52 Discrimination relating to access to premises
(1) Section 19 does not make unlawful discrimination on the ground of
disability in relation to the provision of access to premises if—
(a) the premises are so designed or constructed as to be inaccessible
to a person with a disability; and
(b) any alteration of the premises to provide such access would
impose unjustifiable hardship on the person who would have to
provide that access.
(2) The Minister may declare that subsection (1) does not apply to a
building the construction of which begins on or after a day stated in
the declaration.
(3) The declaration is a notifiable instrument.
(4) Subsection (1) does not apply to a building the construction of which
begins on or after a day stated in the declaration.
(5) For this section, the construction of a building begins on the day when
a building approval for the erection of the building is granted under
the Building Act 2004.
