Disability Inclusion (NDIS Worker Check) Regulations 2020

The Regulations revolve around a small set of legal concepts that determine eligibility, information handling and inter‑jurisdictional cooperation.

• Disqualification offence and presumptive disqualification offence: The Regulations declare which offences are “disqualification offences” (Schedule 1) and which are “presumptive disqualification offences” (Schedule 2) for the Act’s purposes (regs 5-6). The Schedules do not simply list offences; they attach conditions (A, B, C in Schedule 1; A, D, E in Schedule 2) that turn an offence into disqualification or presumptive disqualification depending on victim characteristics, relationship and aggravating circumstances (Schedule 1 cl 1(2)-(3); Schedule 2 cl 2(2)). For example, many sexual and violent offences are disqualification offences when committed against a child or vulnerable person (condition A), but may operate as presumptive offences where the victim is not a child or vulnerable person (Schedule 1 note; Schedule 2 cl 2(1)(a)).
• Protected information and register: The Registrar must maintain a register of decisions to classify information as protected information (reg 8(1)). The register may include what the Registrar thinks fit and is inspectable only with the Registrar’s permission (reg 8(2)-(3)). The classification of information as protected is a prescribed function and power (reg 9).
• Central assessment unit powers and information flows: The central assessment unit is given an express power to refuse or terminate applications on new grounds (reg 10). Courts and police have duties to provide defined particulars to the central assessment unit when a finding of guilt or charging of a disqualification/presumptive offence arises, and the form of provision is set by the Registrar (regs 12-13). The central assessment unit may disclose information to a prescribed set of Commonwealth bodies and the NDIS Commission (reg 14).
• Non‑reviewable decisions: The Regulations specify that certain decisions are included within the Act’s definition of non‑reviewable decisions (reg 16). These include refusal to grant clearance (s 18I(2) of the Act), cancellation of clearance (s 18S(2)), termination of application or cancellation under s 18W, and termination of an application under reg 10(1) (reg 16(a)-(d)).
• Notification obligation for holders: Holders of an NDIS worker check clearance must notify the central assessment unit of relevant changes of particulars within three months in a form approved by the central assessment unit (reg 18(1)-(2)), with a maximum penalty stated.

Other definitional concepts appear in reg 3: child (under 18), vulnerable person (an adult who, by reason of age, illness or disability, cannot properly care for or protect themselves), and relative (a wide culturally inclusive definition that includes kinship rules and carers) (reg 3). The Regulations also specify which other jurisdictions’ laws count as corresponding laws for cross‑jurisdiction recognition and information sharing (reg 4) and a broad list of “relevant laws” that the central assessment unit will treat as pertinent for screening and decisionmaking (reg 7).

The Regulations affect several discrete groups and institutions. State the mechanics first, then the behavioural implications.

• Applicants for an NDIS worker check clearance and current holders: Individuals seeking clearance must ensure their application is verified by a registered NDIS employer if required (reg 10(1)(a)), must not be an excluded or suspended person in another jurisdiction while their application is processed (reg 10(1)(b)-(c)), and must notify the central assessment unit of relevant changes to their name, address or contact details within three months in an approved form or face a penalty (reg 18(1)-(2)). Holders of clearances are directly subject to the notification duty (reg 18(1)).
• NDIS employers: Employers who verify applications must be registered with the NDIS Commission for the verification to be valid under reg 10(1)(a). That creates a direct compliance touchpoint for employers who use the verification route for their prospective workforce.
• Central assessment unit and Registrar: The central assessment unit has responsibility for refusing, terminating, sharing and disclosing NDIS worker check information (regs 9, 10, 14-15). The Registrar maintains the protected information register and determines the form and manner for courts and police to provide prescribed information (regs 8(1), 12(2), 13(2)).
• Courts and police: Courts must supply the full name, date of birth, residential address, particulars of offence, date of finding and court details for findings of guilt prescribed by reg 12(1) and in the form determined by the Registrar (reg 12). The Commissioner of Police must provide prescribed particulars of charges (reg 13(1)-(2)). Both obligations are mechanistic data flows to the central assessment unit.
• Other jurisdictions and Commonwealth bodies: The Regulations authorise the central assessment unit to disclose information to defined Commonwealth bodies and the NDIS Commission (reg 14). The Regulations also treat a range of other State and Territory laws as corresponding or relevant for the purpose of recognising suspensions, exclusions or offences across jurisdictions (regs 4, 7). That affects interstate workers and people with criminal histories outside South Australia.
• Minister and advisory panel members: The Minister may establish an advisory panel to assist the central assessment unit, appoint members, determine terms and allow allowances (reg 17). That affects those appointed and the administrative structure around the unit.

Who pays and who decides: the Regulations do not create new fees but impose administrative obligations on individuals and employers. Decisionmakers are the central assessment unit, the Registrar and the Minister (reg 17). Compliance costs fall primarily on applicants, clearance holders, employers who must verify applications, and the central assessment unit and Registrar who must process, maintain registers and determine forms. Courts and police bear procedural costs in providing prescribed particulars in the form and manner required (regs 12-13). The Regulations also set an enforcement cost on a clearance holder who fails to notify, with a maximum penalty of $50 000 (reg 18(1)).

The Regulations implant a set of explicit duties and confer procedural powers; rights are largely administrative and defined by the Act plus these implementing rules.

Primary duties:

• Notification of change of particulars: Holders must notify the central assessment unit of relevant changes in name, residential address or contact details or use of another name within three months, in a form approved by the central assessment unit. Maximum penalty $50 000 (reg 18(1)-(2)). This is an express statutory duty on clearance holders.
• Provision of information by courts and police: Courts must provide the full name, DOB, address, particulars of the offence, date and court to the central assessment unit when a finding of guilt arises, and police must provide full name, DOB, residential address (if known), particulars of the charge, description of conduct (including whether the alleged victim was a child or adult), and, for aggravated offences under the Criminal Law Consolidation Act 1935, the aggravating circumstances (regs 12(1), 13(1)). Both must supply the prescribed information in the manner and form the Registrar determines (regs 12(2), 13(2)). These are procedural duties on state institutions.
• Verification by registered NDIS employers: The central assessment unit may refuse or terminate an application if not verified by an NDIS employer registered with the NDIS Commission (reg 10(1)(a)). That imposes a practical duty on applicants/employers to secure verification from registered employers where verification is being relied on.

Key administrative powers:

• Refusal and termination powers: The central assessment unit may refuse or terminate an application on the new grounds in reg 10(1) (not verified, excluded, suspended elsewhere, not permitted under s 18H of the Act). Those terminate an application under the Act’s scheme (reg 10(1)).
• Classification of protected information: The Registrar is empowered to classify information as protected information and must maintain a register of such classifications (regs 8-9). The Registrar also controls inspection of that register (reg 8(3)).
• Information sharing: The central assessment unit may disclose and receive information from the NDIS Commission, ACIC, NDIA and Department of Social Services (reg 14). The central assessment unit can also determine what offences it treats as relevant for disclosure (reg 15).

Rights and limits:

• Non‑reviewable decisions: The Regulations add specific decisions to the Act’s list of non‑reviewable decisions (reg 16). The listed decisions include refusal to grant clearance, cancellation of clearance, termination under s 18W and termination under reg 10(1) (reg 16(a)-(d)). That narrows the statutory avenues for merits review of those administrative decisions. The Act retains whatever judicial review rights the general law provides, but the Regulations expressly place those administrative decisions in the Act’s non‑reviewable category.
• Procedural requirement to issue notices: Notices of grant or exclusion must comply with guidelines under s 12 of the Act and be issued as soon as reasonably practicable after the determination is made (reg 11(1)-(2)). This sets a timeliness duty on the central assessment unit and Registrar.

Ancillary provisions that affect duties and rights:

• Ministerial power to establish an advisory panel and set terms and allowances for non‑Public Service members (reg 17).
• The Minister may add further presumptive disqualification offences by Gazette according to Schedule 2 cl 2(1)(d). That provides a dynamic mechanism to widen the presumptive list without primary legislative change.

Collectively, the key duties create ongoing compliance obligations on clearance holders and impose institutional reporting duties on courts and police. Decision rights lie primarily with the central assessment unit and Registrar, and the statutory carve out of certain decisions as non‑reviewable compresses administrative review options for affected persons.

The Regulations set a specific civil penalty and vest enforcement and reporting functions with administrative bodies rather than imposing new criminal sanctions.

Explicit civil penalty:

• Failure to notify change of particulars: Regulation 18(1) imposes a maximum penalty of $50 000 for a holder of an NDIS worker check clearance who does not notify the central assessment unit of relevant changes of particulars within three months of the change occurring (reg 18(1)-(2)). The instrument does not specify whether this penalty is pecuniary fine, infringement or an administrative penalty application procedure; it states the maximum penalty amount.

Administrative enforcement mechanisms:

• Application refusal or termination: The central assessment unit has express powers to refuse or terminate an application on grounds added by the Regulations (reg 10(1)). These are administrative enforcement tools that prevent or terminate clearance.
• Cancellation of clearance: The Regulations include cancellation decisions among non‑reviewable decisions (reg 16(b)). Cancellation therefore acts as an enforcement step the central assessment unit may take under the Act and Regulations.
• Information flows to enable enforcement: The Regulations create mandatory reporting channels from courts and police (regs 12-13) and authorise disclosure to Commonwealth bodies and the NDIS Commission (reg 14). These information flows enable real‑time or near‑real‑time detection of events (charges, findings of guilt, exclusions in other jurisdictions) that may trigger enforcement action such as refusal, termination or cancellation.

Limits on review and procedural protections:

• Non‑reviewable decisions: The Regulations declare certain decisions to be within the Act’s definition of non‑reviewable decisions (reg 16). The practical effect is to limit merits review of core adverse administrative decisions taken by the central assessment unit. The Regulations do not themselves create a separate internal review mechanism for those decisions; they specify only that these decisions are included under the Act’s non‑reviewable category.
• Discretion and form requirements: Enforcement actions depend on the Registrar’s determinations of form and manner for police and court reporting (regs 12(2), 13(2)), and on guidelines published under s 12 of the Act for how notices must be issued (reg 11(1)). That centralises practical control of how enforcement triggers arrive and may introduce administrative bottlenecks or procedural dependencies.

No criminal penalties or specified enforcement process:

• The Regulations do not create new criminal offences other than relying on existing criminal offences listed in the Schedules. The principal new sanction created on the face of the Regulations is the civil penalty for failure to notify (reg 18). The enforcement pathway for that penalty (e.g. prosecuting agency, infringement scheme) is not specified in the Regulations text provided.

Operational enforcement responsibilities:

• The central assessment unit, Registrar, courts and police are the primary actors in effecting enforcement through information exchange and administrative decisionmaking (regs 8, 10, 12-14, 16-18). The Minister and an advisory panel may shape policy and procedure (reg 17), but the Regulations gate day‑to‑day enforcement into administrative decisionmaking rather than criminal enforcement.

The Regulations are heavily connective: they explicitly incorporate, recognise and interoperate with a wide range of State, Territory and Commonwealth legislation.

Inter‑jurisdictional recognition and information sharing:

• Corresponding laws: The Regulations prescribe a list of laws from other jurisdictions that count as corresponding laws for s 18A(1)(b) of the Disability Inclusion Act. The list includes the Working with Vulnerable People Act (ACT), the NDIS Worker Checks Act (NSW), the NDIS Worker Clearance Act (NT), Registration to Work with Vulnerable People Act (Tasmania) and the Worker Screening Act (Victoria) (reg 4). This means exclusions, suspensions or decisions under those laws can be recognised under the South Australian scheme.
• Relevant laws: The Regulations also prescribe a broad list of “relevant laws” for the purposes of the Act (reg 7). That list includes child protection, guardianship, adult safeguarding and various State and Territory ombudsman and working with children laws, and explicitly includes “a previous enactment corresponding to a law referred to in a preceding paragraph” (reg 7(a)-(p)). By listing these statutes, the Regulations set an evidentiary and contextual baseline for what conduct and administrative decisions are pertinent to screening decisions.

Criminal jurisprudence as input:

• The Schedules adopt offences across South Australian statutes and Commonwealth criminal law. They refer to sections within the Criminal Law Consolidation Act 1935, the Criminal Code (Cth), Summary Offences Act 1953 and others (Schedules 1 and 2). Where an offence has cross‑jurisdictional analogues, the Schedules explicitly include corresponding offences under previous enactments or other States and Territories (Schedule 1 cl 1(4); Schedule 2 cl 2(3)). That creates a mechanism for extraterritorial criminal incidents to be treated as disqualifying or presumptively disqualifying.

Administrative law and review intersections:

• The Regulations declare certain decisions non‑reviewable (reg 16). That interacts with the Act’s administrative review scheme (s 18ZI(5)), curbing merits review available under the Act. The Regulations do not address judicial review remedies under general administrative law; practitioners should note the statutory non‑reviewable label applies to administrative merits review avenues articulated in the Act.
• Guidelines under s 12 of the Act: Regulation 11(1) requires compliance with guidelines published under s 12 of the Act when notices are issued. The content of those guidelines will interact with the procedural fairness and information rights of applicants and holders.

Privacy and information law:

• The Registrar’s discretion about what the protected information register may include and who may inspect it (reg 8(2)-(3)) creates an administrative interface with privacy obligations, although the Regulations themselves do not restate privacy law. Information sharing with ACIC, NDIA and federal agencies (reg 14) raises inter‑agency privacy interface issues governed by other Acts and instruments external to these Regulations.

Ministerial powers and Gazette declarations:

• The Regulations allow the Minister to add offences to the presumptive list by Gazette (Schedule 2 cl 2(1)(d)) and to establish an advisory panel (reg 17). Those Ministerial powers create a low‑threshold route for future change without primary legislation.

Practical interaction effects:

• Employers and individuals operating across jurisdictions are captured by the interoperation rules (regs 4, 7, 10(1)(b)-(c)). A person excluded or suspended elsewhere can be refused or terminated in South Australia while an application is processed (reg 10(1)(b)-(c)). Courts and police are co‑opted into a nationalised reporting system through the Registrar’s prescribed forms (regs 12-13).

In short, the Regulations do not operate in isolation. They expressly import and rely on State, Territory and Commonwealth criminal and administrative laws to determine screening outcomes and build a reporting network that reaches courts, police, the NDIS Commission and federal agencies.

The Regulations record a limited formal legislative history and also create mechanisms by which the substantive lists these Regulations contain may be amended administratively.

Formal legislative timeline in the instrument:

• The bottom of the text records the principal regulations: Disability Inclusion (NDIS Worker Check) Regulations 2020, No 316 (Gazette 17.12.2020 p5761) with commencement aligned to reg 2,these Regulations come into operation on the day Part 5A of the Disability Inclusion Act 2018 (as enacted by the Statutes Amendment (Screening) Act 2019) commences (reg 2). The Gazette and commencement details in the Legislative history section indicate that the instrument was made in 2020 and commenced 1 February 2021 (Legislative history: Principal regulations 2020 No 316; commencement 1.2.2021: r 2).
• The text does not itself record any subsequent amendments, repeal or consolidating changes beyond the original instrument details contained in the Legislative history note.

Administrative amendment pathways provided inside the Regulations:

• Ministerial Gazette power for presumptive offences: Schedule 2 cl 2(1)(d) permits the Minister to declare any other offence a presumptive disqualification offence by notice in the Gazette. That is an administrative amendment mechanism that allows the Government to add to the presumptive list without returning to Parliament.
• Registrar discretion over form and register content: Reg 8(2) states the register “may include such information as the Registrar thinks fit”, and regs 12(2) and 13(2) give the Registrar power to determine the manner and form in which courts and police provide information. These are delegated administrative levers that change how the scheme operates without formal amendment to the Regulations.
• Guidelines under s 12 of the Act: Reg 11(1) requires that notices comply with guidelines published under s 12 of the Act. Those guidelines are not in the Regulations but are an implementing instrument that can be updated to change notification content and processes.

Limits and implications:

• The Regulations rely on and reference multiple external instruments and Acts (reg 4, reg 7). Changes to those external laws (other States’ worker screening statutes, relevant South Australian Acts) will therefore alter the practical application of the Regulations without necessitating amendment to this instrument.
• The Minister’s Gazette power and Registrar’s procedural controls permit fairly quick operational change. That accelerates responsiveness but can reduce parliamentary scrutiny of substantive additions to the presumptive list or procedural changes in reporting.

In sum, the Regulations themselves reflect a single making event in 2020 with commencement in 2021. They incorporate delegated amendment mechanisms (Ministerial Gazette, Registrar determinations, guidelines under the Act) that allow the scheme to evolve administratively rather than exclusively by legislative amendment.

The Regulations as provided do not include or cite any litigation history. The text contains no references to judicial decisions, case law or challenges to the provisions, and the Legislative history entry records only the instrument and commencement particulars (Legislative history: Principal regulations 2020 No 316; commencement 1.2.2021: r 2).

However, the instrument creates features that are, as a matter of legal design, likely to intersect with litigation or administrative review questions:

• Non‑reviewable decisions: The Regulations expressly include certain decisions within the Act’s definition of non‑reviewable decisions (reg 16). Typical litigation or review arguments in contexts with statutory non‑reviewable labels concern whether the non‑reviewable label ousts judicial review altogether, or only excludes merits review under the statute. The Regulations do not themselves resolve that broader legal question; they simply identify the decisions (reg 16(a)-(d)). The instrument therefore sets the stage for potential litigation over the scope and effect of the non‑reviewable designation, though no cases are recorded here.
• Information and privacy disputes: The creation of a protected information register that the Registrar controls and the authorisation to disclose information to federal bodies (regs 8, 14) can generate disputes over unlawful disclosure, procedural fairness, or privacy obligations under other law. The Regulations do not create a right of inspection beyond Registrar permission (reg 8(3)), which may be challenged procedurally in particular cases, but no examples appear in the text.
• Administrative discretion and form requirements: The Registrar determines the manner and form for courts and police to provide information (regs 12(2), 13(2)). Litigation could arise from a contention that a decision or an adverse administrative outcome flowed from a requirement that was not properly promulgated or applied. The Regulations make the power clear; they do not catalogue litigation outcomes.

Practical note for practitioners:

• Because the Regulations rely on other domestic and Commonwealth criminal laws and designate many decisions as non‑reviewable, any litigation emerging from the operation of these Regulations will likely involve interplay of administrative law principles, evidence of criminal history, inter‑jurisdictional recognition and statutory interpretation of the Act and its delegated instruments. The Regulations themselves supply the framework but are silent on any litigation to date.

In short, the Regulations contain provisions that could be involved in litigation, but the instrument as provided records no litigation history.

The Regulations contain multiple technical features and delegated discretions that create traps for the unwary. Highlight the concrete hazards to watch for.

1. Non‑reviewable classification narrows remedies: Reg 16 puts refusal to grant clearance, cancellation, termination of applications and reg 10 terminations explicitly into the Act’s “non‑reviewable decision” bucket (reg 16(a)-(d)). Practitioners should note statutory non‑reviewable labelling may restrict merits review avenues under the Act. This does not automatically mean there is no judicial review at common law but it does mean merits review under the Act is curtailed.

2. Verification must be by an NDIS employer registered with the NDIS Commission: Reg 10(1)(a) allows termination or refusal where “the application is not verified by an NDIS employer who is registered with the NDIS Commission”. That creates a hiring trap: if an employer who is not registered attempts to verify, the central assessment unit may refuse or terminate irrespective of other merits. Employers and recruiters must confirm registration status before relying on their verification.

3. Cross‑jurisdictional suspensions and exclusions operate during processing: Reg 10(1)(b)-(c) allows termination if the applicant is excluded by or suspended in another jurisdiction while their application is being processed. For interstate or nationally mobile workers, a suspension elsewhere will affect a South Australian application even if the exclusion is temporary.

4. Complex schedule conditions (A, B, C, D, E) determine categorisation: Whether an offence is disqualifying or presumptively disqualifying depends on factual predicates (victim age, relationship, aggravation). For example, an offence listed with condition B is taken to be a disqualification offence only if condition A applies; otherwise it is presumptive (Schedule 1 cl 1(2)-(3)). The double negative interplay means practitioners must inspect the Schedules closely and map facts to conditions to determine legal effect.

5. “Protected information” register under Registrar control: Reg 8 permits the Registrar to include “such information as the Registrar thinks fit” and to restrict inspection to permissioned access (reg 8(2)-(3)). That grants wide internal powers over sensitive records and limits external scrutiny.

6. Registrar determines form and manner for court/police reporting: Courts and police must provide prescribed particulars but “in a manner and form determined by the Registrar” (regs 12(2), 13(2)). Delays or mismatches between court/police systems and Registrar forms could delay reporting or produce technical non‑compliance.

7. Penalty for late notification of particulars is large but enforcement process unspecified: Reg 18 sets a maximum penalty of $50 000 for late notification of change in particulars. The Regulations do not set out the enforcement or recovery mechanism for that penalty. Practitioners should be cautious about non‑compliance even where procedural ambiguity about enforcement exists.

8. Ministerial Gazette power to add presumptive offences: Schedule 2 cl 2(1)(d) allows the Minister to add offences by Gazette. This is a quick regulatory expansion path and can change an individual’s legal status without parliamentary amendment, practitioners should monitor Gazette notices.

9. Broad list of “relevant laws”: Reg 7 lists many State and Territory Acts as relevant. The practical effect is an expansive net for events and administrative decisions outside the criminal code to feed into screening decisions (eg guardianship, aged care safeguarding). This may catch conduct that is administrative rather than criminal in other contexts.

10. No statutory fees, but administrative burden remains: The Regulations do not state fees or resourcing for the central assessment unit, but they create reporting, verification and data‑handling obligations on courts, police, employers and applicants. The absence of fee provisions in the Regulations means practitioners must plan for administrative cost rather than fee recovery.

In short, the main gotchas are the delegated discretions that centralise control with the Registrar and central assessment unit, the non‑reviewable decisions, the verification requirement tied to NDIS Commission registration, the cross‑jurisdiction operation, and the potentially large penalty for late notification without a clearly articulated enforcement mechanism in the text provided.

This section sets out practical, source‑grounded steps for applicants, employers, courts, police and administrators to align with the Regulations.

For applicants and clearance holders:

1. Verify employer registration before relying on verification. If your application requires verification by an NDIS employer, ensure that employer is registered with the NDIS Commission (reg 10(1)(a)). Ask for documentary evidence of registration and record it in recruitment files.
2. Update particulars timely. If you hold an NDIS worker check clearance, notify the central assessment unit of any relevant change of particulars (name, residential address, contact details, or use of another name) within three months in the form approved by the central assessment unit (reg 18(1)-(2)). Treat the $50 000 maximum penalty as a strong compliance incentive and keep contemporaneous proof of notification.
3. Disclose interstate suspensions or exclusions. If you are excluded or suspended in another jurisdiction while applying, expect the central assessment unit may refuse or terminate your application (reg 10(1)(b)-(c)). Address and resolve interstate administrative actions before lodging or during processing where possible.

For employers and recruiters:

1. Confirm verification protocols. Do not verify an applicant’s NDIS worker check unless your organisation is registered with the NDIS Commission. Verification by a non‑registered employer is grounds for refusal (reg 10(1)(a)).
2. Maintain records of verification and any steps taken to check criminal history against the Schedules. Keep evidence of how you checked across jurisdictions listed in reg 4 and reg 7, and any follow‑up steps if you find suspensions or exclusions elsewhere.

For courts and police:

1. Provide prescribed information in the form and manner required. Courts must provide the full name, DOB, address, particulars of offence, date and court for findings of guilt (reg 12(1)); police must provide prescribed particulars for charges including description of conduct and aggravating circumstances where applicable (reg 13(1)). Both must use the manner and form determined by the Registrar (regs 12(2), 13(2)). Liaise with the Registrar to obtain the current forms and technical specifications required.
2. Establish reliable data pipelines. Since the Regulations expect these particulars to feed directly to the central assessment unit in Registrar‑determined form, establish secure electronic transfer mechanisms, record transmissions and confirm receipt.

For the central assessment unit and Registrar:

1. Publish forms and guidelines promptly. The Registrar must determine the manner and form for courts and police to make prescribed notifications (regs 12(2), 13(2)), and notices of grant or exclusion must comply with guidelines under s 12 of the Act (reg 11(1)). Make those forms and guidelines publicly accessible and ensure compatibility with court and police systems to avoid delays.
2. Maintain the protected information register and limit access consistent with reg 8. Define internal procedures for classification decisions, document reasons for protected classification, and implement a permissioning process for inspection (reg 8(1)-(3)).
3. Implement verification and exclusion checks against corresponding and relevant laws. Use the list of corresponding laws (reg 4) and relevant laws (reg 7) to develop cross‑jurisdiction screening checks. Keep a record of how interstate exclusions and suspensions are identified and acted on under reg 10.
4. Document decisions that are non‑reviewable and provide clear reasons. Where deciding to refuse, cancel or terminate (including under reg 10), provide clear written reasons and reference the non‑reviewable status under reg 16 to ensure transparency and mitigate procedural challenge risk.

For Ministers and advisory panel members:

1. Use Gazette power and advisory panel carefully. If adding presumptive offences by Gazette (Schedule 2 cl 2(1)(d)), document the policy rationale. For advisory panel appointments (reg 17), set procedural terms and make allowances decisions transparent to reduce perception of arbitrariness.

Cross‑cutting compliance steps:

• Map offences to the Schedules. Practitioners should map relevant criminal convictions and charges to the precise Schedule entries and conditions (Schedule 1 cl 1(2)-(4); Schedule 2 cl 2(2)-(3)). Many offences are described by statute and section numbers; ensure accurate legal matching, especially where conditions about victim age, relationship and aggravating circumstances apply.
• Maintain inter‑jurisdictional awareness. Because the Regulations rely on recognition of interstate laws and allow sharing with federal bodies (regs 4, 14), maintain processes to check corresponding interstate registers and to manage responses to interstate suspensions or exclusions.
• Keep records and proof of compliance. Given the Registrar’s discretion over forms and the potential for administrative termination, keep dated records of all submissions, verifications, notifications and communications with the central assessment unit, Registrar, courts and police.

These steps translate the Regulations’ mechanistic rules into operational practices that reduce the risk of termination, refusal or penalty. The Regulations delegate significant procedural detail to the Registrar and to guidelines under s 12 of the Act, so obtaining and monitoring those instruments is essential for continuing compliance.
