51 Discrimination by educational institutions
(1) Section 18 does not make unlawful discrimination on the ground of
disability in relation to a failure to accept a person’s application for
admission as a student at an educational institution that is conducted
solely for students with a disability that the applicant does not have.
Exceptions relating to disability Division 4.5
(2) Section 18 does not make unlawful discrimination on the ground of
disability in relation to a failure to accept an application by a person
with a disability for admission as a student at an educational
institution if the person, if so admitted, would require services or
facilities that are not required by students who do not have a
disability, the provision of which would impose unjustifiable
hardship on the relevant educational authority.
