Disability Regulations 2018

This instrument repeatedly implements a small set of legal concepts drawn from the Disability Act 2006. Those concepts appear in the text of the Regulations as defined terms or references to specific Act provisions. The main concepts and how the Regulations operationalise them follow.

Exempt service provider and prescribed service provider

• The Regulations identify particular entities as an exempt service provider (reg 6) and as a prescribed service provider (reg 7) for the statutory definitions in s 3(1) of the Act. Specifically, the Department of Education and Training is prescribed in both capacities, albeit subject to explicit temporal limitation until 31 December 2019 (regs 6(1)-(2) and 7(1)-(2)). The object is to attach those statutory labels to the Department for defined periods, thereby changing how provisions of the Act that depend on those labels will apply to that Department during those dates (reg 1(a)-(b)).

Public sector body (s 38(6) context)

• Regulation 8 prescribes a discrete list of statutory authorities and statutory corporations to be taken as “public sector bodies” for paragraphs (b) and (c) of the definition in s 38(6) of the Act. The list names a range of entities from Ambulance Victoria to Victoria Legal Aid and V/Line (reg 8(a)-(za)). The legal effect is to make these entities fall within the Act’s information or operational provisions that hinge on the “public sector body” categorisation.

Monetary thresholds and charging mechanics

• The Regulations fix amounts and the means of calculation for a number of financial references in the Act. Regulation 9 sets the “relevant prescribed amount” for residential charge purposes to 75% of the Commonwealth disability support pension plus 100% of Commonwealth rent assistance on an annual basis. Regulation 14 governs the monthly charge for accommodation and care in residential institutions other than community residential units: this charge is set every six months and equates to 57.1% of the monthly sum of the Commonwealth disability support pension and rent assistance. The Regulations also prescribe $500 and $5000 as the prescribed amounts for the management of a resident’s money and the limit on the amount that may be held respectively (regs 10-11).

Authorisation to use restrictive interventions and supervised treatment

• Regulations 12 and 13 enumerate the particulars a disability service provider must supply when applying for approval to use restrictive interventions (s 135(2)(a) of the Act) or supervised treatment (s 186(2)(a) of the Act). The listed particulars include premises addresses, Authorised Program Officer names/qualifications where applicable, reasons for the proposed measures at each premises, and an assessment of capacity to comply with the relevant Parts of the Act (Part 7 for restrictive interventions; Division 5 of Part 8 for supervised treatment).

Community visitors governance

• Part 4 creates a prescriptive electoral and administrative regime for electing community visitors to the Community Visitors Board: annual election timing with staggered two-year terms for members (reg 15), appointment of a returning officer and defined powers (reg 16), strict notices and deadlines (regs 17-19), nomination/withdrawal/formalities of nomination papers (regs 20-22), balloting mechanics including order-by-lot, postal distribution, ballot form content and an explicit single-number preferential method where a valid vote is to be marked by inserting “1” opposite a single candidate (regs 23-31), and post-election custody of papers (reg 35). The Regulations also prescribe the exact form for a record of community visitor visits (reg 37 and Schedule 1).

Information sharing for NDIS and by the Disability Services Commissioner

• The Regulations prescribe the NDIS Quality and Safeguards Commission as a body for the purposes of s 39(4)(m) (reg 39) and list recipients for disclosure, use or transfer of information with respect to the NDIS (reg 40). Regulation 41 lists persons and bodies to whom the Disability Services Commissioner may disclose information under s 132ZB(m), and the 2020 amendment expanded that list to include the Disability Worker Registration Board of Victoria, the Victorian Disability Worker Commission, and the Victorian Disability Worker Commissioner (reg 41, notes on amendment). These provisions channel which state, Commonwealth and regulatory bodies are formally authorised recipients of DSC-held information.

Procedural specificity versus high-level policy

• The Regulations are procedural and numeric. They do not restate broader policy rationales beyond reg 1’s list of objectives. Their principal function is to supply the precise inputs that the Act requires be “prescribed”: lists, amounts, forms and timelines. Where requirements in the Act refer to compliance with Parts of the Act (for example Part 7 or Division 5 of Part 8), the Regulations require applicants to show capacity to comply (regs 12(d) and 13(d)); the substantive content of those Parts and the sanctions for non-compliance remain in the Act.

Interplay with Commonwealth payments and other statutes

• The Regulations repeatedly treat Commonwealth disability support pension and Commonwealth rent assistance as the monetary bases for prescribed amounts and charges (reg 5 definitions; regs 9 and 14). They therefore link Victorian charges and thresholds to amounts determined under the Commonwealth’s Social Security Act 1991 (reg 5). The Regulations also cross-reference entities and statutory offices established under other Victorian and Commonwealth statutes for the purposes of information sharing (reg 8; reg 41 and the references to the Ombudsman Act 1976 and various 2018 Safeguards Act entities).

In short, the main concepts are identification and labelling of specific bodies for Act purposes, binding numeric rules for charges and limits, prescribed application content for sensitive treatment types, a fully-prescribed election and record-keeping system for community visitors, and a defined list of recipients for information flows to and from the Disability Services Commissioner and for NDIS-related purposes.

The Regulations specify a finite set of actors whose legal position or administrative obligations they alter. The following parties are directly affected by the prescriptions and timeframes established in the instrument.

Department of Education and Training

• The Department is expressly designated as an exempt service provider to the extent it is a regulated service provider, and as a prescribed service provider to the extent it provides early childhood intervention services, but both designations are expressly time-limited to apply from 24 June 2018 until 31 December 2019 (regs 6(1)-(2) and 7(1)-(2)). During those dates the Department will attract the legal consequences that the Act attaches to those labels.

Regulated and prescribed disability service providers

• Providers that are “regulated service providers” under the Act will be affected in multiple ways. If they seek approval to use restrictive interventions or supervised treatment they must supply the particulars specified at regs 12 and 13. Providers delivering accommodation in residential institutions other than community residential units will need to levy a monthly charge calculated under reg 14 and set every six months. Providers under contract with the State for services previously provided by the State are potential recipients of information under reg 40(b) and (c).

Residents and their financial affairs

• The Regulations affect residents in two financial ways. First, those facing a proposed residential charge will have the “relevant prescribed amount” under s 72(3) set as specified in reg 9 (75% of DSP plus 100% of rent assistance annually). Second, residents in residential institutions (other than community residential units) will be charged monthly under the mechanics in reg 14, which equates to 57.1% of monthly DSP plus rent assistance. The Regulations also impose fixed monetary caps relevant to the custody of a resident’s money: $500 as the prescribed amount for management of a resident’s money (reg 10) and $5000 as the prescribed limit on the amount of money that may be held (reg 11), for the purposes of s 93(1)-(2) and s 95(1) of the Act respectively.

Community visitors and the Community Visitors Board

• Community visitors themselves are extensively addressed. The Regulations set election timing rules (reg 15), nominate the Public Advocate to appoint a returning officer (reg 16), require the maintenance of a list of names and addresses (reg 16(2)(a)), and impose procedural obligations on candidates and voters (regs 20-31). Community visitors acting as candidates must comply with nomination and personal statement form and timing rules (regs 20-21; reg 26). The Regulations also prescribe the specific form to be used for records of visits (reg 37 and Schedule 1), which will affect how community visitors document visits.

Public Advocate and returning officer

• The Public Advocate must appoint a returning officer (reg 16(1)) and determines disputes about vote validity or regularity (reg 33). The returning officer is given functions to manage the electoral roll, fix dates (reg 16(2)(a)-(b)), prepare and distribute ballots and envelopes (reg 23(2) and reg 25), receive and process postal votes (reg 29), determine the order of names by lot (reg 24) and declare results (reg 31). The returning officer must also keep election materials in safe custody for 30 days post-declaration (reg 35). Those functions impose administrative duties on both the Public Advocate and the returning officer.

Disability Services Commissioner, NDIA, NDIS Quality and Safeguards Commission and other agencies

• The Regulations prescribe the NDIS Quality and Safeguards Commission as a body for s 39(4)(m) (reg 39). Reg 40 prescribes persons or bodies who may use, disclose or receive information for NDIS purposes, including service providers that have contracted with the State to deliver previously State-provided services (reg 40(b)-(c)). Regulation 41 identifies persons to whom the Disability Services Commissioner may disclose information (reg 41(a)-(k)), which includes the NDIS Quality and Safeguards Commission, the NDIA, the Commonwealth Ombudsman, and, following the 2020 amendments, the Disability Worker Registration Board of Victoria and the Victorian Disability Worker Commission and Commissioner. These listings affect inter-agency information flows and the DSC’s administrative delegation of data.

Other statutory authorities and statutory corporations

• A defined group of statutory entities named in regulation 8 are prescribed as public sector bodies for the purposes of s 38(6) of the Act. Entities such as Ambulance Victoria, Melbourne Water Corporation, State Trustees Limited, Victoria Legal Aid, and others listed in reg 8 will have the status that the Act attributes to “public sector bodies” for the purposes identified in s 38(6).

Contracted early childhood intervention providers

• Providers who have entered into contracts or deeds with the State to provide early childhood intervention services previously delivered by or on behalf of the State are specifically mentioned as possible recipients or users of information under reg 40(c). This treats contracted providers as participants in information exchanges for NDIS transition matters.

Members of the public and candidates

• People who are community visitors and those who wish to stand as candidates will be affected by the nomination, voting and personal statement rules. Voters must follow strict postal procedures, signatures and timing to ensure valid votes (regs 27-29 and 30).

Who does not fall under the Regulations

• The Regulations exclude “community residential units” from the accommodation charge mechanism in reg 14: the monthly charge set by reg 14 applies to residents in residential institutions other than community residential units. That exclusion will affect providers and residents in community residential units as to whether the reg 14 charging rule applies.

Timing and sunset effects

• The Department of Education and Training’s designations are expressly time-limited to 31 December 2019 (regs 6-7). The instrument itself is scheduled to sunset ten years after making under the Subordinate Legislation Act 1994 (endnote 1), which will be relevant for longer-term planning by affected parties.

In sum, the Regulations have a concentrated effect on government departments that provide disability services, regulated service providers who must seek authorisations for specific interventions, residents subject to prescribed charges or caps, the administrative actors who run community visitor elections, and a bounded set of agencies authorised to receive or use information under the Act and the NDIS transition provisions.

The Regulations impose precise duties on administrative actors and set numerical entitlements or caps that affect both providers and residents. They also create procedural rights and formalities around elections and information flows. Below are the principal duties and rights instantiated by the Regulations, with citations to the relevant provisions.

Duties to supply particulars for authorisation of interventions

• A disability service provider seeking approval to use restrictive interventions must supply the particulars prescribed in reg 12. Those particulars include the addresses and contact details for every premises where restrictive interventions are to be used (reg 12(a)), names and qualifications of each Authorised Program Officer if more than one is proposed at any premises (reg 12(b)), reasons why the provider considers the use of restrictive interventions necessary at each premises (reg 12(c)), and evidence of the provider’s capacity and ability to comply with the requirements in Part 7 of the Act (reg 12(d)). An equivalent duty applies for supervised treatment applications under reg 13, referring to Division 5 of Part 8 of the Act (reg 13(a)-(d)). These duties require providers to assemble facility-level and personnel-level information and to demonstrate capacity for statutory compliance.

Duty to calculate and levy residential charges

• Providers of residential institution accommodation (excluding community residential units) must levy a monthly charge calculated as set out in reg 14: the charge is set every six months and is equivalent to 57.1% of the sum of the Commonwealth disability support pension and Commonwealth rent assistance received by the resident for the corresponding month (reg 14(a)-(b)). The duty here is not simply to charge but to re-set that charge on a six-month cycle according to the formula.

Duties relating to management of resident money and holdings

• For the purposes of s 93 and s 95 of the Act, the Regulations prescribe $500 as the amount relevant to the management of a resident’s money (reg 10) and $5000 as the maximum amount that may be held (reg 11). These figures are fixed duties insofar as sections 93 and 95 of the Act impose obligations or limits; the Regulations provide the precise monetary thresholds to be applied.

Election-related duties and rights

• The Public Advocate must appoint a returning officer to manage Community Visitors Board elections (reg 16(1)). The returning officer has duties that include maintaining a list of community visitors’ names and addresses (reg 16(2)(a)), fixing nomination and polling dates (reg 16(2)(b)), determining questions about validity or regularity of votes (reg 16(2)(c)), preparing ballot materials (reg 23(2)), distributing ballot packs at least 14 days before polling day (reg 25), receipt and processing of reply-paid return envelopes in prescribed fashion (reg 29), separating signed and unsigned ballot paper envelopes and disallowing unsigned ones (reg 29(c)-(d)), and keeping election materials in safe custody for 30 days after declaration (reg 35). Community visitors have the right to run for election by lodging a written nomination paper with required elements (reg 21), to withdraw by written notice before noon on nomination day (reg 22), to lodge a personal statement of up to 150 words for inclusion in ballot packs (reg 26), and to vote by inserting the number “1” opposite a single candidate (reg 27). Voting is strictly postal in effect and requires signed ballot paper envelopes (reg 28).

Decision-making rights and dispute resolution

• The Public Advocate retains the decision-making function in relation to disputes about validity or regularity of votes (reg 33). The returning officer may conduct recounts on application by a candidate or on the officer’s own motion, and must notify candidates if a recount will occur (reg 32). The returning officer declares the candidate with the most votes elected, and resolves ties by lot (reg 31).

Information disclosure rights and duties

• The Regulations grant defined rights to specified recipients to receive information under particular Act provisions. The NDIS Quality and Safeguards Commission is prescribed for s 39(4)(m) (reg 39). Regulation 40 prescribes certain persons or bodies for the purposes of s 39(6), including disability service providers and persons or bodies contracted by the State to provide early childhood intervention services that were previously provided by the State (reg 40(b)-(c)). Regulation 41 prescribes a list of permitted recipients for disclosures made by the Disability Services Commissioner under s 132ZB(m) of the Act, encompassing disability service providers, regulated service providers, the Secretary to the Department of Education and Training, the Registrar of Births, Deaths and Marriages, the Transport Accident Commission, the NDIA, the NDIS Quality and Safeguards Commission, the Commonwealth Ombudsman, and disability worker regulatory bodies added by the 2020 amendments (reg 41(a)-(k)). These provisions create formal avenues for information exchange and impose the duty on the DSC to confine disclosures to the prescribed recipients.

Record-keeping obligations

• Community visitors must use the prescribed particulars and form for records of visits under s 132 of the Act; reg 37 prescribes Schedule 1 as the form to be used. The Schedule lists fields such as facility name and address, arrival and departure times, issues from previous visits, observations, issues requiring attention, signatures of visitors and staff, and dates.

No penal codes in the Regulations

• The Regulations do not themselves create offences or monetary penalties. The instrument refers back to the Act for the legal regimes that govern conduct, authorisations and enforcement (for example regs 12(d) and 13(d) reference compliance with Part 7 and Division 5 of Part 8 of the Act). Therefore the Regulations’ duties are primarily administrative and prescribing in character; rights and sanctions remain those found in the parent Act and any other connected statute.

Temporal duties and rights

• Some duties and rights are time-bound. For example, the Department of Education and Training’s status as an exempt and prescribed service provider applies only until 31 December 2019 (regs 6-7). Community Visitors Board elections must occur before 30 June each year, with nomination and polling days prescribed by date ranges and minimum intervals (regs 15(1), 19(1)-(2)). These timing rules impose calendar-bound duties on officials and candidates.

In sum, the Regulations convert statutory placeholders into concrete administrative obligations and rights: providers must provide specified materials to obtain approvals; residential charges and thresholds are numerically fixed and must be recalculated according to specified periods; community visitor elections and visit records must follow procedural rules; and the DSC and certain bodies have prescribed rights to receive information. Enforcement of these duties relies on the Act’s broader enforcement framework rather than on new sanctions in the Regulations themselves.

The Regulations do not create new offences or attach specific monetary penalties. Instead they prescribe administrative processes, numerical thresholds and forms which operate within the enforcement architecture of the Disability Act 2006 and other statutes. The picture that emerges from the text is one of rule-setting rather than rule-punishment; enforcement therefore falls into two categories: procedures within the Regulations for administrative validity and the enforcement mechanisms of the parent Act.

Administrative validity mechanisms in the Regulations

• Election integrity measures. The Regulations set procedural rules designed to ensure the integrity of Community Visitors Board elections and provide internal mechanisms that disallow invalid votes. For example, the returning officer must separate signed from unsigned ballot paper envelopes and disallow unsigned ones (reg 29(c)-(d)). A vote is invalid if it is not enclosed in a ballot paper envelope signed by a community visitor, if it comes from someone whose name is not on the provided list, or if it is not marked with a single "1" opposite a candidate (reg 30(a)-(c)). The returning officer is empowered to determine questions of validity or regularity and to conduct recounts on request or on the officer’s own motion (regs 16(2)(c), 32(1)). The Public Advocate resolves disputes over validity or regularity of votes (reg 33). These are procedural enforcement features internal to the electoral process; they do not prescribe criminal sanctions but they exclude improperly cast votes from counting and give officials decision-making powers about election regularity.

Administrative custody and record-keeping

• The returning officer must ensure safe custody of election materials for 30 days after declaration of results (reg 35). That prescription is an administrative safeguard that facilitates audit or challenge during the short post-election window. Similarly, the prescribed Schedule 1 form for records of visits standardises documentation by community visitors (reg 37). Non-compliance with these measures may be evidence of procedural failings that the Act or related administrative processes can address.

Enforcement through the Disability Act 2006

• The Regulations frequently reference specific provisions of the Act (for example the particulars required for approvals to use restrictive interventions under s 135(2)(a) and for supervised treatment under s 186(2)(a) at regs 12 and 13). The Regulations do not restate the Act’s sanctioning or enforcement provisions; they supply the details the Act requires be prescribed. Therefore any formal enforcement , such as revocation of approvals, statutory penalties, disciplinary processes, or other sanctions for misuse of restrictive interventions, breaches of care obligations or unauthorised disclosures , will derive from the substantive enforcement provisions contained in the Act and potentially in other statutes referenced (for example the Ombudsman Act or the Disability Service Safeguards Act 2018 where those bodies and offices are involved). The Regulations themselves provide required inputs for those enforcement processes rather than separate penal tools.

Information disclosure controls

• The Regulations prescribe which bodies may receive information from the Disability Services Commissioner (reg 41) and which bodies may be recipients for NDIS purposes (reg 39 and reg 40). The Regulations therefore constrain the DSC’s discretion to disclose by listing permitted recipients. Any misuse of disclosed information or wrongful disclosure would be governed by the Act’s disclosure and confidentiality rules (for example s 132ZB of the Act is cited as the operative provision in reg 41). Again, the Regulations do not create stand-alone penalties but structure permissible disclosures.

Practical enforcement consequences

• The practical enforcement effect of the Regulations lies in their ability to:
  • trigger statutory consequences under the Act once the prescribed particulars or thresholds are met or not met (for example an application for restrictive interventions not supported by the required particulars may fail under the Act’s decision-making processes);
  • invalidate electoral acts (unsigned ballot envelopes are disallowed and votes not meeting reg 27 are not counted); and
  • limit or permit disclosures (the DSC must confine disclosures to the persons and bodies listed in reg 41).

Absence of express fines or criminal offences in the instrument

• Because these Regulations do not include express offence provisions or monetary fines, counsel and compliance officers must look to the Act and any connected Victorian or Commonwealth statutes for the formal enforcement tools and for the remedies available where an entity contravenes an Act-based duty to which these prescribed particulars or amounts relate.

In short, enforcement under the Regulations is primarily procedural and enabling: the instrument defines what must be supplied or how votes must be cast, gives officials decision-making and custody powers, prescribes recipients of information, and leaves penalties and formal sanctions to the Act and other statutes.

The Regulations sit as subordinate legislation under the Disability Act 2006 and operate by prescribing matters that the Act requires. They also reference and rely upon Commonwealth social security payments and a range of other Victorian and Commonwealth statutes. The interactional points are structural and cross-referential rather than substantive innovations.

Authorising and parent statute

• The Regulations are made under s 221 of the Disability Act 2006 (reg 2). Numerous regulations expressly invoke specific provisions of the Act as the operational context for the prescription. For example, regs 12 and 13 are “for the purposes of” s 135(2)(a) and s 186(2)(a) respectively, reg 9 is “for the purposes of” s 72(3), reg 10 for s 93(1)-(2), reg 11 for s 95(1), reg 37 for s 132, and reg 41 for s 132ZB(m). This means the Regulations are intended to be read as filling statutory blanks in the Act rather than as standalone rules.

Dependence on Commonwealth social security legislation

• The Regulations repeatedly use terms and payment amounts that are defined or paid under the Commonwealth Social Security Act 1991. The definitions in reg 5 expressly tie “Commonwealth disability support pension” to Part 2.3 of the Social Security Act 1991 and “Commonwealth rent assistance” to Part 3.7 of the same Act. The monetary rules in regs 9 and 14 depend on the resident’s receipt of those Commonwealth payments. Practically, changes to Commonwealth pension or rent assistance rates will directly affect Victorian prescribed amounts and charges under these Regulations because the formulas use the amounts received by the individual.

Information-sharing and Commonwealth Acts

• The Regulations prescribe the NDIS Quality and Safeguards Commission, established under the Commonwealth National Disability Insurance Scheme Act 2013, as a prescribed body for s 39(4)(m) (reg 39). Regulation 41 also lists the NDIA and the Commonwealth Ombudsman created under the Commonwealth Ombudsman Act 1976 as recipients. These cross-jurisdictional links formalise inter-governmental information sharing in respect of the NDIS and allied regulatory functions. They make the Regulations a vehicle for operational coordination with Commonwealth NDIS structures.

Interaction with Victorian statutes

• Several bodies named in reg 8 are established under other Victorian statutes: for example Adult Multicultural Education Services under the Education and Training Reform Act 2006, the State Sport Centres Trust under the State Sport Centres Act 1994, the Victorian Arts Centre Trust under the Victorian Arts Centre Act 1979, and V/Line Corporation under the Transport Integration Act 2010 (reg 8). Regulation 41 references the Disability Service Safeguards Act 2018 in prescribing the Disability Worker Registration Board of Victoria and the Victorian Disability Worker Commission and Commissioner (reg 41(i)-(k)), reflecting that the scheme interacts with the separate safeguards and regulatory architecture created in 2018.

Transitional and revocation effects

• Regulation 4 revokes the Disability Regulations 2007 and the 2009 amendments. Regulation 38 contains a transitional provision preserving community visitors who held office immediately before 24 June 2018 for the remainder of their elected two-year period. The endnotes record the date the Regulations were made (13 June 2018) and the commencement date (24 June 2018) and also note a sunset provision under the Subordinate Legislation Act 1994 which will cause the instrument to expire 10 years after making (endnote 1). Practitioners must therefore take account of transitional continuity from the prior regulatory regime and the finite duration of certain prescriptions (for example regs 6-7).

Amendment linkages

• The version quoted incorporates amendments up to 1 July 2020 (header). The Table of Amendments records Disability Amendment Regulations 2020, S.R. No. 59/2020, which made changes including revocation of a subparagraph of reg 40 and insertion/amendment of items in reg 41 (see Table of Amendments and the notes in regs 40 and 41). Those amendments show the Regulations can be adjusted to reflect changing institutional arrangements, notably around NDIS-related organisations and disability worker regulation.

Operational dependence on Act provisions

• Several regulations explicitly require applicants to demonstrate capacity to comply with particular Parts or Divisions of the Act (regs 12(d) and 13(d)). That creates a functional dependency: the Regulations list what must be supplied in an application while the Act contains the substantive compliance standards and presumably the criteria for approval. In other words, approval decisions will require reading the Regulations alongside the relevant Act provisions on restrictive interventions and supervised treatment.

Limitations and exclusions

• The Regulations exclude community residential units from the charging mechanism in reg 14. That exclusion creates an internal interaction within the disability regulatory regime where different residential settings fall under different charging or funding rules.

In practice the Regulations are an enabling instrument to ensure the Act interfaces in operational detail with Commonwealth payments and with other Victorian and Commonwealth statutory institutions. They structure inter-agency information flows for NDIS transition and embed detailed administrative procedures into the broader statutory framework.

The Regulations document their own making and subsequent amendment notes. The published instrument incorporates amendments up to 1 July 2020 and the endnotes record the principal amendment instrument and other contextual information.

Original making and commencement

• The Disability Regulations 2018 were made by the Governor in Council on 13 June 2018 under s 221 of the Disability Act 2006 and came into operation on 24 June 2018 (reg 3; Endnote 1). The instrument replaced and revoked the prior Disability Regulations 2007 and its amending instruments (reg 4).

Notable amendments reflected in the current version

• The Table of Amendments identifies the Disability Amendment Regulations 2020, S.R. No. 59/2020, as a source of amendment. The date of making for that amendment instrument is 30 June 2020 and it commenced on 1 July 2020 (Table of Amendments entry for 2020 instrument). The 2020 amendments are noted in the text where specific subparagraphs were revoked or where reg 41 was amended and subparagraphs inserted. For example:
  • Reg 40(a) was revoked by S.R. No. 59/2020 reg 5 (the text notes “Reg. 40(a) revoked by S.R. No. 59/2020 reg. 5”).
  • Reg 41(h) is annotated as amended by S.R. No. 59/2020 reg 6(a).
  • Reg 41(i), (j) and (k) were inserted by S.R. No. 59/2020 reg 6(b), adding the Disability Worker Registration Board of Victoria, the Victorian Disability Worker Commission, and the Victorian Disability Worker Commissioner as prescribed persons for the purposes of s 132ZB(m).

Temporal prescriptions in the original instrument

• Regulations 6 and 7, which prescribe the Department of Education and Training as an exempt service provider and as a prescribed service provider respectively, specify that those regulations apply from 24 June 2018 until 31 December 2019 (regs 6(2) and 7(2)). Those temporal confines are part of the original instrument and are not described as amended in the Table of Amendments.

Revocations and transitional continuity

• Regulation 4 revokes the Disability Regulations 2007 and its two amending instruments (2009). Regulation 38 provides a transitional provision preserving community visitors who held office immediately before 24 June 2018 for the remainder of their elected two-year period. The Explanatory Details in endnote 4 explicitly cross-reference the revocations and their sources.

Sunset and statutory review

• Endnote 1 records that the Regulations will sunset ten years after the day of making on 13 June 2028 under the Subordinate Legislation Act 1994. This fixed statutory expiry means that, absent re-making or extension under the Subordinate Legislation Act framework, the instrument will lapse in mid-2028.

Practical effect of amendments

• The 2020 amendments materially adjusted the list of permitted disclosure recipients in reg 41 by adding bodies created under the Disability Service Safeguards Act 2018 (specifically the registration board, commission and commissioner). The revocation of reg 40(a) and related changes indicate that disclosure and NDIS-related recipients were being recalibrated as institutional arrangements around the NDIS and disability workforce regulation evolved.

Record-keeping of amendments

• The endnotes include a Table of Amendments and a section “Amendments Not in Operation,” and the header of the instrument states the version incorporates amendments as at 1 July 2020. Practitioners should consult the Table of Amendments and the official legislative database for any subsequent amendments after 1 July 2020.

In short, the instrument was made in June 2018, commenced in June 2018, and has been amended (notably in mid-2020) to reflect the evolving institutional architecture of disability worker regulation and NDIS-related bodies. The instrument also contains specific time-limited prescriptions and will sunset in 2028 unless re-made.

The text of the Disability Regulations 2018 that has been provided contains no references to litigation, case law, or judicial decisions. There are no cases named in the instrument and no notes referring to judicial interpretation or challenge. The endnotes and explanatory details do not record any litigation concerning these Regulations.

Consequently:

• There is no litigation history recorded in the Regulations themselves that would indicate contested provisions or interpretative disputes.
• Where the Regulations prescribe particulars for approval to use restrictive interventions or supervised treatment or where they set charge formulas and monetary limits, any judicial review, merits review or dispute would arise under the Disability Act 2006 or other statutes, but such cases are not recorded in the instrument.

For practitioners seeking litigation precedent on how these prescriptions have been interpreted or enforced, the Regulations themselves do not supply a body of case law. One must therefore look to decisions under the parent Act, administrative tribunals or other court decisions post-dating the instrument’s commencement to find litigation involving these particular regulatory prescriptions. The Regulations do not list any decisions or disputes nor do they annotate any interpretive guidance resulting from judicial proceedings.

The Regulations are precise and technical. Several traps for the unwary and potential areas of confusion or risk appear directly from the text. Below are the concrete “gotchas” that arise from the instrument as written, each tied to the applicable regulation.

Temporal scope for Department of Education and Training

• Regulations 6 and 7 prescribe the Department of Education and Training as an exempt service provider and as a prescribed service provider respectively, but both regulations expressly apply only to the period from 24 June 2018 until 31 December 2019 (regs 6(2) and 7(2)). Practitioners must not assume these designations are ongoing. Any administrative action taken after 31 December 2019 that treats the Department under those labels must be checked against whether those temporary prescriptions have been extended or replaced.

Different bases for “relevant prescribed amount” and the monthly charge

• Reg 9 fixes the “relevant prescribed amount for residential charge” (for s 72(3)) as an annual amount equal to 75% of the Commonwealth disability support pension plus 100% of Commonwealth rent assistance received annually. Reg 14, by contrast, sets the actual monthly charge for accommodation as equivalent to 57.1% of the sum of the Commonwealth disability support pension and rent assistance received in respect of the corresponding month and requires the charge be set every six months. Practitioners must not conflate the annual “relevant prescribed amount” in reg 9 with the monthly charging formula in reg 14; each serves a different statutory purpose under the Act and uses different percentages (75% annual vs 57.1% monthly). Careful attention is needed when advising on means assessments or when calculating the interplay of charges with social security entitlements.

Exclusion of community residential units from reg 14

• Regulation 14 explicitly applies to residents in residential institutions “other than a community residential unit.” Failure to note that parenthetical exclusion may lead to incorrect charging, particularly because the common-language distinction between types of residential services is not spelled out in the Regulations; the operative difference depends on the Act’s definitions. Confirm whether a particular facility is a community residential unit under the Act before applying reg 14.

Signature and receipt formalities for votes

• The electoral system for the Community Visitors Board is heavily dependent on postal procedures and signatures. The ballot envelope containing the ballot paper must be signed and dated by the elector and enclosed within a reply paid return envelope that must be posted to reach the returning officer before 4 p.m. on polling day (reg 28). The returning officer must separate unsigned ballot paper envelopes and disallow them (reg 29(c)-(d)). A small administrative omission (unsigned envelope, late posting) will render a vote invalid under reg 30. Election administrators, candidates and voters must strictly observe timelines and signature requirements.

Strict limits on candidate personal statements

• Candidate personal statements for inclusion in the ballot pack are limited to 150 words, must be signed, and must be lodged no later than 12 noon on the third day after nomination day (reg 26(2)-(3)). Candidates must also not refer to another candidate without that candidate’s written consent (reg 26(4)). Failure to observe the word limit or timing may exclude the statement from the ballot pack.

Custody and short retention of election materials

• The returning officer must ensure safe custody of election materials for only 30 days from declaration of results (reg 35). That is a short window for any challenge or audit; parties should act quickly if complaints arise.

Revocation of former provisions and transitional appointments

• The Regulations revoke the Disability Regulations 2007 (reg 4) but include transitional provision reg 38 preserving community visitors in office for their elected two-year period. Practitioners who rely on historical rules must check transitional coverage for specific actions and dates.

Confusion arising from revocations and amendments

• The 2020 amendment revoked reg 40(a) and amended reg 41. If relying on earlier versions or external commentary, confirm the version date: this textual instrument purports to incorporate amendments up to 1 July 2020. Legal advice or compliance work must be based on the current consolidated text.

Information sharing may reach contracted private providers

• Regulation 40(b)-(c) permits a disability service provider that has entered into a contract or deed with the State for the provision of services previously provided by the State, and persons or bodies that have entered contracts for early childhood intervention services previously provided by the State, to be prescribed recipients for NDIS purposes. This means that private or not-for-profit contractors may lawfully receive information from State agencies for NDIS-related purposes. Providers and counsel should examine confidentiality and data handling rules linked to those disclosures.

Monetary thresholds are fixed and may not be indexed

• The Regulations prescribe flat dollar amounts ($500; $5000) and fixed percentage formulas (75%, 57.1%). Unless amended or otherwise indexed, these figures will not change automatically with inflation or changes in Commonwealth payments. This can create drift in real value and administrative misalignment over time.

Dependency on Commonwealth payments and timing mismatch

• Because the formulas use the amount of Commonwealth disability support pension and rent assistance received by a person, changes to Commonwealth rates or the person’s receipt of these payments will alter the prescribed calculations. Synchronisation issues may arise where Commonwealth benefit changes do not align temporally with the six-month charge-setting cycle in reg 14, creating practical difficulties in implementing the exact monthly charge.

Limited remedies or guidance in the Regulations themselves

• The Regulations are prescriptive but do not contain guidance notes, appeal mechanisms beyond what the Act provides, or detailed operational instructions for the DSC’s disclosure processes. Entities must refer back to the Disability Act for remedies and to relevant privacy and information-sharing protocols in other statutes where appropriate.

Ambiguities around definitions not restated in the Regulations

• The Regulations explicitly define “Commonwealth disability support pension” and “Commonwealth rent assistance” by reference to the Social Security Act 1991 (reg 5). Other key terms used in the Regulations (for example “community residential unit,” “regulated service provider,” or “Authorised Program Officer”) rely on definitions in the Disability Act. Practitioners must consult the Act for those definitions rather than assuming a common-sense meaning.

In sum, the main practical “gotchas” involve strict procedural timelines for elections, time-limited prescriptions for a government department, careful attention to which residential settings are covered by the charges, the dependence of Victorian calculations on Commonwealth payments, and the fact that the Regulations set numbers and formulas that do not self-adjust. Those who administer or advise on these rules should check dates, ensure signature and postal formalities are complied with, and coordinate with Commonwealth payment records when calculating charges.

Compliance under these Regulations is primarily administrative: collecting prescribed particulars, adhering to procedural timelines and form requirements, computing charges correctly, and directing disclosures to the prescribed recipients. Below are concrete steps and checklists for each major compliance area with precise references to the regulations.

If you are a disability service provider seeking approval to use restrictive interventions (reg 12) or supervised treatment (reg 13)

• Prepare an application dossier that includes, for each premises where the measure is proposed:
  • address and contact details for every premises (reg 12(a); reg 13(a));
  • where more than one Authorised Program Officer is proposed at any premises, the full name and qualifications of each holder of that position at each such premises (reg 12(b); reg 13(b));
  • an explicit statement of reasons explaining why the provider considers it necessary to use restrictive interventions or supervised treatment at each premises (reg 12(c); reg 13(c)); and
  • an assessment and supporting evidence of the provider’s capacity and ability to comply with the applicable statutory requirements (for restrictive interventions, Part 7 of the Act , reg 12(d); for supervised treatment, Division 5 of Part 8 of the Act , reg 13(d)). Include staffing profiles, training records, policies and procedures demonstrating capacity to comply.
• Ensure the application is structured to align with the Act’s substantive criteria for approval (the Regulations prescribe particulars; the Act contains approval criteria and any decision-making timelines).

If you are a provider levying residential accommodation charges (reg 14) or advising on such charges

• Identify whether the residence is a “residential institution” and, crucially, whether it is a “community residential unit” , reg 14 explicitly excludes community residential units (reg 14 introductory words).
• For each resident in a residential institution covered by reg 14:
  • obtain documented evidence of the Commonwealth disability support pension and the Commonwealth rent assistance amounts received by the resident for the corresponding month (reg 14(b) and reg 5 definitions);
  • calculate the monthly charge as 57.1% of the sum of those amounts for the relevant month (reg 14(b)); and
  • set and document the charge every six months, maintaining records of the basis for the calculation and the effective dates (reg 14(a)).
• For means assessments under s 72(3) of the Act, apply the “relevant prescribed amount” as set out in reg 9: the annual prescribed amount equals 75% of the Commonwealth disability support pension plus 100% of Commonwealth rent assistance received annually. Ensure reconciliations between annual and monthly bases are documented to show how reg 9 and reg 14 were applied.

If you manage a resident’s money or hold resident funds (regs 10-11)

• Ensure that the prescribed amount for the purposes of s 93(1)-(2) is $500 (reg 10) and that the limit on the amount held under s 95(1) is $5000 (reg 11).
• Implement accounting controls and audit trails so that held amounts are continuously monitored and do not exceed $5000. Maintain records showing when moneys are received, when transfers are made, and who authorised the holding or spending.
• Document and publish policies on management of resident funds that reference the statutory thresholds, and train staff in the required procedures.

If you are the Public Advocate, a returning officer or a candidate for the Community Visitors Board (Part 4)

• Public Advocate duties:
  • appoint a returning officer (reg 16(1));
  • provide the returning officer with a list of community visitors including postal addresses to enable the required notices and ballot distribution (reg 16(2)(a); reg 17(2)).
• Returning officer duties and timeline checklist:
  • give notice of the election to each community visitor on or before 1 April each year by sending the notice to their postal address (reg 17(1)-(2));
  • fix nomination and polling days consistent with reg 19: nomination day on or before 1 May; polling day on or before 1 June and at least 21 days after nomination day (reg 19(1)-(2));
  • prepare ballot papers, postal ballot envelopes and reply paid return envelopes (reg 23(2));
  • determine order of names on ballot by lot in the presence of at least one other person and any candidate who wishes to attend (reg 24(1)-(2));
  • send ballot packs at least 14 days before polling day to each community visitor postal address containing the voting instructions, ballot paper, ballot paper envelope, reply paid return envelope and candidate personal statements or a notice that a candidate has not lodged one (reg 25(a)-(e));
  • receive reply paid envelopes and process them as soon as practicable after close by removing ballot paper envelopes, recording receipt on the list, separating signed and unsigned envelopes, disallowing unsigned envelopes, and counting only votes from signed envelopes (reg 29(a)-(f); reg 30).
  • keep all election materials in safe custody for 30 days after declaration (reg 35).
• Candidate obligations:
  • lodge a written nomination paper by not later than 12 noon on nomination day by in-person delivery, post, or electronic transmission (reg 20(1)-(2));
  • ensure the nomination paper includes the full name and address, signature and date and a statement nominating as a candidate for the Community Visitors Board (reg 21(a)-(d));
  • lodge any personal statement signed and no longer than 150 words no later than 12 noon on the third day after nomination day (reg 26(2)-(3)); and
  • avoid referring to another candidate in the personal statement without their written consent (reg 26(4)).
• Voter actions:
  • mark the ballot paper by inserting the number “1” opposite the single candidate of choice (reg 27);
  • place the ballot paper into the ballot paper envelope and seal, sign and date that envelope, place in reply paid return envelope and post or deliver so it reaches the returning officer before 4 p.m. on polling day (reg 28(a)-(d)).

If you are the Disability Services Commissioner or an agency handling disclosures (regs 39-41)

• Only disclose information under the Act to persons and bodies prescribed in the Regulations. For NDIS purposes, the NDIS Quality and Safeguards Commission is prescribed (reg 39). For s 39(6) purposes, the persons or bodies listed in reg 40 are permitted (noting reg 40(a) was revoked by the 2020 instrument); for s 132ZB(m) disclosure by the DSC, consult the list in reg 41(a)-(k).
• Ensure that disclosures are documented, record the statutory basis for disclosure, and confirm that recipients are listed in the Regulations. For newly added recipients (for example, those inserted in 2020 such as disability worker regulatory bodies), ensure organisational arrangements and data-sharing agreements are in place before disclosure (reg 41 notes on amendment).

Record-keeping and form usage

• Use Schedule 1 as the prescribed form for records of community visitor visits (reg 37). Ensure completed forms capture the fields required by the Schedule and that originals are retained consistent with any record-retention policies that apply to the Public Advocate or the relevant provider.

General compliance governance

• Maintain a compliance register noting the relevant Regulations, the sections of the Act they give effect to, the dates of any prescribed deadlines (for example the annual election calendar), and any interdependencies with Commonwealth payment records.
• Where a matter involves the Act (for example approval decisions or sanctions), ensure that compliance with the prescribed particulars in these Regulations is documented because the Act-based decision-maker will rely on those particulars.
• Keep up to date with amendments. This consolidated version includes amendments up to 1 July 2020; check the official legislative database for subsequent changes, especially with respect to information-sharing recipients and any changes to monetary thresholds.

Practical administrative steps

• For providers, appoint a compliance officer to:
  • manage evidence of residents’ Commonwealth payment receipts;
  • run six-monthly reviews of charges under reg 14 and record decisions and calculations;
  • ensure any authorisation applications for interventions contain the reg 12 and reg 13 particulars.
• For election administrators, prepare templates for nomination papers, personal statements, postal ballot packs and a checklist for the receipt and verification of signed ballot envelopes.
• For agencies engaging in information exchange, draft or review Memoranda of Understanding or data-sharing agreements that reference the statutory basis for disclosure and the precise tasks to be performed by recipient entities.

By following these concrete steps tied to the specific regulations, administrative actors and regulated entities can align operational processes with the Regulations’ prescriptions and create an audit trail demonstrating compliance.
