Disability Inclusion Act 2024

The Act defines a compact set of substantive and procedural concepts that determine scope and compliance obligations.

Disability inclusion is defined as a process to achieve equity between people with disability and others by ensuring equality of rights, opportunities and outcomes, redressing discrimination and disadvantage, addressing stigma and abuse, accommodating difference through structural change, and addressing barriers compounded by intersectionality (s 6(1)). Ableism is given a working definition as a belief that people with disability are less worthy of respect, less able to contribute or inherently of less value (s 6(2)). The Act therefore frames the problem in both structural and attitudinal terms.

Disability is defined in the dictionary as any impairment or functional limitation that, in interaction with a barrier to accessibility, hinders full and equal participation; it explicitly includes permanent, temporary or episodic conditions and conditions not obvious to others (dictionary: disability). This is a functional, interactional definition rather than a purely medical threshold. Barrier to accessibility is broadly defined to include physical, architectural, technological, policy, financial or attitudinal obstacles (dictionary: barrier). Accessibility itself covers the physical environment, transport, information and communication (including systems and technologies), and facilities and services open to the public (dictionary: accessibility). Universal design is mandatorily referenced as best practice (Schedule 1, s 1.2(4)).

Priority inclusion areas are either areas called out in the national disability strategy or areas declared by the Minister (s 9(1)). The Act provides a non-exhaustive example list that mirrors typical policy domains such as employment, inclusive homes, safety and justice, personal supports, education, health and community attitudes (s 9(1), examples). The responsible Minister for each priority area is a Minister declared by the Chief Minister (s 9(1) definition of responsible Minister) and declarations identifying priority areas and responsible Ministers are notifiable instruments (s 9(2)).

A disability inclusion strategy for the Territory is a ten-year strategy for a priority inclusion area that must be consistent with the Act’s principles, must contain measures to promote inclusion, remove barriers and address ableism, and must relate to other significant ACT strategies in that area (s 8, s 10(2)(a)-(d)). The Act allows certain pre-existing ACT strategies to be adopted as the first strategies for specific priority areas (s 12 and table 12), with specified expiry dates and with the consultation obligations exempted where an adoption occurs (s 12(2)(a)-(b)).

Public sector entities are required to prepare disability inclusion plans that implement the strategies in relation to the entity’s work and that detail actions to promote inclusion, reduce barriers and address ableism (s 15). Responsible persons for public sector entities must consult the groups identified in the Act when making or reviewing plans (s 16). Plans must be publicly available and reviewed on new relevant strategies or at least every five years (s 15(4)-(5)).

The Disability Advisory Council is established as a statutory advisory body (s 19). Its functions include advising the Minister on matters affecting people with disability, fostering cooperative relationships, and advising on NDIS issues and rights under the Convention (s 20(1)). Membership rules impose representativeness requirements and term limits (s 21). The council produces an annual report under the Annual Reports (Government Agencies) Act 2004 (s 25).

Finally, the disability inclusion principles are set out in schedule 1 and comprise the CRPD principles, care relationship principles for people in care relationships, and ACT community principles such as freedom to participate, evolving needs, intersectionality, universal design, decision-making informed by experience, protection of existing rights under other Territory Acts and the importance of advocacy (Schedule 1, s 1.1-1.2). The Act expressly states that these schedule-based principles should be read so that where care or ACT community principles conflict with CRPD principles, the CRPD principles prevail (Schedule 1, s 1.1(2)).

Together, these concepts create a legally structured but administratively driven scheme of planning, consultation and reporting, with emphasis on lived-experience consultation and public transparency rather than on private enforcement.

The Act structures duties and expectations across three principal groups: Territory Ministers and the ACT Executive; public sector entities and their responsible persons; and people and organisations representing people with disability. Private businesses and individual members of the public are affected indirectly.

Territory Ministers and the Executive

• Ministers declared as responsible for priority inclusion areas must prepare ten-year disability inclusion strategies in consultation with the Minister for this Act (s 10(1), s 9(1)). Declarations identifying priority areas and responsible Ministers are notifiable instruments (s 9(2)). The responsible Minister must prepare annual progress reports for each financial year (s 13(1)). The duty sits with the Minister and therefore with administrative resources of the relevant portfolio.

Public sector entities and responsible persons

• An administrative unit’s director-general or a public sector body’s head is the “responsible person” required to make, publish and review a disability inclusion plan for that entity (s 14, s 15(1)). The plan must be consistent with the disability inclusion principles and with relevant disability inclusion strategies (s 15(2)(a)-(b)). Responsible persons must consult people with disability, carers, disabled peoples organisations and systemic advocacy groups when preparing or reviewing plans (s 16(1)). Plans must be publicly available on an ACT government website (s 15(4)), and director-general and public sector body annual reports must include statements about measures taken to support strategy development and plan implementation (s 18(1)-(2)).

Disability Advisory Council and related actors

• The Disability Advisory Council is a statutory body established to advise on issues affecting people with disability and to foster cooperative relationships between people with disability, their families, carers, relevant organisations and government (s 19-20). The Minister appoints the council’s chair, deputy chair and ordinary members (s 21(2)). Composition rules require at least half the ordinary members to be people with disability, the chair to be a person with disability, at least one ordinary member to be an unpaid carer, and at least one member to be Aboriginal or Torres Strait Islander (s 21(4)-(8)). The council’s membership and function rules create a statutory pathway for sector voice into government decision-making and advice.

Disabled peoples organisations and systemic advocacy groups

• These organisations are required consultees for both strategies and public sector inclusion plans (s 11(1)(a)(iv), s 16(1)(a)(iii)). The Act directs Ministers and responsible persons to take “all practicable steps” to ensure that consultation reflects ACT community diversity across disabilities, sexual and gender identities, veterans’ experiences, age groups, cultural identities including Aboriginal or Torres Strait Islander identity, and socioeconomic backgrounds (s 11(2), s 16(2), s 21(8)).

Non-government actors and businesses

• The Act does not impose a legal obligation on non-government entities to prepare disability inclusion plans. However, strategies must include information for non-government entities about ways to support the strategy and how to make a plan (s 10(2)(d)). This creates a non-compulsory informational role intended to encourage or enable non-government participation. The absence of compulsion reduces direct legal exposure for private businesses under this Act, but public reporting and the presence of public sector procurement and service delivery may create indirect commercial incentives to align with strategies and planning expectations.

Individuals with disability and carers

• The Act’s substantive definitions and principles, and the mandatory consultative pathways, place people with disability and carers in a central role as consultees and members of the advisory council (s 11(1), s 16(1), s 21). That role is framed as influential for policy design rather than as creating enforceable individual legal rights under this Act; s 26 clarifies the Act does not create civil causes of action.

Other legislative instruments and agencies

• Existing ACT strategies named in s 12 can be adopted as first territory strategies with specified expiry dates; these include the ACT Disability Strategy 2024-2033 and various education and health strategies (s 12, table 12). The Act also references the national disability strategy (s 9(3)) and requires consistency with the Convention on the Rights of Persons with Disabilities (s 5(3), Schedule 1).

Who pays and who decides

• Costs fall primarily on responsible Ministers and public sector entities for strategy and plan development, consultation, publication, review and reporting. The Chief Minister decides which Minister is responsible for a declared priority area (s 9(1) definition of responsible Minister), and the relevant responsible Ministers and responsible persons decide how to meet consultation and content requirements within the statutory parameters (s 10(1), s 11, s 15, s 16). The Disability Advisory Council advises but does not have executive decision-making power (s 20).

Overall, the Act reallocates administrative responsibilities within the ACT public sector and channels consultative duties to specified stakeholders without imposing private-law remedies or direct obligations on private-sector entities.

The Act’s operative obligations are administrative duties on Ministers, public sector responsible persons and the Executive, supplemented by representational duties for the Disability Advisory Council. The Act provides few direct legal rights and expressly disclaims creation of private remedies.

Ministerial duties to prepare strategies

• The responsible Minister for each priority inclusion area must make a disability inclusion strategy for the Territory in relation to that priority area, and must do so in consultation with the Minister (s 10(1)). The strategy must be consistent with the disability inclusion principles and include strategies to promote inclusion, reduce, remove and prevent barriers to accessibility, and address ableism (s 10(2)(a)-(b)). The strategy must relate to significant ACT strategies in the area and include information for non-government entities about supporting the strategy, including how to make a disability inclusion plan (s 10(2)(c)-(d)). Each strategy is a notifiable instrument and is subject to a ten-year expiry (s 10(3), s 10(6)).

Consultation duties on Ministers

• When preparing a territory strategy, responsible Ministers must consult people with disability, families and carers, the council, and disabled peoples organisations and systemic advocacy groups; they may also consult other entities (s 11(1)). Ministers must take all practicable steps to ensure consultees reflect ACT diversity (s 11(2)) and must carry out consultation in a way that supports collaboration and ensures consultees understand the process and can participate effectively (s 11(3)). Before making a strategy, Ministers must consider comments received during consultation (s 11(4)).

Public sector entities’ duties to make plans

• The responsible person for each public sector entity must make a disability inclusion plan explaining how the entity will implement inclusion and address ableism within the entity’s business (s 15(1)). The plan must be consistent with the disability inclusion principles and relevant strategies (s 15(2)(a)-(b)), must include actions to promote inclusion and reduce barriers (s 15(2)(c)), and any other matters prescribed by regulation (s 15(2)(d)). The plan must be publicly available on an ACT government website (s 15(4)) and reviewed on the commencement of a new related strategy and at least every five years (s 15(5)).

Consultation duties for public sector plans

• Responsible persons must consult people with disability, families and carers, disabled peoples organisations and systemic advocacy groups when developing or reviewing plans (s 16(1)). The same diversity and process requirements apply as for Ministerial consultation (s 16(2)-(3)). Before making a plan, responsible persons must consider comments raised during consultation (s 16(4)).

Reporting duties

• Ministers must prepare annual progress reports for each financial year on achievements under the strategy (s 13(1)). The report must not identify individuals without consent and must include any information prescribed by regulation (s 13(2)-(3)). The report must be given to the Minister for this Act if it is prepared by another Minister and must be published on an ACT government website within three months after the end of the financial year (s 13(4)). Public sector entities must include statements in director-general and public sector body annual reports describing measures taken to support strategy development and plan implementation (s 18(1)-(2)). Annual reports may also carry prescribed information (s 18(3)).

Disability Advisory Council duties and rights

• The council must advise the Minister on issues affecting people with disability, foster cooperative relationships between people with disability and government, and exercise any other functions given under a Territory law (s 20). The council prepares an annual report under the Annual Reports (Government Agencies) Act 2004 (s 25).

Rights and non-rights under the Act

• The Act contains an explicit non-creation clause stating the Legislative Assembly does not intend the Act to create any legal right or give rise to any civil cause of action (s 26). Conversely, the disability inclusion principles state that people with disability have rights under the Human Rights Act 2004, the Disability Services Act 1991 and the Discrimination Act 1991 that must be respected and protected (Schedule 1, s 1.2(6)). Therefore, the Act is framed to coordinate policy and administrative practice while leaving enforceable legal rights to existing statutes.

Regulatory powers and interplay with other laws

• The Executive may make regulations for this Act (s 28). If a provision of this Act is inconsistent with a provision in any other Territory law, the other law prevails to the extent of the inconsistency (s 27). Strategies and declarations (priority area and responsible Minister) are notifiable instruments (s 9(2), s 10(6)), which subjects them to the usual administrative law and tabling arrangements for notifiable instruments.

Timing and life cycle

• Strategies expire after ten years (s 10(3)); certain existing strategies may be adopted as the first strategies with specified expiry dates listed in s 12 and table 12; s 12’s transitional adoption power expires on 1 December 2035 (s 12(3)). The statutory review provision requires the Minister to review the Act’s operation and effectiveness as soon as practicable after the end of the Act’s fifth year and to present the review to the Legislative Assembly (s 29(1)); s 29 itself expires seven years after commencement (s 29(2)).

In summary, the Act imposes structured planning, consultation and reporting duties on Ministers and public sector entities, while stopping short of creating new private legal entitlements under the Act itself. The principal enforcement levers are procedural: consultation obligations, transparency through publication and annual reporting, and advice from a statutory council.

The Act is procedural and administrative. It contains no bespoke punitive or coercive sanctions for failure to prepare a strategy or plan, and it expressly disclaims the creation of private causes of action. The Act therefore relies on transparency, political accountability and public sector governance mechanisms rather than criminal or civil enforcement to secure compliance.

Absence of statutory offences or direct penalties

• The body of the Act contains no offence provisions, monetary penalties, or enforcement subdivisions that authorise prosecutions or fines for non-compliance with the duties to prepare strategies, conduct consultation, or publish plans and reports. The Act’s statement that it is not intended to create legal rights or give rise to civil actions (s 26) further confirms the legislature’s intent not to create directly enforceable private remedies for non-compliance.

Administrative and transparency-based enforcement levers

• Strategies and certain declarations are notifiable instruments (s 9(2), s 10(6)). As notifiable instruments, strategies will be subject to the administrative machinery that applies to such instruments, for example tabling and publication requirements under the Legislation Act 2001; the Act itself does not describe the tabling consequences but the notifiable instrument status imports that administrative process. Publication requirements are explicit: Ministers must publish annual progress reports on an ACT government website within three months after the end of the financial year (s 13(4)(b)), and public sector entities must make their plans publicly available on an ACT government website (s 15(4)). Director-general and public sector body annual reports must include statements about measures taken to support plan development and strategy implementation (s 18(1)-(2)). These public-facing reporting obligations create reputational and political accountability channels.

Role of the Disability Advisory Council

• The council has functions to advise the Minister about issues affecting people with disability and to foster cooperative relationships (s 20). While its role is advisory rather than coercive, its statutory status, composition requirements and annual reporting (s 25) create an institutional review and policy feedback mechanism that can shape government practice.

Interaction with other laws and remedies

• The Act states that it does not create legal rights and that other Territory laws prevail in case of inconsistency (s 26-27). This means legal enforcement of disability-related rights will continue to depend on other statutes such as the Discrimination Act 1991, the Disability Services Act 1991 and the Human Rights Act 2004. The disability inclusion principles expressly record that rights under those Acts must be respected and protected (Schedule 1, s 1.2(6)). Those other statutes, not this Act, are therefore the locus for legal claims.

Penalty unit value context

• The republication note at the front of the Act records the penalty unit values at the republication date, namely $160 for an individual and $810 for a corporation, referencing the Legislation Act 2001, s 133. The text of the Act contains no offences that attract penalty units. If future regulations or instruments made under this Act were to create offences or fines, the penalty unit values would be the operative measure for calculating monetary penalties, but no such provision currently appears in the Act.

Practical enforcement consequences

• Practically, enforcement will occur through administrative levers: the requirement to publish strategies, plans and progress reports; the council’s advisory and reporting role; and the political accountability of Ministers and agency heads. The absence of private enforcement under the Act reduces litigation risk arising directly from this Act, but obligations under other Territory laws provide potential legal pathways where discrimination or service failures arise.

In sum, the Act institutionalises planning, consultation and reporting duties, and relies on transparency and administrative control rather than statutory penalties or private enforcement to secure compliance. Legal remedies for individuals remain the preserve of other applicable laws referenced in the disability inclusion principles.

The Act is structured to sit alongside and interact with existing Territory and Commonwealth instruments, and it embeds cross-references that practitioners must consider at both the drafting and implementation stages.

Supremacy and inconsistency

• Section 27 provides that if a provision of this Act is inconsistent with any other Territory law, the other Territory law prevails to the extent of the inconsistency. Practically, this means obligations under, for example, the Public Sector Management Act 1994, the Annual Reports (Government Agencies) Act 2004, the Discrimination Act 1991, the Human Rights Act 2004 and the Disability Services Act 1991 remain operative and can override or displace provisions of this Act in cases of direct conflict (s 27; Schedule 1, s 1.2(6) acknowledges rights under those Acts).

Cross-references and signpost definitions

• The Dictionary contains signpost references to other statutes. For example, protected attribute is defined by reference to the Discrimination Act 1991, section 7, and care relationship and care relationship principles are defined by reference to the Carers Recognition Act 2021 (dictionary notes and Schedule 1). The Act also directs alignment with the Convention on the Rights of Persons with Disabilities (CRPD) “to the extent reasonably practicable” (s 5(3), Schedule 1, s 1.1(1)(a)). Practitioners must therefore treat the Act as a policy overlay that imports, references and defers to substantive rights and procedural frameworks in existing legislation.

Annual reporting and agency reporting statutes

• The Act incorporates the reporting frameworks of established annual report regimes. The director-general annual report and public sector body annual report requirements referenced in s 18 rely on definitions and mechanisms in the Annual Reports (Government Agencies) Act 2004 (s 18(4)). The Disability Advisory Council’s annual report obligations are explicitly to prepare an annual report under the Annual Reports (Government Agencies) Act 2004, s 7 (s 25). Practitioners preparing plans and annual statements must therefore reconcile the Act’s content requirements with the form and timing of those existing reporting instruments.

Public sector management and allocation of responsibility

• The Act allows heads of public sector bodies to adopt the disability inclusion plan made by the administrative unit allocated responsibility for the Act under which the body is established (s 15(3)). That cross-reference to Public Sector Management Act 1994, s 14(1)(b) creates a channel for administrative units to centralise planning and for other public bodies to adopt those plans, subject to the delegation and allocation rules in the public sector management regime.

National and Commonwealth frameworks

• Priority inclusion areas include areas mentioned in the national disability strategy (s 9(1)). The Act defines national disability strategy as the national disability policy framework developed by Commonwealth, State, Territory and local governments (s 9(3)). The Act therefore establishes a mechanism for the ACT’s strategies to align with national policy frameworks without displacing Commonwealth law. The Disability Advisory Council’s functions refer to the National Disability Insurance Scheme and the NDIS Act 2013 (Cwlth), section 9 (s 20(1)(a)(i) and note), indicating that the council should engage with Commonwealth NDIS policy and administration as part of its advisory remit.

Notifiable instrument and subordinate legislation consequences

• A disability inclusion strategy and declarations of priority inclusion area and responsible Minister are notifiable instruments (s 9(2), s 10(6)). Notifiable instruments are subject to publication and tabling regimes under the Legislation Act 2001; they may also be subject to administrative scrutiny and possible disallowance depending on the instrument type and the Legislation Act’s rules. The Executive also has regulation-making power under s 28, which can create prescribed content for reports or plans, or other operative rules that will be subordinate legislation.

Transitional and adoption provisions

• Section 12 allows a responsible Minister to adopt certain existing ACT strategies as the first disability inclusion strategy for a given priority area. The adoption provision exempts the adopted strategy from the Act’s consultation requirements (s 12(2)(b)), treats the adopted strategy as satisfying the requirements of s 10(2) (s 12(2)(a)), and sets a statutory expiry date for the adopted strategy (s 12(2)(c) and table 12). This transitional mechanism means that for certain priority areas the first ten-year cycle may be fulfilled by an already-published strategy, but the statutory framework requires a replacement strategy at or before the stated expiry.

Rights under other legislation

• Schedule 1, s 1.2(6) expressly states that people with disability have rights under the Human Rights Act 2004, the Disability Services Act 1991 and the Discrimination Act 1991, and that those rights must be respected and protected. The Act is therefore an administrative complement to the existing legal rights framework, not a substitute for it.

Practical implications for lawyers and compliance professionals

• Practitioners must ensure disability inclusion plans and strategies are drafted and implemented with cross-references in mind: published strategies may need to reflect relevant obligations under the Human Rights Act and anti-discrimination statutes; agency reporting under s 18 must be reconciled with the Annual Reports (Government Agencies) Act 2004; and the allocation of responsibility and plan adoption requires integration with the Public Sector Management Act 1994. Regulatory instruments and any future subordinate legislation under s 28 may further flesh out reporting content or procedural obligations, and will themselves be subject to the Legislation Act’s instruments regime.

In short, the Act is designed to be interoperable with an existing patchwork of Territory, national and Commonwealth instruments; it places administrative duties on public actors and defers to substantive legal protections contained in other laws.

The Act’s legislative history and amendment schedule as set out in the republished law provide the key dates and transitional arrangements that affect current obligations.

Commencement and republication

• The Disability Inclusion Act 2024 (A2024-44) was notified on the ACT legislation register on 17 September 2024 (legislation history endnote 3). Section 1 and section 2 commenced on 17 September 2024 pursuant to the Legislation Act 2001, s 75(1), while the remainder of the Act commenced on 17 March 2025 (legislation history endnote 3). The republished version is effective as at 17 March 2025 and includes editorial republication notes and the current penalty unit values at the republication date (republication front matter).

Transitional adoption of existing strategies

• Section 12 provides a transitional pathway allowing responsible Ministers to adopt certain existing ACT strategies as the first disability inclusion strategy for particular priority inclusion areas (s 12(1)). Table 12 names specific strategies and fixed expiry years for each adopted strategy: for example, the ACT Disability Strategy 2024-2033 may be adopted as the first strategy for community attitudes and personal and community support, and is taken to expire in 2033 (s 12, table 12, items 1 and 4). The education strategy item in table 12 lists an expiry of 2034 and the justice strategy lists 2029 (s 12, table 12). Section 12(2) deems an adopted strategy to meet the content requirements of s 10(2), exempts the adopted strategy from the consultation duties in s 11, and fixes the expiry date referenced in the table. Section 12(3) itself expires on 1 December 2035.

Expiry of review provision

• Section 29 requires a review of the Act as soon as practicable after the end of the Act’s fifth year of operation, with a report to the Legislative Assembly (s 29(1)). Section 29(2) states that the review provision expires seven years after the day it commences. The effect is that the statutory requirement to review the Act is subject to a temporal limitation; the operative obligation is to conduct the review around the five-year mark, but the provision establishing the requirement will not be permanent.

Editorial and consequential amendments

• The republished law notes editorial changes authorised by the Legislation Act 2001, part 11.3 and references certain repeals and omissions relating to headings and the Annual Reports (Government Agencies) Act 2004 in the amendment history (endnote 4). Section 2 was omitted pursuant to the Legislation Act's commencement provisions (endnote 4). The Legislative Assembly’s Parliamentary Counsel’s Office is authorised to make editorial and formal changes when preparing a republication, which may affect numbering and presentation but not substantive content.

Penalty unit note

• The republication front matter records the penalty unit values applicable at the republication date, namely $160 for an individual and $810 for a corporation, with reference to the Legislation Act 2001, s 133. These are not amendments to the Act itself but contextual information about penalty unit values should future subordinate instruments or regulations under the Act employ penalty units.

Practical timing consequences

• Because sections commenced at two different dates, affected agencies and ministers should confirm transitional timeframes for meeting the Act’s obligations, especially for strategies adopted under s 12 which may already be in force and have statutory expiry dates under the table. The review timeline, linked to the fifth year of operation, creates an expectation of a formal evaluation; failure to perform the review would be a failure to comply with s 29 until s 29 expires seven years after commencement.

Advice to users

• Practitioners should consult the legislation history and endnotes on the ACT legislation register for any subsequent amendments not captured in this republication. The Act allows regulations under s 28; changes may occur through subordinate legislation that fills out regulatory details, reporting particulars or other procedural elements. The Act’s transition clauses in s 12 and the expiry of s 29 are temporal features that affect planning and should be monitored.

The republished Act includes no references to case law and contains no statutory causes of action created by the Act itself. The text therefore records no litigation history under the Act and gives no examples of disputes or judicial interpretation.

Absence of litigation in the statute

• The Act does not cite any judicial decisions and contains no enforcement or civil remedy provisions. Section 26 expressly states that the Legislative Assembly does not intend by this Act to create in any person any legal right or to give rise to any civil cause of action. That express clause both limits the Act’s direct litigability and shapes the likely litigation landscape (s 26).

How disputes related to disability matters will be litigated

• Because the Act expressly disclaims creation of private legal rights, litigation concerning disability rights in the ACT will continue to be brought under existing substantive laws that provide private remedies. Schedule 1, s 1.2(6) explicitly recognises that people with disability have rights under the Human Rights Act 2004, the Disability Services Act 1991 and the Discrimination Act 1991 and that these rights must be respected and protected. Where grievances allege discrimination or breaches of these other statutes, remedies and litigation will proceed under those Acts rather than under this Act.

Potential for administrative-review litigation

• The Act makes several instruments notifiable (s 9(2), s 10(6)). Notifiable instruments are subject to administrative law norms under the Legislation Act and subject to procedural requirements such as tabling. If a notifiable instrument were improperly made, questions about its procedural validity could attract legal challenge on administrative law grounds. The Act itself does not create the right to judicial review, but administrative law remedies under the common law and the Administrative Decisions (Judicial Review) Act 1977 (Cwlth) where relevant, or Territory equivalents, may be available to challenge ultra vires or procedurally flawed decisions that intersect with the Act’s instruments.

Council and administrative decisions

• Decisions about council appointments, termination under s 22, and administrative arrangements may be susceptible to judicial review if they are alleged to be unlawful, procedurally unfair or inconsistent with administrative law norms. The Act sets appointment criteria (s 21) and discretion to end appointments for misconduct, incapacity or absence (s 22). Those statutory powers are likely to be exercised within the wider framework of public sector employment law and administrative review principles, not by the Act’s private enforcement mechanisms.

Implication for practitioners

• Because the Act is constructed as a framework statute that creates planning and reporting duties without civil remedies, litigation history specific to this Act is likely to be negligible or non-existent. Legal challenges that do arise in the disability space will principally rely on other statutes that confer rights and remedies. Practitioners should therefore focus on aligning agency practice with the Act’s procedural obligations to reduce reputational and administrative risk while relying on existing rights-based statutes when advising individuals on enforceable claims.

In brief, the Act’s text records no litigation history and its structure intentionally channels legal enforcement to other statutory regimes rather than to itself.

This section flags potential practical pitfalls and unintended consequences that arise directly from the statutory text. Each item is anchored to the relevant provision.

No private cause of action under the Act (s 26)

• The Act expressly disclaims creation of legal rights or civil remedies (s 26). Stakeholders or advocates expecting direct enforceability of strategies or plans should note the Act is administratively prescriptive rather than remedial. Remedies for discrimination or rights breaches will continue to rely on other legislation (Schedule 1, s 1.2(6)). If a stakeholder expects a right to litigate non-compliance with a plan or strategy, the Act provides none.

Reliance on transparency rather than penalties

• The Act adopts public reporting and publication as the primary compliance levers (s 13(4), s 15(4), s 18). There are no internal fines or criminal sanctions for failing to prepare or publish plans and strategies within the Act’s text. If internal governance is weak, non-compliance may produce political but not legal consequences.

Adoption of existing strategies bypasses consultation (s 12)

• Section 12 permits adoption of existing ACT strategies as the first disability inclusion strategy for particular priority areas and treats the adopted strategy as meeting s 10(2) requirements while exempting it from consultation duties in s 11(2)-(4) (s 12(2)(a)-(b)). Where an adopted strategy is outdated in its consultative legitimacy or lacks recent lived-experience input, adoption locks in the strategy until the statutory expiry date specified in table 12. Stakeholders should monitor the expiry dates and any subsequent replacement process.

Ten-year strategy cycle and possible lag (s 10(3)-(5))

• Strategies expire after ten years (s 10(3)). The Act allows an expiring strategy to continue in force until a new strategy commences if a replacement has not been made (s 10(5)). This prevents a legal vacuum but could extend an out-of-date strategy if a successor is delayed. Practitioners should plan for timely successor strategies.

Consultation standards are exacting and resource-intensive (s 11(2)-(3), s 16(2)-(3))

• The Act requires Ministers and responsible persons to take “all practicable steps” to ensure consultation reflects the community’s diversity across many axes including disability type, sexual and gender identity, veteran experience, age, culture and socioeconomic background (s 11(2), s 16(2)). Consultation must be conducted in a manner that supports collaborative working arrangements and ensures participants can understand and effectively take part, which may require accessible formats, translated materials or specialised supports (s 11(3), s 16(3)). Agencies must budget for these accessibility and diversity demands or risk inadequate consultation.

Public sector adoption of one administrative unit’s plan (s 15(3))

• The head of a public sector body may adopt the disability inclusion plan made by the administrative unit allocated responsibility for the Act under the Act establishing the body (s 15(3)). Adoption promotes administrative efficiency but risks uneven applicability if the adopted plan does not align tightly with the adopting body’s functions. Heads should assess whether adoption genuinely covers the body’s responsibilities.

Scope tensions with other laws (s 27, Schedule 1 s 1.2(6))

• The Act defers to other Territory laws on inconsistency (s 27) and recognises rights under other statutes (Schedule 1, s 1.2(6)). Practitioners should not assume the Act creates new legal protection where other statutes provide more specific remedies or duties. Conflicts between plan content and legal obligations under, for example, the Human Rights Act 2004 or the Discrimination Act 1991 will be resolved in favour of those other laws.

Notifiable instrument status brings administrative oversight (s 9(2), s 10(6))

• Strategies and declarations are notifiable instruments. That status subjects those instruments to the Legislation Act’s tabling and publication processes and may expose them to administrative scrutiny or parliamentary oversight. Administrations should prepare legal advice and drafting quality control for strategies accordingly.

Statutory review timeline may lapse (s 29)

• Section 29 imposes a review of the Act as soon as practicable after the end of the Act’s fifth year, but s 29 itself expires seven years after commencement (s 29(2)). If the review is not completed within the narrow window provided by the statutory lifecycle, there may be no further express statutory obligation to review. Practitioners should treat the five-year review as time-bound and ensure its delivery.

Ambiguity about non-government expectations (s 10(2)(d))

• Strategies must include information for non-government entities about ways to support the strategy, including how to make a plan (s 10(2)(d)). The Act does not impose obligations on non-government entities to prepare plans, so the information requirement could create expectations without legal teeth. Private actors may nonetheless be subject to indirect market or procurement pressures to align with strategies; agencies should be clear about the non-binding nature of such guidance.

No built-in enforcement escalation mechanism

• Because the Act relies on publication and advice, it provides no statutory escalation mechanism to compel remedial action if strategies or plans are ineffective. Stakeholders seeking corrective enforcement must rely on political, reputational and administrative levers, or on other statutes for legal remedies.

Practitioners should therefore read the Act as a planning and governance instrument that raises administrative, representational and transparency obligations while not creating standalone legal remedies. Failure to factor in resource needs for accessible, diverse consultation and public reporting is a frequent compliance trap.

This checklist translates the Act’s statutory duties into a practical, source-grounded compliance programme for responsible Ministers, agency heads and compliance officers. Each step is tied to the Act’s sections.

1. Establish governance and project ownership

• Assign a named project lead for each priority inclusion area strategy within the responsible Minister’s portfolio (s 10(1)). For each public sector entity, designate the responsible person (director-general or head) and ensure their responsibilities under s 15 are documented internally (s 14-15). Record who will publish the strategy, plan and annual report content.

2. Map priority inclusion areas and responsible Ministers

• Confirm which priority inclusion areas are to be managed under the Act. If the Chief Minister has declared responsible Ministers or priority areas, ensure declarations are logged; such declarations are notifiable instruments (s 9(1), s 9(2)). If adopting an existing ACT strategy as the first strategy under s 12, record the statutory expiry date and note the s 12(2) exemption from consultation.

3. Budget for consultation and accessibility

• Build budget lines for accessible consultation processes that satisfy s 11(3) and s 16(3). This includes costs for accessible venues, Auslan interpreters, easy-read and translated materials, outreach to diverse communities, and supports that enable participation. The Act requires “practicable steps” to ensure diverse representation (s 11(2), s 16(2)), and consultation must include sufficient information in language and format consultees understand (s 11(3)(c), s 16(3)(c)).

4. Design the consultation plan and record-keeping

• Prepare a documented consultation plan identifying targeted stakeholders: people with disability, families and carers, the Disability Advisory Council, disabled peoples organisations and systemic advocacy groups, and other relevant entities (s 11(1), s 16(1)). Document invitations, responses, meeting minutes, and how comments were considered; s 11(4) and s 16(4) require consideration of comments before making strategies or plans.

5. Draft strategies to statutory content requirements

• Ensure strategies include the elements mandated in s 10(2): consistency with the disability inclusion principles, strategies to promote inclusion and address ableism, measures to reduce/remove/prevent accessibility barriers, information about relationships with other ACT strategies (s 10(2)(a)-(c)), and guidance for non-government entities (s 10(2)(d)). Verify the drafting quality needed for a notifiable instrument (s 10(6)).

6. Manage the notifiable instrument process

• Treat the final strategy and any declarations as notifiable instruments and follow the Legislation Act’s procedures for drafting, legal clearance and tabling (s 9(2), s 10(6)). Coordinate with Parliamentary Counsel and the responsible policy/legal teams to ensure the instrument is ready for filing and publication.

7. Publish plans, strategies and progress reports on schedule

• Publish public sector disability inclusion plans on an ACT government website (s 15(4)). Prepare the Minister’s annual progress report for each financial year and publish it within three months after the financial year’s end; if a Minister other than the Minister for this Act prepares the report, give it to the Minister for this Act before publication (s 13(1), s 13(4)). Ensure director-general and public sector body annual reports include the required statements under s 18(1)-(2).

8. Implement plan actions and monitoring frameworks

• Translate plan commitments into measurable actions, assign responsible branches, set timelines and KPIs, and integrate monitoring systems. Because the Act emphasises outcomes and reporting, agencies should create performance metrics aligned to technical content in the plan and mechanisms for annual progress reporting (s 15(2)(c), s 13(1)).

9. Review and update plans on triggers and periodic schedules

• Review a disability inclusion plan when a new related disability inclusion strategy commences and at least every five years after the plan is made (s 15(5)). For strategies, observe the ten-year expiry and plan successor strategy timelines to avoid extended reliance on expired strategies (s 10(3)-(5)). For adopted initial strategies under s 12, note the statutory expiry in table 12.

10. Ensure Disability Advisory Council engagement and appointments compliance

• When appointing council members ensure compliance with s 21: the chair must be a person with disability, at least half ordinary members must be people with disability, at least one ordinary member must be an unpaid carer, at least one member must be Aboriginal or Torres Strait Islander and overall membership must reflect diversity (s 21(4)-(8)). Maintain transparent appointment records, terms of appointment not exceeding three years, and compliance with term limits (s 21(9)-(10)). Prepare for council annual reporting obligations (s 25).

11. Align plans with other statutory obligations

• Check compatibility with the Human Rights Act 2004, Discrimination Act 1991 and Disability Services Act 1991, given the Act’s requirement that those rights be respected and protected (Schedule 1, s 1.2(6)) and the inconsistency provision (s 27). Ensure agency counsel reviews plan commitments for legal compatibility.

12. Prepare for the statutory review

• The Minister must review the operation and effectiveness of the Act as soon as practicable after the end of the Act’s fifth year and present a report to the Legislative Assembly (s 29(1)). Start internal data collection early so the statutory review can be evidence-based.

13. Document decisions about adoption vs bespoke plans

• Where a head of a public sector body wishes to adopt an administrative unit’s plan under s 15(3), document the fit-for-purpose analysis and any required modifications. Adoption is permitted but heads should retain legal and practical oversight.

14. Keep an eye on subordinate legislation

• Monitor regulations made under s 28 for prescribed matters that the Act leaves to regulation (for example, the content of reports or additional duties). Incorporate changes early into compliance processes.

15. Communicate with non-government stakeholders about the non-binding nature of guidance

• When strategies provide information for non-government entities on “how to make a disability inclusion plan” (s 10(2)(d)), make the non-binding nature of that guidance clear while offering practical tools to encourage voluntary uptake.

By following these steps and embedding statutory citations and records into procurement, communications, reporting and governance processes, agencies can reduce implementation risk, show demonstrable compliance with s 11 and s 16 consultation standards, meet publication and reporting timelines and create an auditable trail for the five-year statutory review.
