District Court (Fees) Regulations 2002

The regulations rest on several core concepts that determine who pays what, when, and under what conditions. Those concepts are defined in regulation 3 and used throughout the instrument.

Fee schedules and columns

• Schedule 1 lists the registry fees and sets three relevant columns: Column A for individuals who are not eligible individuals, Column B for entities that are not eligible entities, and Column C for eligible individuals (regulation 4(2), Schedule 1 table). For an eligible entity, the “eligible entity fee” is the figure shown in Column A for that item as designated by the definitions in reg 3, and by regulation 4(2)(d).
• Schedule 2 lists sheriff’s fees for execution, service, travel and other enforcement activities (regulation 4(1), Schedule 2).

Eligibility and concessions

• “Eligible individual” is a defined category that includes holders of specific Centrelink or Department of Veterans’ Affairs concession cards, recipients of certain Commonwealth allowances (youth training allowance, AUSTUDY, ABSTUDY), persons granted legal aid in respect of the proceedings, and persons the Court or a registrar directs should be treated as eligible (regulation 7(2)). “Eligible entity” includes entities granted legal aid or entities so directed (regulation 7(3)).
• “Small business” and “non‑profit association” are separately defined in regulation 3. A small business can self‑declare using Schedule 3 Form 1 and, on lodgment, is charged as if it were an eligible entity (regulation 4A(1)-(2)). The self‑declaration duty is subject to a notification duty if status changes, with an express fine for failure to notify (regulation 4A(4)).

Payment timing, deferral and refunds

• The baseline rule is that fees must be paid before a pleading, application, or other document is filed, issued or otherwise dealt with, and before other Court matters are done (regulation 6(1)). The Court or a registrar may direct that whole or part payment be deferred, on conditions the Court or registrar specifies (regulation 6(2)). An application for a deferral or reduction must use Schedule 3 Form 2, and no fee is charged for the application (regulation 6(3)-(4), (5)).
• The regulations contain precise refund and transfer rules for hearing allocation fees when matters are settled, vacated or relisted (regulation 9(6)-(9), 10). Judicial officers and the Principal Registrar have power to order refunds where fees were wrongly charged or paid in error (regulation 8C).

Searchable information

• The Principal Registrar must provide searchable information (party names and addresses, claim amount and nature, judgment amount, discontinuation status) each working day to persons approved in writing by the Attorney General (regulation 11A(1)-(2)). Approved recipients pay either a per‑action fee or an annual email subscription (Schedule 1 item 13).

Offences and enforcement

• False or misleading statements in declarations or applications under the regulations attract an express offence and penalty of $1 000 (regulation 8B(1)). The Court or registrar may declare a Form 1 invalid, revoke directions, and order recovery of differences plus make consequential orders affecting the conduct of proceedings (regulation 8B(2)-(5), regulation 4A(5)-(6)).

Cross‑cutting definitions and references

• The regulations use external statutory concepts, adopting the Corporations Act meanings for corporation and subsidiary, and referencing the Co‑operatives Act 2009, Statutory Corporations (Liability of Directors) Act 1996, Legal Aid Commission Act 1976, Civil Judgments Enforcement Act 2004, Prohibited Behaviour Orders Act 2010, Criminal Law (Mental Impairment) Act 2023, Commercial Arbitration Act 2012, Road Traffic (Authorisation to Drive) Act 2008 and Spent Convictions Act 1988 for particular fee items and exemptions (regulation 3, regulation 5, Schedule 1 notes).

The regulations therefore combine a tariff with eligibility rules, compliance pathways and administrative discretion, and map specific operational outcomes such as when a hearing may be vacated for non‑payment (regulation 9(5B)), and that unpaid fees are debts due to the State and recoverable by action (regulation 11).

The regulations affect three main categories of stakeholders: litigants and their representatives, third parties who request Court services or searchable information, and Court officers (judges, registrars, the Principal Registrar and the Sheriff).

Litigants and parties

• Individuals, corporations, partnerships and other entities that initiate or respond to District Court proceedings are subject to fees charged under Schedule 1 when they commence proceedings, file applications, enter matters for hearing, request transcripts, seek copies, or use other paid services (regulation 4(1), Schedule 1 items). Where a person is an “eligible individual” or “eligible entity” under regulation 7, they pay reduced fees in the columns designated for eligible persons. Individuals who hold specified Centrelink or Department of Veterans’ Affairs cards, recipients of Commonwealth allowances, and those granted legal aid are explicitly within the eligible individual or eligible entity categories (regulation 7(2)-(3)).
• Small businesses and non‑profit associations that meet the definition in regulation 3 may lodge a Form 1 declaration to be charged as eligible entities (regulation 4A(1)-(2)). That affects unincorporated businesses wholly owned and operated by individuals and corporations that meet the employee count thresholds in reg 3, with the caveat that subsidiaries and bodies with larger group employment are excluded by the definitions (regulation 3).

Legal aid and concession recipients

• Legal aid recipients are treated as eligible (regulation 7(2)(e), 7(3)(a)). This means representation funded by legal aid translates into lower assessed fees on certain filings or may remove fee burdens where legal aid covers the proceedings. The regulations also permit the Court or registrar to exercise discretion to declare a person eligible on financial hardship or interests of justice grounds (regulation 8A).

Third parties and commercial users

• Reporting services, media organisations and commercial data users who obtain searchable information are affected by regulation 11A and Schedule 1 item 13. Approved recipients must be approved in writing by the Attorney General (regulation 11A(1)), receive daily searchable information from the Principal Registrar (regulation 11A(2)) and pay either a small per‑action fee of $2.95, or take an email subscription at $3 001 per annum (Schedule 1 item 13). Approved recipients who receive information in another way may incur per‑action charges (regulation 11A(3)-(4)).

Court officers and enforcement bodies

• The Principal Registrar is required to provide searchable information daily to approved recipients, administer approvals and charge fees (regulation 11A). Registrars and judges exercise discretion to defer or waive fees, to direct further information on eligibility applications, to order refunds or revoke directions, and to make orders enforcing recovery where declarations are invalid or fees unpaid (regulations 6(2), 8A(3), 8B(2)-(5), 8C).
• The Sheriff, and enforcement officers under the Civil Judgments Enforcement Act 2004 definitions, charge and collect Sheriff’s fees under Schedule 2 where arrests, service, travel and attendances occur. Those fees apply to parties requiring service or enforcement (Schedule 2).

Other affected groups

• Children under 18 are exempt from paying fees (regulation 5(2)(b)). Several jurisdictions of proceedings are expressly excluded from the scope of the regulations, for example criminal proceedings, Civil Judgments Enforcement Act proceedings, Prohibited Behaviour Orders Act applications and civil proceedings under the Criminal Law (Mental Impairment) Act 2023 (regulation 5(1)). That affects how different procedural tracks and participants are treated.

In short, the regulations allocate cash costs and administrative duties across litigants, legal aid recipients, small businesses and non‑profit associations, commercial data users, Court officers and enforcement personnel. The distribution depends on defined eligibility criteria, self‑declaration, judicial discretion, and statutory exclusions.

The regulations establish specific duties on litigants, entities and Court officers, and confer procedural rights to apply for concessions, deferrals, refunds and determinations.

Duties to pay fees and timing

• Baseline duty: a pleading, application or document must not be filed, issued, or otherwise dealt with unless the fee payable has been paid, and no other Court business is to be done unless the fee is paid (regulation 6(1)). The rule applies subject to deferment powers that the Court or a registrar may exercise (regulation 6(2)-(3)).
• For allocated hearing dates and daily hearing fees, there are timing rules: the fee for allocation (Schedule 1 item 7) and daily hearing fees (item 8) are payable as set out in regulation 9. The Court may list a proceeding before fee payment, but the fee becomes payable after the listing order and if unpaid by the specified day, the Court may vacate the allocated dates (regulation 9(5), (5A), (5B)). For reconvening hearings where item 8 fees apply, regulation 10 requires the fee to be paid before reconvening.

Duties on small businesses and associations

• An entity lodging a small business or non‑profit declaration must immediately advise the Principal Registrar if it ceases to be a small business or non‑profit association (regulation 4A(4)). The regulation specifies a penalty of $1 000 for contravention of that duty (regulation 4A(4)). If fees were charged at eligible rates when the entity was not entitled to them, the Court may order the entity to pay the difference and make enforcement orders, including orders relating to the future conduct of the proceedings until payment is made (regulation 4A(5)-(6)).

Duties regarding truthful statements

• Persons making declarations or applications under the regulations, or providing further information, must not make statements the person knows or has reason to believe are false or misleading in a material particular. Contravention is an offence with a prescribed penalty of $1 000 (regulation 8B(1)). The Court or registrar may invalidate declarations or revoke directions if satisfied of contravention, after providing an opportunity for written submissions, and may make consequential payment and conduct orders (regulation 8B(2)-(5)).

Rights to apply for concessions, deferrals and determinations

• A person may apply for a direction from the Court or a registrar that they are an eligible individual or eligible entity for the purposes of paying reduced fees, on grounds of financial hardship or the interests of justice (regulations 8 and 8A). An application uses Schedule 3 Form 2 and is not subject to a fee (regulation 8(1)-(3)).
• The Court or registrar may direct eligibility if satisfied by financial hardship or interests of justice (regulation 8A(1)-(2)). The Court or registrar may request further information before determining the application (regulation 8A(3)-(4)).

Rights to refunds and transfers

• If fees were overpaid or paid in error, a judicial officer or legally qualified registrar presiding in a proceeding may order the refund of the difference between the amount paid and the amount the person was entitled to under the regulations (regulation 8C(1)). The Principal Registrar may refund amounts paid in error (regulation 8C(2)). Specific refund percentages and transfer rules apply to hearing allocation fees when matters settle, are vacated or relisted (regulation 9(6)-(9)).

Rights to dispute fees

• An application for a determination under section 89A(3) of the Act about fees must be in Schedule 3 Form 3 and carries no fee (regulation 5A(1)-(2)). That provides a formal avenue to contest whether a fee is payable or its amount.

Right to searchable information and obligations of approved recipients

• Approved recipients, once authorised in writing by the Attorney General, are entitled to daily searchable information provided by the Principal Registrar, but they are liable to pay fees per action or an annual email fee when suitable facilities exist (regulation 11A(1)-(4), Schedule 1 item 13). The regulations place the administrative duty to provide the information on the Principal Registrar (regulation 11A(2)).

Enforcement rights and remedies

• Any unpaid fee is a debt due to the State and may be recovered by action in a court of competent jurisdiction (regulation 11). The Court may make orders to enforce payment where declarations are invalid or direction revoked (regulation 4A(5)(b), regulation 8B(4)(b)). The Sheriff’s fees in Schedule 2 are payable for enforcement activities and may be charged whether or not service or arrest is successful, subject to the notes for each item.

These duties and rights create an administrative framework that places up‑front payment obligations on most litigants, establishes defined concession and dispute mechanisms, and gives the Court and registrars powers to adapt fee outcomes on grounds of hardship and justice.

The regulations set out a limited suite of penal and enforcement mechanisms directed at non‑compliance with declaration and reporting duties, non‑payment of fees, and the collection of fees for Court services and enforcement actions.

Monetary penalties for false or misleading statements and notification failures

• Regulation 8B(1) creates a statutory offence for making a statement or representation in a declaration or application under the regulations, or providing further information, that the person knows or has reason to believe is false or misleading in a material particular. The penalty for that offence is a fine of $1 000. The Court or registrar may, after giving the person an opportunity to make written submissions, declare a small business/non‑profit declaration invalid (regulation 8B(2)) or revoke a direction granted under regulation 8A (regulation 8B(3)). Where a declaration is declared invalid or a direction revoked, the Court may order the person to pay the difference between the fee paid and the fee otherwise payable, and make orders to enforce the payment, including orders relating to future conduct of the proceedings until the ordered sum is paid (regulation 8B(4)-(5)).

• Similarly, regulation 4A(4) imposes a penalty of $1 000 where an entity that has lodged a declaration under reg 4A(1) fails to immediately advise the Principal Registrar if it ceases to be a small business or non‑profit association.

Debt recovery and enforcement

• Unpaid fees are declared a debt due to the State and may be recovered by action in a court of competent jurisdiction (regulation 11). That provision creates a civil avenue for fee recovery rather than prescribing administrative sanctions only.

Court power to make consequential orders

• The Court may, when ordering payment of differences due to invalid declarations or revoked directions, make orders to enforce the payment that may include directions relating to the future conduct of the proceedings or the legal effect of steps taken until the ordered payment has been made (regulation 4A(5)(b), regulation 8B(5)). Those provisions give the Court leverage to withhold further procedural progress until fee liabilities are discharged.

Vacating hearing dates for non‑payment

• Regulation 9(5A)-(5B) allow the Court to set the day by which a hearing allocation fee must be paid and authorise the Court to vacate allocated hearing dates if the fee is not paid by the day specified. That is an operational enforcement tool to secure payment of listing and daily hearing fees.

Sheriff’s fees and operational enforcement costs

• Schedule 2 prescribes fees for Sheriff activities such as execution of arrest warrants, conveyance, service of process, travel and attendance. Those fees are payable whether or not the service or arrest is successful in some cases, and travel and attendance fees are calculated by reference to time and distance. The Sheriff’s fee items include notes that define coverage, such as up to three attempts at service being included in the standard fee (Schedule 2, item 2 notes; item 1 notes).

Administrative consequences for improper approval recipients

• For recipients of searchable information, the Principal Registrar must provide information daily to approved recipients and charge the per‑action fee or annual subscription as applicable (regulation 11A(2)-(4), Schedule 1 item 13). Failure to pay those fees would fall into the unpaid fee recovery mechanism at regulation 11.

Refund and rectification powers

• The regulations give a judicial officer or a legally qualified registrar the power to order refunds where a person has paid a fee that differs from the amount to which they were entitled under the regulations (regulation 8C(1)). The Principal Registrar may order refunds for payments made in error (regulation 8C(2)). Those powers operate alongside enforcement powers, enabling rectification where administrative error or successful eligibility application changes the payee’s liability.

Overall, enforcement is a mix of civil recovery (debt claims), administrative Court powers to suspend further procedural progress or vacate dates, monetary penalties for false statements and notification failures, and Sheriff fee mechanisms that can be claimed in relation to enforcement steps. The regulations vest judges and registrars with discretion to balance enforcement with justice and hardship considerations through directions, refunds and eligibility determinations.

The District Court (Fees) Regulations 2002 interlock with multiple statutes, both by reference and by exclusion, and with court rules that govern procedure. The text names specific Acts and concepts that shape application and scope.

References to federal and state statutes for definitions and eligibility

• The regulations borrow corporate definitions from the Corporations Act 2001 (Commonwealth), by declaring that “corporation” and “subsidiary” have the same meanings as in that Act (regulation 3). This means that eligibility calculations for small business status that exclude subsidiaries replicate Corporations Act subsidiary concepts.

• The small business definition and “co‑operative” reference the Co‑operatives Act 2009 for co‑operatives, and the Statutory Corporations (Liability of Directors) Act 1996 is used for certain statutory corporations (regulation 3). Those cross‑references determine when the small business thresholds in regulation 3 operate and which bodies are excluded from small business treatment.

• The eligibility categories for individuals include Centrelink and Department of Veterans’ Affairs concession cards and Commonwealth allowances defined under the Social Security Act 1991 (Commonwealth) (regulation 7(2)(a)-(d)). The Legal Aid Commission Act 1976 is referenced for the treatment of persons or entities granted legal aid (regulation 7(2)(e), 7(3)(a)).

Scope exclusions and cross‑statutory overlap

• Regulation 5 expressly excludes criminal proceedings, proceedings under the Civil Judgments Enforcement Act 2004, Prohibited Behaviour Orders Act 2010 applications for prohibited behaviour orders, and civil proceedings under the Criminal Law (Mental Impairment) Act 2023 from the operation of these regulations. That directs users to other fee regimes or statutory arrangements for those proceedings.

Interaction with Court Rules and procedural law

• The regulations define “Rules” as the District Court Rules 1996 or the rules applicable under s 87 of the Act, and various Schedule notes and items cross‑reference the Rules for procedure and interlocutory conduct (regulation 3, regulation 4(4)). Schedule 1 item notes refer to the District Court Rules 2005 rule 56A in relation to appeal hearing fee consequences for non‑payment, showing an operational link between fees and procedural sanctions in the Rules (Schedule 1 item 5 note 3).

Specific statutory loci for fee items

• Schedule 1 item 2 relates to an extraordinary licence application under the Road Traffic (Authorisation to Drive) Act 2008 s 27. Schedule 1 item 3 concerns applications under the Spent Convictions Act 1988 s 6(1). Schedule 1 item 11 references appointments to tax bills under the Commercial Arbitration Act 2012. These links tie fee items to discrete statutory procedures and mean users must consider the underlying Act when determining the fee consequence.

Attorney General and approval powers

• Regulation 11A establishes an approved recipient regime for searchable information, requiring written approval by the Attorney General. The provision delegates control over access to court metadata to the Attorney General’s written approvals and to the Principal Registrar’s daily provision duties. The compilation notes contain a transitional clause that recognised reporting services approved before commencement are taken to be approved, showing administrative continuity.

Recovery, enforcement and external remedies

• The debt recovery provision (regulation 11) states that unpaid fees are debts due to the State and may be recovered by action in a court of competent jurisdiction. That situates unpaid fee recovery in the civil litigation framework and allows enforcement consistent with civil procedure and judgment enforcement statutes.

In practice therefore, the regulations must be read alongside the District Court Rules, the listed substantive statutes, and federal definitions used for social security and corporate structure. Users need to track which proceedings are excluded from the fee regime and which external statutes determine both the procedural vehicle for a filing and the contextual entitlement to fees or exemptions.

The regulations have been amended numerous times since they commenced on 1 January 2002 (regulation 2). The compilation table in the instrument lists a sequence of amendment instruments, reprints and commencement dates that show iterative changes to fee levels, definitions and administrative detail. Key points visible in the compilation table and marginal notes include the following.

Major amendment waves and reprints

• The original District Court (Fees) Regulations 2002 were gazetted 27 December 2001 and commenced 1 January 2002 (Compilation table). Early amendments include the Equality of Status Subsidiary Legislation Amendment Regulations 2003 and specific fee amendment regulations in 2003, with Reprint 1 capturing changes as at 8 December 2006. Subsequent reprints occurred in 2009 and 2014 capturing intervening amendments (Compilation table).

Significant modernisation and policy‑driven amendments

• A suite of amendments in 2016 and later are recorded, notably the Attorney General Regulations Amendment (Fees) Regulations 2016 and further District Court (Fees) Amendment Regulations in 2016 and 2017. Those instruments likely reflect periodic government‑wide fee adjustments and targeted changes such as the searchable information regime introduced in 2005 and updated later (regulation 11A was inserted in Gazette 28 Apr 2005; subsequent amendments to r 11A noted in 2016 and 2024).

• The regulations were updated in 2016 to introduce eligible individual and entity recognition procedures, Form 2 and Form 3, and the small business and non‑profit association declaration procedure under regulation 4A, as evidenced by multiple 2016 Gazette entries and the insertion of new regulations (regulations 4A, 7, 8, 8A, 8B, 8C, 8D were inserted 14 Jun 2016). Those changes added discretion for hardship and interests of justice considerations and created explicit offence provisions for false statements.

Recent amendments and fee schedule updates

• The compilation table records a flurry of amendments from 2018 through 2025, including instruments titled Attorney General Regulations Amendment (Transcript Fees) Regulations 2018 and 2019, and multiple annual or periodic Attorney General fee and charges regulations (2018, 2019, 2020, 2021, 2022, 2023, 2024, 2025). The Schedule 1 and Schedule 2 headings were explicitly inserted as recently as SL 2025/111 r. 15, indicating a reformatting or re‑heading of the schedules in mid‑2025.

Transitional provisions and continuity

• A transitional note in the other notes shows that recognised reporting services previously approved by the Attorney General were taken to be approved recipients on commencement of regulation changes in 2005. That indicates the searchable information scheme was an introduced regime with transitional continuity for existing services.

Granularity of amendment records

• Each Gazette entry in the compilation table lists the instrument, its page references and commencement dates for particular parts. Not all amendments necessarily changed fees; many are timing, administrative or technical amendments to definitions, forms, or fee levels. The marginal notes next to specific regulations show amendment dates for regulations 3, 4, 5, 6, 7, 8A, 8B, 9, 11A and Schedule updates.

Practical implication of the history

• The amendment history shows frequent updates to fee amounts, transcription pricing, searchable information fees, and the introduction of procedural mechanisms such as Form 2 and Form 3 and small business concessions. Users must therefore consult the current consolidated version for up‑to‑date amounts and procedural steps, and track Attorney General fee instruments for annual fee adjustments (Compilation table shows periodic Attorney General Regulations Amendment instruments).

For authoritative application, practitioners should rely on the latest consolidated regulations and the compilation table entries to confirm commencement dates for particular amendments, since fee levels and procedural rights have changed multiple times since 2002.

The text of the regulations supplied contains no case citations, reported judicial decisions, or litigation history. The instrument provides internal procedural mechanisms for disputing fees but does not list or cite judicial authority or past litigation outcomes.

Mechanisms for dispute and review within the regulatory framework

• The regulations provide a statutory pathway for disputes about fees under section 89A(3) of the District Court of Western Australia Act 1969, requiring an application in Schedule 3 Form 3 and expressly providing that no fee is payable for that application (regulation 5A(1)-(2), Schedule 3 Form 3). That pathway is an administrative starting point for litigants to obtain a determination about the correctness or amount of a fee.

• The regulations also permit courts and registrars to direct eligibility on grounds of financial hardship or the interests of justice (regulation 8A), and to order refunds and make enforcement orders where declarations are invalid or directions revoked (regulation 8B(2)-(5), 8C(1)). Those powers are internal mechanisms intended to resolve disputes without external litigation, although they do not preclude a party seeking judicial review or a further legal remedy outside the regulatory framework.

Absence of precedent material in the text

• Because the instrument does not name any cases, and because the compilation notes do not include reported litigation about the regulations themselves, this document contains no litigation history to cite. Practitioners seeking case law on interpretation of the fee regulations, eligibility determinations under regulation 8A, or challenges to fee amounts would need to search court databases for relevant decisions on the District Court Act and accompanying regulations.

Operational observations for litigators

• The existence of Form 3 for determinations under s 89A(3) indicates a formalised administrative remedy before the Principal Registrar and the Court. Where parties have used Form 3 and been dissatisfied with administrative outcomes, they may have pursued further judicial remedies, but none are recorded in this text. The absence of litigation references in the regulations should be treated as a lack of embedded precedent in the instrument, not as evidence that no litigation has ever occurred.

In practice, a practitioner confronted with a contested fee question should consider using the s 89A(3) Form 3 procedure first, and preserve rights to pursue judicial review or other remedies if necessary, while recognising that the regulations themselves do not summarise any relevant case law.

This section flags precise procedural and practical pitfalls that arise directly from the text of the regulations. Each is grounded in a regulation or Schedule item and highlights operational risk.

1. Up‑front payment requirement, with limited deferral

• Regulation 6(1) bars filing or other Court dealings unless the fee has been paid. While regulation 6(2) permits the Court or a registrar to defer payment, that is discretionary and conditional, not an automatic right. Practically, practitioners cannot assume filing without payment will be accepted; they must either pay, secure a deferral order under Form 2, or risk rejection of the filing.

2. Listing before payment but payment after listing

• Regulation 9 allows a proceeding to be listed before the hearing fee is paid (regulation 9(5)), but it then makes the fee payable after the Court makes the listing order and provides strict deadlines: either the day the Court specifies or 14 days after the listing order if no date is set (regulation 9(5A)). If payment is not made, the Court may vacate the dates (regulation 9(5B)). This two‑step process can trap parties who assume listing equals payment grace.

3. Reconvening hearings blocked until daily fee paid

• Regulation 10 and the note at Schedule 1 item 8 require that if a daily fee under item 8 is payable, the hearing must not be reconvened until the fee has been paid (regulation 10). That can interrupt trial timetables and impose urgent payment obligations for ongoing hearings.

4. Large fee disparities between columns

• Schedule 1 shows material differentials between Column A (individual or eligible entity) and Column B (entity) fees. For example, filing an originating process is $1 306 for an individual (Column A) and $2 545 for an entity (Column B), while an eligible individual fee is $100 (Schedule 1 item 1). Organisations that do not qualify as eligible entities pay substantially higher fees. Misclassification risks significant unexpected costs.

5. Self‑declaration risk for small businesses and non‑profits

• An entity may lodge Form 1 to be treated as an eligible entity under reg 4A(1)-(2), but it must immediately notify the Principal Registrar if it ceases to qualify, with a $1 000 penalty for failure to notify (regulation 4A(4)). If an entity wrongly took eligible rates, the Court may order payment of the difference and make enforcement orders affecting the proceedings (regulation 4A(5)-(6)). Practitioners must verify small business status and document the basis for the declaration.

6. False or misleading statement offence

• Regulation 8B(1) creates an offence with a $1 000 fine for false or misleading statements in declarations or applications. The Court or registrar may invalidate declarations or revoke directions and order payment of differences. The offence triggers both criminal (penalty) and civil consequences (regulation 8B(2)-(5)).

7. Search fee exemptions are limited

• Schedule 1 item 12 provides a search fee, but the note states no fee is payable for searches made by or on behalf of a party to the proceedings, or by an approved recipient of searchable information under regulation 11A. However public or commercial users who are not approved recipients pay per search. Practitioners relying on free searches must ensure they meet one of the carve‑outs.

8. Approved recipient complexity and cost

• Approved recipients of searchable information must be approved in writing by the Attorney General (regulation 11A(1)). The per‑action fee is small at $2.95, but the alternative annual email fee is $3 001 (Schedule 1 item 13). Organisations that can use automated email delivery must pay the substantial annual subscription, otherwise they face per‑action charges and operational friction.

9. Limited waiver power for document copy fees

• Regulation 8D allows waiver of copy or transcript copy fees in Schedule 1 items 15(a) or 16 where the Court or registrar is satisfied waiver would assist the efficient operation of the Court. The discretion is not automatic and may be used sparingly.

10. Unpaid fees are state debts

• Unpaid fees are recoverable as debts due to the State (regulation 11). Courts may make orders affecting the conduct of proceedings until payment is made (regulation 4A(5)(b), regulation 8B(5)). Parties should expect active enforcement rather than mere administrative reminders.

11. Multiple procedural reference points

• The regulations cross‑reference other statutes, the District Court Rules and specific Act sections for certain items (regulation 3; Schedule 1 notes). Misreading the correct statutory vehicle or failing to check the Rules (for example rule 56A referenced in Schedule 1 item 5 note 3) can cause late payment consequences such as dismissal for want of prosecution.

Practitioners should therefore check eligibility status before filing, use Form 2 early to seek deferral where payment would cause difficulty, verify the correct column in Schedule 1, maintain documentary evidence supporting small business or concession card status, and plan cashflow for hearing allocation and daily hearing fees to avoid vacated hearing dates or reconvening blocks.

The regulations set out clear process steps and documentation requirements that practitioners and parties should follow to avoid fee disputes and enforcement outcomes. Below are actionable steps grounded in the relevant provisions.

1. Determine the correct payer category before filing

• Consult regulation 3 definitions and regulation 4(2) to identify whether the filer is an individual, an eligible individual, an entity, or an eligible entity. Check the specific eligibility criteria in regulation 7(2)-(3), for example concession card holder status, receipt of specified allowances, or legal aid grants. If the party qualifies under any of those, the lower eligible fees in Schedule 1 apply.

2. For small businesses and non‑profit associations, use Form 1 and keep records

• If the party qualifies as a small business or non‑profit association under regulation 3, lodge the Schedule 3 Form 1 declaration to be charged as if an eligible entity (regulation 4A(1)-(2)). Maintain contemporaneous documentation to substantiate the employee count threshold and ownership structure. Immediately notify the Principal Registrar if status changes, as required by regulation 4A(4), to avoid the $1 000 penalty and potential liability for fee differences.

3. Use Form 2 to seek deferral or reduction where payment causes difficulty

• If unable to pay up‑front as required by regulation 6(1), apply under regulation 6(3) using Schedule 3 Form 2. Provide full supporting financial information where financial hardship is relied on (Form 2 has detailed income and asset sections), and be prepared to supply further information if a judge or registrar directs it under regulation 8A(3)-(4).

4. Apply for eligibility recognition where appropriate, early

• Where the eligibility criteria in regulation 7 do not obviously apply, but financial hardship or the interests of justice make fee relief appropriate, apply under regulation 8 using Schedule 3 Form 2 before filing if possible, or at the earliest stage. Regulation 8A permits the Court or a registrar to direct a person be treated as an eligible individual or entity on those grounds, but the decision is discretionary.

5. Pay hearing allocation and daily fees on time, or obtain express directions

• For matters listed for hearing, note regulation 9(5A) requires payment after the listing order and sets a default deadline of 14 days if the Court does not set a day. If payment is not made by the specified day the Court may vacate the hearing dates (regulation 9(5B)). For reconvened hearings requiring item 8 fees, do not reconvene until the fee is paid (regulation 10). Ensure the client’s accounts and retainer arrangements provide for these payments.

6. Keep documentary evidence if relying on concession cards or legal aid

• Proof of Centrelink or Department of Veterans’ Affairs concession cards, receipts of specified allowances, or legal aid grants should be attached to Form 2 or provided at filing where eligible rates are claimed. The Court or registrar may require further evidence under regulation 8A(3)-(4).

7. Avoid false statements, and use care in declarations

• The offence in regulation 8B(1) carries a fine of $1 000 and the Court may invalidate declarations or revoke directions if false or misleading statements are made. Ensure all statements in Form 1, Form 2, Form 3 or other applications are accurate and supported by documents. Keep copies of declarations and supporting proof.

8. Use Form 3 to dispute fees under s 89A(3)

• If there is a dispute about whether a fee is payable or about its amount, file Schedule 3 Form 3 under regulation 5A(1), noting that no fee is payable for the application (regulation 5A(2)). Include precise grounds and relevant fee item references in the application.

9. For searchable information, secure Attorney General approval and budget

• Organisations seeking daily searchable information must be approved in writing by the Attorney General (regulation 11A(1)). Decide whether to pay the per‑action fee ($2.95 per action, Schedule 1 item 13(a)) or the annual email subscription ($3 001, Schedule 1 item 13(b)), bearing in mind regulation 11A(4) requires email delivery where suitable facilities exist and the annual fee is paid.

10. Monitor refunds and transfers, and apply promptly where entitled

• If a fee has been overpaid, seek a refund from a judicial officer or legally qualified registrar in the proceeding under regulation 8C(1), or contact the Principal Registrar for refunds of payments made in error under regulation 8C(2). For hearing allocation fee refunds or transfers, follow the precise percentage refund rules in regulation 9(7)-(9).

11. Prepare for sheriff and enforcement cost exposure

• When seeking service or enforcement, advise clients that Schedule 2 fees apply for arrest, service and travel, and that certain fees cover up to three attempts or include costs of receiving and printing process (Schedule 2 notes). Budget for per‑kilometre travel fees and attendance time where enforcement is required.

12. Maintain a compliance and recordkeeping protocol

• Keep records of all payments, declarations, notifications of status changes and communications with the Principal Registrar or registry staff. Retain copies of Court orders deferring payment or directing eligibility, since these orders determine fee liabilities and may affect refund or enforcement outcomes.

Following these steps aligned to the statutory provisions will reduce the risk of vacated hearings, invalidated declarations, enforcement actions and fines. When in doubt, apply for a determination under s 89A(3) using Form 3 or seek interlocutory directions from the Court about fee timing and eligibility.
