Dividing Fences Act 1961

The Act operates through a small set of interlocking legal concepts that determine liability, process and remedies.

• Dividing fence and sufficient fence: The Act concerns a "dividing fence", defined broadly to include a fence on the common boundary or on another line separating different owners (s 5). Whether a fence is "sufficient" is crucial because owners of adjoining lands are only liable to contribute if a sufficient fence is absent (s 7). "Sufficient fence" is defined by (a) any local law prescribing a sufficient fence for the local government area; (b) an agreed fence description; or, failing both, a substantial fence ordinarily capable of resisting cattle and sheep, or a court determination (s 5, definition of "sufficient fence"). The local-law route delegates substantive standard-setting to local government when the Minister requires it (s 24).
• Owner: The statutory owner definition is broad and includes freehold owners, trustees, mortgagees in possession, and in specified circumstances lessees with an unexpired term of five years or more at defined times (s 5(1)(a), (b); s 16(2)). For community titles schemes the question of who counts as owner is explicitly left to the by‑laws, and otherwise to the lot owner or the community corporation (s 5(2); s 6(2)).
• Compulsory contribution and equality: The starting default is equal contributions by adjoining owners for construction and repairs (s 7; s 14). The court, however, may apportion responsibility differently, determine who constructs what portion, and award compensation for loss of occupation or re‑alignment (s 9(1)(e),(f),(h); s 15(5)(c)-(e)).
• Notice and time frames: Before court involvement, a formal written notice is required for construction (s 8) and for repair (s 15(1)). The Act prescribes response periods: 21 days before court proceedings for construction disputes (s 9(1)); 14 days for repair responses (s 15(3)); seven days for responding to boundary survey notices (s 12(2)); and one‑month timeframes for certain post‑construction claims by a fencing owner (s 11(3), s 13(3)).
• Court intervention and finality: The Magistrates Court is given summary jurisdiction to determine factual and remedial questions (s 5; s 9(1), (4); s 13(5)-(6); s 15(5)-(6)). Certain orders operate as judgments enforceable as such (s 18(3)). An ex parte route exists where an adjoining owner cannot be found, subject to prescribed evidentiary expectations and notification duties (s 11(1)-(6)).
• Surveyor mechanism: Where boundary position is in dispute, either owner can require the line be fixed by a licensed surveyor; the Act sets short notice and response windows and provides cost‑sharing rules (s 12). The surveyor must be licensed under the Licensed Surveyors Act 1909 (s 5 definition).
• Landlord/tenant and lease thresholds: The Act sets rules for apportioning costs between landlord and tenant by reference to the unexpired term of the tenant's interest (s 19). A lessee with a lease unexpired term of five years or more may be treated as an owner for certain notices (s 5(1)(b)).
• Interaction with local laws and other statutes: Local laws may prescribe the standard of sufficiency and thereby change the baseline obligations (s 5 definition; s 24). The Act explicitly preserves the primacy of specified statutes where inconsistent (s 3).

These concepts determine who pays, who decides, how disagreement is resolved, and where cost‑shifting may occur. Practically, disputes reduce to factual questions (is a fence "sufficient"; is repair needed; where is the boundary) and legal questions on entitlement to cost recovery, all to be addressed either by agreement or summary court determination.

The Act's reach is described primarily by its definition of "owner" and by provisions that bring lessees, community title bodies, local governments, and particular occupiers into play.

• Owners of adjoining land: The default financial obligation falls on the owners of adjoining lands where they are "not divided by a sufficient fence" (s 7). The definition of owner includes persons entitled in possession to a freehold estate, persons entitled to receive rents and profits (including trustees and mortgagees in possession), and, in specified circumstances, lessees with at least five years unexpired term at particular moments (s 5(1)(a)-(b)). Therefore, freehold owners, trustees, mortgagees in possession and qualifying long‑lease holders are principally affected.
• Lessees with medium‑to‑long term leases: The Act treats a lessee with an unexpired term of five years or more as an "owner" for particular procedural triggers: when notice to fence is given or received, when an application under s 11(1) is made, when a copy of an ex parte order is given, and when a notice under s 15 is given (s 5(1)(b)). Separately s 19 apportions construction and repair costs between landlord and tenant depending on remaining lease term (less than 5 years: landlord pays all; 5-7 years: 3/4 landlord, 1/4 tenant; 7-12 years: equal; 12+ years: tenant pays all).
• Community titles schemes and common property: For community schemes under the Community Titles Act 2018, the Act defers to by‑laws on who counts as owner for these purposes (s 5(2)(a)), and preserves by‑laws touching dividing fences between lots, common property, and owners (s 6(2)). Where by‑laws do not resolve owner status, the lot owner or community corporation are the owner under the Act (s 5(2)(b)).
• Persons using a fence from the other side of a road: The Act expressly captures an owner whose land becomes enclosed, or who avails himself of the fence, by adopting means that enclose his land behind a fence constructed on another owner’s road boundary; that person becomes liable for equal contribution to repair of that portion for as long as they continue to use it (s 16(1)). Lessees with a term of five years or more are included within the definition (s 16(2)).
• Local governments and the Minister: Local governments are affected when the Minister requires them to make local laws prescribing what constitutes a "sufficient fence" (s 24). A prescribed local law changes the statutory standard and therefore the obligations and costs for owners within that district (s 5 definition of sufficient fence).
• The Crown: The Act explicitly does not bind the Crown (s 4). Thus Crown‑owned land is generally outside the Act’s compulsory contribution regime unless a different legal relationship applies.
• Persons who construct a fence unilaterally: A person who has already constructed a sufficient fence without giving prior notice may later claim half its value if the adjoining owner builds or occupies (s 13). That creates a class of affected persons who can seek retrospective contribution.
• Courts and surveyors: The Magistrates Court is the adjudicative forum under the Act (s 5), and licensed surveyors are engaged to resolve boundary position disputes (s 5 definition; s 12).

The Act therefore affects a concentrated group of landholders adjacent to one another, lessees with defined lease lengths, local governments who can define sufficiency, and magistrates and surveyors who implement determinations. The Crown is excluded. Practitioners should map the precise legal status of a party (owner, lessee, trustee, mortgagee in possession, community corporation) against the Act’s procedural triggers to determine who must act and who can be sued.

This section sets out the principal statutory duties imposed and the rights the Act gives to those parties.

Duties

• Duty to contribute to construction: Owners of adjoining lands not divided by a sufficient fence must join in or contribute equally to construction of a dividing fence (s 7). This establishes the baseline financial duty.
• Duty to give and respond to notices: An owner seeking to compel contribution must give a written notice specifying the boundary/line proposed, the proposal for fencing and the kind of fence (s 8). For repairs, the owner must give a written notice describing the proposals and specifying the kind and extent of repairs (s 15(1)-(2)). The recipient of a repair notice must answer in writing within 14 days indicating whether they will join in one of the options or dispute need, kind, extent or line (s 15(3)).
• Duty to repair: Owners on both sides are liable to join in or contribute equally to repair of a dividing fence when it is in need of repair, subject to the procedural provisions of s 15 (s 14).
• Duty to notify local government after ex parte orders: An owner who obtains an ex parte order because the adjoining owner cannot be found must give a copy of that order to the chief executive officer of the local government within 21 days, or they forfeit entitlement to recover any portion of the cost from the owner to whom the copy may later be given (s 11(6)).
• Duty to enter when constructing/repairing: Persons constructing or repairing under the Act and their agents may enter adjoining land at reasonable times and do acts reasonably required to carry out the work (s 21).
• Duty in cases of negligence or consequential damage: If damage or destruction arises because of neglect by the owner on one side (e.g. fire originating through their neglect or tree fall caused by them), that owner is bound to repair or renew the fence and the adjoining owner may recover costs (s 15(7)(c)-(8)).

Rights

• Right to recover contributions: The non-defaulting owner may construct the agreed or ordered fence and recover half the cost from the defaulting owner (s 10(1)-(2)).
• Right to seek court determination: Where parties cannot agree within prescribed periods, either owner may apply to the Magistrates Court, which may determine the need, kind, position and apportionment of fencing or repairs, and award compensation for loss of occupation (s 9(1); s 15(4)-(5)).
• Right to ex parte orders where adjoining owner cannot be found: After demonstrating reasonable enquiries, an owner can apply for an ex parte order authorising construction, then later serve that order on the owner when found and claim half its value (s 11(1)-(3)). The owner served may, within one month, apply to the court for relief from the claim or alteration of the fence position (s 11(4)).
• Right to have boundary fixed by licensed surveyor: Either owner can require the line be defined by a licensed surveyor, with statutory response windows and cost‑sharing defaults (s 12).
• Rights of tenants and landlords: Parties have statutory apportionment rules (s 19) governing who pays what portion; a party who pays more than their statutory share may recover the excess (s 19(2)).
• Enforcement rights: Court orders specified in s 9(1)(h), s 13(5)(d) and s 15(5)(d),(e) are judgments enforceable as such (s 18(3)). More generally, moneys recoverable under the Act may be sued for in any court of competent jurisdiction (s 18(1)).

Administrative and procedural constraints

• Notices and demands must be in writing and served personally or by registered mail (s 22). Corporations require delivery or leaving at principal office, or registered mail (s 22(3)).
• Description of land in notices must allow no reasonable doubt as to what land is referred (s 22(4)).
• Court orders under the Act are final under the Act (s 9(4); s 13(6); s 15(6)). The Act provides specific one‑month challenge windows in some contexts (s 11(4); s 13(3)).

These duties and rights create a procedural architecture designed for summary resolution. The Act sets hard timeframes, clearly allocates initial burdens (notice, reply, survey), and turns unresolved disputes into court questions for the Magistrates Court.

Enforcement under the Act combines summary civil remedies, court judgment status for certain orders, costs discretion, and a narrow crimes/penalties regime for breach of regulations.

Civil enforcement

• Recovery in court: Moneys payable under the Act may be sued for and recovered in any court of competent jurisdiction (s 18(1)). This encompasses debt recovery processes in the State courts available to litigants.
• Orders as judgments: The Act expressly provides that orders made under specified provisions operate as judgments of the court and may be enforced accordingly: orders under s 9(1)(h) (annual compensation for loss of occupation), s 13(5)(d) (amount and payment period in fence value claims), and s 15(5)(d)-(e) (compensation and annual payments related to repairs and re‑alignment) are judgments enforceable as such (s 18(3)). Practitioners should treat these orders as having the same enforcement machinery and consequences as ordinary Magistrates Court judgments.
• Costs: The court has a general discretion to award costs against either party in any proceedings under the Act (s 17). Costs can be recovered as part of enforcement processes.
• Certificate as evidence: In proceedings to recover moneys, a certificate of the court as to the making and contents of an order under s 9, s 11 or s 15 is evidence of those matters (s 18(2)), aiding enforcement where a respondent refuses to pay.

Finality and limited relief

• Finality of orders: Orders made under s 9(1), s 13(5) and s 15(5) are stated to be final under the Act (s 9(4); s 13(6); s 15(6)). The Act limits further challenges under the Act, although it contains specific mechanisms to set aside or vary ex parte orders in limited windows (s 11(4)). The Act does not itself set out appeal routes; however, the classification of these orders as final under the Act is significant when advising clients as to post‑order processes and enforcement.
• Ex parte order protection: Where an owner obtains an ex parte order under s 11(1), the later obligation to give a copy to the chief executive officer of the relevant local government within 21 days is mandatory. Failure to comply bars recovery from the adjoining owner later identified (s 11(6)), which is a statutory forfeiture mechanism protecting unidentified owners.

Criminal or regulatory penalties

• Regulations may carry small penalties: The Act allows the Governor to make regulations and sets a maximum penalty for any regulation breach of $40 (s 23(2)). The Act itself does not create a broad suite of criminal penalties for non‑compliance with its substantive fencing or repair obligations; enforcement is primarily civil.

Practical enforcement mechanisms and considerations

• Execution and judgment collection: Where orders become judgments (s 18(3)), usual Magistrates Court enforcement mechanisms apply (writs, garnishee, sheriff processes in line with court rules), but the Act does not itself set proprietary remedies or charges over land other than ordinary judgment enforcement.
• Proof and service: The Act emphasises written notices and prescribed service modes (s 22). Where service is defective, enforcement of subsequent orders may be vulnerable; conversely, strict compliance with s 22 facilitates evidentiary proof in recovery actions.
• Time windows matter: Failure to observe prescribed timeframes (eg, 21 days before court action under s 9(1); 14 days reply under s 15(3); 7 days under s 12(2); one month challenge windows under s 11(4) and s 13(3)) can result in loss of procedural protections or quick entitlement to recover costs. These statutory time limits are central to enforcement risk and should be monitored closely.

The enforcement architecture is primarily civil and summary, with the Magistrates Court central to adjudication. The Act’s design is to encourage timely notice, negotiation and swift judicial resolution, backed by a modest regulatory penalty power for supporting regulations.

The Act embeds a set of primacies and delegations that intersect with local laws, community titles legislation, surveying law, and specified other statutes.

Statutory primacy and preservation

• Saved statutes: Section 3 expressly preserves the provisions of the Land Administration Act 1997, the Local Government Act 1995, the Vermin Act 1918, and the Bush Fires Act 1954, and provides that where those Acts are inconsistent with a provision in the Dividing Fences Act, the other statute prevails to the extent of the inconsistency (s 3). This operates as an express rule of conflict: if a requirement or power in those older or later Acts clashes with the Dividing Fences Act, the named Act takes precedence.
• Crown not bound: The Act does not bind the Crown (s 4). Therefore Crown land and Crown actions are outside the default compulsory contribution regime unless another statutory relationship imposes liabilities.

Community titles and by‑laws

• Community Titles Act 2018 interface: The Act expressly defers to by‑laws of community titles schemes. If the by‑laws determine who is the owner for the Act’s purposes, those by‑laws govern (s 5(2)(a)). In other cases, ownership is determined as either lot owner or the community corporation for common property (s 5(2)(b)). Section 6 preserves by‑laws that affect dividing fences between lots, between lots and common property, or determining owner status (s 6). This gives community scheme governance structures primary effect with respect to internal dividing fences, and potentially removes standard owner obligations under the Dividing Fences Act within schemes where by‑laws address the matter.
• Contracts and private agreements: Section 6(1) states nothing in the Act affects covenants, contracts or agreements between landlords and tenants or between adjoining owners as to cost sharing. That preserves private allocations of responsibility and allows parties to contract out of the Act’s default apportionment rules.

Surveying and professional regulation

• Licensed surveyor requirement: The definition of "surveyor" refers to a surveyor licensed under the Licensed Surveyors Act 1909 (s 5). Section 12 expressly contemplates obtaining a licensed surveyor to define the common boundary, with statutory response windows. The Act therefore interacts with the licensing and professional standards governed by the Licensed Surveyors Act and its successors.

Local government law and local laws

• Local laws as substantive standards: The "sufficient fence" definition gives primacy to local laws that prescribe the kind of fence required in a local government district (s 5, definition of "sufficient fence"). Section 24 empowers the Minister to require a local government to make such a local law prescribing a sufficient fence. This delegates substantive standard‑setting on the adequacy of fencing to local government, producing an operational interaction with the Local Government Act framework under which local laws are made and enforced.
• Local government notification: For ex parte orders under s 11 the applicant must, within 21 days, provide a copy of the order to the chief executive officer of the local government in whose district the fence will be constructed (s 11(6)). Failure to do so defeats subsequent recovery, creating an administrative compliance interface with local government officers.

Other statutes and planning/land law

• Land Administration Act and land status: The saving in s 3 means the Land Administration Act 1997 may prevail where inconsistent (for example, where land is reserved for public purposes and the Dividing Fences Act would otherwise impose liabilities on owners). The Dividing Fences Act’s owner definition excludes trustees of public reserves and persons managing such public land (s 5(1)(a)-(b) exceptions), meaning public land management regimes under other Acts will often govern.
• Courts and jurisdiction: The Act defines "court" as the Magistrates Court (s 5). It does not expressly deal with appeals, so appellate routes follow general court practice and appellate jurisdiction statutes rather than being provided under the Act.

Regulatory cross‑effects

• Bushfire and vermin controls: Because the Act preserves the Vermin Act and the Bush Fires Act (s 3), local or state obligations to clear vegetation, maintain firebreaks, or control vermin may affect fencing decisions and costs. A fence that is required by local vermin or bushfire regulations may not be exclusively regulated under the Dividing Fences Act where inconsistency arises.

In short, the Dividing Fences Act works alongside local government law (particularly local laws prescribing sufficient fences), community titles by‑laws, surveying regulation, and the specified Acts that have primacy in case of inconsistency. Practitioners must check local laws, community scheme by‑laws, the Licensed Surveyors Act, and land status under land administration statutes before concluding rights and duties under the Dividing Fences Act apply in a straightforward way.

The compilation table included in the source lists the statute’s legislative history, including primary amendments and reprints. Key chronological milestones are:

• 1961: Original enactment as Dividing Fences Act 1961 (44 of 1961), assent 23 November 1961; commencement 1 January 1962 (s 1(2) and Gazette 15 Dec 1961 p. 3704).
• 1965: Decimal Currency Act 1965 (113 of 1965) made some consequential commencement or technical changes, with different commencement dates for provisions (see table).
• 1969: Dividing Fences Act Amendment Act 1969 (5 of 1969) amended s 1 and s 5 (as noted in the source).
• 1972: Reprint of the Act approved 2 February 1972 incorporating prior amendments.
• 1996: Local Government (Consequential Amendments) Act 1996 (14 of 1996) amended s 3 and introduced s 24 (inserted by No. 14 of 1996 s 4), and other consequential adjustments. The Licensed Surveyors Amendment Act 1996 (79 of 1996 s 28) amended the definition referencing surveyor licensing.
• 1997: Acts Amendment (Land Administration) Act 1997 (31 of 1997 s 141) updated references and preserved certain land administration provisions.
• 1998: Statutes (Repeals and Minor Amendments) Act (No. 2) 1998 (10 of 1998 s 76) made a technical amendment to s 1 regarding commencement citation.
• 2004-2005: Courts Legislation Amendment and Repeal Act 2004 (59 of 2004 s 141) amended the Act and came into operation 1 May 2005 for relevant provisions.
• 2015: Reprint 3 published as at 22 May 2015, consolidating earlier amendments.
• 2018-2021: The Community Titles Act 2018 (32 of 2018), Part 14 Div 5, amended this Act to address community titles interactions; those amendments were brought into operation 30 June 2021 by SL 2021/69 cl. 2.

The source’s compilation table records which sections were amended by which Acts and provides the assent and commencement dates for each amending instrument. Notably, s 5’s owner definition, the local government sufficiency power (s 24) and the community titles interface (s 5(2); s 6) are outcomes of more recent amendments to align this Act with contemporary land management regimes.

For practitioners, the amendment history indicates repeated adjustments to align the 1961 statute with changes in local government, surveying licensing and community titles law. Always check the current reprint or consolidated version and local regulations or local laws made under s 24 to ensure that the statutory tests (for example, "sufficient fence") reflect the most recent local‑law prescriptions.

The statutory text supplied contains no reported case law, and the compilation notes section does not list litigation. The Act itself designates the Magistrates Court as the forum for disputes (s 5), and describes orders as "final" under its terms (s 9(4); s 13(6); s 15(6)). Because the source contains no case references, this deep dive does not cite any judicial decisions.

What the Act does show about the likely litigation profile

• Summary, local litigation: The Act is structured for summary controversy resolution in the Magistrates Court (s 5). Matters likely to reach court include whether a fence is "sufficient", whether repair is necessary, boundary line disputes requiring surveyor determination, apportionment of costs, valuation disputes in claims under s 13(2), and enforcement of orders treated as judgments under s 18(3).
• Finality and limited challenges: The Act’s express finality language for orders (s 9(4); s 13(6); s 15(6)) indicates that, within the statutory architecture, parties should expect prompt, binding Magistrates Court determinations. The Act provides specific time windows for certain post‑order challenges (eg, s 11(4) after ex parte orders) but otherwise describes orders as final under the Act. Appeal or review routes are not addressed in the statute itself; any such avenues follow the general appellate rules applicable to Magistrates Court judgments.
• Evidentiary facilitation: The Act provides that certificates of the court as to orders are evidence in recovery proceedings (s 18(2)), aiding enforcement and reducing litigation over whether an order was made.
• No statutory damages or punitive multipliers: The Act’s remedies are compensatory and declaratory (orders, cost recovery, contribution), and do not create a statutory regime of exemplary damages for fencing disputes.

Because the source provides no reported decisions, practitioners should consult the full case law database for Magistrates Court and appellate decisions dealing with the Dividing Fences Act to understand judicial interpretations of core concepts such as "sufficient fence", "need" and "desirability", the scope of the court’s apportionment power, and procedural strictness around notices and service under s 22. The Act itself, however, frames disputes as summary, locality‑based matters for Magistrates Court resolution.

The Act contains many small but consequential procedural and substantive traps for parties, whose effects turn on timing, form, definitions and local‑law interaction.

1. "Sufficient fence" depends on local law or cattle/sheep standard: The threshold for liability is the absence of a "sufficient fence" (s 7). What counts as sufficient is first any local law for that locality, then any agreement between parties, otherwise a fence ordinarily capable of resisting cattle and sheep, or a court determination (s 5 definition). If a local government has, pursuant to s 24, prescribed a particular standard, that standard will displace the Act’s default. Practitioners must check local laws. Failure to do so can surprise clients about whether a statutory contribution obligation arises.

2. Strict time windows and procedural preconditions: The Act prescribes short, non‑extendable‑in‑text time limits: 21 days after service of a s 8 notice before proceeding to court under s 9(1); the recipient of a s 15 notice must answer within 14 days (s 15(3)); a notice under s 12(1) requires the recipient to act within 7 days (s 12(2)); ex parte claimants have to serve a found owner a copy within one month to trigger s 11(3) rights; failure to give a copy of an ex parte order to the local government within 21 days defeats recovery (s 11(6)). Missing any of these windows can lose rights to relief or recovery.

3. Ex parte orders come with a mandatory local government notification, or loss of recovery: If you obtain an ex parte order because the adjoining owner cannot be located (s 11(1)), the applicant must give a copy to the local government CEO within 21 days (s 11(6)). Failure to comply prevents recovery from the adjoining owner later found. That notification obligation is a hard compliance risk that may be overlooked by practitioners acting quickly to construct a fence.

4. Owner definition nuances: A lessee with at least five years unexpired term is an "owner" only for particular triggers listed in s 5(1)(b). Those specific moments are: when notice to fence is given or received under s 8; when s 11(1) application is made; when a copy of s 11(2) order is given; when notice under s 15 is given. Outside those contexts a long leaseholder may not be an owner for other parts of the Act. Interpreting which events treat the lessee as owner affects standing and liability.

5. Contractual and scheme overrides: The Act does not displace private agreements or community scheme by‑laws that allocate fencing responsibilities (s 6(1)-(2)). A written by‑law or covenant may therefore supersede the Act’s default cost apportionment. Advising clients requires checking for such agreements which may render statutory notice steps less relevant or inapplicable.

6. Apportionment between landlord and tenant is fixed by lease term cut‑offs: Section 19 sets fixed fractional apportionments by lease term (<5 years: landlord pays all; 5-7 years: landlord 3/4, tenant 1/4; 7-12 years: 50/50; 12+ years: tenant pays all). These numeric cut‑offs can create sharp rent/lease negotiation incentives and can produce counter‑intuitive allocations if parties do not review leases before undertaking works.

7. Damage/repair exceptions and immediate repairs: Where a fence is damaged or destroyed by flood, fire, storm or accident, the owner of land on either side may immediately repair without notice and recover half the cost (s 15(7)(b)). But if repair is required because of neglect of an owner (eg fire originating because of their neglect or a fallen tree due to their land), the negligent owner is bound to repair and is liable for the costs (s 15(7)(c)-(8)). These rules allocate emergency costs but require careful proof of cause in recovery actions.

8. Court orders are "final": The Act says orders under s 9, s 13 and s 15 are final (s 9(4); s 13(6); s 15(6)). The Act gives narrow windows for relief (eg s 11(4) where an owner served a copy of an ex parte order considers it inequitable), but otherwise internal statutory re‑litigation is limited. Parties should be ready to accept binding determinations at Magistrates Court level or seek external appellate remedies under general court law where available.

9. Small regulatory penalties: The Act allows regulations with penalties up to $40 for breach (s 23(2)). That figure is nominal; the primary deterrent is civil liability and court enforcement rather than penal fines.

10. Service and form formalities: Notices must be in writing, signed, and served by personal delivery or registered mail (s 22). Corporations have specified service modalities (s 22(3)). Physical description of land in notices must allow no reasonable doubt (s 22(4)). Failure to comply with these formalities can defeat subsequent recovery and court enforcement.

These "gotchas" are practical compliance traps that shift recovery rights, preclude later claims, or impose administrative obligations. Advisers should audit lease terms, check for local laws prescribing "sufficient fence", comply strictly with the Act’s notice forms and timeframes, and ensure local government notification where ex parte relief is used.

This section provides a step‑by‑step compliance checklist tied precisely to the Act’s provisions and practical notes on documentation and timing.

1. Confirm title and status of parties

   • Determine the legal owner(s) as defined by s 5. For community titles schemes, check by‑laws under the Community Titles Act 2018 because s 5(2)(a) allows by‑laws to determine owner status and s 6(2) preserves by‑laws affecting dividing fences. If the land is common property, the community corporation may be the owner (s 5(2)(b)).
   • If the party is a lessee, calculate the unexpired term. A lessee with an unexpired term of five years or more may be treated as an owner for certain notices and events under s 5(1)(b) and s 16(2).

2. Check local law prescriptions for "sufficient fence"

   • Inspect local government local laws to see if they have prescribed what a "sufficient fence" is for the area (s 5 definition; s 24). If such a local law exists, the statutory obligation to contribute may only arise where the existing fence fails the local‑law standard.

3. If construction is sought, serve a proper s 8 notice

   • Prepare a written notice meeting s 8: it must specify the boundary or, where impracticable, the proposed line; contain a proposal for fencing; and specify the kind of fence proposed. Use clear land descriptions that "allow no reasonable doubt" (s 22(4)).
   • Serve the notice by personal delivery or registered mail in accordance with s 22(2); for corporate recipients, deliver or leave at the principal office or use registered mail (s 22(3)). Preserve proof of service (signed receipt, registered mail tracking, statutory declaration of service).

4. Allow response period and attempt agreement

   • Wait 21 days after service of the s 8 notice before initiating court proceedings; if the parties agree, record the agreement in writing. If no agreement, either owner may apply to the Magistrates Court to determine issues under s 9(1). Where appropriate, consider mediation or negotiation to avoid court costs.

5. If boundary position is disputed, follow s 12

   • Issue a s 12 notice if the accurate position of the common boundary is in dispute. The recipient has 7 days to peg the boundary or employ a licensed surveyor (s 12(2)). If the recipient pegs the boundary and a later survey confirms it, the pegging owner recovers survey costs from the party who sought the survey (s 12(4)). If a surveyor is employed, apportion costs equally (s 12(4)).

6. If the adjoining owner cannot be found, use s 11 ex parte process

   • Demonstrate to the Magistrates Court you have made "reasonable inquiries" to locate the owner before seeking an ex parte order (s 11(1)). Apply in the prescribed form. If granted, construct in accordance with the order but remember the two further obligations: (a) when the owner is later identified, serve them a copy of the order (s 11(2)); and (b) within 21 days of obtaining the ex parte order, give a copy to the chief executive officer of the local government in whose district the fence will be constructed (s 11(6)) or you lose the right to recover costs from the owner later discovered. If the owner served with the order considers it inequitable, they may apply within one month under s 11(4).

7. If you build without prior notice, preserve s 13 recourse

   • If an owner has already constructed a sufficient dividing fence without prior notice, they can claim half the value when the adjoining owner later develops or occupies (s 13(2)). Serve a written claim at the time the conditions in s 13(2) obtain. If disputed within one month the claimant must apply to the Magistrates Court to resolve need, desirability, value and payment (s 13(3)-(5)). Keep contemporaneous records of construction costs and specifications.

8. For repairs, follow s 15 procedure precisely

   • Give a written s 15 notice specifying proposals and options available (s 15(1)-(2)). The recipient must reply in writing within 14 days indicating acceptance of one of the options or disputing need, kind or line (s 15(3)). If they fail to reply within 14 days, you may repair and recover one‑half the cost (s 15(7)). In emergency damage circumstances (flood, storm, lightning) immediate repair is permitted and half costs are recoverable (s 15(7)(b)); if neglect by the adjoining owner caused the damage (eg fire or fallen tree due to their neglect), the negligent owner is bound to repair and you may recover costs (s 15(7)(c)-(8)).

9. Where court determination is sought, prepare evidence on locality standards

   • The court must be guided by the kind of fence usually constructed in the locality, the use of the lands, and any local law prescribing a sufficient fence (s 9(3); s 15(5b)). Provide local comparators, photographs, expert evidence (eg fencing contractor estimates), and copies of any applicable local laws.

10. Enforce orders and collect payments

• Orders under specified subsections constitute judgments enforceable as such (s 18(3)). Where a monetary order is obtained, use Magistrates Court enforcement processes. Obtain a certified copy of the order (s 18(2)) to expedite recovery and preserve evidence.

11. Keep granular records and proof of service

• Because notices and service modes are strictly prescribed (s 22), maintain signed notices, registered mail tracking, proof of delivery, photographic evidence of fence condition, contractor invoices and estimates, and surveyor certificates where used.

12. Observe landlord/tenant apportionment rules

• If land is held by a tenant, apply the apportionment rules in s 19. If a party pays a greater proportion than allowed under s 19 they may recover the excess; tenants may set off recoverable sums against rent (s 19(2)).

13. Check for contractual allocations and scheme by‑laws

• Before taking statutory steps under the Act, check for written covenants, leases, easements, or community scheme by‑laws that allocate responsibility for fencing. Section 6 preserves such private arrangements and they may override statutory defaults.

14. Local government engagement where required

• If an ex parte order will be sought or if a local law prescribes sufficiency, engage the relevant local government early. Failure to serve the local government within statutory windows after ex parte orders defeats recovery (s 11(6)).

15. Professional engagement

• Use licensed surveyors as the Act requires for formal boundary surveys (s 5 definition; s 12). Where valuation of fence or repair costs will be contested, obtain independent contractor quotations and, if necessary, valuations to support s 13 or s 15 court claims.

Following these procedural steps will maximise the chance of establishing statutory rights to contribution, defend against claims, and ensure enforceability of court orders made under the Dividing Fences Act 1961. Keep in mind that local law prescriptions and community scheme by‑laws can alter obligations substantively, so those must be checked before progression.
