39 Accommodation provided for employees, contract
workers or students
(1) Part 3, in its application in relation to discrimination on the ground of
sex, relationship status, pregnancy or breastfeeding, does not make it
unlawful for an employer or principal who provides accommodation
to employees or contract workers to provide accommodation of
different standards to different employees or contract workers if—
(a) the standard of the accommodation provided is decided having
regard to the number of people in the household of the employee
or contract worker; and
(b) it is not reasonable to expect the employer or principal to provide
accommodation of the same standard for all employees or
contract workers.
Exceptions about sex, relationship status, pregnancy or breastfeeding Division 4.2
(2) Part 3 does not make unlawful discrimination on the ground of sex in
relation to the provision of accommodation if the accommodation is
provided solely for people of one sex who are students at an
educational institution.
