure and destruction powers. The Regulations specify persons and bodies approved by the Board to exercise powers concerning destruction and detention of cats under the Act (rr 15-16). These interact with the Act’s enforcement, seizure and destruction powers and with administrative procedures for approval.

Implication for private contracts and transactions

• Sale disclosure requirements. The Regulations affect contractual obligations in sales of companion animals by requiring specified disclosures (r 19). Failure to provide required information may have civil as well as regulatory consequences given the overlap between disclosure requirements and consumer law claims, although such civil interplay is not expressly addressed in the Regulations.

Overall, the Regulations are tightly coupled to the Act for delegated implementation, recognise interstate actions where compatible with the specified standard, and incorporate industry and local government interfaces. They also create extensive Gazette-based delegations that permit regulatory specification without primary legislative amendment.

The Regulations are a 2017 instrument that revokes the 2010 Regulations and establishes new prescriptions. The text itself contains the following historical and commencement notes.

• Principal instrument. The Dog and Cat Management Regulations 2017 (No 30) were published in the Gazette on 19 April 2017 (Gazette reference p1103) and the principal commencement date is 1 July 2017 except for rr 10, 12 and 18 (Legislative history; r 2). The schedule explicitly revokes the Dog and Cat Management Regulations 2010 (Schedule 1).

• Staggered commencements. Regulation 2(2)-(4) make rr 10 (microchipping requirements), 12 (desexing requirements) and 18 (pre-sale microchipping and desexing) operate on the day that corresponding sections of the Act, as enacted by the Dog and Cat Management (Miscellaneous) Amendment Act 2016, come into operation. The Legislative history notes that rr 10, 12 and 18 came into effect on 1 July 2018, whereas the rest of the Regulations commenced on 1 July 2017 (Legislative history; r 2). This staging reflects the timing of the Act’s amendment provisions and aligns the Regulations with the Act’s substantive amendments.

• Links to 2016 Amendment Act. The cross-references to sections 42A, 42E and 70 of the Act, identified as being enacted by the Dog and Cat Management (Miscellaneous) Amendment Act 2016, indicate the Regulations were drafted to support and implement those Act-level changes once they were brought into force (r 2).

• Gazette-based updates. Substantial aspects of the Regulations are delegated to Gazette notices by the Board (for example, r 5 prescribing accreditation bodies allows “any other person or body prescribed by the Board”; rr 10(4)-(5), 12(8)-(9), 19(5)(e), 21 and 22). This structure permits the Board to update technical or administrative particulars without an amendment to the Regulations. The Regulations themselves do not list any Gazette variations, but this delegation is a standing mechanism for future changes.

• Revocation of previous subordinate law. The Regulations explicitly revoke the 2010 Regulations (Schedule 1), indicating a statutory reset of detailed operational prescriptions accompanying the Act.

What the Regulations do not show

• No further amending instruments are recorded within the text provided beyond the principal 2017 instrument and the commencement staging noted above. The Regulations signal an expectation of further Board-directed specification via Gazette notices, but those notices are not included in the text provided.

In short, the 2017 Regulations replaced the earlier 2010 subordinate rules, introduced timing-linked commencements to align with Act amendments from 2016, and delegated ongoing detail-making to Gazette notices by the Board.

The body of regulations provided contains no citation to cases, no reported litigation history, and no references to judicial interpretation. The instrument is a subordinate legislative text that implements the Act and relies on the Act for enforcement powers. Accordingly:

• There are no cases named in the Regulations. The Regulations do not record any legal proceedings, challenges, or judicial interpretations.

• The instrument’s enforcement and dispute mechanisms rely on the Act’s broader enforcement framework and the administrative processes the Board and councils operate. Any litigation arising from these Regulations would be brought under the Act or relevant civil remedies, but no such proceedings are referenced in the text.

• Potential future litigation vectors, based on the Regulations’ content, might relate to administrative law challenges to Board decisions (for example, revocation or variation of an extension or exemption), disputes over whether microchipping/desexing complies with the Regulations (including interstate compliance questions), or challenges to veterinary exemptions granted or refused. Those are hypothetical and not present in the Regulations themselves.

Given the absence of recorded cases or litigation in the instrument, practitioners seeking precedential authority will need to search for case law under the Act and administrative decisions involving the Board and councils. The Regulations themselves supply the statutory framework but do not record litigation outcomes or interpretations.

This section flags technical traps, timing and procedural risks that arise directly from the Regulations’ wording, with precise references.

Timelines and “whichever is the later” language

• Microchipping and desexing timings use compound triggers. For both microchipping and desexing, compliance is required before sale and by the later of age thresholds (12 weeks for microchipping; 6 months for desexing) or within 28 days after possession, or by any Board-granted extension (rr 10(1)(a)-(b), 12(1)(a)). The “whichever is the later” clause can extend the owner’s duty beyond the 28 days if the animal is young, which means sellers who transfer animals young may still be liable if they don’t ensure microchipping/desexing by the later date.

• Pre-sale requirement is absolute. r 10(1)(a) and r 12(1)(a) require microchipping and desexing “before it is sold” as a primary obligation. While some exceptions exist (exemptions or extensions), sellers must be careful that transfers are not treated as sales without meeting these pre-sale obligations (see r 18 elaborating pre-sale requirements).

Registration disc obligations and narrow exemption windows

• Collar/disc rule is active whenever a dog is not “effectively confined” to the owner’s occupier premises (r 9(1)). Effective confinement is not defined in the Regulations; disputes may arise over whether a dog is “effectively confined”. Owners relying on health or activity exceptions must ensure they meet the narrow textual grounds in r 9(2)(b)-(c).

Information timing and reporting traps

• Microchip data to Registrar and Board changes within 14 days. Owners must notify the Board within 14 days of changes to name, address and telephone number in the manner determined by the Board, and provide the microchip number to the Registrar (r 10(6)-(7)). The Board determines the manner and form, creating potential risk if owners do not follow current Board-prescribed processes. Delays can attract penalties and expiation fees.

• Persons who implant or desex must provide information “as the Board may, by notice in the Gazette, require” and within the manner, form and period specified (rr 10(4)-(5), 12(8)-(9)). Those notice requirements may not be obvious unless Gazette notices are actively consulted. Practitioners must track Gazette notices to be sure of current reporting forms and timelines.

Exemptions and veterinary discretion

• Vets have conditional but reviewable authority to exempt. A registered veterinary surgeon may exempt an owner where certain medical grounds exist (r 13(1)-(2)), but they face a $5 000 penalty for granting an exemption without proper satisfaction (r 13(3)). Exemptions are time-limited and must be provided in an approved form; vets must supply information to the Board “as soon as is reasonably practicable” (r 13(4)-(6)). Vets must therefore document their medical reasoning and follow Board forms to avoid liability.

• Exemptions may be varied or revoked by the Board or by the issuing vet if grounds cease to apply (r 13(7)). Owners relying on medical exemptions should expect potential re-examination.

Board’s Gazette powers create shifting obligations

• Many operational details are determined by Board notices in the Gazette (r 5, r 10(4)-(5), r 12(8)-(9), r 19(5)(e), r 21, r 22). These create an ongoing compliance monitoring task; failure to consult up-to-date Gazette notices can expose owners, vets, breeders and councils to inadvertent non-compliance.

Breeding definition and unintended liability

• Broadened breeder definition. A person who provides semen, ova, facilities or assistance, or who allows or fails to take reasonable steps to prevent impregnation that results in birth is taken to have bred the animal (r 17(1)-(2)). That extended reach can unexpectedly capture parties who contribute services, facilities, or lack of supervision, with the regulatory consequences of being treated as a breeder. Practitioners should assess whether commercial arrangements could trigger “breeder” status.

Sales exceptions and the contours of “sale”

• Several sales exemptions are prescribed (r 18(4)), including sales between registered breeders and greyhound sales under Greyhound Racing SA rules. However, r 17(3) notes s 69(1) of the Act does not apply in relation to the sale of a dog or cat in circumstances contemplated by ss 62(1) or 64A(1) of the Act. Those cross-references require careful drafting in contracts and sale documents to ensure that the sale falls into a prescribed exception where relied upon.

Interstate compliance pitfalls

• Interstate microchipping or desexing is accepted if it complies with that State or Territory’s law and matches the microchip standard (rr 10(8), 12(7)). However, the standard prescribed is AS 5018-2001; microchips from other jurisdictions must still meet that technical requirement. Sellers and buyers should verify both jurisdictional compliance and microchip standards.

Fund and fee complexities

• Differential percentage splits for the Fund create fiscal variation by council and by date. r 6 prescribes different percentages for named “prescribed councils” versus other councils and includes a change in percentages on or after 1 July 2018. Councils and councils’ accountants must track which percentage applies to which period and which councils are on the prescribed list (r 6(4)).

Practical consequence

• The Regulations stitch technical veterinary rules into administrative and fiscal obligations, with specific reporting mechanisms largely determined by the Board through Gazette processes. That design places a practical compliance burden on owners, vets, sellers and councils to track changing Board notices, to meet short notification windows and to ensure documentation is retained and transferred on sales.

This section lists concrete, actionable compliance steps for the principal actors under the Regulations and highlights ongoing recordkeeping and administrative practices to manage risk.

For owners of dogs and cats

• Microchip and desex on the required timetable. Ensure microchipping occurs before sale and by the later of 12 weeks of age or 28 days after taking possession, unless a Board extension applies (r 10(1)(a)-(b)). Ensure desexing occurs before 6 months or within 28 days after possession, subject to extension (r 12(1)(a)). If interstate procedures are used, verify that the microchip conforms to AS 5018-2001 and that the interstate desexing complies with that jurisdiction (rr 10(1)(c), 10(8), 12(7)).

• Use authorised implanting personnel. Ensure implantation is performed by a registered veterinary surgeon or authorised person as listed in r 10(1)(d), or a person approved by the Board.

• Provide accurate registry and Registrar information. Provide the microchip number to the relevant local Registrar in the form determined by the Board (r 10(7)). Update the Board within 14 days of any change to the owner’s name, residential address or telephone number in the manner and form determined by the Board (r 10(6)). Keep records of these notifications and proof of submission or postal/correspondence dates.

• Maintain registration discs. Ensure dogs wear the registration disc, or where the dog is used in a registered business use approved business identification on collars or tags (r 9(1)). If the dog is in categories excluded at r 9(2), keep veterinary evidence or activity documentation to support an exemption.

• Retain sale documentation. When selling, provide the buyer with the full prescribed information under r 19 including seller and breeder names and contacts, vaccine and desexing details (with vet details and dates), microchip number and registry details, any exemptions and extension details, and any known illnesses or control orders. Use a standard checklist to ensure full compliance.

For sellers and breeders

• Verify compliance before sale. Do not sell a dog or cat unless it complies with pre-sale microchip and desexing requirements, or a valid exemption or extension is in place and supplied to the buyer in accordance with r 19(5)(a)-(b) and r 18. Record the basis for any exception used.

• Document breeder status. If you provide semen/ova, facilities or assistance, or operate in a way that could be construed as failing to prevent impregnation, treat yourself as a breeder for compliance planning (r 17). Maintain breeding records and registration details for any sale disclosure obligations.

• Monitor and follow Board Gazette notices. The Board may require information about breeding, microchipping or desexing by Gazette notice (rr 10(4)-(5), 12(8)-(9)). Subscribe to the Gazette or the Board’s communications to ensure you meet any reporting forms, timelines and content requirements.

For registered veterinary surgeons

• Follow the authorised form for exemptions. If granting an exemption under r 13, ensure the veterinary decision is well documented, in an approved form (r 13(5)), specifies the period of exemption, and is backed by clinical reasoning that would satisfy the statutory test in r 13(2). Provide the prescribed information to the Board “as soon as is reasonably practicable” (r 13(6)). Recordkeeping is essential to defend any alleged contravention under r 13(3).

• Comply with Board reporting requirements. If the Board has issued a Gazette notice requiring particular information on microchipping or desexing, provide it in the manner and period specified (rr 10(4)-(5), 12(8)-(9)).

For councils

• Correctly apply Fund percentages. For the relevant period, apply the correct percentage of dog registration fees into the Fund and the correct percentage to be received back from the Board for dogs registered through the Board, distinguishing between prescribed councils and others and noting the dates when percentages change (r 6(1)-(3), (4)).

• Set fees within Board maxima. When setting registration fees for non-standard or other matters, adhere to the Board’s fixed maxima where applicable; if the Board has not fixed a fee, council-determined fees should not exceed any Board maximums (r 22).

• Receive guard dog notifications and maintain records. Ensure systems are in place to capture guard dog notices within 24 hours (oral) and to confirm in writing within 48 hours as required under r 20(2)(a)-(b).

For the Board and registries

• Publish and maintain Gazette notices. Use the Gazette mechanism to publish required information such as prescribed accreditation bodies, reporting requirements for microchipping/desexing, the fees maximums and other delegated matters (rr 5, 10(4)-(5), 12(8)-(9), 19(5)(e), 22(1)). Keep accessible records of forms and timeframes.

• Administer extensions and exemptions with clear conditions. When exercising powers under r 14 and r 12(3), issue clear notices of extension and record any conditions attached. Provide a process for variation and revocation and ensure affected owners receive formal notice.

• Maintain Registrar systems. Ensure Registrars can receive and record microchip numbers and have public registries available as defined at r 3. Ensure the Registrar’s data interfaces with council and Board records to reduce duplication and to support enforcement.

Recordkeeping best practice

• Retain clinical and administrative evidence. Keep vaccination records, microchip implantation certificates, desexing certificates, exemption notices and extension notices, and all sale disclosure documents. For each transaction, create a file that contains copies of the seller statement required by r 19 and proof of Registrar/Board notices.

• Timestamp and prove notifications. For owner and seller notifications to the Board or Registrar, use traceable methods (email with read receipts, certified mail, or Board-prescribed electronic forms that generate receipts). Maintain these receipts for the statutory period likely to be relevant to enforcement or dispute resolution.

• Monitor legal and Gazette changes. Given the Board can vary many details by Gazette notice, entities should build a process to check the Gazette and Board communications regularly and allocate responsibility for this to a compliance officer.

Practical checklist on sale

1. Confirm microchip conforms to AS 5018-2001 and is implanted by an authorised person; record microchip number and provide to Registrar (r 10).
2. Confirm desexing performed by registered veterinary surgeon and record date, surgeon and nature of procedure (r 12, r 19(3)(b)(i)-(iv)).
3. Provide buyer with full r 19 disclosures including any exemptions or extensions (r 19).
4. Ensure registration disc or business identifier in place if the dog is not confined (r 9).
5. Keep copies of all documentation and confirmations for compliance and potential enforcement review.

Adhering to these steps reduces exposure to the specific penalties identified in the Regulations and to administrative revocations or inquiries from the Board.
