Disability Services (Community Visitor Scheme) Regulations 2013

These Regulations set out a narrow supervisory and reporting framework for the Community Visitor Scheme established under the Disability Services Act 1993. They do four mechanical things.

First, they define key terms used for the scheme (r 3), including cross-references to the Disability Services Act 1993 and to the Mental Health Act 2009 for the definition of "community visitor" and "Principal Community Visitor" (r 3). The 2017 variations inserted definitions for "day options program", "day options program premises", and "eligible person" (r 3), thereby expanding the scope of where community visitors may operate.

Second, they prescribe the functions and powers of community visitors when visiting disability accommodation premises and, since the 2017 amendment, day options program premises (r 4). The functions include inquiries into the physical standard and appropriateness of premises, inclusion and participation opportunities, compliance with principles and objectives in Schedules 1 and 2 of the Act, adequacy of information provided to residents, suspected abuse or neglect, use of restrictive interventions and compulsory treatment, failures to comply with the Act or a performance agreement, and complaints made by or on behalf of residents or attendees (r 4(1)(a)-(ab)(vi), (viii)/(ab)(vi)).

Third, the Regulations give community visitors operational powers for carrying out those functions: they may enter relevant premises "at any reasonable time", meet with residents or program attendees, request production of documents or records, examine and take extracts or copies, and, with the permission of the manager, inspect premises or equipment (r 4(2)(a)-(d)).

Fourth, they set out procedural requirements for requests to see community visitors and for reporting. A resident, a person attending a day options program, or a guardian/medical agent/relative/carer/friend or other support person may request to see a community visitor (r 5(1)). A manager or person in authority who receives such a request must advise a community visitor within two days (r 5(2)). After a visit, community visitors must report to the Principal Community Visitor in accordance with the Principal’s requirements unless one of the visitors is the Principal (r 6(1)). The Principal Community Visitor must forward an annual report to the Minister by 30 September each year for the preceding financial year (r 6(2)). The Principal may prepare special reports at any time (r 6(3)). The Minister must have copies of any report laid before both Houses of Parliament within six sitting days of receipt (r 6(4)).

The instrument contains no penalty provisions. Its primary enforcement mechanisms are inspection powers for community visitors, reporting to the Principal Community Visitor and the Minister, and parliamentary tabling of reports. The Regulations are scheduled for revocation on 1 July 2026 by the Disability Services (Community Visitor Scheme) Repeal Regulations 2025 (Legislative history).

The Regulations rely on and re-state a small number of legal concepts and cross-references to other laws. The definitions in r 3 are the building blocks of how the functions and powers operate.

• Act (r 3): the Regulations explicitly operate under the Disability Services Act 1993. Several functions require assessing compliance with the Act’s Schedules 1 and 2 (r 4(1)(a)(iii), (ab)(ii)). The Regulations do not reproduce those Schedules, so compliance assessments involve applying the Act itself.

• Community visitor and Principal Community Visitor (r 3): those terms are defined by reference to the Mental Health Act 2009. The Regulations therefore import any role, appointment or eligibility rules for community visitors from that Act rather than restating them.

• Disability accommodation premises and resident (r 3): the Regulations define the premises where accommodation services are provided, including short-term accommodation such as respite care, and define resident as a person with a disability who resides at such premises. The definition was varied in 2017 (Legislative history).

• Day options program and day options program premises (r 3): added in 2017, these extend the scheme beyond residential settings to daytime programs for eligible persons, defined in r 3 as adults assessed as unable to work or undertake formal study in connection with a funding arrangement under state or Commonwealth law. The inclusion of day options programs expands the range of service settings subject to visitor inquiries (r 4(1)(ab)).

• Eligible person (r 3): a defined term introduced in 2017. It ties attendance at day options programs to an assessed inability to work or undertake formal study under an applicable funding arrangement.

Functions and powers (r 4): The core concept is an inspection-and-advocacy role. Community visitors are tasked to inquire into matters listed in r 4(1)(a) and (ab) and to act as advocates and referrers (r 4(1)(b)-(c)). Operationally they are given powers to enter premises at "any reasonable time" and to meet with residents or attendees (r 4(2)(a)). Distinctions in access exist: while meeting with residents does not require manager permission, inspection of premises or equipment does (r 4(2)(b)). They may also require documents and take copies or extracts (r 4(2)(c)-(d)).

Requests and notification (r 5): The Regulations create a right for certain persons to request a meeting with a community visitor (r 5(1)). Managers who receive such requests have a strict timeframe , two days , within which to notify a community visitor (r 5(2)).

The Regulations identify a compact set of parties with direct rights, duties and operational effects.

• Residents: defined as persons with a disability who live in disability accommodation premises (r 3). Residents may request to see a community visitor (r 5(1)(a)). Community visitors may meet with residents during visits (r 4(2)(a)) and may inquire into the standard of accommodation, inclusion opportunities, information provided to residents, abuse or neglect, restrictive interventions and compliance with the Act or performance agreements (r 4(1)(a)(i)-(viii)).

• Persons attending day options programs: added in 2017 (r 3, r 4(1)(ab)). They and their guardians/support persons may request to see a community visitor (r 5(1)(b), (c), (d)). Community visitors can inquire into appropriateness and standard of premises, whether services adhere to the Act’s principles and objectives, suspected abuse or neglect, restrictive interventions, compliance with the Act or performance agreements, and complaints made by or on behalf of attendees (r 4(1)(ab)(i)-(vi)).

• Guardians, medical agents, relatives, carers, friends and other support persons: explicitly given standing to request visits on behalf of residents or day program attendees (r 5(1)(c), (d)). Complaints raised by these persons are a specific subject of inquiry for community visitors (r 4(1)(a)(viii), (ab)(vi)).

• Disability services providers and managers of premises: bear operational consequences. If a manager receives a request to see a community visitor they must notify a community visitor within two days (r 5(2)). Community visitors may enter premises at reasonable times and meet with residents (r 4(2)(a)), and with the manager’s permission may inspect premises and equipment (r 4(2)(b)). Providers are also the subject of inquiries regarding compliance with performance agreements between providers and the Minister (r 4(1)(a)(vii), (ab)(v)).

• Community visitors and the Principal Community Visitor: have statutory functions and powers (r 4, r 6). Community visitors are required to report to the Principal after visits (r 6(1)) unless the Principal is one of the visitors. The Principal is responsible for compiling annual reports to the Minister by 30 September each year for the previous financial year and may prepare special reports at any time (r 6(2)-(3)).

• The Minister and Parliament: The Principal must forward the annual report to the Minister (r 6(2)). The Minister must lay reports before both Houses of Parliament within six sitting days of receipt (r 6(4)), making the Parliament a recipient of oversight information.

The Regulations create specific duties and rights for a limited set of actors. The duties tend to be procedural and time-bound, while rights are access-oriented.

Rights

• Right to request a community visitor: Residents, persons attending day options programs, their guardians/medical agents/relatives/carers/friends, and other support persons have a statutory right to request a meeting with a community visitor (r 5(1)). That is a standing right in the text of the Regulations.

• Right to be met by a community visitor on-site: Community visitors may meet with residents or persons attending day options programs while on the premises (r 4(2)(a)). The Regulations do not require manager permission for such meetings.

• Right to have complaints considered: Complaints made by residents or their supporters are expressly within the scope of community visitor inquiries (r 4(1)(a)(viii), (ab)(vi)).

Duties

• Manager notification duty: If a manager or person in authority receives a request to see a community visitor, that person must advise a community visitor within two days after receipt of the request (r 5(2)). The duty is mandatory in language and carries a tight timetable.

• Duty to report to the Principal: Community visitors, after a visit to premises, must report to the Principal Community Visitor about the visit in accordance with the Principal’s requirements, unless one of them is the Principal (r 6(1)). The content and form of these reports are delegated to the Principal.

• Principal’s reporting duty to the Minister: The Principal Community Visitor must forward an annual report to the Minister on or before 30 September each year covering the financial year ending 30 June (r 6(2)). The Principal may also prepare special reports at any time (r 6(3)).

• Minister’s duty to table reports: The Minister must have copies of any report laid before both Houses of Parliament within six sitting days after receiving the report (r 6(4)).

Powers relevant to duties

• Entry and access: Community visitors may enter disability accommodation premises or day options program premises at any reasonable time for the purposes of carrying out their functions (r 4(2)).

• Information and records: Community visitors can request any person to produce documents or records, examine them and take extracts or copies (r 4(2)(c)-(d)). The Regulations do not qualify these powers by specifying limits on privacy, confidentiality or freedom from disclosure; providers must therefore reconcile these statutory powers with other legal obligations.

The Regulations are primarily supervisory and do not create an express sanctions regime in the instrument itself. The enforcement architecture relies on access, reporting and parliamentary scrutiny rather than specified penalties.

What the Regulations provide for enforcement

• Access and information powers: Community visitors are empowered to enter premises at any reasonable time, meet with residents or program attendees, request documents and records, examine them, and take extracts or make copies (r 4(2)(a), (c), (d)). These powers are the primary means by which community visitors gather evidence of non-compliance or concern.

• Conditional inspection power: Inspecting premises or equipment requires the manager’s permission (r 4(2)(b)), which acts as a procedural gate for certain types of physical inspections.

• Referral and reporting: Community visitors must refer matters of concern about the organisation or delivery of services to the Minister (r 4(1)(b)). The Principal is required to report annually to the Minister, and the Minister must table reports in Parliament within six sitting days (r 6(2)-(4)). Parliamentary tabling creates a public transparency mechanism that can prompt administrative or political responses.

What the Regulations do not provide

• No criminal offences or administrative penalties: The text contains no offence provisions, fines, or mechanisms to compel compliance with a community visitor’s requests or to punish failure to notify a request within two days. There are also no express powers to require a manager to grant an inspection where permission is withheld.

• No specified sanctions for non-cooperation: While the Regulations expect cooperation through duties such as the manager’s two-day notification duty (r 5(2)), they do not set out enforcement steps or delegated administrative actions if a manager fails to comply.

Practical enforcement consequences that follow from the instrument

• Reputational and political consequences: The reporting regime (r 6) and the Minister’s obligation to table reports (r 6(4)) create reputational and parliamentary pressure. The ability of community visitors to refer matters to the Minister (r 4(1)(b)) means serious findings can be escalated to a political or administrative decision-maker who holds regulatory tools under the Act.

The Regulations expressly cross-reference and rely upon other statutory regimes and contractual arrangements. The interaction points are limited but operationally significant.

Cross-references in the Regulations

• Disability Services Act 1993 (the Act): The Regulations operate under the Act (r 3). Many of the matters that community visitors must assess are compliance with the principles and objectives specified in Schedules 1 and 2 of the Act (r 4(1)(a)(iii), (ab)(ii)). Community visitors are also to inquire into failures to comply with the Act (r 4(1)(a)(vii), (ab)(v)).

• Mental Health Act 2009: The definitions for "community visitor" and "Principal Community Visitor" are taken from the Mental Health Act 2009 (r 3). The Regulations therefore import appointment, qualifications, and perhaps procedural norms or incompatibilities from that Act, although those materials are not reproduced here.

• Performance agreements with the Minister: The Regulations explicitly require inquiries into compliance with any performance agreement entered into between a disability services provider and the Minister (r 4(1)(a)(vii), (ab)(v)). Such agreements are contractual or administrative instruments separate from the Regulations; community visitors inquire into whether providers are meeting their obligations under those agreements.

• Funding arrangements under State or Commonwealth law: The definition of "eligible person" is expressly linked to an assessment made "in connection with a funding arrangement under a law of this State or the Commonwealth" (r 3). This ties the operational reach of the day options program component to other funding frameworks and administrative processes.

Tensions and gaps the Regulations do not resolve

• Privacy and confidentiality laws: The Regulations permit community visitors to request and copy documents (r 4(2)(c)-(d)), but they do not set out how those powers operate alongside privacy legislation, health records laws or confidentiality obligations. Service providers will need to reconcile the statutory inspection and copying powers with privacy and secrecy obligations under other laws. The Regulations do not prescribe redaction, consent, or secure handling protocols.

• Powers in other statutory instruments: While the Regulations provide entry and examination powers, they do not specify how these interact with statutory powers to search and seize under other Acts, or with obligations under child protection, public health or criminal law where suspected abuse or neglect is uncovered. The community visitor’s role is investigative and referential; enforcement action under other laws is not described in the instrument.

The instrument has a concise amendment record and a scheduled revocation.

• Original instrument: Disability Services (Community Visitor Scheme) Regulations 2013, Gazette 2.5.2013 No 31, commenced 2 May 2013 (Legislative history).

• 2017 variations: The Regulations were varied by Gazette 7.6.2017 No 77, effective 7 June 2017. The 2017 instrument made several insertions and variations:

  • Inserted definitions for "day options program" and "day options program premises" and inserted "eligible person" (r 3 varied by 77/2017 r 4(1), r 4(2), r 4(3); Legislative history entries show these insertions came into effect 7.6.2017).
  • Varied r 4, including addition of r 4(1)(ab) expanding functions to cover day options program premises (77/2017 r 5(1), (2), with r 4(2) also varied by r 5(3), (4)).
  • Replaced r 5(1) and varied r 5(2) (77/2017 r 6(1), (2)).
  • Varied r 6(1) (77/2017 r 7).
  • The Legislation Revision and Publication Act 2002 caused omission of r 2 on 7.6.2017 as noted in the legislative history.

• Revocation scheduled: The Regulations will be revoked by r 3 of the Disability Services (Community Visitor Scheme) Repeal Regulations 2025 on 1 July 2026 (Legislative history). The legislative history entry explicitly records that revocation date and instrument. The text therefore remains in force until that revocation date unless otherwise amended or repealed earlier.

• Notes in legislative history: The Index and the official website are referenced for further information (Legislative history: "For further information ... see the Index of South Australian Statutes or www.legislation.sa.gov.au.").

What the amendment history signals mechanistically

• Expansion of scope in 2017: The 2017 changes mechanically expanded the remit of community visitors from residential accommodation premises to also cover day options program premises and attendees. This creates new access points for oversight in non-residential settings.

• Delegation and reporting consistency: The 2017 changes adjusted the reporting and request provisions (r 5 and r 6), suggesting the operational framework was clarified or synchronised with practice. The Regulations delegate report content, form and frequency to the Principal (r 6(1), (2)) but fix the Ministerial tabling timeframe (r 6(4)).

The Regulations themselves include no record of litigation. The instrument does not cite any cases, judicial decisions, or tribunal determinations.

What the source provides

• No cases named: The text contains no references to judicial interpretations, appeals, or enforcement litigation arising from the Regulations. It makes no mention of court challenges or tribunal findings.

• No administrative review procedure in the instrument: The Regulations do not set out appeal rights against actions taken by community visitors, nor do they create an enforcement mechanism that would naturally generate a litigation record within the instrument itself.

Practical implications for lawyers and compliance officers

• Absence of precedent in the instrument: Because the Regulations do not record litigation, practitioners cannot rely on on-instrument signals about how courts have interpreted rights to enter, document production powers, the conditional inspection power requiring manager permission, or the manager’s two-day notification duty.

• Search for external materials: To understand enforcement and interpretation, practitioners must consult: (a) the Disability Services Act 1993 and any delegated legislation associated with community visitors; (b) the Mental Health Act 2009 for definitions and appointment mechanisms; and (c) any Departmental policies, guidelines or administrative materials that govern how community visitors operate in practice. The Regulations do not summarise these cross-instruments.

• No statutory case law trail: Because the Regulations are procedural and the primary enforcement mechanism is reporting and referral, contested matters arising under these Regulations may appear as part of more general litigation against providers or administrative reviews by Ministers, but any such cases are not listed in the instrument.

If litigation arises, the Regulations will be one part of the statutory matrix practitioners must navigate, but the instrument itself provides no litigation guidance or precedent history.

This section flags specific textual and operational features of the Regulations that can produce friction or unintended consequences because the Regulations are terse and rely on other laws or administrative practices.

1. Manager permission for physical inspection (r 4(2)(b))

• Text: Community visitors may "inspect the premises or any equipment or other thing on the premises" only "with the permission of the manager of the premises" (r 4(2)(b)).
• Practical effect: A manager can delay, condition or refuse permission to inspect equipment or certain physical parts of premises. The Regulations do not say what happens if permission is refused. A provider may therefore be able to limit certain inspections without breaching an express statutory penalty provision in these Regulations, though refusal may trigger referral to the Minister under r 4(1)(b).

2. Community visitors can meet residents without manager permission (r 4(2)(a))

• Text: While on premises, a community visitor may meet with a resident or person attending a day options program (r 4(2)(a)); entry is permitted "at any reasonable time" (r 4(2)).
• Practical tension: Entry and meetings are broad, but inspection of premises requires permission. This split-right could create confusion at the front-line: staff may accept meeting requests but resist document production or equipment inspection. The Regulations do not reconcile this tension.

3. Two-day notification duty is tight and absolute (r 5(2))

• Text: Managers must advise a community visitor of a request within two days after receipt (r 5(2)).
• Operational risk: If a manager fails to notify within two days, the Regulations do not specify consequences. Nevertheless, non-compliance may be used as evidence of obstructing oversight or be escalated to the Minister. Providers should therefore have processes to capture and notify requests promptly.

4. Broad document powers with no privacy safeguards (r 4(2)(c)-(d))

• Text: Community visitors may request documents, examine them, and take extracts or make copies (r 4(2)(c), (d)).
• Data risk: The Regulations do not limit document access by type or require redaction, consent, or secure handling. Providers must reconcile these powers with privacy laws, health records requirements and other confidentiality obligations. The instrument offers no compliance procedure to manage these conflicts.

This section offers a practical, source-grounded compliance checklist and risk-management measures for providers, managers and advisers. Each item maps to the relevant regulation.

1. Establish an internal request log and notification process (r 5(1), (2))

• Action: Record any request to see a community visitor immediately. Ensure that a named person (a manager or delegate) has responsibility for advising a community visitor within two days of receiving the request.
• Rationale: r 5(2) imposes a mandatory two-day notification duty; failure to notify could lead to escalation to the Minister and reputational risk.

2. Prepare staff training and scripts for on-premises meetings (r 4(2)(a))

• Action: Train frontline staff and managers on the community visitor’s right to meet with residents or day program attendees while on premises, including procedures to offer private meeting spaces and to ensure the resident’s voluntary participation.
• Rationale: Community visitors may meet with residents or attendees without manager permission; staff must facilitate safe, private and timely access.

3. Create a document production procedure that accounts for privacy laws (r 4(2)(c)-(d))

• Action: Maintain an indexed, up-to-date record system for documents likely to be requested by community visitors (care plans, incident reports, restrictive intervention logs, complaint registers, training records). Develop an internal privacy review process for disclosures, including an approach to redaction where legally appropriate and a secure copying protocol.
• Rationale: The Regulations allow community visitors to request and copy documents. Providers will need to reconcile statutory requests with privacy, health records and confidentiality obligations. The Regulations do not provide procedural safeguards.

4. Adopt a clear position on inspection requests and manager permission (r 4(2)(b))

• Action: Decide in advance which premises and equipment the manager will permit community visitors to inspect and document permitted entry protocols. Where permission is withheld, record reasons and consider advising the Principal or the Minister proactively if withholding is due to safety or legal constraints.
• Rationale: Inspection of premises and equipment requires manager permission; having a clear, documented policy reduces ad hoc refusals and potential escalation.
