#### 16 Agreements may be entered into with transferees of land etc. (1) Where: (a) either of the following subparagraphs apply: (i) a grant of financial assistance to a person under this Part has been made on terms and conditions with respect to the use or disposal of any land, building or equipment; (ii) a person has entered into an agreement under this subsection under which the person is required to comply with terms and conditions with respect to the use or disposal of any land, building or equipment; and (b) the person has transferred, or proposes to transfer, the whole or a part of the person’s interest in the land, building or equipment to another person; the Minister may, on the Commonwealth’s behalf, enter into an agreement with the other person under which the other person is required to comply, or will, upon the transfer being effected, be required to comply, with terms and conditions, whether with respect to the use or disposal of the land, building or equipment or otherwise. (1A) Without limiting subsection (1), an agreement may contain terms and conditions providing for the other person to repay the whole, or part of, the grant that was made to the transferor in respect of the land, building or equipment. (2) In subsection (1), person includes a State or eligible organisation.
