What it does
The Disability Inclusion Regulation 2025 is a short subordinate instrument that prescribes the specific matters a public sector entity must include in a disability inclusion plan produced under the Disability Inclusion Act 2024. Section 1 states the regulation name. Section 3 identifies the matters that are prescribed for the purpose of the Act, s 15(2)(d). The prescription is limited and procedural: it requires that each action listed in a disability inclusion plan include a link to the relevant disability inclusion strategy, an outline of the action, timing information (when the action was, is being, or is planned to be taken), and the position in the public sector entity responsible for the action (s 3(1)(a)(i)-(iv)). The regulation also prescribes that a plan must include information about how the public sector entity will keep the ACT community informed about progress on each action (s 3(1)(b)) and a statement describing the consultation undertaken when the plan was most recently developed or reviewed (s 3(1)(c)). The regulation defines the term action, in a disability action plan, by cross-reference to the Act, s 15(2)(c) (s 3(2)).
Mechanically, the regulation does not create new substantive rights or carve out offences; rather it specifies formatting and content requirements for disability inclusion plans prepared by public sector entities. The instrument was notified 19 June 2025 and wholly commenced by 20 June 2025 (Legislation history, endnote 3). The republication preface records editorial-change authority under the Legislation Act 2001, part 11.3 and notes the value of a penalty unit for offences against the law at the republication date, however the regulation itself contains no penalty provisions (preamble; see Legislation Act 2001, s 133 as cited in the republished material).
