50 Discrimination by qualifying bodies etc (1) Section 16 does not make unlawful discrimination by an authority or body against a person on the ground of disability if the authority or body believes on reasonable grounds that, because of a disability, the person is, or would be, unable to carry out work that is essential to the position concerned. disability does not include anything mentioned in— (a) section 5AA (2) (b) or (c) (Meaning of disability etc); or (b) section 7 (2) (Protected attributes), other than a disability that the person has.
